RE: ACTION OF BOARD CONCERNING THE APPEAL OF THE DECISION BY THE
DEPARTMENT OF PUBLIC WORKS TO DENY ACCESS PERMITS AP17-00493 and
AP17-00494 FOR SITE PLAN REVIEW, SPR17-0014 (LOT 5) AND SPR17-0015
(LOT 8) - PECKHAM DEVELOPMENT CORPORATION I WELD COUNTY
INDUSTRIAL PARK, CIO MARK GOLDSTEIN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 18, 2017, pursuant to Weld County Code Sections 2-4-10 and
12-5-100, the Board of County Commissioners considered the appeal of the decision by the
Department of Public Works to deny Access Permits AP17-00493 and AP17-00494 for Site Plan
Review, SPR17-0014 (Lot 5) and SPR17-0015 (Lot 8), submitted by the appellant, Peckham
Development Corporation / Weld County Industrial Park, c/o Mark Goldstein, and
WHEREAS, the Board heard testimony and took evidence from Public Works staff, Mark
Goldstein, and his attorney James Martell, and
WHEREAS, based on the testimony and evidence, the Board deemed it advisable to
continue said matter to October 30, 2017, to allow adequate time for the appellant and staff to
revise a new Improvements Agreement to provide additional safety measures.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, continued to October 30,
2017, at 9:00 a.m.
