Subject: Closing of File
On Friday afternoon, January 28, 1977, Howard Kennedy from the Weld
County Dept. of Social Services requested the application for CUP 24
be withdrawn. This action was precipitated by the numerous voices
of opposition from surrounding land owners heard the night before
in a meeting between representatives of the Dept. of Social Services,
the Eaton School District, and surrounding land owners.

We, the undersigned owners of property adjacent to that where the
proposed change is located, wisn to notify you of our objections to the
proposed change, because of past problems that occurred when the property
was used as a foster home, including children playing on the road ways,
interference with irrigation processes, and the additional burdens which
would be imposed upon our telephone service and school districpt.

t.n lease the Wyatt School 1 ocated nor' h and east of Greeley, Col orado.
The Wyatt School will be used for a pr.Hfessionall.y-staffed, long-term group
home facility administered through the Weld County Department of Social
Services. Children ranging `. n ages twelve through eighteen, needing a
structured living environment with intensive evaluation and behavioral
attention will be the target pop elation.
The facility will complement an existing shelter home facility where children
have been identified as needing much more structured environments than are
now available in Weld County.
The proposed facility will be administered by an already existing and
successful organizational stricture.
The treatment program will be designed using behavioral and humanistic
psychology concepts, implemented by persons experienced in group home
treatment programs.
It is our intention to use the Wyatt School and surrounding three (3)
acres for agriculture, horticulture programs. The Wyatt School was
determined the most appropriate facility after eight months of research
and evaluation. We feel confident this program offers a great opportunity
for children in Weld County, and would emphasize our interest in cooperating
with all surrounding land owners.
The facility is classified as a Specialized Group Home.
It will be set up for 8 to 14 children (male and female)
ranging in ages from 12 to 18 years in age. The children
are from troubled homes who have been turned over to the
Courts. The children will attend public school in the
Eaton School District . There will be 6 counselors; 2
counselors will live-in with the children and 4 counselors
will be on hand on a day shift basis.

West Right-of-Way line of the County Road, a distance of 128.00
feet; thence North 90°00'00" East, a distance of 12.00 feet;
thence South 00°00'00" East along the West Right-of-Way line of
the County Road, a distance of 407.13 feet to the True Point of
Beginning;
WHEREAS , the parties desire to enter into an agreement fixing
the terms of occupancy by Lessee of the premises .
NOW, THEREFORE, in consideration of the premises and the
mutual covenants and agreements hereinafter contained, it is
hereby covenanted and agreed by and between the parties hereto
as follows :
1. Lease and the Term Hereof:
The Lessor hereby agrees to and does lease and let unto
Lessee and Lessee agrees to rent from Lessor the above described
property , for a term of one (1) year from and after 12 : 00 noon
March 1, 1977, to and unto 12 : 00 noon March 1, 1978, on the
terms and conditions hereinafter contained.
2 . Contingency:
This Lease Agreement is contingent upon Lessee obtaining a
Specialized Group Home License and a conditional use permit for
the operation of a group home for children. Lessee shall make
a good faith effort to obtain these items, but if they are
not obtained by Lessee, then and in that event, this Lease
Agreement shall terminate and Lessee shall neither occupy the
leased premises nor be obligated to make any rental payments .
3. Rent:
Lessee agrees to pay as rental for said property and im-
provements thereon during the term of this Lease, beginning
March 1, 1977, the sum of Twelve Thousand Dollars ($12 ,000.0O)
for said twelve (12) month term, payable in equal monthly in-
stallments of One Thousand Dollars ($1, 000. 00) in advance
without notice, on the first day of each month.
4 . Utilities :
Lessee shall timely pay all bills for all water, light,
heat, power or other services or utilities furnished to the
demised premises during the term of this Lease.

5. Maintenance:
c_Lesso , shall be responsible for repair and maintenance
of the building, driveways, parking areas and all other items
in their present state of good repair and condition.
6. Insurance:
During the term of this Lease, Lessor shall obtain and main-
tain fire and extended coverage insurance on the buildings in
a sum of not less than 80% of said building's full value.
7. Loss From Fire, Etc. :
If the demised premises be damaged or destroyed by fire or
other casualty and cannot be repaired or restored within thirty
(30) days , the Lease shall terminate and the parties hereto
shall be released from any and all continuing obligations here-
under, but if the damage so caused can be repaired within said

period, Lessor shall repair said damaged premises at its own
cost and expense, reasonable allowance being made for delays
occasioned by Acts of God, strikes or other causes beyond
control of Lessor. During the period that such repairs are
being made, rental hereunder shall be abated in proportion to
the amount of damage to the property (even to the extent of all)
if Lessee is prevented from occupying and using said demised
premises or any substantial portion thereof during such repairs
and if such damage was not caused by Lessee. Upon completion
of such repairs , Lessee shall pay the full rent on said pre-
mises in accordance with the terms of this Lease.
8 . Use of Building.
The demised premises shall be used by Lessee for the pur-
pose of operating a specialzed group home for children. Lessee
shall observe and comply with all Federal , State and/or Municipal
Statutes, Ordinances , Rules and Regulations applicable to the
use of the demised premises and agrees to and will indemnify
and hold harmless said Lessor from any and all liabilities
resulting from any violation of any such statute, ordinance,
rule or regulations by Lessee, its employees , or any person who
shall be upon the demised premises with Lessee ' s consent.
9 . No Sub-Lease or Assignment:
Lessee shall not, without the written consent of Lessor
first hand and obtained, assign this Lease, or any interest
herein or let or sublet said demised premises , or any part or
portion thereof. However, in the event the program for the
youth home is terminated by reasons beyond the control of
Lessee, Lessors will not unreasonably withhold consent to permit
Lessee to sublease to a responsible party. If written consent
is given by Lessor, Lessee shall, notwithstanding anything
herein contained to the contrary, remain liable and obligated
for the payment of rent and performance of all other terms
and conditions herein contained to be performed by Lessee.
10. Default:
The Lessee further covenants and agrees that if the rent
or any part thereof, shall be in default or in case of a breach
of my of the covenants or agreements herein, the Lessor may

declare this Lease terminated, and after the expiration of five
(5) days from the date of the service of a written notice to
that effect, be entitled to possession of said premises without
further notice or demand.
11. Lessor's Right to Inspect Premises :
Lessor reserves the right to enter upon said demised pre-
mises at any and all reasonable times to ascertain the condition
of said property and to see whether Lessee is complying with the
terms and conditions of this Lease in regard to the maintenance
and care of said property.
12. Non-waiver.
No express or implied waiver of the Lessor or any default
or breach hereunder shall in any way be or be construed to be a
waiver of any future or subsequent default or breach on the
part of Lessee or waiver of the rights of Lessor under the
terms hereof or modification of any of said terms or an extension
or enlargement of the rights of Lessee.
13. Alterations, Improvements, Machinery and Equipment:
All structural alterations, repairs, additions or improvements
made by Lessee to the demised premises , upon the expiration of
this Lease or upon the prior termination thereof, shall be and
become the property of Lessor and shall remain upon and be sur-
rendered with the said premises at such time. Lessee shall make
no major alterations without prior written consent of Lessor.
14 . Monthly Tenancy After Expiration or Termination:
Upon the expiration of the term of this Lease or upon
prior termination hereof, Lessee shall quit and surrender the
demised premises and if Lessee shall hold over after such ex-
piration or termination with the written consent of Lessor, such
holdover shall be deemed to be a tenancy from month to month
at a monthly rental in effect at the time of such expiration or
termination, which monthly rental shall be payable in advance
on the 1st day of each month during the continuance of Lessee' s
occupancy.

15. Notices :
Any notice required or desired to be given by either party
hereto to the other party shall be sent by Registered Mail,
Return Receipt Requested and postage prepaid to Lessor at
, Greeley, Colorado 80631 ,
and to Lessee at the Centennial Center, 915 10th Street, Greeley,
Colorado 80631, and receipt of such notice shall be presumed
seventy-two (72) hours after the mailing of such notice. It
is understood and agreed that the addresses to which such notice
or notices shall be sent may be changed at any time or from time
to time by either party hereto to the other party by notice
sent pursuant to the provisions of this paragraph.
16. Successors in Interest:
This Contract and Lease and the terms and provision hereof
contained shall be binding upon and inure to the benefit of the
successors and assigns of the parties hereto. However, this
contract, or any part hereof, may not be assigned by Lessee
without Lessors ' prior written consent.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be executed by the proper officers of the parties

This is to acknowledge your request for soil information for a parcel of
land located in SEA Section 16 Township 7 North, Range 65 West, 6th
P.M. The needed soil information is to be for foster child care facility
use. The entire land parcel lies within the soil type Dacono Clay loam,
0 to 1 percent slope.
This is a deep, well drainedsoil with a typical surface layer of grayish
brown clay loam about 12 inches, thick. The subsoil is grayish brown clay
loam about 15 inches thick. The substratum is a gravelly sand. Depth to
sand and gravel ranges from 20 to 40 inches.
Permeability is moderately slow. Available water capacity is moderate.
Effective rooting depth is 20 to 40 inches. Surface runoff is slow and
erosion hazard is low.
Windbreaks and environmental plantings are generally well suited on this
soil. Generally all trees and shrubs adapted to this area will grow.
Continued cultivation to control competing vegetation should be practiced
for as many years as possible following planting. Trees that are best
suited and have good survival are Rocky Mt. juniper , eastern redcedar ,
ponderosa pine, Siberian elm, Russian olive and hackberry. Shrubs best
suited are skunkbush sumac , lilac , Siberian peashrub and American plum.
Openland wildlife, such as pheasants , mourning doves and cottontails , are
best adapted to this soil. Wildlife habitat development , including tree
and shrub plantings are well as grass plantings to serve as nesting areas
should be suceessful without irrigation during most years. Under irriga-
tion good wildlife habitat developments could be established that would
benefit many kinds of openland wildlife.
This Dacono soil has only fair potential for urban and recreational
development. Above the sand and gravel substratum the soil has a moderate
to high shrink-swell, low strength and moderately slow permeability, all
of which will create problems in dwellings and road construction.
Excessive permeability in the substratum may cause contamination of the
ground water supply from septic tank leach fields.
