HomeMy WebLinkAbout20173681.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO OCTOBER 25, 2017 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 25, 2017, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer - EXCUSED Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of October 23, 2017, as printed. Commissioner Conway seconded the motion, and it carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner Moreno seconded the motion, and it carried unanimously. PRESENTATIONS: • 1) RECOGNITION OF SERVICES, DEPARTMENT OF HUMAN SERVICES - GAY LYNN SMALL: Chair Cozad read the certificate for the record recognizing Ms. Small for her outstanding contributions to the Department of Human Services. Judy Greigo, Director of the Department of Human Services, presented the details of Ms. Small's career progression with the Weld County Human Services and stated she found her niche working in the Adult Protection Services with the adults and elderly in crisis. Eva Jewell, Department of Human Services, thanked Ms. Small for her dedication to Weld County and presented her with a plaque and pin to acknowledge her service to Weld County. Ms. Small stated she enjoyed working for the County and is thankful for everyone she worked with. Each one of the Commissioners thanked her for showing compassion and taking care of the vunerable residents of Weld County and invited her back to volunteer on one of the many advisory boards. They wished her an enjoyable and relaxing retirement. (Clerk's Note: the Board paused the meeting for a photo opportunity.) ►/I$raoI i Minutes, October 25, 2017 Page 1 2017-3681 BC0016 PUBLIC INPUT: Steve Teets, resident of Greeley, stated the Weld Project Connect Event had a great turnout and there were a lot more volunteers. He suggested at next year's event there should be testing for vision. Weld Advocacy Group for People with Disabilities, will be meeting to discuss legislation. In reponse to Mr. Teets, Commissioner Conway stated he will find out what the plans are for the Transfer Station located in Loveland. Commissioner Conway commended Mr. Teets who has been a navigator for the last five years at the Weld Project Connect. Each one of the Commissioners thanked Mr. Teets for being an outstanding volunteer and for his hard work. COMMISSIONER COORDINATOR REPORTS: Commissioner Freeman stated he wanted to recognize Sandy Elder, Greeley -Weld County Airport Authority Board, member and Mayor Tom Norton, Upstate Colorado Economic Development member, for serving the citizens of Weld County and for their accomplishments and leadership. Commissioner Conway attended the Transportation Summit with Chair Cozad. He expressed his frustration with the slow development of solutions for transportation issues. He also attended the ground- breaking of the Rocky Mountain Sports Park and appreciated the Mayor of Windsor acknowledging the Weld County Board of Commissioners for their contributions. Commissioner Moreno attended the Downtown Development Association meeting, where they discussed the future of Downtown Greeley. He acknowledged the success of Weld Project Connect and extended his thanks to Chair Cozad for her work with Weld Project Connect and recognized Marjorie Martinez, United Way representative, for successfully being able to recruit several energetic volunteers. He reported he attended the Ribbon -Cutting for the new Windsor Public Works Department. Chair Cozad thanked all the staff that coordinated the Town and County Dinner and stated the dinner was wonderful. Chair Cozad acknowledged the Weld Project Connect event and stated for this to be successful it takes a group effort and Marjorie Martinez did a great job. She reported at the event there were Senior Services available. Chair Cozad expressed her frustration with the issues that were not addressed at the Transportation Summit and explained finding solutions will fall back on the local municipalities. She also attended the Town Board Meeting in Frederick. Lastly, she mentioned the Workforce Development Board meeting where they discussed the future of the Weld County Bright Future's Program and how to make sure it is sustainable. Commissioner Conway reported the discussion surrounding issues of Public Safety at the Quarterly CTSI meeting. BIDS: 1) APPROVE BID #B1700105, INMATE TELEPHONE SERVICES - SHERIFF'S OFFICE AND DEPARTMENT OF JUSTICE SERVICES: Rob Turf, Department of Purchasing, reviewed the request from the Sheriff's Office to continue this matter to November 1, 2017. In response to Commissioner Conway, Brandon Cody, Sheriff's Office, stated they need more time to accurately address a protest and schedule a work session. Commissioner Conway moved to continue said matter to November 1, 2017. The motion, which was seconded by Commissioner Moreno, carried unanimously. OLD BUSINESS: 1) CONSIDER EXTENSION OF OIL AND GAS LEASE COVERING CERTAIN PROPERTY OWNED BY WELD COUNTY, COLORADO - SE1/4, S26, T7N, R67W (CONT'D FROM 10/16/2017): Esther Gesick, Clerk to the Board, reviewed the terms for the extension, noting Weld County holds 75% mineral interest. Commissioner Freeman moved to approve said extension of oil and gas lease. The motion was seconded by Commissioner Conway and it carried unanimously. Minutes, October 25, 2017 Page 2 2017-3681 BC0016 NEW BUSINESS: 1) CONSIDER CONTRACT ID #1507 RAILROAD CROSSING RENEWAL AGREEMENT FOR IMPROVEMENTS TO GRADE CROSSING ON CR 13 AND AUTHORIZE CHAIR TO SIGN - GREAT WESTERN RAILWAY OF COLORADO, LLC: Michael Bedell, Department of Public Works, reviewed the agreement to partner with Great Western Railway to replace the crossing which is in poor condition. He explained the County will be responsible for the cost of materials and Great Western will be responsible for the cost of installation and maintenance required. Ken Rose, representative of Great Western Railway, reviewed the process of the replacement of the railroad crossing. Commissioner Conway thanked Mr. Rose for being proactive. He then moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. 2) CONSIDER CONTRACT ID #1501 APPLICATION FOR FINDING OF REASONABLE DILIGENCE FOR CONDITIONAL WATER RIGHT FOR GEISERT DUST CONTROL WELL #1 AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY DOCUMENTS - DISTRICT COURT, WATER DIVISION NO. 1: Devin Traff, Department of Public Works, stated for the County to use the is 10.8 acre- feet per year of conditional water, the decree states that Weld County shall file a signed Diligence Application. Commissioner Freeman moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. El 3) CONSIDER CONTRACT ID #1511 AGREEMENT CONCERNING PURCHASE OF TEMPORARY CONSTRUCTION EASEMENTS FOR CR 47 CORRIDOR IMPROVEMENT PROJECT AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY DOCUMENTS - STEVEN KELLY: Tiffane Johnson, Department of Public Works, presented the details of the agreement for the total amount of $11,499.00. In response to Commissioner Conway, Ms. Johnson explained Northern Colorado Water Conservancy District is requiring a new backflow pit. Commissioner Moreno moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. El 4) CONSIDER CONTRACT ID #1512 AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT FOR CR 47 CORRIDOR IMPROVEMENT PROJECT AND AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS - BOHMCO, LLC: Ms. Johnson reviewed the terms of the agreement for the total amount of $22,300.00. Commissioner Conway moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously. 5) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING SCHEDULED FOR NOVEMBER 29, 2017: Commissioner Freeman moved to cancel said Board of County Commissioners Meeting. The motion was seconded by Commissioner Moreno and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
