HomeMy WebLinkAbout20171205.tiffRESOLUTION RE: APPROVE ZONING PERMIT, ZPTT17-0002, FOR A TELECOMMUNICATION ANTENNA TOWER (65 -FOOT TOWER) - SAMAD AND SUSAN AGHAJANI WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 3rd day of April, 2017, considered the request of Samad and Susan Aghajani, P.O. Box 200375, Evans, CO 80620, for a Zoning Permit, ZPTT17-0002, for a Telecommunication Antenna Tower (65 -foot tower), and WHEREAS, said Telecommunication Antenna Tower is to be located in the A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Part of the NW1/4 NE1/4 of Section 18, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, the Board deemed it advisable to continue the matter to May 1, 2017, to allow adequate time for the applicant to continue working with the City of Greeley to address concerns regarding visual impacts, and WHEREAS, on May 1, 2017, the applicants were present, and WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. All proposed or existing structures will, or do, meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M and R in Section 302.1 of the 2012 International Building Code, shall be constructed within a 200 -foot radius of any tank battery, or within a 150 -foot radius of any wellhead, or within a 25 -foot radius of any plugged or abandoned oil and gas well. Any construction within a 200 -foot radius of any tank battery or 150 -foot radius of any wellhead shall require a variance from the terms of Chapter 23 of the Weld County Code, in accordance with subsection 23-6-10.C. 2. Any future structures or uses on the site must obtain the appropriate zoning and building permits. 3. The applicant shall maintain compliance with all county, state and federal regulations. 5. A CDOT access permit to the site must be approved and documented on the SUBX17-0002 plat and adequate access to the site must be maintained. Such access is only for the telecommunications tower approved by this Zoning Permit ZPTT17-0002. Future access shall be governed by the Highway 34 Access Control Plan. 6. The property owner shall control noxious weeds on the site. 7. The historical flow patterns and runoff amounts will be maintained on the site. 8. Building Permits issued on the proposed lot will be required to adhere to the fee structure of the County -Wide Road Impact Fee Program, County Facility Fee and Drainage Impact Fee Programs. 9. The applicants must obtain a Building Permit from the Weld County Department of Building Inspection for the Telecommunications Antenna Tower and must comply with all installation standards of Chapter 29 of the Weld County Code. 10. Sources of light shall be shielded so that beams or rays of light will not shine directly onto adjacent properties. Sources of light should not cause a nuisance or interfere with the use on the adjacent properties in accordance with the map. Neither the direct, nor reflected, light from any light source may create a traffic hazard to operators of motor vehicles on public or private streets. No colored lights may be used which may be confused with, or construed as, traffic control devices. 11. Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of road right-of-way to allow a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users. 12. Additional information, which shall be placed as notes on the SUBX17-0002 plat: a) The telecommunication antenna tower is an unmanned facility. No water or sewage disposal services are proposed as part of the tower facility. b) The West Greeley Soil Conservation District has provided information regarding the soils on the site. Parent Parcel: +/- 3.32 Acres Zoning: A (Agricultural) Lease Area: +/- 0.023 Acres Parcel #: 0959-18-1-00-006 Narrative: The applicant is proposing to build a 65 -foot monopole telecommunications antenna tower (plus a 4 -foot lightning rod) and supporting equipment on an adjacent platform to be located on the Subdivision Exemption Lot (SUBX17-0002) being created for leasing the telecommunications tower site to Verizon Wireless on the property. The tower and associated equipment will be located within a 50 -foot by 20 -foot chain link fence enclosure. Associated equipment includes a new 65 -foot tall Monopole and 4 -foot tall lightning rod, (12) 6 - foot panel antennas, a future 8 -foot in diameter microwave dish, 8 -foot tall chain link fence, 3 -foot tall raised steel platform, outdoor power plant, (2) outdoor radio cabinets, safety tech lighting, stand-by generator and new power / fiber routes. The purpose of the tower is to provide expanded wireless services and greater communication coverage and access for emergency services in the west Greeley area. The proposed site is currently a vacant parcel of land zoned A (Agricultural) and currently has one (1) approximately 20 -foot tall billboard sign near the west side of the property which is closest to State Highway 34. THE DEPARTMENT OF PLANNING SERVICES STAFF RECOMMENDS THAT THIS REQUEST BE DENIED AND THIS CASE COMES BEFORE THE BOARD OF COUNTY COMMISSIONERS FOR THE FOLLOWING REASON: 1. Section 23-4-890.C -- The Department of Planning Services and has not received referral responses in opposition to the location of the Telecommunication Antenna Tower from municipalities within 1/2 mile of the subject property. The City of Greeley is located directly adjacent to and north of the subject parcel proposing the new tower site and has expressed opposition to this land use proposal. Both a referral response received on February 8, 2017 and a follow up letter received on February 23, 2017 expressing specifically that the city objected to the tower site proposal. In both opposition letters the City of Greeley expressed concerns that the proposed site has been identified as an important location by the City of Greeley's Entry Master Plan and acts as a gateway into the City of Greeley, ZPTT17-0002 Pagel 2017-1205 Peat'73 providing first impressions into the lifestyles of its residents. They also state in their two responses that the site is located in a county enclave expected to be annexed into the City of Greeley in the near future. Lastly the city expressed in the initial referral response that if the monopole were to be approved they would request a stealth design of the tower by either locating antennas inside the pole or flush mounting the antennas to the pole so that it lessens the visual impact. THIS RECOMMENDATION IS BASED, IN PART, UPON A REVIEW OF THE APPLICATION MATERIALS SUBMITTED BY THE APPLICANT, OTHER RELEVANT INFORMATION REGARDING THE REQUEST, AND RESPONSES FROM REFERRAL ENTITIES. IF APPROVED BY THE BOARD OF COUNTY COMMISSIONERS STAFF'S RECOMMENDATION FOR APPROVAL IS CONDITIONAL UPON THE FOLLOWING: 1) All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. If the proposed monopole were to be approved. the City requests a stealth design, either locating antennas inside the pole or flush mounting the antennas to the pole so that it lessens the visual impact. o As mentioned above, the site is located i7.i a corridor identified as a part of the City of Greeley's Entry Master Plan and acts as a gateway into the City of Greeley, providing first impressions into the lifestyles of its residents.
