RESOLUTION State of Colorado, Weld County Clerk & Recorder RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 80 - TRI-STATE GENERA- TION AND TRANSMISSION ASSOCIATION. WHEREAS, the Board of County Commissioners of Weld County, TN Colorado, pursuant to Colorado statute and the Weld County Home w Rule Charter, is vested with the authority of administering the r4 affairs of Weld County, Colorado, and e WHEREAB, the Board of County Commissioners of Weld County, t4 Colorado has reviewed the request of Tri-State Generation and 0 Transmission Association for an exemption from the definitions 0 of "subdivision" and "sub-divided land" in Section 30-29-101 (10) , CRS 1973 , as amended, and Section 2-1 of the Weld County Subdi- rq 2R vision Regulations, and WHEREAS, the Board of County Commissioners finds that Tri- State Generation and Transmission Association is the owner of a parcel of land in Part of the Northeast Quarter of Section 6 , Township 7 North, Range 66 West of the 6th P.M. , Weld County, Colorado. The legal description of the abovementioned tract of land is set forth in "Exhibit A" which is attached hereto and incorporated herein by reference at this point. The subdivision exemption will create a parcel strictly for the purpose of the microwave tower and two electronics shelter buildings, and WHEREAS, the Board of County Commissioners has considered the recommendation of the Department of Planning Services in this matter and has reviewed the information submitted by the applicant. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the aforementioned tract of land owned by the applicant be, and hereby is, declared to be exempt from the definitions of "subdivision" and "sub-divided land" as set forth in Section 30-29-101 (10) , CRS 1973 , as amended, and in Section 2-1 of the Weld County Subdivision Regulations, and further finds that said tract shall be considered a single lot. The permitted uses on the hereon described parcel shall be the facilities as shown hereon for a microwave tower not to exceed 110' in height, two electronics shelter buildings housing radio and microwave equipment, and all uses permitted by right under Section 3 .3 B. of the Weld County Zoning Resolution. 2. Installation of the microwave tower shall conform to Federal Aviation Administration standards and/or regulations regarding air safety and lighting and any other applicable rules and regulations of governmental bodies having jurisdiction on the premises . 3 . The Conditional Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds . 4. Upon termination of construction, all disturbed soil areas shall be revegetated or gravelled as per Soil Conservation Service recommendations to reduce susceptibility to wind erosion. 5. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems . 6. All construction, electrical work and fabrication shall be done in accordance with the Weld County Building Code. 7 . The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 8 . An executed application form. 2. A certified boundary survey and a legal description of the property for which application is being made (Exhibit A) . 3. A soil survey and study of the property prepared by the Soil Conserva- tion District (Exhibit B) . Soil borings have not been made on the property. Our construction and engineering department has built similar structures on the type of soil found at this site. It is our experience that the soil has adequate bearing capacity for the tower and building anticipated to be built and that borings need not be taken. In the event that unusual subsurface conditions are encountered during excava- tion for footers, we will have random borings taken and submit a report to your office. 4. The proposed use of the property will be for erection of a one hundred ten foot (110' ) guyed tower bearing three microwave dishes and an electronics shelter building housing radio and microwave equipment. The operation of the facility will be unmanned and automatic. The communication facility is part of a system extending through the states of Colorado, Wyoming and Nebraska and functions as the primary communication and automated switching control for the Tri-State power supply network serving twenty-five REA's in the three state area (Exhibit C) . This particular facility will receive and transmit a microwave radio signal between similar facilities at the Bald Mountain, Colorado Substation and the State Line, Colorado Substation. Both power density and electro- magnetic field density are substantially less than recommended federal limits. The facility will produce no air or water pollution, odor, noise, glare fire or safety hazard or traffic congestion. FAA approval has been given for this facility (Exhibit 0) . An application for FCC approval has been submitted and approval is expected. Since the facility is automatic, once construction is completed, traffic into the site will be minimal . We anticipate that our maintenance crew will visit the site about six times every year. 5. Since the facility is unmanned, and only visited for repair and maintenance, water and sanitary facilities are not required. There will be no well or septic tank. 6. Access to the facility will be by private road as shown on Exhibit E. Since traffic will be minimal , the road will not be improved except for placement of gravel as needed. 7. Twelve sets of plans. 8. There is no housing, commercial or industrial development within five hundred feet of the facility, with the exception of an electrical substation operated by the Western Area Power Administration, who uses the undeveloped land for grazing of cattle. 9. The site is located on the soil type Olney fine sandy loam, 3 to 5 per- cent slopes. The soil exhibits very few limiting characteristics for the intended purpose. With adequate and sound engineering designs for concrete, the site should be suitable. However, this soil type is sus- ceptable to wind erosion when the surface vegetation or residue cover is destroyed. This can be overcome during construction by uncovering only the area needed for actual installation. Surface water drainage designs should be made so that erosion will not be induced.
