This "Use by Special Review" application will be coming before you on August 16. If the five of you approve it, you will change my and my wife Deb's world forever. We have lived in our home for close to 15 years and have no interest in moving. We love it here. We have a 4800 square feet home and 8 acres on a paved road with very little traffic and the closest neighbor is over 1/2 mile away. The home has been completely renovated/upgraded including the walk out basement. Our dogs enjoy a five acre fenced yard with no disturbances. I have a 3000 square foot dream shop (not just my dream but any hobby person's dream shop). We are 35 minutes from the airport, less than an hour to Anshutz Medical Center (Deb's dad is often receiving medical care there), and 12 minutes from work, Auto Collision Specialists. OK, admittedly the 12 minutes is longer because CR 49 is under construction but that won't last forever. I walked out of my bedroom onto my deck last night and looked at the stars with no light disturbance and listened to the crickets and frogs enjoying their evening. All of that may change. DCP Midstream plans to build an industrial, three -turbine gas compressor station approximately 1000 feet from my property line and, as I said in the first paragraph, 1,500 feet from my bedroom window. Paul Park, the DCP representative with whom we have been working, admitted, "We [my wife and I] are in a unique situation" as to our proximity to this compressor station. We visited the "Rocky" compressor station on Wells Ranch on Friday, July 8. "Rocky" is the sister compressor station to the proposed USR17-0023 that DCP plans to build. What we discovered was that our situation isn't "unique." It's unlivable. We were shocked. My wife Deb, having grown up in Grover is one of the strongest women I have ever known, left Wells ranch in tears. I now find myself in the fight of my life. During my discussion with Paul Park on July 8, I relayed to him that I was forced into becoming an "EXPERT" in a very short period of time to fight this. DCP and all their experts are asking me, a body shop owner, what noise mitigation needs to be done so I can live with sound levels that exceed 90 decibels. How in the love of God would I know that? Even the planning commission posed that question to me (really). What we need is an independent sound engineer to see if our situation is livable at all. I told Paul Park during that discussion that my research, mostly from reading research done by Professor Thomas Gabrielson, head of the Physical Acoustics Department Applied Research Laboratory at Penn State University, that their proposed "BERM" would do no good in mitigating the noise and vibration created by this compressor station because of our close proximity -1500 feet to our house. Mr. Park agreed, you can only imagine the look on my face at that moment. How is that possible for their representative to know this and still look me in the eye? For those of you that know me, you know I will not back down when I believe in something. I am only asking one thing from all you. Please, take a field trip to the Rocky compressor station on Wells Ranch. Stand at all four sides of that plant and ask yourselves three questions: 1. Does this belong 1500 feet from a home? 2. Would you allow it 1500 feet from your home? 3. What actions would you take? I can't help but believe that you will come to the same conclusion that I have, and you will understand my resolve in this matter. This is not about protecting owners of mineral rights, this is about what is convenient for DCP, and my wife and I are merely collateral damage. DCP has options that don't include ruining someone's life for profit. By DCP's own attorneys' admission in the planning commissions meeting, this is the most financially viable option. I ask for who? (I didn't make that up read the minutes) In closing, I urge you to review the planning commission meetings notes. Review and weigh all the facts. My belief is that if any or all of you vote yes or no on this USR without taking the time to drive out to Wells Ranch, see it first hand and make up your own mind, you are not fit to hold office. You will have to wake up every morning and look in the mirror and think- wow - wonder how Mike and Deb Morris out on County Road 44 are doing. If that doesn't bother you, God help you. One last thought, no last question. How many of your staff that are working on USR17-0023 have actually been to the Rocky compressor station? And so it begins. Hope you are having a nice weekend. Thank you for emailing us your concerns and request to extend the hearing. Given that the hearing as already been scheduled. posted and advertised your 1 request for a continuance should be made at the actual date and time of the hearing. During the hearing the Commissioners will take all the facts and testimony under consideration and decide on whether or not to continue a case. In the meantime, I would recommend that the expert witnesses provide written statements if they are not able to make the hearing. Sincerely, Tom Parko Mr. Parko we are requesting that the hearing on this USR be moved back a minimum of 30 days. We have a residence within 1500 feet of this project and feel that the project is not a compatible use with the surrounding area. We have found ourselves in the position of researching and hiring our own experts in the use of gas compressor stations in proximity to homes. Our research is indicating that concerns will include but not be limited to noise, light, and emission. We are flying to meet with the head of Physical Acoustics Department Applied Research Laboratory at Penn State, Professor Thomas Gabrielson, on Monday to garner further information on his research. We have contacted a number of other researchers to have as expert witnesses. We are in negotiating with a researcher to initiate a local study of the effects of compressor stations. Of course, all of this takes time. We were caught off guard by DCP and the planning staff as to the size of this project. We received the card in the mail notifying of us of the pending hearing before the planning commission. Mike took that card to Kim Ogle who indicated by marking on the card with a red pen a very insignificant area on the southwest corner of the property indicating a very small foot print. We were caught off guard how large this stations foot print was in comparison to the area indicated by Mr. Ogle. Our attorney has kept this card in his file and a we will provide a copy to y ou if requested. DCP asked us to meet with them to discuss mitigation of the sound. They offered an opportunity for us to visit the "sister" sight to this plant. We did so on the date they chose, the time they chose and the conditions that existed at that time. We were beyond shocked at the noise and vibration level. In the subsequent meeting with DCP's attorneys their in-house counsel started the meeting with "we had picked a bad day to go to the site". They supposedly were having problems that created an unusual sound level. Please keep in mind that their representative was at the site with us for approximately an hour and never mentioned the "unusual" conditions. They assured us that their engineers could fix the sound issue and get the sound to under 34 decibels. They had not brought an engineer to the meeting. When we asked "how" we were told the attorneys weren't experts and couldn't give us any information. If they could not answer our questions the meeting seemed pointless and we left. We did offer to fly anywhere (on our dime) in the United States where this noise mitigation has been accomplished. We have not been contacted by DCP to provide us with that information. We are requesting moving themeeting to 1) Have our research time 2) Schedule expert "w itnesses" 3) Visit the "ideal" gas compressor station that DCP locates for us. Currently the DCP Mewbourn Gas Plant has conducted an analysis with WAVE Engineering. In response to Question No. 3 Any USR's that have been granted in the vicinity of this application. This information was not included in the planning commission hearing presentation. The DCP Midstream Mewbourn and O'Connor plants. You know the location of the Mewbourn plant. The O'Connor plant is located at WCR 51 and WCR 50 or about a mile east of WCR 40 and 2 miles south of Hwy 34. Never found a violation for either operation. The O'Connor plant was reportedly generating a low frequency, harmonic noise transmitted through the ground. As you know there are operating as of today. The interesting thing about O'Connor is that the compressors are driven by huge electric motors and not RICE's. 2. The Public Service Company Yosemite Plant located at the SW %, or the NE quadrant bordering WCR 4 and WCR 19. This was a complaint of 10-12 years ago (or more). This was mainly a complaint of noise vibrations passing to the complainant through the ground and ascending and vibrating his home. Complainant lived east of this plant about 1/2 to % mile. No complaints since. This is still operating. 3. Anadarko (Kerr-McGee) gathering, compressor plant located at SE corner of the intersection of WCR 19 and WCR 10. This was also a decade or more ago. This was before they enclosed their engines/compressors in buildings. No complaints since. Never could capture a violation ---just the usual background, low frequency unceasing noise from engines/compressors/fans. This place is continuing to operate. 4. Anadarko (Kerr McGee) Platteville Compressor Station. This is located NW of the intersection of WCR 32 and WCR 37. One person who lived NW of the plant about % +/- miles had repeated complaints about noise from the plant. Anadarko eventually enclosed their engines and compressors in sound mitigating buildings. These complaints ceased and I have had no further complaints in the past 12 or so years. This plant is still operating. 5. DCP Midstream plant located at the NE corner of WCR 14 and WCR 19. This is the "Spindle" Plant. I am guessing 7+ years ago I had complaints of noise from a person about one of the compressors/fans (this plant has a lot of engines/compressors/fans). DCP knew about the problem and they had already had ordered parts for the repair. No complaints since. This compressor stations is still operating. I am trying to think of what I have done for looking at compressor noise complaints over the past 17 years and those are all that come to mind. If I come up with any others I'll let you know. Phil J.
