HomeMy WebLinkAbout20173769.tiffRESOLUTION RE: ACTION OF THE BOARD CONCERNING REVIEW OF CONDITION OF APPROVAL #1.C OF 5TH AMENDED USE BY SPECIAL REVIEW PERMIT, 5MJUSR17-83-542 - DCP OPERATING COMPANY, LP (MEWBOURN GAS PLANT) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 17, 2017, by Resolution #2017-1596, the Board of County Commissioners approved the application of DCP Operating Company, LP ("DCP Operating"), 3620 W. 10th Street, Greeley, Colorado 80631, for a Site Specific Development Plan and 5th Amended Use by Special Review Permit, 5MJUSR17-83-542, for Mineral Resource Development Facilities, Oil and Gas Support and Service, Natural Gas Processing Facility, and the addition of new gas processing equipment to improve capacity and efficiency of the existing plant and one (1) up to one hundred (100) feet in height secure communications tower (Mewbourn Gas Plant) in the A (Agricultural) Zone District, on the following described real estate to -wit: Lot A of Amended Recorded Exemption, AMRE-591, and Lot B of Corrected Recorded Exemption, CORR RE -3203, being part of the SE1/4 of Section 35, Township 4 North, Range 68 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners is in receipt of a request from DCP Operating Company, LP, to determine satisfaction of Condition of Approval #1.C of 5th Amended Use by Special Review Permit, 5MJUSR17-83-542, and WHEREAS, on November 1, 2017, the Board of Commissioners reviewed the Department of Planning Services staff comments and heard the testimony presented, and deemed it advisable to continue to Monday, November 6, 2017, at 9:00 a.m., to allow DCP Operating Company, LP, to research and submit landscaping elevations, and WHEREAS, on November 6, 2017, the Board of County Commissioners reviewed the submitted landscaping elevations and finds that the updated Landscaping/Screening Plan proposed by DCP Operating, Company, LP, a copy of which is attached hereto and incorporated herein by reference, satisfies Condition of Approval #1.C. (DCP Operating Company, LP — Mewbourn Gas Plant) on July 17, 2017. Condition of Approval 1.C states "A landscaping/screening plan to mitigate visual impacts shall be submitted to the Department of Planning Services after consultation with area property owners." DCP held two (2) community meetings with area property owners after the USR hearing: August 16 and September 12, 2017. At the August meeting DCP proposed: 1. The addition of a 16 -foot prefabricated metal screening walls to extend the existing barrier wall on the west side of the property 2. To modify existing chain -link fencing to provide additional screening on the east side of the property 3. To add a row of trees on the west side of the 16 -ft screening wall for visual interest Community feedback to the DCP proposal indicated area property owners requested: 1. Using alternate materials for the screening walls 2. Adding landscaping features like a berm 3. Adding more screening on the east side of the property At the September 12, 2017 meeting DCP presented a new plan based on the area property owners suggestions. 1. To use precast concrete walls designed to resemble stone instead of corrugated metal for the extension of the screening wall along the west side of the facility. 2. To modify existing chain -link fencing on the east side by inserting matte finished aluminum slats to provide a visual barrier along this side of the property, as well as on the south side of the property 3. To use groups of evergreen trees in locations selected to lineup with adjacent residences and to install a drip irrigation to support the existing and new vegetation 2017-3769 Community feedback to the DCP proposal indicated area property owners requested: 1. Requested a review of new approaches to add additional sound mitigation on the west, north and east of the site through use of sound reduction walls similar to those used at well drilling sites 2. Adding tall (25 feet +) earth berms 3. Adding multiple rows of "full-size" deciduous shade trees and evergreens, as well as native grasses. Based on comments received from the area property owners during the August and September 2017 meetings, DCP and their landscape architect consultant developed a Landscape design that includes an elongated five-foot berm along the northwestern perimeter of the property. The berm, is approximately 2100 feet in length and 50 feet wide, planted with medium sized trees on the berm, primarily pine and spruce evergreen trees with native grasses. In concept, trees will be planted in patterns resembling natural groupings and will utilize native grasses. The Department of Planning Services reviewed the proposed Landscape Plan for the Mewbourn Gas Plant Facility and offers the following comments: The south and east side of the facility have the greatest restrictions primarily due to the construction of the plant infrastructure and the future right-of-way associated with County Road 35. The proposal of a continuous blank wall in the form of matte finish slats placed within the existing chain link fencing creates no visual interest. It is recommended that the flat fence wall should be broken up with shallow rooted shrubs or native grasses planted in natural groupings to avoid underground infrastructure encumbrances. The north side of the facility has a concrete wall that contains existing equipment within the Mewbourn 1 gas plant. There are constraints here due to an emergency/ maintenance access road and the irrigation canal. In lieu of a single row of trees, it is recommended that trees be placed in a triangular configuration and utilize an upright evergreen tree in form. The west side of the facility has three design elements proposed. The proposed berm, limited palette of evergreen trees and native grasses and a large blank split faced tan colored concrete wall. Without knowing the specific level of sub -surface constraints on this side of the facility it is difficult to provide a specific comment. In general, it is suggested that the approximately 1740 feet in length and a minimum of 15 feet in height sound barrier wall system flanking the Mewbourn 3 gas plant be broken up with shrubs or native grasses planted in natural groupings. There may be opportunities for a climbing vine to grow on the walls thereby softening the wall. The natural grouping of plant material does not necessarily need to abut the wall, rather extending the plantings away from the wall and into the parcel may be beneficial and not contrived. This sound wall does not enclose the Mewbourn 3 gas plant facility. Was this action intended? Without a provision for a wall adjacent to unmaintained County Road 38 or a means to mitigate plant noise to the south, a vacant parcel of land, will the facility be able to maintain the 65 dB(A) operating levels at this location. The proposed sound wall is generic in description and offers no specific information as to manufacturer, sound mitigation effectiveness and construction methods to be employed for the erection of the wall. While this component of the Landscape plan is an engineered solution to a specific component on the property, it may be beneficial to have additional information on this structure. It is suggested that mitigation techniques be employed and surround the facility on all sides, especially in light that there is a vacant parcel of land that in the future may development. The proposed artificial elongated lineal earth berm approximately 2100 feet in length, 50 feet width and 5 feet in height located near the edge of the property line and planted with two evergreen species and native grasses may provide screening in 10+ years if watered and fertilized according to landscape standards. The visual aesthetic offers limited to little visual interest. It is suggested that the berm be increased in height in areas, offering an undulating form of hills, slopes and valleys and perhaps the width of the berm modulates. It is also suggested that in addition to the evergreen trees, a native shrub component be introduced to create interest and provide a hedgerow of mixed native plantings, including grasses that would thrive in the soil conditions, aspect, climate and the unknown subsurface encumbrances. It is also suggested that small bumps of earth berms in the landscape be constructed to compliment the larger undulating earth berm and provide a slight topographic change in grade to create interest. There are two locations having a lineal row of trees that appear to be artificially placed for screening of a specific resident or residents. The first location is adjacent to the west property line and north of and adjacent to County Road 38. Similarly, there is the same lineal form of the plantings on property owned by DCP Operating Company, LP yet not included in the Special Use Permit boundary. This property is located east of County Road 35 and north of and adjacent to County Road 38. It is suggested that the lineal form of the plantings be enhanced with the trees, shrubs and grasses planted in patterns resembling natural groupings at both locations. This action may be accomplished by adding trees away from the lineal form in a naturally appearing stand of vegetation. The Mewbourn Gas Plant Landscape Plan as proposed is very structured, almost artificial in appearance and does not lend itself to appearing as a native and natural stand of vegetation indicative of the Front Range and Eastern Plains. Comments outlined herein are suggestions only for consideration that may well enhance the overall plan and the visual interest that will be the resultant. Introduction On July 17, 2017, The Weld County Board of Commissioners (the "Board") granted an amended use by special review (USR) permit allowing DCP to construct additional gas processing facilities at the DCP's Mewbourn gas processing plant, subject to certain conditions, including the submittal of a Landscaping/Screening Plan to mitigate visual impacts associated with the project. DCP was directed to consult with area property owners in development of the Plan. The following sections describe the planning process and the resulting elements of DCP's Landscaping/Screening Plan. 2. Description of Planning Process DCP held two community meetings with area property owners after the USR hearing: August 16 and September 12, 2017. At the first meeting, DCP discussed options to add 16 -foot prefabricated metal screening walls to extend the existing barrier wall on the west side of the property, and to modify existing chain -link fencing to provide additional screening on the east side of the property. DCP also proposed to add a row of trees on the west side of the 16 -ft screening wall for visual interest. Community feedback at the August 16, 2017 meeting indicated that area property owners wanted DCP to consider using alternate materials for the screening walls, as well as additional landscaping features like a berm, and to include more screening on the east side of the property. At the meeting, DCP explained that a berm along the full length of the west side of the Mewbourn facility would not be feasible due to the multiple underground pipelines that cross the site, and the overall size and shape of the site. DCP also explained that DCP would achieve the light industrial sound standards imposed by the Board through sound mitigation measures implemented inside the Mewbourn facility, and that additional sound mitigation was not needed to meet these requirements. DCP agreed to review other materials for the screening walls and to consider additional screening on the east side of the property, as well as to work with a landscape architect on the placement and selection of trees. DCP met again with the area property owners on September 12, 2017, to present DCP's proposed Plan. DCP proposed to use precast concrete walls designed to resemble stone instead of corrugated metal for the extension of the screening wall along the west side of the facility, and to modify existing chain -link fencing on the east side by inserting slats to provide a visual barrier along this side of the property, as well as on the south side of the property. DCP also proposed to use groups of evergreen trees in locations selected to line up with adjacent residences. DCP would use drip irrigation to support the vegetation. The community also presented ideas at the September 12, 2017 meeting, focusing on approaches to add additional sound mitigation on the west, north and east of the site through use of sound reduction walls similar to those used at well drilling sites, in combination with tall (25 feet +) berms, and multiple rows of "full-size" deciduous shade trees and evergreens, as well as native grasses. 3. Discussion DCP reviewed ideas presented by the area property owners at both meetings, and has incorporated certain elements to reflect such input. Some ideas proposed by the area property owners, such as the use of very tall berms and sound wall materials, are expressly intended to provide additional sound mitigation rather than visual screening. Because the Mewbourn facility covers a large parcel [sizing info], and consists of multiple structures and equipment installations, DCP proposed in its USR application to provide noise mitigation through engineering controls at the most significant noise sources rather than through external barriers, which are less effective. DCP's noise mitigation approach will meet the light industrial sound standards imposed by the Board at the USR hearing. The USR amendment granted by the Board directed DCP to implement these measures as proposed, and to develop a separate landscaping/screening plan for mitigation of visual impacts. DCP's Plan has been developed to provide such mitigation through landscaping and use of screening walls at the perimeter of the existing and proposed facility area. The following sections describe DCP's analysis of the comments received and the changes to DCP's plan made in response to such comments. a. Screening/sound walls In the September 12, 2017 meeting, the area property owners presented ideas for using sound reduction barrier walls on the full perimeter of the site. The examples shown include metal, fiberglass and PVC components, as well as rockwool or fiberglass batting to provide sound reduction. Although the purpose of the Plan is to provide visual screening, as opposed to sound mitigation, DCP has agreed to use materials that provide additional sound mitigation benefits. However, not all of the specific products presented at the meeting may be suitable for the Mewbourn site, either for reasons of durability and resistance to weather over a long period of time, because they are not cost-effective for use as a perimeter wall at a large industrial site, or because their appearance is not consistent with the County's visual standards. DCP will construct a sound wall around the west and east sides of the new facility area with a minimum height of 15 feet, as shown on the plan in Exhibit A. DCP's preliminary recommendation, subject to availability, is the SoundTec modular wall system, manufactured by AFTEC. The SoundTec system is comprised of precast concrete panels installed between either metal or concrete columns, and is available in colors and textures which can be selected to resemble a wall made from blocks of natural buff -colored sandstone. This system is designed to provide sound absorption, which will add to the existing noise mitigation features of DCP's engineering design. DCP also proposes to select the Ashlar pattern in Tan, based on its resemblance to local stone, as shown in Exhibit B. The final design and materials will depend on additional engineering analysis and commercial availability, but at a minimum the resulting sound wall will be tan or beige in color and have a non -reflective, attractive surface that resembles stone. DCP will also install opaque slats into the existing chain -link fence that runs along the east side of the property, in order to provide additional screening between the facility and the road. Although the area residents expressed a desire for additional sound walls on this side, DCP does not think that replacing its existing perimeter fencing in this area is warranted. First, DCP will achieve its sound mitigation goals by engineering controls within the plant, as previously stated. Second, DCP has limited room on this side of the facility, given the proximity of the current perimeter to CR35, as well as the location of equipment and structures on this side of the property. DCP's primary access route into the facility is located on the east and any wall would necessarily be interrupted over a significant area, thereby reducing any perceived sound mitigation effect. At this time, DCP does not plan to install a screening wall on the south side of the property, along CR38, due to the absence of any residential properties along that boundary. However, DCP may add a screening/sound barrier wall feature comparable to the one used on the west and east side of the Mewbourn 3 facilities when and to the extent warranted by future residential development in that area. b. Berm Many area property owners expressed a strong interest in the use of berms as part of the DCP design. As discussed below, there are technical limitations imposed by the size, topography and subsurface characteristics of the Mewbourn property which affect the use of berms to provide visual screening or other benefits. However, DCP has determined that an elongated berm of limited but variable height along the northwestern perimeter of the property may be used as a landscape feature to offer visual interest and provide some screening. DCP will install the berm in combination with irrigated tree plantings oriented towards the current adjacent residential properties on the northwest. Based on an analysis of the site characteristics, DCP has concluded that installation of a 25' berm along the western and eastern sides of the facility is technically infeasible and offers limited additional benefits either as a sound barrier or a visual screen, given the topography of the area and the geographic distance between area property owners from the Mewbourn plant facilities. First, the Mewbourn site is much larger than the examples offered by the area property owners in the second meeting; the Mewbourn property covers approximately 125 acres, with the western perimeter of the facility measuring nearly 4000 linear feet. From an engineering perspective, an artificial hill of the size proposed by the residents would require an enormous "footprint" and considerable internal structural support to ensure a stable landscaping feature. Even at this size, the berm would not provide the screening that area property owners expect, given the distance between their properties and the berm, and the relative elevations of the site and surrounding area. Second, DCP and other parties operate multiple pipelines that underlie the west side of the site, so that any surface structure on the west side of the property must be constructed to avoid impact to these underground facilities and to allow access for repairs and maintenance purposes. A modular wall system as proposed by DCP can be constructed of smaller components, and can be installed to avoid such interference. Third, with respect to the proposal that DCP construct such a berm on the east side of CR 35 as well as on the west side of the plant site, DCP does not own all of the property on the east side of CR35, and cannot install a berm feature along the length of this corridor as requested. As discussed below, DCP has instead proposed to plant trees along the border of the adjacent residential property east of the facility, across CR 35, in order to provide visual screening for these properties. Finally, as recognized in the noise mitigation approach approved by the Board, DCP will be taking out of service certain noise -emitting equipment located in the northern portion of the Mewbourn site, and there is little justification for adding noise mitigation features in this area as requested by the area property owners. As shown in Exhibit A, DCP has developed a landscaping design that includes an elongated berm with a base height of five feet relative to grade along the northwestern perimeter of the property. Additional height will be added in selected locations intended to provide more visual interest to the landscape. The berm will be approximately 2100 feet in length and 50 feet wide. This feature will provide more visual screening in this perimeter location than if placed closer to the Mewbourn facility, because it is closer to nearby residential properties. DCP will plant trees, shrubs and native grasses on the berm, as discussed in the following section, which will further enhance the visual benefits. As discussed in the following section, DCP will plant trees, shrubs and native grasses in certain other areas as well. c. Vegetation/Trees The area property owners proposed in the September 12 meeting that DCP install a variety of full-size shade and other deciduous trees, such as maples and elms, in combination with evergreens, shrubs and native grasses, to be located in three rows between the berms located to the west and east of the property and a sound wall. Based on input from DCP's landscape architecture consultant, as well as the site's physical characteristics, DCP does not think this proposal is feasible. First, even with irrigation, many of the species desired by the area property owners are not compatible with the site environment, let alone native to the high plains ecosystem, and would not thrive or even survive over the longer term. Second, use of full-size trees in a new planting is rarely successful, even under the best circumstances, as well as extremely costly. There are very few species of trees that are native to this area and/or that would be compatible with the site environment without irrigation. However, the pine and spruce species common in the Front Plains would be most likely to thrive and grow at this site with irrigation, and transplanting medium-sized trees is likely to be more successful than re-establishing more mature, larger ones. DCP proposes to use medium-sized evergreen trees, in several varieties chosen for compatibility with the physical environment, as well as compatible shrubs and native grasses. In DCP's design, such trees are planted on and near the northwest berm, and in three other locations chosen for their location relative to the view from nearby residential properties. DCP will plant the trees in patterns resembling natural groupings in all four locations rather than in rows. DCP will also plant larger species of native grasses or similar grasses along the eastern fence of the Mewbourn facility, adjacent to CR35, and other native grasses will be used to revegetate disturbed areas outside the plant site. A drip irrigation system will be necessary to provide adequate water and sustain the tree and shrub plantings. DCP believes this comprehensive approach will produce a sustainable landscape that is most likely to provide the visual benefits desired by the community. 4. Based on comments received from the area property owners during the August and September 2017 meetings, DCP and their landscape architect consultant developed a Landscape design that includes an elongated berm along the northwestern perimeter of the property. The berm, is approximately 2100 feet in length and 50 feet wide, planted with medium sized trees on the berm, primarily pine and spruce evergreen trees with native grasses. In concept, trees will be planted in patterns resembling natural groupings and will utilize native grasses. The Department of Planning Services reviewed the Landscape Plan for the Mewbourn Gas Plant Facility and offers the following comments: The south and east side of the facility have the greatest restrictions primarily due to the construction of the plant infrastructure and the future right-of-way associated with County Road 35. Opaque slats will be threaded into the existing chain -link fence that runs along the east side of the property, in order to provide additional screening between the facility and the road. To soften the appearance of the vertical slats, DCP will also plant larger species of native grasses or similar grasses along the eastern fence of the Mewbourn facility, adjacent to CR35. The north side of the facility has a concrete wall that contains existing equipment within the Mewbourn 1 gas plant. There are constraints here due to an emergency/ maintenance access road and the irrigation canal. In lieu of a single row of trees, that may not adequately screen the facility, it is recommended that trees be placed in a triangular configuration and utilize an upright evergreen tree in form. The west side of the facility has three design elements proposed. The elongated earth berm; a diversified palette of evergreen trees, shrubs and native grasses and a sound/ screening wall to assist in the visual and noise mitigation associated with the Mewbourn 3 gas plant. The proposed elongated lineal earth berm approximately 2100 feet in length, 50 feet width and offering an undulating form of hills, slopes and valleys with changes in the width of the berm will offer a visual aesthetic and visual interest. The trees, shrubs and native grasses planted on and in front of the berm will create interest and provide a hedgerow of mixed native plantings, including grasses that would thrive in the soil conditions, aspect, climate and the unknown subsurface encumbrances. While not graphically shown on the plan, it is also suggested that small mounds be placed in the landscape to compliment the larger undulating earth berm and provide a slight topographic change in grade to create interest. A modular sound wall system is proposed to surround the new Mewbourn Gas Plant 3. The sound wall also provides a screening component and the wall has a textured surface resembling local area stones in a natural buff color. The wall is proposed to be a minimum of 15 feet in height from grade and has been designed per the manufacturer's specification to provide sound absorption which will add to the noise mitigation features associated with the engineering plan. A suggestion is to add a vegetative component to the wall facade through the introduction of a climbing vine such as Boston ivy that would create visual interest in the fall, with their characteristic bright burgundy red leaves with hints of green and dark purple. This plant may assist in the softening to the wall and may be of additional benefit. There are two locations with medium size evergreen trees that appear to be screening a specific resident or residents. The first location is adjacent to the west property line and north of and adjacent to County Road 38. Medium-sized evergreen trees, in several varieties selected for compatibility with the physical environment, as well as compatible shrubs and native grasses are to be placed in patterns resembling natural groupings. The second location is east of the plant site, planted on an uphill slope on lands outside of the permit area. The 80 acre parcel on which the plantings are proposed are owned by DCP and the property is encumbered with several pipelines adjacent to County Road 35. The vegetative pattern here is similar to other locations and will utilize native trees, shrubs and grasses planted in patterns resembling natural groupings found along the front range. In all planted area's a drip irrigation system will be installed and maintained to provide adequate water for the long term survival of all tree, shrub and grass plantings. As stated in the applicants Landscape narrative white paper, and as delineated on the USR Map, the Mewbourn Gas Plant Landscape Plan proposes to use medium-sized evergreen trees, in several varieties chosen for compatibility with the physical environment, as well as compatible shrubs and native grasses. Changes in topography, undulating surfaces and the introduction of vegetation offering spring flowers, fall color, and vegetation with berries offers a diverse plant palette. The installation of an engineered sound wall will assist in mitigating visual and noise related concerns associated with the new plant site. Vinyl strips in the chain link fence and some trees is not good enough. I've also asked for a drawing that shows the plant from my perspective and the little bubble showing a tree or two really isn't adequate. State Regulation Violations (Alleged) I've also been working with the Air Pollution Control Division at the State. We are continuing to drill down to the details and it appears that DCP will not be able to meet the affirmative defense for the excessive pollution. The Division is commencing this action because it has cause to believe that the compliance issues identified below may constitute violations of the Colorado Air Pollution Prevention and Control Act ("the Act") and its implementing regulations. Please be aware that you are responsible for complying with applicable State air pollution requirements and that there are substantial penalties for failing to do so. Pursuant to Permit Number 09WE1136 Issuance 2, Condition 33, DCP must demonstrate compliance with the requirements of this permit by following the operating and maintenance (O&M) plan and record keeping format approved by the Division. The approved OEtM plan for AIRS Point 102 (engine C-167) states that DCP shalt establish the catalyst differential pressure (dP) baseline during each initial compliance and portable analyzer test. DCP must monitor and record the catalyst dP monthly and must maintain catalyst dP within (plus or minus) 2 inches of water column from the baseline. DCP failed to maintain catalyst dP within (plus or minus) 2 inches of water column from the baseline for AIRS Point 102 for the months of November 2015, December 2015, and January 2016, in violation of Permit Number 09WE1136, Condition 33. C. Pursuant to Permit Number 09WE1136, Condition 33, DCP must demonstrate compliance with the requirements of this permit by following the OFtM plan and record keeping format approved by the Division. The approved O£tM plan for AIRS Point 110 (TANKS) states that the thief hatch seals shall be inspected for integrity annually and DCP submitted an APEN to the Division on July 27, 2015 requesting an increase to the annual permitted emission limit for AIRS Point 108 from 31.73 tpy to 50.79 tpy of VOC. Issuance 3 of Permit Number 09WE1136 with the increased annual emission limit for AIRS Point 108 of 50.8 tpy of VOC was issued to DCP on October 21, 2016. COLORADO Air Pollution Control Division replaced as necessary; pressure relief valves (PRV) shall be inspected annually for proper operation and replaced as necessary; and PRVs shall be set to release at a pressure that will ensure flashing, working and breathing losses (as applicable) are routed to the control device under normal operating conditions. DCP failed to perform an inspection on the thief hatch seals and PRVs during 2015, in violation of Permit Number 09WE1136, Condition 33. During the inspection on September 23, 2016, emissions were observed with an IR camera from the PRVs on two of the four tanks, demonstrating that DCP failed to ensure that PRVs were set to release at a pressure that ensured flashing, working and breathing losses were routed to the control device under normal operating conditions, in violation of Permit Number 09WE1136, Condition 33. D. Pursuant to COC Paragraph 13, repairs shall be completed on the seven (7) components remaining on Delay of Repair no later than the next process unit shutdown before the end of 2016. DCP completed repairs on the seven (7) components remaining on Delay of Repair on December 28, 2016. However, a process unit shutdown on all units occurred from September 12 to September 15, 2016. DCP failed to repair the seven (7) components remaining on Delay of Repair no later than the next process unit shutdown, in violation of COC Paragraph 13. E. Pursuant to COC Paragraph 14, DCP was required to complete any necessary repairs to ensure the PRVs on the condensate storage tanks are operated to ensure flashing, working and breathing losses (as applicable) are routed to the control device under normal operating conditions by September 19, 2016. Venting was observed during the inspection on September 23, 2016, demonstrating that DCP fatted to make necessary repairs by September 19, 2016, in violation of COC Paragraph 14. DCP repaired the PRVs on September 26, 2016. It is important to resolve the above -referenced issues as soon as possible. Therefore, the Division encourages DCP to immediately identify those compliance issues that are not in dispute and to rectify those issues before the upcoming Compliance Advisory meeting. In accordance with 5 25-7-115(3)(a), C.R.S., the Compliance Advisory meeting will be held within thirty (30) days of the Division's issuance of the Compliance Advisory in this matter. The Division also requests that DCP provide the Division with a brief written response to the alleged violations ("Source Response"). The Source Response should identify the undisputed compliance issues and, if an alleged violation is disputed, the basis for the dispute. There are 3 packets containing pictures and descriptions of the 8 different sites that I visited in Weld County. Another two sites are included in the power point addendum. Please note that I wasn't able to access the sites in their entirety due to trespassing concerns. Most of my observations were taken from the roadways adjacent to the various sites. I estimated the footprints of the sites and the heights of the berms encompassing them. These packets will be going around the room for you to look at. I will focus on 6 slides that represent the various locations and sizes of the berms. Please refer to the packets for more pictures of each site and their descriptions. There are at least 5 different types of industries represented I this presentation that construct berms and each industry has their own financial resources available for constructing them. DCP is by far the largest of its kind in the gas and oil industry and it is the most financially resourceful of all the companies that are represented in this presentation according to the information on company websites. The other companies like Excel Energy are large but the homebuilders are local and significantly smaller and have less financial resources available than DCP. The old sugar mill in Johnstown was by far a very small and local company with limited financial resources and yet they have a 10' berm around the perimeter on a location on their site. The industries represented are: Gas and Oil Xcel Energy Home Developers Manufacturing And an Old Sugar Mill All but 3 sites would be considered large and on par with Mewbourn's footprint. What I found was: Berms are common among a variety of industries, they can be very substantial, meaning 20-30' high and around the entire perimeter of a site. The larger sites, with tall equipment typically berm around their entire perimeter but this isn't limited to just the larger sites. The berms consist of: dirt native grasses trees and shrubs. Irrigation is used to establish the plants When the pictures were shown to the neighbors, many people commented on just how normal and common place berms are! I absolutely agree, the construction of berms is a normal and common practice that a variety of industries invest their financial resources in for the benefit of good relations with their neighbors. I'd like to show the 6 slides now so that you can see a few examples of what I'm talking about. Slide one please: Excel Energy plant is on CR 19 and CR 18 in Firestone It is an example of an aesthetically pleasing berm that is substantial in nature. I estimated its height to be about 25' on the north side and it extends at least a1/4 mile along the north side of the plant. In the packet that is going around, you will see pictures of the south side where the berm is 15'. Notice the variety of trees and how they are staggered at various heights along the entire berm. Also notice that the berm is in grass. Excel also went to the expense to add brick work at the entrance and along several breaks along the north side. This is a fairly large site Slide 2 please: Slide two is an Anandarko gas industry site located on CR 18 and CR 21, just to the NE of the Excel site. This is a large site also. Notice that this site also has a substantial berm and it goes around the entire perimeter. It is about 25/ tall. On the south side, they have installed a variety of trees along the top of the berm. There a very few neighbors close in to these two sites and yet Excel and Anandarko have gone to the expense of constructing a substantial berm around their entire perimeters. Slide 3 please: This site is located just off of Crossroads Blvd and Hwy 257. It is just west of the home development that is going in for Water Valley that also has a berm that wilt be shown in the next slide. It is a fairly small gas industry site and is bermed with Rolling Hills and trees. There are several breaks in the berm for pipeline access I'm assuming. It looks very natural. With this slide, and the photos in the packet, I wanted to point out that this type of berm is actually very aesthetically pleasing as it looks very natural, even with the breaks. Having breaks in the berm to address pipeline concerns was an issue that Craig brought up at the last meeting when he suggested that having breaks might look weird. In fact, it doesn't look weird but very natural. Slide 4 please: This site is at Crossroads Blvd and Hwy 257. It's a Homebuilders site at Water Valley along the ridgeline above. This is a picture of a huge berm, 30' high and at least al/4 mile long if not longer. It is being built by a Home Developer and for no apparent reason, in my opinion. The berm will block the view of the valley from the homes being built to the south side of it. In fact, 1 am having trouble understanding why a home builder would go through the expense of building such a substantial berm if it isn't necessary and actually blocks views and takes up valuable real estate. Yet, we have a local home builder financing a huge berm, which begs the question, if a home builder with less financial means than DCP constructs a berm for an unknown purpose, why can't DCP finance a substantial berm to address the very real concerns of its neighbors? Slide 5 please: This is a large site again along Crossroads blvd and just to the west of a housing development. I estimate the berm to be between 25'30' high visually limiting the plant presence. It is bermed around the entire perimeter Slide 6 please: This site is very large and comparable to Mewbourn's footprint and is an oil and gas industry site. It is also on Crossroads Blvd west of the other sites. I estimate the berm to be at 30' and it goes around 3 sides of the site, to the W, N and E and may eventually encompass the south side when construction is completed. It is directly east of a very large home development that is being prepared for building residential homes. This berm basically makes the large plant disappear from the view of its future neighbors. In conclusion: Construction of berms, some which are very substantial and encompass the entire perimeter of their sites, is a normal and commonplace practice. Various types of industries construct berms for a variety of reasons. The financial ability to construct berms varies from local companies to the larger industries, yet DCP is by far the largest and wealthiest of the companies represented in this presentation according to my research. I would like for DCP to give serious consideration about how the construction of a substantial berm around the majority of the perimeter at the Mewbourn would be an investment in current and future relationships with its neighbors. DCP, as a company, may want to entertain the idea that constructing substantial berms around their various sites, wherever they may be located, should be automatically included in their "standards of Best Practices". It seems to me that Excel Energy, Anandarko, and the local Homebuilders take their responsibilities of being good neighbors far more seriously than DCP to date. I hope that you will give this serious consideration in your response to our suggestions and recommendations for constructing a berm at the Mewbourn site. In my opinion, and from my observations regarding berms at other locations, I feel that this is a reasonable request and is an investment in the future. As you may know, two years ago, DCP expanded their Lucerne Plant which is located in the NW corner of WCR 64 ("O" Street) and WCR 43 (E2SE4Sec28T6NR65W/6PM). My family and I own the land directly south and downwind of the aforementioned DCP plant. Ever since it's construction, DCP has consistently failed to control the weeds on and around their property there. This situation has caused a tremendous increase in fugitive weed infestation of our irrigated farmland at considerable cost and aggravation to us and our tenant fanner, Mr. Perry Wiedeman. Both Mr. Wiedeman and I have communicated with DCP annually about this ongoing problem, but to little or no avail. In frustration, just three weeks ago, I tried to contact Mr. Troy Swain, Weld County Oil and Gas Liaison regarding the matter, but he failed to respond to my call. Afterward, I saw Mr. Swain at the conclusion of the last Pipeline Working Group meeting and mentioned to him the continuing weed problems DCP has been causing to our neighborhood. Mr. Swain responded that the issue was "upstream" from him, whatever that meant, but I took it to mean that he did not want to or could not get involved in the matter. The next day I contacted Ms. Tina Booton, Weld County Public Works Department Weed Division Supervisor to report the situation. After Ms. Booton investigated my complaint, she told me that even though most of the weeds were over six feet tall, there was nothing she could "officially" do because the weeds were not "noxious" weeds, which are under her jurisdiction. However, she offered to contact DCP about the situation. Later, Ms. Booton told me DCP informed her that they would have the weeds mowed no later than last Friday, October 27, 2017, which they finally did. The reason I am reporting allof this to you is because today's Tribune article indicated you will be meeting with DCP next Monday to further discuss their plans for expanding another one of their Weld County facilities, and I want you to be aware of DCP's persistent failure to maintain their existing facility which is located only one and one-half miles east of your own offices. We're glad that you see the landscaping proposal that DCP submitted will not be adequate to any of the surrounding neighbors due to the elevations. 8 foot trees will do nothing for our generation. We need results now. This plant has been an eye and ear sore for us for many years. I agree that trees on the surrounding neighbors property may give us the best chance of hiding the plant. If DCP eliminates trees and the berm and years of watering they can put those dollars towards a wall that would surround the plant on the three sides that we are affected. A 28 foot sound wall would not only hide a substanial part of the plant, but would also help cover the noisiest machines of the plant. IAC acoustics is sending a proposal for a sound sealing wall that is fire proof, weather proof rust proof, wind proof, and will last over a 100 years. DCP has been in touch with them and a sample of their product was at the last commissioners meeting. They have put walls up around other gas plants with great success for other surrounding communities. Building this large of an expansion, DCP clearly has the monetary means to afford this project and should to show their neighborly integrity. They won the first fight of getting their expansion, now it's our time for some relief. We had no intention of completely covering the plant only trying to make it more neighbor friendly. These products would not put any weight on the pipelines that DCP mentioned. The weight of the walls rest completely on the support posts, no matter the height. Theses companies have done walls around other plants with great success to surrounding communities. From Don and my (Terri Dechant) perspective, the current proposed 5' berm will not even come up to the current canal road and ditch bank. With that said the berm will not do any good except for the height of the trees. With planting small trees (8') we will not see the benefit for years. For example: Look at the big tree in the photo below. This photo is taken from our house. The canal road/ditch bank is hiding the bottom 5' or more of the tree. In conclusion: I recommend 15' tall berm, to give us the benefit of the berm with trees. Chain link fencing: The east side chain -link fence is a bad attempt. We recommend replacing the chain -link with the stone wall proposed on the west side. Please deny approval until DCP Midstream brings their landscape proposal up to standards and expectations.
