. RESOLUTION RE: GRANT OF A SPECIAL USE PERMIT FOR EXPANSION OF GAS PRO- CESSING FACILITY - TOA AMERICAN GAS PRODUCTS, 1131 OCEAN AVENUE, SANTA MONICA, CALIFORNIA 90403. The permitted use on the hereon described parcel of land shall be facilities for a gas products plant consisting of facilities for gathering incoming gas, compressing the gas, and processing the gas for the removal of liquids. 2. The gas products plant and its operation shall be in compliance with all County and State Health standards and regulations pertaining to air quality, water quality, noise emissions, and sanitary disposal systems. 3. Water shall be supplied by the Central Weld County Water District. 4. Upon termination of the operation of the gas products plant all facilities and structures shall be removed to 30" below grade. 5. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 6. The access shall be limited to the one access off County Road 19 as shown hereon. 7. No structure shall be permitted to be constructed within 70 feet of the edge of the right-of-way of County Road 19 unless granted through a variance by the Board of Adjustment. 8. The Special Use Permit shall be limited to the plans submitted and governed by the development standards stated above. One is to ' add additional storage to hold product in the event of inclement weather and the other is to add additional cooling equipment in the form of water useage to supplement the air cooling system that we presently have. Mr. Waterstreet explained that he felt the word "expansion" was somewhat misleading as they are not going beyond the compound enclosure but modifying within the enclosure itself. He explained that the life of the area is anticipated to be some - where between 10 and 20 years based on the oil and gas production in that particular vicinity of the spindal area. He also said that he was surprised at the objection of the town of Firestone and Tri-Area, as he is just modifying what is already there. ;, RESOLUTION: Be it therefore resolved to recommend approval to the Board of County Commissioners subject to staff recommendations and development standards. The Toa-American Plant was built in 1974 and 1975 and placed in operation in June of 1975. The installation of this plant was covered by Special User Permit 238-74 :1. At the time this Permit was applied for the survey of the tract, soil survey, a sanitation program and road accesses were submitted. The additions we propose will not alter these items. Operations of the gas products plant consists of gathering the gas produced from wells in the area, compressing the gas and processing the gas to remove gas liquids and deliver domestic quality gas. We are applying for a permit to install A 42,000 gallon propane tanks to hold plant production. At the time the plant was finished, it was planned to transport the liquids by pipeline. Due to pipeline capacity and marketing conditions, this was not the case. We have been trucking the product and due to the un- availability of trucks to move the product at times we have had to burn this material. In view of upcoming winter road conditions, we feel it is necessary to have more than 24 hours storage capacity. This additional storage will not increase truck traffic above the present three loads per day. Normal plant installations have 5 days storage and we are requesting authority to install a second tank if it proves to be needed. The aerial cooling system for the plant was designed at 90OF. Although the official temperature seldom exceeds this, the Colorado sun and rarified dry air have proven our cooling system shy of doing the job. We are requesting permission to install a water cooling system with its cooling towers and heat exchangers to meet our design conditions. As these exchangers are in short supply Plant Addition Page 2 August 2, 1976 we may not install all 5 of them at this time. The water for this system will be purchased from Central Weld County Water District. It is estimated that water requirements will vary between 4 and 8 GPM or 8,000 gallons/day. Depending on deliveries of equipment we would anticipate completion of our initial program in mid-October. The remaining heat exchangers would likely be delivered and installed next Spring. According to our information John and Mollie Horst own the acreage within 500 ' of the facility. Colorado Interstate Gas Company has a compressor station adjacent to our property as shown on the plot plan. A copy of the deed to this property in the name of Machii- Ross Petroleum Co. is attached to this application. Machii- Ross and Toa American Gas Products Co. are both owned by Mr. Machii and Mr. Kenneth A. Ross. The plot plan 's 0+00 point is the SW corner of the tract in Section 21 and locates on the survey at this point. Shown on the plot plan are the locations of the equipment and buildings presently on the property. The locations for the cooling tower, exchangers and storage tank applied for under this permit are shown by the cross-hatched areas. The other storage tank is outlined by broken lines. In the upper right hand corner of the plot plan the vicinity map shows the location of houses with reference to the plant site. Lupton, Colorado 80621 Re: Status of facilities at the TOA American Gas Products facility in the SE4 Sec. 21 T2N R67W Dear Mr. Waterstreet: The purpose of this letter is to clear up the confusion with regards to the addition of the two compressors and related facilities granted earlier this year. Apparently, it was unclear to our office that the building Permit #5541 applied for on May 28, 1975, included two new gas compressors which were not included in the original Special Use Permit application (SUP 238) . The Weld County Zoning Resolution specifically states in Section 3.3(E) (1 ) that "any expansion or enlargement of a Special Use shall be treated as a new application under the provisions hereof" . Per said regulations, T0A American Gas Products Company should have applied for said expansion before the issuance of building permit #5541 . However, since that permit was issued by our office and the installation of those facilities has been completed, our office does not feel it is justified to require T0A American- Gas Products to apply for the Special Use Permit for said expansion at this time. In addition, the current application for a steel building to house the compressors applied for and granted in building permit #5541 will not be considered an expansion of the facility, and therefore T0A American Gas Products will not be required to apply for a Special Use Permit for said facility. Please be advised that any further enlargement or expansion of the facility will be subject to the requirement of applying for a Special Use Permit as stated in Section 3.3(E)(1 ) cited above. M. , Weld County, Colorado. After discussing this matter in our office with you, the files were researched to determine the status of housing. The following items are findings from the file review: 1 . The Board of County Commissioners Resolution, dated April 3, 1974, number 3, page 2 states "that such oil and gas processing facilities and any related transmission facilities shall be limited to the items as shown on the plans as submitted". 2. The Board of County Commissioners ' resolution, dated April 3, 1974, number 4, page 2 states "that all applicable subdivision regulations and zoning regulations shall be followed and complied with". 3. The plot plan as submitted shows space for two (2) homes; these must be Uniform Building Code structures to comply with Weld County regula- tions. These items reflect that under the existing permit, named the Machii-Ross Petroleum Company Special Use Permit, located in part of the NE4 SE4 of Section 21 , T2N, R67W of the 6th P. M. , Weld County, Colorado, comprising approximately 14.6 acres only two living units are allowed. If any additions are anticipated or desired for this location, Section 3.3(E) (1 ) of the Weld County Zoning Resolution states "any expansion or enlargement of a Special Use shall be treated as a new application". When the plant was built P year Pgo, it was designed to handle ten (10) million feet of gas each dry. All indications pointed to the disposition of liquid product by pipeline, -nd storage facilities were installed rccordingly. The design method of cooling was mir drawn through overhead condensers. These are the three points pertinent to our reauest. It is only within the last month that the designed volume of 10 million feet r,er day has been reached. This has not been due to plrnt capacity but rather the ability of the field to deliver it. The plans to deliver liquid product by pipeline did not m^teri^lize and we have been disposing of 2;roduct by truck. There is no present evidence that this will be altered. Having reached the anticipated 10 million feet each dry, it has been discovered that the existing air coolers are inrc1eC1uPte to provide necessary temperature control. Therefore, we are requesting permits to make the necessPry modifications. The instrllrtion of the cooling tower Pnd connecting heft exchangers will increrse the cooling efficiency of the existing overhead coolers. The in- stallation of these vessels does not represent rn en1rrgement of our design, merely a modification to correct a def icieacy. The increased throughput of gas realizes liquid production in line with the anticipated amount of the original engineering. In fact, the piers on which the tank will set were erected rt the time of plant construction. However, we must still rely on trucking and so need the storage in keeping with such mode of disposition. These modifications do not represent Pn expansion beyond original concept -2— of the plant nor a physical expansion beyond the enclosed boundries of the yard. There are no obnoxious characteristics to any of the equipment, no unsightliness. There is no reduction in the safety features of our facilities , no increase in noise. The soils in this area are deep, well drained, coarse to moderately coarse textured with little runoff. The area is not subject to flooding and the area has only slight limitations for commercial structures, houses, and septic tanks. The soils are Class VI dryland agricultural soils, so are quite marginal from an agricultural standpoint. Recognizing that uses of this type are necessary in a producing oil field, I see no real conflict with the interests of the Soil Conser- vation District. The area could be made more compatable with adjoining property with screen type landscape plantings of Russian Olive, Red Cedar, Rocky Mountain Juniper, Sand Cherry, and many other adapted trees and shrubs. In relocating the proposed access road, it will become necessary to cross the Bull Canal. This will require some type of structure or tube of sufficient size to carry the waters in the Bull Canal . 4 . Crossing the Bull canal will of necessity, require an agreement in writing, between the two parties properly executed establishing responsibility and liability for the construction. I am certain that these things can be agreed to and would suggest that the planning and necessary liaison with the County Agencies continue.
