n RE: GRANT OF CHANGE OF ZONE FROM A - AGRICULTURAL TO C -
COMMERCIAL, FOR DORA SALIMAN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, apublic hearing was held on the 18th day of

the petition of Dora Saliman, c/o Richard Pfeifer - Trust Real

y WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the
petitioners for a change of zone upon the aforementioned tract
of land, and
WHEREAS, Section 8. 2 and 8 . 3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the petitioners and the recommendations of the Weld
County Planning Commission, and having been fully informed and

satisfied that the request for rezoning complies with the Weld
County Comprehensive Plan and the conditions set out in Section
8. 2 and 8 . 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the petition of
Dora Saliman for a change of zone from A-Agriculture District to
C-Commercial District on the above-described tract of land, be,
and hereby is , granted.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated January 6, 1978 , be, and hereby are, incorporated as
the findings of fact of the Board of County Commissioners in
this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 18th day of
January A.D. , 1978.

I hereby certify that pursuant to a notice dated December 12 ,
1977, duly published December 14, 1977 and January 4 , 1978 in
the Greeley Journal, a public hearing was held on the request
of Dora Saliman, et al, for a change of zone from A-Agricultural
to C-Commercial District. Mr. Richard Pfeifer, Trust Real Estate
Officer with Colorado National Bank, represented the applicant
and elaborated on the request. Ken McWilliams, Weld County Planner
informed the Board that the request includes a recorded exemption
and approval of a planned unit development plan. There was no
one in the audience in opposition to the requests. After review,
Commissioner Steinmark made a motion to approve Recorded Exemption
#296. Commissioner Carlson seconded the motion and it carried
unanimously. Commissioner Jacobucci made a motion to approve
the Change of Zone from A-Agricultural to C-Commercial District.
Commissioner Roe seconded the motion and it carried unanimously.
Commissioner Steinmark then made a motion to approve the Planned
Unit Development Plan with the development standards as recommended
by the Weld County Planning Commission. Commissioner Roe seconded
the motion and it carried unanimously. All five Commissioners
were present for the hearing.

1. It is the opinion of the Planning Commission that the applicant
has complied with Section 8,3 of the Weld County Zoning
Resolution which states : "Request for rezoning of tracts within
Weld County should be supported by detailed and substantial
evidence that such rezoning is necessary. Recent findings and
oral statements by petitioners should show very clearly that
either the original zoning was faulty or that changing conditions
in the area now justify a new classification. Without the
presentation of such supporting documentation, the County Planning
Commission should not recommend a change of zoning. "
It is the opinion of the Planning Commission that the applicant has
demonstrated that changing conditions in the area now justify a new
zoning classification,

2. The rezoning request agrees with the policies contained within
the Weld County Comprehensive Plan in that the request for
commercial development is in compliance with the use designation
for this area as outlined in the Ft. Lupton Comprehensive Plan,
3. The Ft. Lupton Planning Commission has recommended this zoning
request be approved since the proposed commercial use agrees
with Ft. Lupton' s Comprehensive Plan.
4 . The Weld County Health Department has indicated that the proposed
commercial development does not conflict with Weld County and
State Health Standards and Regulations,
5. The Ft. Lupton Fire Protection District indicated they had no
objections with the approval of this request.
6. The Soil Conservation Service has indicated they have no
objection to the proposed zone change.
7. The County Engineer indicated they could not identify any
engineering problems with the request.
8. To date our office has not received any opposition to this
rezoning request from any of the surrounding property owners,

1. The permitted uses on the hereon described property shall
be storage, service, repair, and sales of oil field
equipment and office or headquarters for the operation.
This commercial operation shall include the facilities
as shown hereon which includes a mobile home for office
use.
2. The landowner shall secure all the necessary and applicable
building permits including a building permit for the
mobile home and any building permits needed to upgrade
the existing structures for the commercial use.
3 . The property in question shall he maintained in such a
manner so as to prevent fugitive dust, soil erosion, and
the growth of noxious weeds.
4. All phases of the operation of the facility shall at all
times comply with all applicable Weld County and State
Health Standards and Regulations.
5. Access shall be limited to the one access point shown
hereon. The access must be approved by the County Engineer
prior to installation.
6. All parking shall be provided on-site.
7. Any changes to the plans and/or Development Standards
shall require the approval of the Board of County Commissioners

FARM MANAGEMENT AGREEMENT
belle Lieberman , Sylvia Rubin , Dora Saliman and Ruth Strathinan,
(hereinafter called "Owners" ) and The Colorado National Bank of Denver
(hereinafter called "Agent" ) hereby enter into this agreement for the management
and operation of the following property:
Lots 3 , 4, 5 and 6 , Block 10, Town of
Ft. Lupton, Weld County, known and numbered as
326 Denver Avenue, Fort Lupton
W/2 IM/4 and E/2 N'd/4 East of U. P . ROW, Section
20 and NW/4 NE/4 and N/2 NE/4 of Section 32,
all in TWWP 2 North , Range 66 West, Weld County,
Colorado , with 50 shares Fulton Irrigating Ditch
Co. stock appurtenant thereto.
1 . OPERATION: Agent will care for and manage the property, such care and
management to include obtaining tenants and leases , collecting rents and crop
shares , purchasing supplies , supervising repairs and maintenance, and in general
employing Agent' s Lest efforts to protect, preserve and improve the property so
as to enhance its value, as well as to secure the greatest income therefrom:.
2. LEASES: Leases for one year or less shall be negotiated and signed by
Agent, in Owner 's na:r.e; leases for more than one year shall be negotiated ay Agenti
and submitted to Owners for their approval and signature.
3. RENT `: Thilnt will collect cash rentals and Owners ' share of all crop rent,Ha ,
and see to it that the provisions of all leases are complied with by the tenants,
provided that legal proceedings for collection , enforcement, or termination shall
he initiated only upon Owners ' direction or approval .
4 . REPAIRS AND IMPROVEMENTS: Agent will .ivuk after all necessary maintenance
and repairs which are Owners obligation ard supervise the tenants in
connection with their lease obligations for maintenance and repair. Agent
will not let any contract or make any single disbursement for repairs or
improvements in excess of $500.00 without first obtaining Owners ' written consent.
5. FUNDS: All funds collected by Agent less expenses incurred and reasonable
reserves for anticipated expenses will be remitted quarterly to Owners.
G. REPORTS: Agent shall make quarterly reports to Owners ' , showing all
cash receipts and disbursements made hereunder for the prior period. Annually
on or before February 15th, Agent shall prepare and furnish to Owners a
narrative report covering the operations hereunder for the prior calendar year.
7. COMPENSATION: Agent shall receive for its services 10% of the gross annual
income collected, to be deducted by Agent before payment to Owners of the
quarterly net income. Such commission shall cover all normal management
activities of Agent. Additional compensation in reasonable amounts shall be paid
to Agent for negotiation of leases longer than one year and oil and gas leases,
of grants of rights of way and easements , and for capital improvements
made under Anent's supervision.
8. TAXES AND INSURANCE: Unless directed to the contrary, insurance premiums
and real estate taxes will be paid by Agent.
9. TERM: This Agency Agreement shall continue until terminated by either party
hereto as herein provided. ,Upon not less than sixty days prior written notice
to the othe►•i either party hereto may terminate this Agree„ient as of the
termination date specified in the notice. Upon a sale of the property,
the agreement shall terminate as to the property sold. Termination by Owners must
be by all acting in concert.
10. LEGAL RELATIONSHIP: The relationship herein established is that of
Principal- and Agent and so lone; as this ac:r.,..2ment is in force Agent shall
accept all instructions of Owners to which all owners have agreed in writing
(even though in contravention of the terms hereof) except that Agent's
compensation shall not be reduced without Agent's consent thereto.
11 . All contact with tenants shall be exclusively by Agent, and Owners'
individually or together shall not negotiate with, give instructions to, approve
expenditures by, or receive rent from any tenant. Owners [nay inspect the
subject property, but this provision is intended to assure the efficiency and
continuity of Agent's business relationship with the tenants.
12. Sale of any of the subject property is not presently contemplated by
Owners, and this Agreement does not contemplate Agent advising Owners
concerning sale, offering or negotiating a sale or in any way being involved in
a sale of any of the subject property.
13. This Agreement shall be considered. to have been made and• executed in
Colorado and shall be construed in accordance with the laws of Colorado.

in a regular meeting of the Planning Commission of the City
of Fort Lupton consideration was given to the zoning change
application of Dora Saliman et al. A motion has been unani-
mously ascribed to recommending to the Weld County Planning
Commission that such change , from "A" to "C" , be granted for
the parcel of land described as Pt . NW e, Section 32 , T2N, P66W .
In addition to this recommendation, the Fort Lupton Planning
Commission would like to express its desire that any additional
parcels of land in this area being considered for similar
zoning be encouraged in a southerly direction toward the City
Limits rather than in an easterly direction.

comments and consideration. As these areas adjacent to or near
the City are critical to our own Master Plan and to the prin-

Dear Mr. McWilliams:
This is to acknowledge receipt of preliminary material for the above
referenced rezoning case . Unfortunately, no information is presented con-
cerning the water supply . We feel that this commercial facility may require
considerable water for equipment washing and related activities . Also, our
office has no record of the existing well on the property nor is it clear if
the well is to be used to supply this business . Because of this , we cannot
recommend approval of the Saliman Rezoning until information is presented
concerning the water supply .

Subject.
1) Box cars can be used for storage only of non-combustible
materials. Do not believe structures safe for people to work
in. Close to lot lines.
2) Barn not too bad structurally, but will need two sets of
plans with floor plan showing what operations will be performed
in each area. Number of employees to work in barn. Will need
heat and plumbing. Possibly some fire walls as building is all
wood.

Dear Sir:
As instructed by your form WELL PERMIT APPLICATION for an exempt well
dated October 31 , 1977 this letter is intended to explain what is
meant by our request for a commercial well .
1 . Our prospective tenant will use the 2'-2 acres for sales yard and
storage of oil field pipe, valves , etc.
2. The tenant will place a housetrailer on the location to be used as
an office with no more than eight office personnel .
3. The well is to be placed on the 21 acre tract which is part of an
approximate 100 acres owned by the applicant. Approximately 250 ft.
south from the proposed commercial well we have an irrigation well ,
reference No. 13013R with a 900 gallon per minute rating used to
irrigate about 95 acres. Approximately 175 ft. east from the proposed
commercial well we have a domestic well having supplied a farm dwelling
for many years.
Enclosed is a vicinty map for your file along with the original
application initially submitted October 24, 1977 for your immediate review
as the planning commission will not act favorably unless they have some
indication the well will be permitted at their scheduled November 15, 1977
meeting.

Dear Sir:
Reference is made to your letter of October 21 , 1977, which you
requested various information along with answers to items 6, 7
and 8 of the rezoning questionaire.
6. These two properties are contiguous to subject property but
are in the town of Ft. Lupton and do not provide us with ingress
or egress therefore the northwest corner along the railroad is the
logical choice. The proposed zoning keeps in line with the planned
industrial area of Ft. Lupton and we can provide access along the
east side of the tracks as needed for additional expansion all the
way to the city limits.
7. The location lends itself to commercial use. And will be a
natural appearance buffer for the heavier industrial zoning that is
proposed for this area in the future. This ground has existing sheds
and storage facility and is the ideal size for this type of business
that Cesco could not locate anywhere else in or out of the city limits.
