On Friday, August 12, 2016 an informal discussion took place at the Greeley Administrative Offices
Conference Room regarding a proposed outdoor storage facility. (The legal description is S2NE4 Section 22,
T1 N, R68W of the 6th P.M.)
Background Information:
The applicant is proposing to create a storage facility for trailers, water craft, recreational vehicles, cars, trucks
and other items that may be placed/parked in a delineated parking area. The storage facility is planned for the
entire parcel; however it will be built in two or three phases, depending on market conditions. An office trailer
would also be located on site for operation of the business. Prior to the final phase of expansion, a residence
will be built on site as well.
Gated access to the property will be available 24/7. At full build out, there would be up to 2 employees on site
daily
The first phase would include 250 spaces. The complete buildout of the facility will consist of 850 spaces.
Building Department
Building Permits will be required, per Section 29-3-10 of the Weld County Code. Currently the following has
been adopted by Weld County: 2012 International Codes; 2006 International Energy Code; 2014 National
Electrical Code. A building permit application must be completed and two complete sets of engineered plans
bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A
geotechnical engineering report or an open -hole inspection report performed by a registered State of Colorado
engineer may be required for new structures and or additions.
The proposed office would need to comply with ADA Handicap Standards.
A Fire District Notification letter may be required and shall be submitted with Commercial Permit applications.

Waste handling: Waste materials shall be handled, stored, and disposed in a manner that controls blowing
debris, and other potential nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
Please answer the following if applicable; indicate if there will be washing of vehicles or equipment, fuel
storage, maintenance of vehicles or equipment, floor drains in shop, air emissions permit.
Onsite dust: Fugitive dust should attem pt to be confined on the property. Uses on the property should comply
with the Colorado Air Quality Commission's air quality regulations.
Sewage disposal information: Include in application how sewage disposal will be accommodated. If using a
septic system provide a copy of the septic permit. Either utilize the County website
http://www.co.weld.co.us/Departments/Assessor/PropertylnformationPortal.htm I or call (970-304-6415) or
stop by EH front counter and request a copy.
Potable water information: Include in application how potable water will be provided. Provide a will serve letter
or water bill from the water district or provide a copy of well permit.
Portable toilets and Bottled water can be used for employees and customers per policy below:
TO DEFINE WHEN PORTABLE TOILETS AND COMMERCIALLY BOTTLED WATER ARE ALLOWED
Purpose: To define when portable toilets and commercially bottled water are allowed.
Policy: Bottled water from a commercial source is allowed in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year (for example
recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
And/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. Employees or contractors that are on site for less than 2 consecutive hours a day
Policy: portable toilets are allowed in the following circumstances:

The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways.
Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access
permit or for any additional requirements that may be needed. (Interstate 25 Frontage Road)
A Site Plan will be required identifying the following (if applicable):

ENGINEERING DEPARTMENT
Weld County has recently adopted a new stormwater drainage code located under Chapter 23, Article 12
Storm Drainage Criteria.

This area IS within an Urbanizing Drainage Area:
Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the
detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for
URBANIZING areas.
Detention pond summarized in a drainage report is required unless the project falls under an exception to
stormwater detention requirements per code section 23-12-30 F.1. To avoid holding up case processing, a
minimum of either a preliminary drainage report or a drainage narrative with exception as shown below must
be submitted with 7 -day case submittal information.
1. Detention pond requirements:
A drainage report and detention pond design shall be completed by a Colorado Licensed Professional
Engineer and adhere to the drainage related sections of the Weld County Code. The drainage report must
include a certification of compliance stamped and signed by the PE which can be found on the
engineering website. A general drainage report guidance checklist is available on the engineering website.
A preliminary drainage report or a qualifying exception and drainage narrative shown below must be
submitted for review at the time of application.
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the
property.
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are
accepted after the planning process is complete (map recorded). An Early Release Request Form may be
entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact an Engineering representative from the
Planning Department for more information. Application Fees: 1-5 Acres/ $50, 5.1 - 20 Acres/$100, 20.1 Acres
or Greater/$200 + $1 per acre over 20.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-
3575.
This site IS in a Geologic Hazard Area. The Colorado Geologic Society will be a referral agency. A geologic
hazard permit may be required. The Colorado Geologic Survey (CGS) has expertise in geologic hazard areas
and is a referral agency for this project. Contact Jill Carlson with the CGS for more detailed information on the
geologic hazards in your project area and any additional requirements that may be needed. Depth to mine

ponds shall be labeled as "No Build/Storage Area" and include design volume

Screening of the parking area or outdoor storage may be required from any adjacent landowners or public
rights -of -way.
Please identify any proposed lighting or signs on the Site Plan. Lighting needs to be downcast and shielded.
A 16sf sign is allowed in the Agricultural Zone District; however if there are potentially any additional or larger
signs please include those in the application.

Staff provided information on Colorado's Enterprise Zone (EZ) program which provides state income tax
credits to encourage businesses to locate/expand in designated economically distressed areas of the state.
The Weld County EZ program is administered by Upstate Colorado Economic Development.
Staff explained the USR process. The applicant shall submit 1 packet for a 7 day completeness review. After
the 7 day completeness review the applicant will be informed of what items are still required to make the
application complete. Staff requested that the applicant submit the remaining material in electronic form.
Upon submittal of a completed application it will be sent out for referral for 28 days. The applicant will then
meet with their Planner to discuss the referrals and address as many of the referrals as possible. At that
meeting the Planning Commission hearing will be scheduled. The Board of County Commissioners hearing
typically follows approximately 3 weeks after the Planning Commission hearing.
The above notes are provided as a courtesy to the applicant. While we strive to help identify as many
potential issues upfront during the pre application meeting we cannot anticipate every issue that may come up
during the formal application process. The information contained herein has been placed on file with the
Department of Planning Services. The pre -application is valid for a period of one (1) year from the date of pre -
application. If a formal application is not received following the time period specified herein the Planning
Department reserves the right to require a new pre -application meeting. Please note that all land use, building

Planning Questions:
1. Explain, in detail, the proposed use of the property.
Answer: The proposed use for the property is to create a storage facility
for trailers, watercraft, recreational vehicles, cars, trucks, and other items
that may be placed/parked in a delineated parking area of certain widths
and lengths. The storage facility is planned for the entire acreage, but
may be built in two or three phases, depending on market conditions.
The business plans to install an eight foot tall chain link perimeter fence
with barbed wired on top with screening attached to the chain link portion .
Gated access to the property would be available 24 hours per day/7 days
per week via automated gate(s). An office trailer would also be placed on
the property to facilitate operation of the business. Prior to construction of
the final phase of expansion, the owners are inclined to install/place an
onsite living facility for the manager of the property and water and dump
station facility — the owner is aware this would include permitting/installing
a well or provide a public water source and permitting/installing an onsite
wastewater treatment system.
2. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 22 of the Comprehensive Plan.
Answer: In the Weld County Code Chapter 22, the county states the
Comprehensive Plan is a long range document to be used in the present
to help reach to goals of the future. This proposal is consistent with intent
of the Comprehensive Plan to economically develop areas adjacent to
major roadways. This proposal is along the west side of Interstate 25 and
on a road that already has a developed commercial/industrial use. This
proposal is the second parcel to willing to be developed in the immediate
vicinity, and by reviewing other projects within a mile radius, urbanizing
development is occurring not in a lump sum of land, but parcel by parcel.
As stated in the plan "The intent of the industrial Goals is to establish
industrial areas where a balanced, diversified economy can be
encouraged in an effort to maintain and enhance the quality of life of Weld
County citizens. These Goals and Policies intend to assure desirable local
employment opportunities and to strengthen and stabilize the economy."
Also stated in another section "These commercial Goals and Policies
intend to further enhance and solidify the economic base of the County. It
is critical to attract sustainable commercial growth and economic
development." This proposal also seeks to minimize impacts on adjacent

property owners who choose to keep their property in the Agricultural
zoning as stated in the code: "The intent of the agricultural Goals is to
support all forms of the agricultural industry and, at the same time, to
protect the rights of the private property owners to convert their
agricultural lands to other appropriate land uses. The County recognizes
the importance of maintaining large contiguous parcels of productive
agricultural lands in nonurbanizing areas of the County to support the
economies of scale required for large agricultural operations." The
applicant believes this parcel meets all listed intent of the Comprehensive
Plan.
3. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 23 (zoning) and the zone district in which it is located.
Answer: This proposal is consistent with Chapter 23 of the Weld County
Code by adhering to the procedures in the code to apply for a Special Use
by Review Permit. As stated in the code: "Uses by Special Review are
USES which have been determined to be more intense or to have a
potentially greater impact than the Uses Allowed by Right in a particular
zone district. Therefore, Uses by Special Review require additional
consideration to ensure that they are established and operated in a
manner that is compatible with existing and planned land USES in the
NEIGHBORHOOD." The land for this proposal is zoned Agricultural and
this proposal is for allowing a more intense use on the land than
agricultural use and the applicant has prepared this application as per
section 23-3-40 subsection S of the Agricultural zoned district. The
Special Review Use that the applicant is requesting is a use in the
industrial 1-3 zoning, specifically section 23-3-330 subsection B, no. 13 :
Outdoor Storage.
4. Described what type of land uses surround the site. Explain how the proposed
use is consistent and compatible with surrounding land uses.
Answer: The surrounding land uses around the site include agriculture, a
shop and yard for an asphalt paving contractor, and the major north/south
interstate in Colorado. The proposed land use in this application falls
between intense adjacent land use and adjacent agricultural land use.
The variations in surrounding land use shows that this region of Weld
County is developing into/or on the edge of urbanization.
5. What are the hours and days of operation? (e.g. Monday thru Friday 8am to

Answer: The operating hours that customers could access their stored
items would be 24 hours per day 7 days per week. The owner plans on
regular business office hours around 8am to 5pm (Thursday thru Tuesday)
up to 7 days a week, depending on market conditions.

6. List the number of full time and part time employees proposed to work at this site.
Answer: The owner anticipates one or two full time employees and/or
two or three part time employees.
7. If shift work is proposed include the number of employees per shift.
Answer: The owner does not anticipate shift work.
8. List the number of people who will use this site. Include contractors, truck
drivers, customers, volunteers, etc.
Answer: During each phase of construction the owner anticipates
between 5 and 12 different contractors onsite - total number of contractor
personnel to use the site is estimated at 21. The site surface will be
trucked in — estimated at 300 truck trips. The first phase estimates about
250 spaces (i.e. customers) to be used. The complete buildout estimates
about 1300 spaces (i.e. customers) to be used. One or two employees
would use the site daily also.
9. If this is a dairy, livestock confinement operation, kennel, etc., List the number
and type of animals.
Answer: Not applicable.
10. Describe the type of lot surface and the square footage of each type. (e.g.
asphalt, gravel, landscaping, dirt, grass, buildings)
Answer: At completion of the final expansion phase, the owner
anticipates the approximate square footages following surfaces:
1. Asphalt (entry from frontage road) : 3200 sf
2. Recycled road base (main storage area) : ~1,002,000 sf
3. Landscaping (near entry gate) : 400 sf
4. Native grass (detention area/swale) : 340,000 sf
5. Buildings : 2200 sf
11. How many parking spaces are proposed? How many handicapped (ADA)
parking spaces are proposed?
Answer: Four (4) customer paved parking places are proposed, one of
the four spaces will be ADA.
12. Explain the existing and proposed landscaping for the site.

Answer: Native grasses will be planted on the outside perimeter of the
fence, in the detention pond area and the entrance area that will be
disturbed during construction.
13. Describe the type of fence proposed for the site (e.g. 6 foot chain link with earth
tone slats).
Answer: the proposed fence will be a total of 8 feet tall it will be a
combination of chain link (7 feet maximum) on the bottom with a three
stand barbed wire on the top (16 inch maximum). Privacy slats will be
installed in the chain link portion.
14. Describe the proposed screening for all parking and outdoor storage areas.
Answer: Screening will be the privacy slats in the perimeter chain link
fence.
15. Explain any proposed reclamation procedures when termination of the Use by
Special Review activity occurs.
Answer: The next use of the land in this application will be a more
intense use than what is proposed in this application. The new owner
would possibly remove all installed utilities and buildings and regrade the
entire site. If the use ceases with the current owner, reclamation may
consist of sign removal and ceasing the use of lighting until another use is
proposed.
16. Who will provide fire protection to the site.
Answer: Mountain View Fire Protection District
17. List all proposed on -site and off -site improvements associated with the use (e.g.
landscaping, fencing, buildings, drainage, turn lanes, etc) and a timeline of when
you have each one of the improvements completed.
Answer: The following improvements will be completed for the project
with the estimated time to complete:
Install site entrance with culverts I offsite & onsite I 1 week
Grading and drainage for the site I onsite I 1 week
Install electrical including storage area lighting/ onsite 14 weeks
Install fencing and gates I onsite 14 weeks
Install office/living unit / onsite / 2 weeks
Install waterline I onsite and offsite 13 weeks
Import and place lot surfacing I onsite / 4 weeks

Engineering Questions:
1. How many roundtripslday are expected for each vehicle type: Passenger
Cars/Pickups, Tandem Trucks, Semi-Trucks/Trailer/RV (Roundtrip = 1 trip in and
1 trip out of site)
Answer: During construction of the site car/pickups are expected to
generate 12 trips per day, semi -trucks delivering recycled asphalt are
expected to generate a total of 300 trips or about 30 trips per day.
The owner expects employees to generate 5 roundtrips per day.
The storage business is expected to generate about 30 trips per day from
customers noting that seasonal and near weekend trips may vary greatly;
about 17 roundtrips are expected at peak hour.
2. Describe the expected travel routes for site traffic.
Answer: Expected travel routes to the site include:
Eastbound on WCR 8 to the West 125 Frontage Rd then south to
site
Westbound on WCR 8 to the West I25 Frontage Rd then south to
site
125 Northbound to WCR8 then westbound on WCR 8 to the West
125 Frontage Rd then south to site;
125 Southbound to WCR8 then westbound on WC R 8 to the West
125 Frontage Rd then south to site.
3. Describe the travel distribution along the routes (e.g. 50% of traffic will come from
the north, 20% from the south, 30% from the east, etc.)
Answer: Expected travel distribution is 35% from the west, 25% from the
east and south and 15% from the north.
4. Describe the time of day that you expect the highest traffic volumes from above.
Answer: The owner would expect peak traffic volumes to occur on Friday
afternoon during the summer season.
5. Describe where the access to the site is planned.
Answer: The site will be accessed from two places along the east side.
A main access to the site on the east site will be south of the emergency
access in the north east corner.

6. Drainage Design. Detention pond summarized in drainage report is required
unless the project falls under an exception to stormwater detention requirements
per code section 23-12-30.F.1.
Answer: This site does not qualify for an exception for a stormwater
detention. This site requires a stormwater detention pond and a drainage
report summarizing the detention pond design, construction drawings,
maintenance plan and a stamped certification of compliance have been
completed by a Colorado Licensed Professional Engineer is attached to
this submittal.
Environmental Health Questions:
1. What is the drinking water source on the property?
Answer: Left Hand Water District will be the drinking water source for the
site. Please see attached letter from Left Hand Water District.
2. What type of sewage disposal system is on the property?
Answer: An onsite wastewater treatment system is proposed for this
property for sewage disposal.

Introduction
This Final Storm Water Report and Plan (Plan) contained herein was completed for the
site located adjacent to the western frontage road of Interstate 25 and approximately
one half mile south of Weld County Road 8 (aka Erie Parkway) as shown in Figure 1.
Access for the site is from the western frontage road. This site has a total land area of
31.95 acres, the offsite portion of the drainage basin consists of 48.3 acres for a total of
80.25 for the basin. The historic topography of the basin is mild slopes from the
northwest to the southeast, the elevation difference in this basin is approximately 72
feet. The site has been dry land farmed for over 60 years, some years it is tilled and
other years planted with a crop, while the surrounding offsite portion is consistent with
dry land farming also. Site soils defined by the National Cooperative soil survey in a
joint effort of the United States Department of Agriculture classifies the entire site as
Nunn Clay Loam, 1 to 3 percent slopes. The parcel does not show any characteristics
of wetlands or shallow groundwater conditions and the Bull Canal (aka Stanley Ditch,
Farmers Reservoir and Irrigation Company ditch) is down gradient and within 200 feet
from the southeast corner of the site. The historic storm water pattern from this site
flows to the Colorado Department of Transportation (CDOT) right-of-way (ROW) on the
eastern edge of the site. From there, the minor storm flows are routed through a culvert
on the western edge of the frontage road and major storm flows would overtop the
culvert and flow into/over the Bull Canal, flows would then continue south and
eventually enter Little Dry Creek.
Storm Water Basins and Drainage Patterns
The site is located in the upper reach of the Little Dry Creek drainage basin. The onsite
basin's existing conditions show no drainage problems, FEMA floodplain zones, or
seeping groundwater conditions that can impact storm water design. There are no
wetlands impacted with this project. The Plan's drainage basin consists of offsite flows
from three sub -basins to the north and one to the northwest and the onsite basin is
divided into three sub -basins. Offsite flow from the northwest sub -basin is designed to
be contained in the channel while the offsite sub -basins to the north will be routed
through the site by swales, typically in the lanes of travel. The flows collected in the
swales and channel will flow into the detention pond located in the southeast corner of
the property.

Development Proposal
The development proposal for this site is an outdoor storage facility which includes a)
one residential unit/office combination b) approximately 1300 outdoor storage parking
spaces c) an onsite wastewater treatment system and d) a storm water detention pond.
This report will utilize the above mentioned use for developed flow parameters and
existing contours and site conditions prior to development for historical parameters.
The design concept for this Plan is to route both offsite and onsite storm flows through
either swales in the parking area or a channel along the southern boundary both which
are designed to drain into the detention facility. The release from the detention facility
for minor storms is through a water quality outlet and the major storm would be routed
through a different outlet structure.
Conformance with Storm Water Policy
The detention facility is designed to both Weld County and Urban Drainage and Flood
Control District (UDFCD) standards for detaining the required storm water volumes and
release rates from the site. Weld County standards require a 5 year historic release
rate for the 100 year developed storm and UDFCD states required water quality capture
volume for minor storms. This Plan will have separate release structures for the water
quality capture volume and the larger storms which will pass the offsite flows through
the site. All details for calculations are in Appendix A and all references for design are
located in Appendix B. Construction activities will incorporate Urban Drainage and
Flood Control District's "Best Management Practices" to minimize runoff and sediment
transport.
Hydrology and Storage
Hydrology calculations for this study use the Rational Method to determine historic site
flows for the minor five year rainfall event and the major one hundred year rainfall event.
Weld County states the 100 year developed storm release flow to be the 5 year
undeveloped flow, hence flow calculations for the 5 year historic from onsite, the 100
year offsite, and the 100 year developed from the basin were necessary to determine
release rates. The calculated historical flow calculations are in Appendix A, below are
the summary of flows:

The earthwork for the detention storage area has both cut and fill incorporated into the
design. The storage and offsite release rates use the hydrograph method for detention
pond sizing and USDFCD recommended release flows. The allowable release for the
100 year storm event is the sum of the offsite flows plus the 5 year historic onsite flow
the sum is: 85.15 + 3.94 = 89.09. USDFCD recommends 90% of the allowable release
rate to achieve downstream water quality, so the release rate for the 100 yr event is:
89.09 x .90 = 80.18cfs. The calculated detention volumes are:
Water Quality Capture Volume (WQCV) _ .639 acre feet (ac -ft)
Volume of 100 year rainfall event (V100)= 3.895 ac -ft
The calculations of volumes are in Appendix A. A small rectangular weir will release
water quality capture volume (wqcv) and a double box culvert for the 100 year release is
proposed to be placed to the south of the wqcv structure, as shown in Figure DRI . The
structures will release storm water at the following rates:
QWQCV release = .19 cfs
Q100 release = 80 cfs
These release rates are below the calculated historical flows from the site and details of
the calculations can be found in Appendix A.
Maintenance and Conclusions

Maintenance of the drainage system will be completed by the owner's or their
representatives or employee. The drainage system will be inspected annually or within
30 days of a major storm event. Sediment levels exceeding 5 cubic yards will be
removed in a timely manner, and when conditions allow normal construction equipment
to complete the task. Vegetation control will be accomplished by regularly mowing the
south swale and the detention area. When any outlet structure becomes damaged to
impede its proper function, the structure will be repaired or replaced.
The Plan created for this site meets Weld County Code and UDFCD FCD standards. The
design standards of the storm water improvements in this Plan adhere to generally
accepted engineering principles and practices and conform to applicable laws and
regulations.

may not be valid. The UD-Rational Excel workbook performs all the needed calculations to find the
runoff coefficient given the soil type and imperviousness and the reader may want to take advantage of
this macro -enabled Excel workbook that is available for download from the UDFCD's website
www.udfcd.org.

5.0 UD-Rain Excel Workbook
Equation 5-4
The UD-Rain Excel workbook has been developed in order to facilitate computation of design rainfall, It
applies the methods in the NOAA Atlas 2, volume III to derive design rainfall statistics and create Depth -
Duration -Frequency (DDF) and Intensity -Duration -Frequency (IDF) tables for any location within
Colorado and includes elevation adjustments. This workbook also prepares a temporal distribution of the
Design Rainfall for the 2-, 5-, 10-, 25-, 50-, 100- and 500-yr events within the UDFCD boundary
including depth reduction factors (DRFs) for use with CUHP and SWMM modeling.
UD-Rain and CUHP may provide slightly different results for the rainfall distribution than the procedure
outlined in this chapter due to a smoothing method implemented in the programming which eliminates
potential dips in the hyetograph.

The time of concentration, te, is the sum of the initial (overland) flow time, ti, and the channelized flow
time, tt, as per Equation 6-2.
2.4.3 First Design Point Time of Concentration in Urban Catchments
Equation 6-4 was solely determined by the waterway characteristics and using a set of empirical formulas.
A calibration study between the Rational Method and the Colorado Urban Hydrograph Procedure
(CUHP) suggests that the time of concentration shall be the lesser of the values calculated by Equation 6-
2 and Equation 6-5 (Guo and Urbonas 2013).

Equation 6-5 is the regional time of concentration that warrants the best agreement on peak flow
predictions between the Rational Method and CUT. It was developed using the UDFCD database that
includes 295 sample urban catchments under 2-, 5-, 10-, 50, and 100-yr storm events (MacKenzie 2010).
It suggests that both initial flow time and channelized flow velocity are directly related to the catchment's
imperviousness (Guo and MacKenzie 2013),
The first design point is defined as a node where surface runoff enters the storm drain system. For
example, all inlets are "first design points" because inlets are designed to accept flow into the storm drain.
Typically, but not always, Equation 6-5 will result in a lesser time of concentration at the first design
point and will govern in an urbanized watershed. For subsequent design points, add the travel time for
each relevant segment downstream.
2.4.4 Minimum Time of Concentration
Use a minimum to value of 5 minutes for urbanized areas and a minimum tC value of 10 minutes for areas
that are not considered urban. Use minimum values even when calculations result in a lesser time of
concentration.
2.4.5 Common Errors in Calculating Time of Concentration
A common mistake in urbanized areas is to assume travel velocities that are too slow. Another common
error is to not check the runoff peak resulting from only part of the catchment. Sometimes a lower
portion of the catchment or a highly impervious area produces a larger peak than . at computed for the
whole catchment. This error is most often encountered when the catchment is long or the upper portion
contains grassy open land and the lower portion is more developed.

Equation 6-3 is adequate for distances up to 300 feet in urban areas and 500 feet in rural areas. Note that
in a highly urbanized catchment, the overland flow length is typically shorter than 300 feet due to
effective man-made drainage systems that collect and convey runoff.
2.4.2 Channelized Flow Time
The channelized flow time (travel time) is calculated using the hydraulic properties of the conveyance
element. The channelized flow time, tt, is estimated by dividing the length of conveyance by the velocity.
The following equation, Equation 6-4 (Guo 2013), can be used to determine the flow velocity in
conjunction with Table 6-2 for the conveyance factor.

Surprise Property Development, LLC is replying to the questions/statements in your email on Friday,
January 20th in regards to the Use by Special Review application.
1) Per the Environmental Health Department the following item is needed:
A) please indicate what ill be used for restrooms before the office is built for customers. If a
portable toilet is proposed please include that in application and then is ok to proceed.
Answer:
The applicant stated that portable toilets would be provided during construction activities and that a
restroom would be provided in the office once the office and onsite wastewater treatment system
(OWTS) was installed. The applicant will also be providing a portable toilet(s) for workers and
customers during the period between a) completed construction and b) the installation of an OWTS
and office. The number of portable toilets to be provided breaks down as follows: 1 toilet per ten
persons per hour, 2 for eleven to twenty persons per hour. A sanitizer station will be included in all
portable toilets.
2) Per the Department of Planning Services — the following items are needed:
A) Per our records - the proposed access point crosses an adjacent private property under
separate ownership (146722100001) before accessing onto Colorado Department of
Transportation (CDOT) right-of-way. We need evidence of an easement agreement (or at
least written approval from the adjacent property owner) giving you permission to access
across their property.
Answer:
The adjacent property owner to the east is the Colorado Department of Transportation (CDOT) and
not a private party as indicated on the county online mapping services. The graphic depiction in the
online mapping of the property due north and east of the applicant is incorrect.
On October 8, 2001, CDOT completed their condemnation of additional property along Interstate 25
for widening of the highway and a new frontage road, Figure 1 and Figure 2 show the before
(73.2532 acres) and after (65.8482 acres) aerials of the affected property. In the CDOT

condemnation, CDOT acquired six parcels in fee. These parcels are shown on part of a scanned
CDOT map included as Figure 3; a) the property prior to condemnation is shown as red lines b) the
red oval on the figure highlights the six parcels the state acquired c) red circles highlight the location
of each of these parcels. These parcels are listed and described in the recorded document at reception
number 2890495, attached hereto as Exhibit A pages 1-17. These parcels were conveyed to CDOT
pursuant to the following:
"IT IS ORDERED, ADJUDGED, and DECREED
1. That parcels No. 401, 401A, 401E Rev., UE-401, PE -401 Rev. and PE -401A described in
Exhibit "A", and the access rights described in Exhibit "B", attached hereto and incorporated
herein by reference, have been duly and lawfully taken by the Department of Transportation
pursuant to the Statues and the Constitution of the State of Colorado;
2. That the interests of the respondents in said parcels have been acquired by the Department of
Transportation, and that the title to said property, together with all appurtenances thereunto
belonging, is hereby vested in the Department of Transportation;"
After the condemnation, two parcels remained: 1) 1.7765 acre parcel east of the new frontage road
and 2) 64.0717 acre parcel to the west of the new frontage road as shown in Figure 4. The 64.0717
acre parcel's eastern boundary abuts the western boundary of the combined CDOT parcels 401E
Rev., PE -401 Rev., and UE-L01. The three parcels' legal descriptions in Exhibit A mapped correctly
will show CDOT as the adjacent property oper to the east.
In 2006, the 64.0717 acres was partitioned which created the north parcel (ID146722100001),
currently owned by Juanitha Jacobs Brennan and a south parcel (ID 146722100002), currently owned
by Surprise Property Development, LLC. The partition did not change the location of the eastern
boundary and only created a east west property line (shown in Figure 5 labeled N89°32'44"E
2152.12'). CDOT remains the eastern adjacent property owner of both parcel ID146722100001 and
M146722100002. Figure 5 shows the correct property boundaries for both Juanitha Jacobs Brennan
and Surprise Property Development, LLC which should be used to accurately reflect the parcels in
the Weld County online mapping services. In summary, to access the parcel (ID146722100002),
only a CDOT State Highway Access Permit is nessesary.
B) Not a requirement at this stage but a suggestion. Have you contact CDOT (or applied for
an access permit) regarding your proposed access location?

with re-_ ect to the acquisition of the property _ which is the subject matter of this action, said
consent being duly executed by the persons interested as owners, and those otherwise interested

said persons are the record owners and those otherwise interested and that said persons have

1. That it has full and complete jurisdiction of the subject matter of this action and the
parties thereto;
2. That service has been made upon all interested parties as required by law;
3� That Art Willis, as treasurer of Weld County has disclaimed;
4. That United Power, Inc., a Colorado corporation was served on March 28, 2001.
Despite being served, said Respondent never filed an Answer or otherwise responded
and is therefore in default, and this court so finds.
5. That the parties have agreed that the sum of $106,290.00 represents the full
compensation to be paid for the taking of said property and all interests therein;
6. That pursuant to said agreement, the Department of Transportation has deposited into
the registry find ofNs court • the total sum of S106,290.00, which represents the full
cY � interests to paid for the taking of said. property and all therein,
including g es, costs, and interest, if any; and, therefore,

1. That parcels No. 401, 401A, 401B Rev., U E-401, PE -401 Rev. and PE -401A described
in Exhibit "A", and the access rights described in Exhibit "B", attached hereto and
incorporated herein by reference, have been duly and lawfully taken by the Department
of Transportation pursuarit to the Statutes and the Constitution of the State of Colorado;
2. That the interests of the respondents in said parcels have been acquired by the
Department of Trantion and that the title to said property, together with all
appurtenances thereunto belonging, is hereby vested in the Depaxtnnlent of
Transportation;
3. That the Clerk of the Cow shall accept for deposit the sum of Si o,2'0.00, from the
Department of Transportation, and the Clerk of the Court is directed to disburse the
