from R-2 to R-3 on my property, being Lot 14 of Northwest Estates 1st Filing; a part of Section 29,17N,
R67W of the 6th P.M., Weld County, Colorado, also known as 37042, 37044, 37046 Northwest Drive,
Windsor, CO 80550.
I have been given hard copies of the staff report and referrals for COZ16-0004 and am hereby notified
that the Planning Commission Hearing is 3/7/2017 at 12:30 pm and the Board of County Commissioners
Hearing is 3/29/2017 at 10:00 am.

CHANGE OF ZONE / REZONING QUESTIONNAIRE RESPONSE:
1. How is the proposed rezoning consistent with the policies of the Weld County Code, Chapter
22? If the proposed rezoning is not consistent with the Comprehensive Plan, explain how the
proposed rezoning will correct what the applicant perceives as faulty zoning, or how the proposed
rezoning will fit with what the applicant perceives as the changing conditions in the area.
The proposed rezoning is consistent with the policies of the Weld County Code, Chapter 22 because it
protects the community's health, safety, and welfare. The Change of Zone would reflect the existing use
of the residence and protect and acknowledge its occupants.
The proposed application corrects the existing situation on the property. It is zoned R-2 which allows for
two (2) units; however, there are three (3) units in the residential structure. By rezoning to R-3, this
building and its use would be in compliance with Weld County Zoning regulations. No other change is
proposed to the property which has existed as it presently does since approximately 1973. The property
is located in Northwest Estates Subdivision, which has no covenants and does not prohibit a Change of
Zone.
2. How will the uses allowed by the proposed rezoning be compatible with the surrounding land
uses? Include a description of existing land uses for all properties adjacent to the subject
property.
The proposed rezoning does not affect or detract from the surrounding land uses. The rezoning would
allow there to be three (3) units in an existing residence provided it is engineered, built, and inspected to
do so. There are no exterior changes to the residence or other modifications, changes in use, building,
that would be associated with the change of zone.
Most properties in the Northwest Estates 1s1 Filing Subdivision are constructed with similar building
materials, aesthetics and intent. Lots within the Subdivision are +/- 1.5 acres. There are several larger
parcels of agricultural land to the south and east of the property, portion of which are annexed into the
Town of Windsor. While an approval of this rezoning would legally allow and recognize up to three (3)
units on -site, there would be no differences to the compatibility, traffic, density, or use as what currently
exists.
3. Will the property use a septic system or public sewer facilities?
The property will use septic system(s). In the event that the septic system(s) needs to be enlarged or
modified, it will be done according to the Weld County Onsite Wastewater Treatment System regulations
4. Who will provide adequate water, including fire protection, to the property?
The North Weld County Water District (NWCWD) provides water to the site. Account No. 1195003
5. Does the property have soils with moderate or severe limitations for construction? If yes, the
applicant shall submit information which demonstrates that the limitations can be overcome.
Refer to the Custom Soil Resource Report dated 09/05/2014. The site is predominately Kim Loam (32),
with 1-3 percent slopes.
6. Is the road and/or highway facility providing access to the property adequate to meet the
requirements of the proposed zone district? If not, the applicant shall supply information
demonstrating the willingness and financial capability to upgrade the road and highway facilities.
Yes. No changes to access are requested or required at this time. There are three (3) access points total.
Two (2) driveways access west onto Northwest Drive, the internal subdivision road. One (1) driveway
accesses south onto County Road 76.
