HomeMy WebLinkAbout20174201HEARING CERTIFICATION DOCKET NO. 2017-95 RE: ANNUAL MEETING AND 2018 BUDGET HEARING - SOUTHWESTERN WELD COUNTY LAW ENFORCEMENT AUTHORITY A public hearing was conducted on December 13, 2017, at 9:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Clerk to the Board, Esther E. Gesick County Attorney, Bruce Barker Director of Finance and Administration, Donald D. Warden The following business was transacted: IR I hereby certify that pursuant to a notice dated November 10, 2017, and duly published November 15, 2017, in the Greeley Tribune, the Annual Meeting of the Southwestern Weld County Law Enforcement District Authority Board was conducted, and a public hearing was conducted to consider the proposed 2018 Budget for the Southwestern Weld County Law Enforcement Authority (LEA) District. Donald Warden, Director of Finance and Administration, stated last year there was only $10 in assessed value due to annexation of the town of Firestone, and when a district is reduced to less than fifty percent (50%) of the original area, it then becomes eligible for an election to be disbanded. The Board previously directed to proceed with that process; however, there was a delay while waiting to determine if the property would be annexed. Because an annexation is no longer anticipated, Mr. Warden recommended going ahead with the passage of a resolution declaring that the district is no longer financially viable and should be dissolved. He stated, according to State statute, the process will require an election of the one remaining resident, therefore, staff recommends not adopting a budget and directing staff to work with the Clerk and Recorder and the County Attorney to hold a Special Election. No public testimony was offered concerning this matter. la Commissioner Kirkmeyer moved to approve the Resolution to Not Adopt the Budget and Act to Dissolve the Southwestern Weld County Law Enforcement Authority District. The motion was seconded by Commissioner Conway, and it carried unanimously. In response to Chair Cozad, Mr. Warden stated the remaining documents which were presented to the Board for consideration are no longer valid or necessary due to the action just taken. co.
