RE: GRANT CONDITIONAL USE PERMIT NO. 23 TO DAVID J. CALVIN.
WHEREAS, the petition of David J. Calvin, 5192 Kiowa Drive,
Greeley, Colorado 80631 , for a Conditional Use Permit for a single
family residence on a parcel of land, Part of the Southeast
Quarter of Section 21, Township 5 North, Range 66 West of the 6th
P.M. , this partial which is to consist of Forty-six (46) acres more
or less, being more particularly described as follows :
Beginning at the Southeast Corner (SE Cor) of said
Section 21, and considering the South line of said
Section 21, as bearing South 88°24'04" West, with
all other bearings contained herein relative thereto;
Thence South 88°24'04" West, along said South line,
2630.46 feet to the South Quarter Corner (S4 Cor)
of said Section 21;
Thence North 01°27'06" West, 705.33 feet; Thence North
63°49'50" East, 332.73 feet; Thence South 61°52'09"
East, 432.91 feet; Thence North 59°01'55" East, 597.91
feet; Thence South 84°22'53" Fast, 396.95 feet; Thence
South 65°46'05" East, 244.39 feet; Thence South 74°48'11"
East, 314.46 feet; Thence South 75°24'54" East, 292.59
feet; Thence North 88°57'34" East, 244.16 feet; Thence
South 00°32'29" East, 591.19 feet to the Southeast Corner
(SE Cor) of said Section 21, said point being the Point
of Beginning.
Said described parcel of land contains 45.592 Acres,
more or less, including a strip of ground 30 feet in
width along the South and West Lines of said described
parcel of land, reserved for County Road Right-of-way pur-
poses and is subject to any rights-of-way or other ease-
ments as recorded by instruments of record or as now
existing on said described parcel of land.

WHEREAS, the above described parcel of land is located in
an Agricultural Zone as set forth in the Weld County Zoning
Resolution, and
WHEREAS, the above described parcel of land is below the
minimum lot size of 80 acres required in an Agricultural Zone,
and
WHEREAS , Section 3. 3 .D. 4 .0 of the Weld County Zoning
Resolution authorizes such a residential use in the Agricultural
District on the grant of a Conditional Use Permit by the Board
of County Commissioners, and
WHEREAS, the petitioner was present, and

WHEREAS, the Board of County Commissioners has considered
all the testimony and statements of those present, has studied
the request of the petitioners , and has studied the recom-
mendation of the Weld County Planning Commission, and having been
fully informed and satisfied that the requested use complies
with the Weld County Comprehensive Plan and the provisions of
the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado, that the application
of David J. Calvin for a Conditional Use Permit be granted.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 7th
day of February, A.D. , 1977.
The above and foregoing Resolution was read into the
record and signed on the 16th day of February A.D. , 1977.

Be it Resolved by the Weld County Planning Commission that the
application for Building Site for resid and Farm

Commissioners for the following reasons:
1 . This Conditional Use Permit complies with the Weld County Comprehensi
Plan because: (a) the improvements will be located on the lease
productive part of the 45 acre parcel thus maintaining the more pro-
ductive irrigated land in agricultural use; (b) The request falls
within the Comprehensive Planning Area of the City of Greeley and the
request conforms with the City's desires as expressed in that Plan
since the land use in the immediate future will continue to be pre-
dominantly agricultural in nature and the parcel size does not exceed
the future proposed residential density of one dwelling unit per 10
acres. (c) The request does not conflict with the desires of the City
of Evans as indicated by their XX Planning and Zoning Commission.

2. It is the opinion of the Planning Commission that this
request is in compliance with the provisions of Section
3.3(D)(2) of the Weld County Zoning Resolution which states,
"The Planning Commission and the Board of County Commissioners
shall consider the following in making their determination in
approving or denying a Conditional Use Permit : Compatability
with the surrounding area, harmony with the character of the
neighborhood and existing agricultural uses, need for the
proposed use, its effect upon the immediate area, its effect
on future development of the area and the health, safety, and
welfare of the inhabitants of the area and the County. "
This determination is based upon the following: (A) The City
of Greeley Planning Commission and the City of Evans Planning
and Zoning Commission have both indicated they have no objection
to this request. (B) The Weld County Engineer' s Department has
indicated they could not identify any engineering problems with
the request. (C) The Weld County Health Department has indicated
the request complies with all applicable Weld County and State
Health Standards and Regulations. (D) To date, none of the
surrounding property owners have indicated any objections to thi
request.

Development Standards
1 . The permitted uses on the hereon described parcel shall
be a single family residence and all uses permitted by
right under Section 3 . 3 (B) of this Weld County Zoning
Resolution .

2 . The sewage disposal system shall conform with all appli-
cable Weld County and State Health standards and regul-
ations .
3 . Access shall be limited to the one proposed ingress/
egress shown on the CUP plans . The access shall be
approved by the County Engineer ' s Department prior to
the issuance of building permits .
4 . The CUP area shall be maintained in such a manner so
as to prevent soil erosion, fugitive dust , and the
growth of noxious weeds .
5 . Construction shall begin within one year of approval by
the Board of County Commissioners .
6. All structures shall he setback a minimum of 70 feet
from the existing right-of-way of County Road 54 and
County Road 29- .
7 . The CUP shall be limited to the plans shown hereon and
governed by the development standards stated above and
all applicable Weld County regulations. Any change to
the plans and/or development standards shall require
the approval of another CUP before such changes shall
be permitted.

DISCUSSION : Mr. Bartels explained that David Calvin contracted
with Mr. Sandberg to purchase the south 46 acres of said
property. It has a natural boundary which is a drainage
ditch which passes through the Sandberg farm. Tom Honn
read the staff comments recommending approval and development
standards.
A discussion of whether this proposal goes against the Com-
prehensive Plan was held. Mr. Heitman pointed out that
it was a special regulation that the county adopted after
Senate Bill 35.
MOTION: Be it therefore resolved to recommend approval of
this request with development standards. Motion by Mr .
Hiatt . Seconded Ms . Kountz. Mr. Ashley , Ms. Kountz,
Mr . Elliott , Mr. Nix, Mr. Heitman , Mr. Carlson , Ms . Yost,
Mr. Hiatt and Ms. White all had a vote of "aye. " Motion
Carried.
A discussion was held on the Vincent Rauch violation but no
action was taken at that time.

TO WHOM IT MAY CONCERN:
This is to certify that Tom Kagohara met with me several
times concerning a building permit for 46 acres from the
Sandberg farm being Pt . of SE* of Section 21 , T5N, RU6W.
According to my notes , the initial contact was October 7 ,
1976 - November 8 , 1976 met with Tom Kagohara and David
Calvin for 45 minutes , and discussed the requirements for
a Conditional Use Permit . We also discussed setback
requirements . December 22 , 1976 - Lefty Bartels brought
in the CUP application . It still needed a Domestic Water
statement , copy of the contract , and fee of $25 . December
23 - completed application submitted to the Weld County
Planning Commission for their consideration .

survey. The land on which we would build is not irrigated
and is the least productive of the 46 acres. The house
would be a ranch style home of approximately 2, 500 square
feet. The barn would be 75'x44' , which would be used
for farm machinery and horses. Our horse operation will
always be on a small scale. At most, we will have six
horses.
The rest of the land would be kept in productive farm
land. Any improvement to the land would be of first
quality and would not create an eye sore. Hopefully,
this will be my opportunity to get into a small farming
operation.

Mr. and Mrs. David Calvin and I find it to be a very desirable site
for the type of house that they plan. There is no basement and the
rock that is deeper should not be of any factor to excavation.

January 25, 1977
The Planning Conmission of the City of Greeley, Colorado was called to
order by Chairman Tom Charles. Those present were Conmuissioners Charles,
Cummins, Ewald, Keirnes and Roeth.
I. APPROVAL OF MINIIIES
Motion was made by Commissioner Cummins to approve the minutes of the
previous meting as mailed. Comnissioner Keirnes seconded the motion
and it carried unanimously.
II. STREET AND DRAINAGE EASEMENT DEDICATION: WILDLIFE PARK P.U.D.
LOCATION: North of the 1700 Block of Reservoir Road
Sam Sasaki, Planning Director, reviewed the item and indicated the P.U.D.
was approved by the Planning Comnission in 1974 subject to street and
easement dedication. The property was sold since then and the developer
is now coming back to the Planning Commission with a final plat.
In response to Commissioner Cummins' question about street width, Bud
Smead, Public Works Director, commented that the 70-foot right-of-way is
wider than normal but the actual street width is the same.
Commissioner Cummins moved that the Planning Commission reconmtnd acceptance
of street and drainage easement dedications in Wildlife Park. The motion
was seconded by Commissioner Ewald and it carried unanimously.
This motion based upon Planning Commission power and duties pursuant to
Section 19-3 and 19-7 of the Greeley Charter. Motion was based on consid-
eration of the Comprehensive Plan, drainage requirements and the fact that
the lot in question would provide a protective barrier for the Bird
Sanctuary.
III. REFERRAL FROM COUNTY: CONDITIONAL USE PERMIT (BUILDING SITE AND FARMING)
LOCATION: East of County Road 29;, North of County Road 54; 5%, SE! ,
Section 21
Prior to consideration of the item, Peter Morrell, City Manager, reported on
the meeting of the City Council and County Commissioners on January 24. The
Commissioners suggested better conmmmication is needed between the Planning
Comnission and the County Comnission. One specific request concerned referrals
from the County. They asked that more specific recommendations he given to
the County after a referral has been acted upon by the Planning Commission.
Mr. Morrell said one means of developing better communication would be to
attend their meetings and he invited them to attend the Planning Commission
meetings.
Mr. Sasaki reviewed the item and said it was before the Planning Commission
because it is a 46-acre parcel zoned agriculture by the County. To develop
on less than 80 acres a use by review procedure must be followed. The plans
arc for horse pasture and one house.
Commissioner Ewald commented that the developer could later split the 46-acre
parcel. He moved that the Planning Commission recommend approval of the
conditional use permit to the County. The motion was seconded by Commissioner
Roeth and it carried unanimously.
The motion was based upon the authority of the Planning Comnission in relation

to the Comprehensive Plan. The Comprehensive Plan defines the area in
question as agriculture. Since the requested use is primarily agriculture,
the Planning Commission reconmened approval of the request.
IV. STAFF REPORT'S
Mr. Sasaki confirmed the joint meeting of the Planning Commission and the
City Council for Thursday, February 3 at 9:00 a.m. He indicated the meeting
would probably run until noon. 'there will be an agenda and two possible
discussion items are Island Grove Park and industrial development.
The Commissioners were urged to attend the Thursday evening, January 27
meeting at 7:00 with the Urban Renewal Authority and the Housing Authority.
Mr. Sasaki reviewed the memo from John Given regarding Capital Improvements
Plan process. He said department heads will be looking at the same areas of
growth and concern that the Planning Commission will be. In addition, the
redevelopment area will be reviewed. He suggested the Planning Staff prepare
a preliminary document to include different concepts and define parameters
for the Planning Commission to look at. This would provide a starting point
for the process.
Mr. Morrell felt the City is at the point where they are able to tie in
Council activities with the Planning Commission, with the citizens. This
is all done in terms of the total Community Resource Management Program.
Commissioner Keimes asked if the Planning Commission would get information
from the Council of Governments 208 Land-Use meeting that was held in Loveland.
Mr. Sasaki replied that it will soon be available to Planning Commissions and
City Councils.
Commissioner Ewald suggested the Planning Commission meet with the County
Commissioners. lie felt such meetingswould be very helpful.
Mr. Regis Daily was present and commented that he was opposed to Wildlife
Park street and drainage easement dedications and hoped that the property
would be adequately taken care of.
There being no further business the meeting was adjourned.

The investigation of 45.5 acfes in the SE's Section 21, Township 5 N
Range 66 West revealed the presence of three soil types. 53M-CD
Nelson fine sandy loam 3 to 9 percent slope; 51B-C Vona sandy loam
3 tb 5 percent slope ; and 53-C Otero sandy loam 3 to 5 percent slope.
(See attached map for location of each soil type.)
53M-CB Neslon fine sandy loam has a typical surface layer about 8
inches thick. The underlying material is a fine sandy loam or sandy
loam about 20 inches thick. Depth to soft sandstone ranges from 20
to 40 inches. This soil is not suited for septic tank filter field
due to shallow depth to sandstone. Dwellings built with basements
are also hampered due to Shallow sandstone depth mainly due to construc-
tion cost of digging out the sandstone. Dwellings built without base-
ments are more suited, however, the foundations should be set on the
sandstone as the surface soil does not have adequate support stability.
53-C Otero sandy loam has a typical surface layer about 10 inches thick.
The underlying material, to a depth of 60 inches, is a calcareous fine
sandy loam. This soil is suitable for septic tank filter-fields due to
rapid permeability in the substratum. Caution should be exorcized to
insure that the leach field is placed far enough from wells to prevent
contamination. This soil is very suitable for building site and should
present very few problems for dwellings with or without basements.
51B-C Vona sandy loam has a typical surface layer about 8 inches thick.
The subsoil is a fine sandy loam about 15 inches thick. The substratum,
to a depth of 60 inches , is a sandy loam or loamy sand. Permeability is
moderately rapid. This soil is similar to the one above and has no
limitations for use as septic tank filter field or as a building site.
All three soils as described are, however , susceptable to wind erosion
due to the fine surface texture. Care should be taken during develop-
ment to maintain vegetative or permanent cover on the soil surface to
prevent the wind erosion hazard.

Your request for soil information indicated that the proposed building
site was to be in the area of 53M-CD Nelson fine sandy loam soil type.
As shown by the description this area has moderate to severe limitations
due to the shallow depth to sandstone.
All information provided has been based on investigations made to 5
foot depth. Any activity that would require excavation at a greater
depth should be specifically investigated on the site.
This soil information and interpretation is intended to assist in gain-
ing knoidge of the physical features of the soil and does not neces-
sarily replace on-site investigation or tests for special physical
hazards and/or design or constitute any type of official approval or
disapproval for a proposed land use.
