General Comments D Advisory. The subject property is located within the City of Greeley Long Range Expected Growth Area (LREGA). If in the future, water and sanitary sewer service are requested to the property, then annexation into the City of Greeley will be required prior to the City of Greeley providing utility service. The City of Greeley does not currently provide utility services to the subject property. Advisory. The City of Greeley and North Weld County Water District (NWCWD) have adopted a Water Service Agreement for providing water in this area. The submitted project information indicates that NWCWD currently provides a water service to the site. Please note that if additional water service is requested then the City of Greeley will decide if water will be provided by the City of Greeley or NWCWD in accordance with the executed Water Service Agreement dated February 5th, 2013. General D Advisory. The subject property is located within the City of Greeley's Long Range Expected Growth Area (LREGA). The LREGA is the range in which the community anticipates development occurring within the coming 20+ years. Any site changes should be mindful of the transition of this area into a more urban built environment. Specific comments regarding development standards will be made with a development proposal. O Advisory. Staff notes thatthe farming use of the site has potentially been in an existence for over nineteen (19) years per the aerial views, and thus, would be considered a grandfathered condition. So long as the property owners continues the same operations as they had previously performed, not allowing a continual lapse of over twelve (12) months of the existing use, and not intensify the use, the existing use would be allowed to be continued indefinitely through the grandfathering clause. Staff notes that commercial and industrial uses have encroached around the property over the years creating a less than an ideal situation for the applicant. There are incompatible uses between properties. If this was vacant land and new rezone request, the requirement would be that the rezone be harmonious with the surrounding land use districts. Spot zoning is not ideal and is highly discouraged within the City of Greeley due to inconsistencies in districts, but also in the manner in which existing land uses have been established. Incompatibilities also trigger intense landscape buffering and screening. Despite potential zoning inconsistencies, staff has no issues with the applicant's request because the land use is proposed to remain the same. E' SW's Section 29, T6N, R65W, 6th P.M. Water Division 1, water District 3 Dear Ms. Aungst: We have reviewed the above referenced application for a Change of Zone. The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this property or the ability of the water supply plan to satisfy any County regulations or requirements. The subject application seeks to change the zoning for a 1.55 -acre parcel from commercial (C-3) to agricultural in order to allow for the reconstruction of a barn that was lost in a fire. Water is provided to the main house and guest house by the North Weld County Water District (NWCWD). There is also an existing well on the property that provides water for lawn/landscape irrigation and animal watering. The existing well was constructed under permit no. 63190 for the replacement of a welt that was first put to use prior to May 8, 1972. The well is permitted for domestic and livestock use and was decreed in case no. W-2669 for domestic and stock use. A Statement of Beneficial Use received for the well on November 3, 1972 indicated that the well was used for lawn and yard irrigation on land totaling 1.5 acres. Please note that in order to remain exempt from administration, the amount of lawn and garden irrigation served by this well cannot exceed one (1.0) acre.
