Re: Proof of Notice for a Division of Reclamation, Mining, and Safety (DRMS)
112(c) Reclamation Operation Permit Application for the Bennett Pit
To Whom It May Concern:
The DRMS requires that applicants submit proof of notice for 112(c) Reclamation
Operation permit applications to all owners of record of surface and mineral rights of
the affected land and the owners of record of all land surface within 200 feet of the
boundary of the affected land including all easement holders located on the affected
land and within 200 feet of the boundary of the affected land.
Attached is a copy of the notice published in the Fort Lupton Press that Northern
Colorado Constructors has applied for a 112(c) Reclamation Operation permit for the
Bennett Pit. Please accept this notice as having been notified that Northern Colorado
Constructors has applied for this permit.
Copies of the entire permit application are on file and available to be viewed at the
Weld County Clerk to the Board, 1150 O Street, Greeley, CO 80632, or at the DRMS
office, 1313 Sherman Street, Room 215, Denver, CO 80203. Comments must be in
writing and must be received by the DRMS within 20 days from the date of this letter.

PUBLIC NOTICE
Northern Colorado Constructors, Inc.;
9075 Weld County Road 10, Fort
Lupton, CO 80621, (303) 857-1754, has
filed an application for a Regular (112)
Construction Materials Operation
Reclamation Permit with the Colorado
Mined Land Reclamation Board under
provisions of the Colorado Land
Reclamation Act for the Extraction of
Construction Materials. The proposed
mine is known as the Bennett Pit, and is
located at or near Section 12, Township
2, Range 67, 6th Prime Meridian.
The proposed date of commencement is
May 1, 2017, and the proposed date of
completion is December 31, 2027. The
proposed future use of the land is
developed water resources. Additional
information and tentative decision date
may be obtained from the Division of
Reclamation, Mining, and Safety, 1313
Sherman Street, Room 215, Denver,
Colorado 80203, (303) 866-3567, or at
the Weld County Clerk and Recorder's
office; 1150 O Street, Greeley, CO
80632, or the above -named applicant.
Comments must be in writing and must
be received by the Division of
Reclamation, Mining, and Safety by 4:00
p.m. on March 29, 2017
Please note that under the provisions of
C.R.S. 34-32.5-101 et seq. Comments
related to noise, truck traffic, hours of
operation, visual impacts, effects on
property values and other social or
economic concerns are issues not
subject to this Office's jurisdiction.
These subjects, and similar ones, are
typically addressed by your local
governments, rather than the Division of
Reclamation, Mining, and Safety or the
Mined Land Reclamation Board.
