RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR17-0045, FOR AN AIRPORT/AIRSTRIP IN THE A (AGRICULTURAL) ZONE
DISTRICT — DENNIE KUTCHER
A public hearing was conducted on December 27, 2017, at 10:00 a.m., with the following present:

The following business was transacted:
• I hereby certify that pursuant to a notice dated November 17, 2017, and duly published
November 22, 2017, in the Greeley Tribune, a public hearing was conducted to consider the
request of Dennie Kutcher, for a Site Specific Development Plan and Use by Special Review
Permit, USR17-0045, for an Airport/Airstrip in the A (Agricultural) Zone District. Bob Choate,
Assistant County Attorney, made this a matter of record.
• Chair Cozad instructed the applicant and reviewed for the public, with two (2) of the five (5)
Commissioners excused, the vote must be unanimous for the case to be approved today.
Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal to include the construction of a new grass runway for private use and a 2,000 -square -foot
airplane hangar with no utilities. He clarified this use will be privately utilized approximately one
to two times per month. Mr. Gathman described the rural location, nearest residences and stated
no objective correspondence was received in conjunction with this application. He reported the
site is not located within the three (3) mile referral area of any municipality or Intergovernmental
Agreement Area and staff sent out 13 referrals and received eight (8) responses which were
considered in the staff recommendation. Mr. Gathman mentioned there are two (2) wells on -site,
originally operated by DCP; however, it appears they are shut-in. He displayed images of the site
and surrounding views and entered the favorable recommendation of the Planning Commission
into the record as written.
• Evan Pinkham, Department of Public Works representative, provided a brief overview of the
transportation plans and requirements, stating the access is on County Road 74, which is a paved

road, and he provided the most recent average daily traffic counts to include truck percentages.
Mr. Pinkham clarified staff is not requiring tracking control or an Improvements Agreement.
• Hayley Balzano, Planning Services Engineer representative, presented the drainage and
grading requirements, stating the applicant provided a drainage narrative stipulating the site
meets exception #1.A.14, and allows provision for a one time exception for a 2,000 -square -foot
structure. She reviewed the Conditions and Development Standards relevant to Engineering.
• Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions, stating the applicant indicated there will be no employees for the Airport/Airstrip and
will be used by the property owner only, and the proposed hangar will have no utilities. He stated
there is water and sewer provided to the on -site residence by a residential well and septic system;
however, if these are used by those associated with the airport, the well will need to be reclassified
as commercial and the septic system may require an evaluation by an engineer. Mr. Frissell stated
Development Standards (DS) #5-17 address Environmental Health items.
• Dennie Kutcher, applicant, offered to answer any questions regarding his project.
IR No public testimony was offered concerning this matter.
• In response to Commissioner Kirkmeyer, Mr. Kutcher pointed out the access on the map. In
further response, he stated this is phase one to get the project approved and built, which is a big
step for him. He explained he wants to use grass for dust abatement for the airstrip. Mr. Kutcher
stated crop dusting may be a good fit in the future.
• In response to Chair Cozad, Mr. Gathman stated he was not aware of the potential crop
dusting use. Per the application materials, he understood this as personal use only. He further
clarified if the use gets bigger, staff would need to review it to see if it would require a minor
amendment or a major amendment. He confirmed an amendment would be based on the number
of aircraft.
• In response to Commissioner Kirkmeyer, Mr. Pinkham agreed to the deletion of Conditions
of Approval (COA) #1.B and #1.C.8. She further requested clarification on DS #8 and #9.
Mr. Frissell reviewed the requirements. Commissioner Kirkmeyer requested the removal of the
second sentence on DS #8 and suggested amending DS #9 to reflect the Light Industrial Zone
District. The Board agreed with the changes. After further discussion, the Board agreed to delete
DS #19 and 20.
El Chair Cozad reviewed the changes for the applicant. In response to Chair Cozad,
Mr. Kutcher indicated he has reviewed, and agrees to abide by, the Conditions of Approval and
Development Standards, as amended.
el Commissioner Moreno moved to approve the request of Dennie Kutcher for a Site Specific
Development Plan and Use by Special Review Permit, USR17-0045, for an Airport/Airstrip in the
A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning

Commission, with the Conditions of Approval and Development Standards, as amended and
entered into the record. The motion was seconded by Commissioner Kirkmeyer, and it carried
unanimously. There being no further discussion, the hearing was completed at 11:11 a.m.
This Certification was approved on the 3rd day of January, 2018.
