RE: RECORDED EXEMPTION NO. 241 - ROSALEE STEHMAN READOUT
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 15th day of December, 1976, in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Rosalee Stehman
Readout, 2835 4th Street, Greeley, Colorado 80631, more particu-
larly described as follows :
All that part of the W1 of the E' of the NWq of
Section 1, Township 5 North, Range 66 West of the
6th P.M. , Weld County, Colorado, lying South of
the South right of way line of Union Colony Canal No.
3 (also known as the canal of The Greeley Irrigation
Company) as the same is now constructed and located;
EXCEPTING from said parcel of land the South 200 feet
of the East 150 feet thereof, more particularly
described as follows : Commencing at the Southeast
corner of the W1 of the E' of the E' of the NWQ
of said Section 1; thence North, parallel to the East
line of Section 1, 200 feet; thence West, parallel
to the South line of said Section 1, 150 feet; thence
South, parallel to the East line of said Section 1,
200 feet to the South line of Section 1; thence East
150 feet along the South line of Section 1 to the point
of beginning;
does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-28-
101 (10) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land from
the definition of "subdivision" and "subdivided land" pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as
amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Rosalee Stehman Readout, be
exempt from the definition of the terms, "subdivision" and
"subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A(3) of
the Weld County Subdivision Regulations.

Dear Commissioners :
The attached application, plat, and related items are in reference
to a request by Rosalie Stehman Readout for a recorded exemption.
The subject property is described as part of the NW* of Section
1, T5N, R66W of the 6th P.M. , Weld County, Colorado. Said property
is located 6/loths of a mile west of 23rd Avenue on the north side
of 4th Street on the northwest perimeter of Greeley. The subject
property contains 4. 706 acres. The request is to split the
property into parcels of 3. 735 acres and .971 acres. The entire
parcel is currently zoned "E" , Estate. The Readouts currently
reside on Lot A of the subject property. Presently there are
no improvements on Lot B, however the stated intent is to split the
property for residential purposes.
Based upon the information submitted, and the adopted policies
in the county, the Planning Commission staff recommends that the
request be approved for the following reasons.
1. The City of Greeley Planning Commission has indicated
the request complies with the Greeley Cbmprehensive
Plan and they have no objections to the granting of
this request ;
2. The subject property is currently zoned "E" , Estate,
and the proposed parcels meet the minimum lot size
in the Estate district ;

PLANNING COMMISSION MINUTES
November 23, 1976
In the absence of Tom Charles and Dean Commins, Commissioner
Ewald moved that John Dietz chair the meeting. Commissioner
Keirns seconded the motion and it passed unanimously.
The meeting was called to order by Chairman Dietz. Those
present were Commissioners Clift, Dietz, Ewald and Keirns.

I. APPROVAL OF MINUTES
Motion was made by Commissioner Ewald that the minutes of
the previous meeting be approved as mailed. It was seconded
by Commissioner Keirns and passed unanimously.
II. PRELIMINARY PLAT: LARSON SUBDIVISION
Location: North of 4th Street, West of 30th Avenue
Sam Sasaki, Planning Director, reviewed the preliminary plat
and the changes that had been made following Administrative
Review Team recommendations. These included changes in B
Street and re-routing of the streets.
Commissioner Clift moved that the preliminary plat be ap-
proved. Commissioner Keirns seconded the motion and it
passed unanimously.
III. REPLAT: LOT 1, BLOCK 2, HOLMES 5th ADDITION
Location: 17th Avenue and 4th Street
Mr. Sasaki reviewed the item and said the developer is asking
for a replat because he wants to divide the property and sell
each lot individually. There is a one-story brick duplex on
each lot; each is served by separate water and sewer taps.
Commissioner Ewald moved that the replat be approved. The
motion was seconded by Commissioner Clift and it passed
unanimously.
IV. AMENDMENTS TO SUBDIVISION REGULATIONS: SECTION 4.1(F)
AND SECTION 4.2(F)
Mr. Sasaki reviewed the amendments to the Subdivision Regula-
tions and the resolution itself.
Commissioner Ewald moved that the resolution be adopted and
Commissioner Clift seconded it. The motion passed unanimously.
V. STAFF REPORT
Mr. Sasaki asked if the Commissioners wished to cancel the
December 28th regular meeting. This has been done in previous
years due to the holidays.
Commissioner Clift moved that the December 28th meeting be
canceled. The motion was seconded by Commissioner Ewald and
it passed unanimously.
Commissioner Dietz reported on the Liason Committee meetings
and commended Barb Oglesby for her fine work. There will be
a public meeting on the Community Development Plan on December
1 at 7:30 p.m. at Jefferson Elementary.

Mr. Sasaki reported on his trip to Texas for the Planning,
Zoning and Eminent Domain Seminar. lie said the Seminar
covered many legal aspects of zoning and the preparation
of a new zoning code and environmental laws.
