RESOLUTION RE: GRANT IN PART, AND DENY IN PART, THE APPEAL OF THE DECISION BY THE DEPARTMENT OF PUBLIC WORKS TO DENY REVISED ACCESS PERMIT, AP17-00438, FOR RECORDED EXEMPTIONS, RECX17-0131 AND RECX17-0132 - NCL INVESTMENTS, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Sections 2-4-10 and 12-5-100 of the Weld County Code, the Board of County Commissioners considered the appeal of the decision by the Department of Public Works to deny Revised Access Permit, AP17-00438, for Recorded Exemptions, RECX17-0131 and RECX17-0132, submitted by the Appellant, and WHEREAS, the Board heard testimony and took evidence from Public Works staff and AGPROfessionals, LLC, 3050 67th Avenue, Greeley, Colorado 80634, on behalf of the Appellant, NCL Investments, LLC, and WHEREAS, upon consideration of such appeal, including a review of all information submitted by the appellant and the Department of Public Works, the Board deems it advisable to Grant in part, and Deny in part, the Appeal of the Decision by the Department of Public Works concerning AP17-00438, as follows: Deny the revised access permit as requested by the Appellant and give direction to staff to issue one (1) oil and gas access as it currently exists; one (1) residential access to Lot A of RECX17-00131 to be located at a point further east to meet sight distance requirements; one (1) shared residential access between Lots A and B of RECX17-00132; and one (1) agricultural access to Lot D of RECX17-00132, all off of County Road 84. The access application identified one existing access and proposed one new shared access on WCR 84, as well as identifying two existing accesses on WCR 27 for Lots C and D. Please see Exhibit A of the attached map associated with this access permit/RE, for which the access permit was issued. Then, AP17-00438 was issued September 14, 2017 for RECX17-0131 and RECX17-0132, which incorporated Lot A of RE -427 and enlarged and shifted Lots A and B of RECX17-0012. The access for RECX17-0131/132 added a third access to WCR 84. Please refer to Exhibit B of the attached map. In October, AGPROfressionals requested a revision to AP17-00438 on behalf of NCL Investments, LLC stating they no longer wanted to share the access point for Lot A RECX17-0132, but wanted this lot to have its own access approximately 1,400 feet from WCR 27. Therefore, staff re -reviewed the accesses on WCR 84 and performed a site inspection. Public Works observed only one existing access along this stretch of WCR 84, which was approximately 220' from WCR 27. This access appears to be on Dave Drake's property, and this parcel is not included in the boundaries of these recorded exemptions. Regardless if this access was intended for Lot A of RECX17- 0131 or not, it is not safe due to sight distance obstruction because of its location along the side of the hill. Once you get over the hill to Lot A RECX17-0132, there is another smaller hill, which is also a sight distance obstruction, but not as severe. Therefore, the staff recommends revising AP17-00438 to relocate a shared access location at the top of the second hill for all the RE Lots on WCR 84 to ensure the residents access WCR 84 in a safe location. According to Section 12-5-90 of the Weld County Code, applicants may be required to coordinate with neighboring property owners to consolidate existing accesses into shared accesses, whenever feasible. In addition, recorded exemption lots are supposed to provide a shared access for the lots, whenever feasible. Essentially, AGPROfessionals is requesting one access per lot along WCR 84. However, due to the hills creating a sight distance safety concern on this road, Public Works is recommending the Commissioners provide no more than two shared accesses for all four lots. This may require the developer to provide an internal access road parallel to WCR 84, where we can ensure accesses to WCR 84 are identified in a safe location. No accesses have been constructed to date. The safest access location is across from the existing access on the north side of WCR 84 at the top of the second hill. You can see the house in the picture at the top of the hill. WCR 84 is a local road with 60' of right-of-way as identified on the County's functional classification map. The main rationale for a shared access is to have as little a net increase as possible, preferably zero net increase. The main lot that is being split to create the other four lots already has S existing access points. If the land owner is willing to close some points in order to get two new ones we can do this trading. I can see there is a small hardship for new lots A & B because of their location north of a ditch. This appears to hinder any future users from utilizing the existing access points on CR 27. This allows for a net increase of one access point but not 2. If your landowner is interested in requesting a variance I would just need a hardship letter stating the reasons why the county code cannot be followed. Once that is complete you can send it to me and I can forward it up the chain for review. My client is not interested in having a shared access due to the potential conflicts with future shared access maintenance agreements and site layout concerns. If your landowner is interested in requesting a variance I would just need a hardship letter stating the reasons why the county code cannot be followed. My client had identified an existing access point on WCR 84 while taking access photos and relayed that information to me. I understand that your department was not able to identify this access point during a site visit. Rather than spend additional resources on this access permit to meet on site and discuss said access point I believe it would be more expedient to move forward with the original agreement. We had originally proposed a new access each for Lots A & B of RECX17-OO12 and were told that only one new access would be granted unless we agreed to close an existing access. My client is willing to close/relocate the existing access point located on proposed Lot B. This was reflected in our last request. The access located on WCR 84 approximately 230 -feet east of said intersection for Lot A RECX17-0131 was approved under the condition that the access could be shown on the plat. AGPROfessionals emailed Morgan Gabbert: AGPROfessionals agreed to verify whether the access located on WCR 84 approximately 230 -feet east of said intersection was located within property boundaries and show on the plat. AGPROfessionals requested clarification of whether it would be necessary to have a shared access point for Lot A RECX17-0131 and Lot A RECX17-0132 if the access located on WCR 84 approximately 230 -feet east of said intersection was located on Lot A RECX17-0131. Morgan Gabbert emailed AGPROfessionals: The access located on WCR 84 approximately 1,220 -feet east of said intersection will need to be shared between Lot A RECX17-0131 and Lot A RECX17-0132 regardless. If the access located on WCR 84 approximately 230 -feet east of said intersection for Lot A RECX17-0131 is located within property boundaries, then it will be advantageous for that lot from a marketability standpoint as it will have two approved accesses. AGPROfessionals emailed Morgan Gabbert: If the concern is marketability of Lots A RECX17-0131 and RECX17- 0132 then it is the belief of AGPROfessionals that a shared access would reduce the value of both lots whereas if each had their own access, they would both be equally desirable from an access standpoint. Morgan Gabbert emailed AGPROfessionals: Morgan Gabbert agreed to consider an access permit revision once the access located on WCR 84 approximately 230 -feet east of said intersection could be located within the property boundaries and shown on the plat. Morgan Gabbert issued AP17-00438 and sent an invoice for the access located on WCR 84 approximately 230 -feet east of said intersection to upgrade the access from ag to residential. AGPROfessionals was given the direction to pay for this access once the surveyor could locate the access and show it on the plat. Access Permit AP17-00438 Appeal Page 4 of 5 10/3/17 AGPROfessionals requested a revision of AP -17-00438: The access located on WCR 84 approximately 230 -feet east of said intersection is located within the property boundary as shown on the plat. AGPROfessionals requested that the access for Lot A RECX17-0132 be located on WCR 84 approximately 1,400 -feet east of said intersection. This would locate the access central to the lot along WCR 84 and it would no longer be a shared access point. We contended that a shared access point was not necessary as each lot had its own access. We were directed to verify the 230' access point's location and show it on the plat, which we have done. An invoice was issued for this approved access point. The approved access located 230' east of the intersection provides access to oil and gas operations, the overhead transmission line and field/farming operations. If this access needs to be shifted due to safety concerns, we would be willing to discuss that but we still need to provide access for these operations. Please provide recommendations based upon sight -line and code criteria. Can you please provide what new information came to light during the latest site visit and what the safety concerns are. It is our understanding that WCR 84 is straight and of similar elevation between the points of 1220' and 1595' east of the intersection of 27 & 84.
