Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway - EXCUSED Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Stephanie Frederick County Attorney, Bruce Barker Planning Services Department representative, Kim Ogle Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: IR I hereby certify that pursuant to a notice dated April 13, 2017, and duly published April 19, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Shawn and Stacey Greathouse, for a Site Specific Development Plan and Major Amendment, 1 MJUSRI7-02-1366, to a Use by Special Review Permit (USR-1366) for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (Majestic Fence Company) to include Mineral Resource Development Facilities including Oil and Gas Support and Service (the staging, storage and parking and maintenance of exploration, production or workover equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. El Chair Cozad reviewed, for the public, the procedures to follow should this case result in a tie vote due to four Commissioners being present and Commissioner Conway excused. cc.: PL-c(co /turn), PE Ct-i0), I -IL C LL), CTe CTS) Co/19/(7 2017-1327 PL1591 HEARING CERTIFICATION - SHAWN AND STACEY GREATHOUSE (1MJUSR17-02-1366) PAGE 2 le Kim Ogle, Department of Planning Services, presented a summary of the proposal and stated the site is located within the three (3) mile referral area of Larimar County, the City of Greeley, and the Towns of Johnstown and Milliken. He stated the property consists of the applicant's residence, outbuildings and the existing Majestic Fence Company offices and fence service yard, permitted under USR-1366. Mr. Ogle stated the applicant wants to expand the uses of the property to include the previously permitted fence company, as well as additional parking and staging of exploration production and workover equipment. He explained that 15 referrals were sent out and six (6) offered comments. He displayed photographs of site and entered the favorable recommendation of the Planning Commission into the record as written. ▪ Shawn Greathouse, applicant, was informed that Commissioner Conway is excused and the procedures to follow in the event of a tie vote. • Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements. He stated an Access Permit has previously been approved for County Road (CR) 15.5, under permit number AP17-00195, which stipulates use by one (1) small commercial oil and gas facility, and one (1) residence. It is classified as a local gravel road. He stated staff will not require tracking control, nor an improvements agreement. • Hayley Balzano, Planning Services Engineer representative, reported the applicant has submitted a drainage narrative explaining they will meet Exception 1.A.8. She stated staff has requested the historical drainage flow pattern be added to the plat. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated the Little Thompson Water District provides water to the site. She stated the septic system capacity, and is sized for eight (8) people at the shop. She explained the applicants will be able to use a portable toilet if the number of employees exceeds, the septic system. Development Standards items 10-18 address Environmental Health items. El No public testimony was offered concerning this matter. ▪ In response to Chair Cozad, Mr. Greathouse indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as proposed. In response to Chair Cozad, Mr. Greathouse stated he has not yet contacted the Front Range Fire District with the address of the property, because he believes they are looking at the wrong parcel. Chair Cozad requested Mr. Greathouse contact Front Range Fire District about his address. Commissioner Moreno asked Mr. Greathouse about the hours of operation. He explained that the crews start at 5:00 a.m. to get equipment and trucks prepped for the work that day. ▪ In response to Commissioner Cozad, Mr. Greathouse stated generally there isn't any business that takes place on Sunday. 2017-1327 PL1591 HEARING CERTIFICATION - SHAWN AND STACEY GREATHOUSE (1MJUSR17-02-1366) PAGE 3 le Mr. Ogle reported the hours of operation were added to address the heavy truck traffic so that it doesn't occur before 5:00 a.m. Commissioner Kirkmeyer moved to approve the request of Shawn and Stacey Greathouse for a Site Specific Development Plan and Major Amendment, 1MJUSR17-02-1366, to a Use by Special Review Permit (USR-1366) for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (Majestic Fence Company) to include Mineral Resource Development Facilities including, Oil and Gas Support and Service (the staging, storage and parking and maintenance of exploration, production or workover equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously. There being no further discussion, the hearing was completed at 10:37 a.m. This Certification was approved on the 31st day of May, 2017.
