Hi Jackie:
It sounds incredibly frustrating, and we appreciate being
kept I the loop about current conditions. I will share this
with the technical staff.
I'm not intimately familiar with the plant operation, but
if they were producing biogas, I believe it would go into a
pipeline, not tanker trucks. My understanding is that
liquid in a lagoon is being trucked offsite to be land -
applied on crops. The company has a beneficial use
determination allowing that from our Materials
Management Unit. That's one possible source of the
odor.

Good morning Jackie:
I'm sorry you are still experiencing odors, but it does not
mean that the plant is operating, which we would define
as accepting new waste and processing it into biogas.
Our last inspection, on May 23, 2017, focused on
nuisance conditions and found no violations nor
indications that the plant was operating. I suspect the
odors reflect the company's handling of residual wastes
at the plant.

We are aware of the company's intent to sell, and will
work closely with the new owners to make sure the
plant runs in compliance with all the regulations.

As you know, Heartland Biogas LLC stopped the operation of its Anaerobic Digestion facility
earlier this year. After careful consideration, we have decided to sell the facility. The sale has
progressed to the due diligence stage which is the reason for my letter. I anticipate that
potential buyers may contact you and your department as they research the status of the
associated regulatory and operating permits and the path to reopening the facility.
Please forward this letter as necessary to ensure all appropriate CDPHE APCD personnel and
officials are aware of this decision. I appreciate your support as we move through the sale

Yes there still is an issue with the Heartland odor. Today, Sunday 4/30/17, it is VERY bad at our home, it is in our

Below are the days of the smell at our home from March; in March there were some bad days and April it has

3/15/17 — 6:30 am — 7:00 am Very Bad smell causing Ken to get nauseated and have a severe headache

3/16/17 — 7:30 am -8:00 am and 1:30 pm — 3:00 pm and 5:40 pm — 7:59 pm VERY bad smell, no wind
again caused horrific nauseating, headaches, hard to breath AND coughing spells
3/17/17 — 2:30 pm — 3:00 pm wind blowing to the SE

At this point my understanding is that they are providing information to the state about their shut down, and copying us,
but this is largely technical data. The court case is continuing to play out, and part of that is the question as to whether
they will be shutting down permanently or temporarily. You will recall that the County only suspended their permit
temporarily until they could come into compliance. As of now, we have not received a new certificate of designation, or
other documentation that they will be coming into compliance. I will continue to gather information. Thanks.

My understanding was that at 14 days upon commencing the Closure Plan they were to provide written notification to
the State and County. They would then have 90 days to complete the closure and then 30 days after completion they
are required to provide a notification that all requirements were met. (6 CCR 1007-2 Sec.14.8.2, 14.8.4 and 14.8.5)
At this point I think all they are required to do is provide the written notification that they were beginning the closure
plan which would then set the dates for the 90 day and post -30 day notifications. I have not seen any written
notification of a closure in the states and county's records so I was just curious if it had been submitted.

We have a strong northwest wind again this afternoon and there is a strong odor from the Heartland facility again. In
fact when we passed by it at the intersection of 49 and 40 it was overwhelming.
Have there been any updates on the shutdown? It was my understanding that they are required to update to county
and state but I have not seen any documentation.

I know that as the Heartland facility shuts down there will still be some odor. However,
wanted to personally write you about this weekend because it was exactly a year ago
that I had the exact same situation and things still aren't better.

There was odor both days at my house again this weekend. However the odor Sunday
morning was the most frustrating. I was out cleaning my animal pens and I could still
smell the rancid stench of Heartland over the manure in my pens. Their "experts" have
tried to claim that it is a manure smell coming from the facility. I cleaned out horse,
swine, cattle and sheep manure this weekend and the Heartland odor smelled nothing
like that and could easily be distinguished from the manure. It is upsetting that the
exact same weekend in February 2016 I had the exact same experience.
This facility has permanently and detrimentally impacted my life. This will be the first
year in 27 years that I have not had a garden because I can't stand be outside and risk
having that stench blow my way. We have discussed selling all of our livestock for the
same reason. My youngest daughters wedding in May has to be held somewhere else.
much like my oldest daughters wedding because of the stench. Depending on what
happens with the facility, we are even considering purchasing an RV and keeping in
town so we can stay in it on the weekends so we don't have to be around this
stench. There is rarely a moment that I am at home that this hasn't somehow impacted
my life.
My venting isn't meant at you. However when I realized that the exact same thing
happened to me exactly a year ago and the odor is still impacting my life, it was very
frustrating.

This message may again label me as "incompetent" and "not very well -tutored".
Julee's message below is exactly what I cautioned months ago that an on-line complaint entry process must be "simple",
"easy", and able to be used by a "lay -person".
The process is "simple", "easy" and "lay-abled" IF a person remembers one thing: One must enter "Accela Citizen
Access" or something like that.
If a person has forgotten "Accela---", finding where to register a complaint on the Weld County Government website is
frustrating, difficult and nearly impossible (it may not be impossible ---I did not try every innumerable combination of
search terms).
When the page appears after entering "Accela Citizen Access" at the top right is a Blue Field labeled "Login" with a
requested "User Name or E-mail" and "Password".

For lay -people that will put a stop to them. They will say: "What, I have no idea what my user name is, but I do know
my e-mail address!"
After that they will say: "I have no idea what my 'password' is."
They will give up at that point and create an e-mail message (as did Julee) or get on the phone and make a phone call.
Then at the near left hand bottom corner in fine print this appears: "New Complaint or Application". Clicking on that
brings up a page about a "General Disclaimer" that must be read and clicked "I have read and accepted the above
terms".
People likely are not going to spend time reading and understanding the "General Disclaimer".
Again, I am equal to a kindergarden student at computers. Most older lay -people are also at this level.
I am guessing that Julee Justice is at a junior high school level for computer use since she is a business owner. Even at a
Junior high level she got stopped because the entry system is not simple and easy to use.
I placed a call to Julee, but she was not available by phone. I left a message for her about 30 minutes ago.
I will remind her to use the "Accela Citizen Access" ---I will do this suggestion tactfully.
I want to caution again: We must keep these things at the level of "reading, writing, and arithmetic".
Our modern culture is not "reading, writing, and arithmetic" ---I understand that.

Good evening Phil,
Through December including Christmas day and this month of January we have had multiple days and times with the
odor from Heartland the we have not reported however today, Sunday, 1-29-17 it was very horrific and intense most of
the day. Ken is suffering from a severe headache after being outside & inside his shop most of the day and having to
endure the odor. Unfortunately for us we have had to let a lot of our outside & shop duties go to the wayside last year
and we are so far behind because of this. Today Ken couldn't just walk away from the things that needed to be done
outside and in his shop.
The wind was blowing to the E most of the day but would switch direction once and a while and the whole time,
including the times the wind stopped, the odor was horrific.

January 23 Monday 3:46 p.m. .. breeze E to W .. location 19595 WCR 45 1.5 miles from plant .. horrible odor from plant
detected while driving on 45 .. continued from road 40 clear to 44
January 23 Monday 9:55 p.m. .. breeze E to SW .. location 21730 WCR 44 2.5 miles from plant.. very strong odor from
plant at our residence, still noticeable at 10:30 p.m.
January 24 Tuesday 5:08 a.m... slight breeze coming into south window .. location 21730 WCR 44 2.5 miles from plant
.. awakened to noxious odor coming from plant continuing until 7:30 appx.
Heartland is not controlling the odors. There are almost always strong odors on 49 and even though we have shut down
our windows on the most part for winter..if they are open even slightly we do get very strong odors on occasion at 2.5.
miles away and my daughters home and south farm at 1.5 miles away. No improvement. If there is a change in odor
reporting it is because of winter and less time spent outdoors and windows shut because of cold weather. It certainly
cannot be attributed to Heartland controlling their odor because that is absolutely not the case here.
Please record as separate incidents. Thank you for your consideration.

window... woke up by very strong odor from plant coming through window..window only open 1/2 inch.. had to get up and
turn on ceiling fan and pull cover over face..very strong. When wind is my direction and is fairly calm the odor settles in
our valley.

Please accept this email in support of the Heartland Biogas Facility.
Our company, Alpine Waste & Recycling, is the largest collector of organic material diverted from landfills in
Colorado. Alpine is the organics collection partner for WalMart, King Soopers, DIA, Chipotle, the City of Golden, and
many others, collecting in excess of 2200 tons per month of organic material to be utilized for beneficial purposes
which would otherwise be destined for Colorado landfills. The majority of this material is sent to the Heartland Biogas
Facility. This is a result of the Heartland facility generating the highest use for this material, and therefore making it the
most cost-effective option available.
As a result of the development of Heartland, Alpine has been able to reduce the cost of this sustainable service to our
customers, which in turn increases the participation in organic waste diversion by the end user, driving up waste

diversion and creating more renewable energy out of waste otherwise destined for landfills. In fact since the opening of
Heartland, organics collection has become by far the fastest growing segment of our business, increasing fourfold in
2016 alone.
Organic material is estimated to be 67% of the total municipal solid waste stream, yet in Colorado organic waste
diversion only represents a tiny fraction of that material. The potential benefit for growing this sustainable practice is
tremendous in our state, and Heartland plays an invaluable role through creating renewable energy, and conserving a
tremendous amount of natural resources and landfill space for future generations. It is my sincere hope that you will
take these facts into consideration when considering the fate of this facility.

I know the decision was made last week but I wanted to give a quick update for future reference.
This Christmas weekend was miserable with the Heartland odor. It truly ruined our holiday with our
family, which at this point it has ruined all holidays for us this year.
We had a family dinner on Christmas eve and the odor was so bad that I had explain and apologize
to all my guests why they had to eat dinner with a disgusting stench in the background in my own
home.
The odor was so strong yesterday evening and this morning that my eyes are burning and it is
making me nauseous inside the house.
As Heartland tries to move forward with their CD, please protect us. It is unreasonable to expect
anyone to live like this.

Wednesday December 28, 2016 2:33 p.m. Headed south on 49 going by plant. Smell was nauseating. High wind
blowing from N/W to S/E. Smell started out just north of plant and got stronger to nauseating as we traveled south on
road 49. It was very strong until we turned west on rd 38. I would label this one definite stench.
There was a red pickup with topper S/W of plant, if that was someone monitoring odor, they were completely out of
direction the odor was traveling this afternoon

Good Afternoon.
I understood that Heartland Bio Gas was shutting down their operation? Since the
Counsel meeting, it is business as usual over at the Plant...lots of truck traffic in and out
and major odor.
I wanted to thank you all for your voting to assist us in this area. I do want to put this on
the record that the stench from December 22-26, 2016 was terrible. It was wonderful to
have company over the Christmas weekend, only to have the inside of my home not
smell like apples pies, rather, Heartland Bio Gas.
I hope that someone will check into whether or not this company is actually shutting
down. From what I can see and smell, that is not the case.
