R. 4, Longmont, Colorado, requesting permission to locate a hog farm operation on the follow- ing described property, to-wit: That portion of the Southeast Quarter of the Southeast Quarter of Section 18, Township 2 North, Range 67 West of the 6th P. M. , Weld County, Colorado, more particularly described as follows: Beginning at the Southeast corner of said Section 18; thence along the East line of said Southeast Quarter North 0°00'58" West 1321 . 40 feet to the Northeast corner of the Southeast Quarter of the Southeast Quarter of said Section 18; thence along the North line of said Southeast Quarter North 88°56'22" West 598. 08 feet to the True Point of Beginning; thence con- tinuing along said line North 88°56'22" West 722. 99 feet; thence along the West line of said Southeast Quarter South 0°09'19" East 722. 99 feet; thence South 88°56'22" East 722. 99 feet; thence North 0°09'19" West 722. 99 feet more or less to the True Point of Beginning. The above described parcel contains a gross acreage of 12. 00 acres, more or less, and WHEREAS, the petitioner was present, and also represented by Mr. Lester Yoder of Big Dutchman Sales, and WHEREAS, there was no opposition to the request of petitioner to locate said hog farm operation on the above-described premises, and WHEREAS, the said requested hog farm operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 (3) (c) of the Zoning Resolution of Weld County, said hog farm operation may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Vincent Rauch, Rural Route 4, Longmont, Colorado, to locate a hog farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1 . That any water and sanitation facilities to be installed shall be approved by the State Health Department. Cej 4. THE WELD COUNTY PLANNING COMMISSION STAFF RECOMMENDS THAT THIS REQUEST BE APPROVED FOR THE FOLLOWING REASONS : 1 . The proposed operation agrees with the Weld County Comprehensive Plan in that the Plan states: "Expansion and development of agri-business and agriculturally oriented industry will be encouraged, provided these enterprises do not adversely affect the total economy or environment" . It is felt that with the design and controls proposed in this operation, there is little chance for adverse impact on the surrounding environment or adverse impacts upon surrounding or proposed residential uses. The where operation would, in fact, provide a means,/the existing operation can be phased out and a more environmentally sound and cleaner operation provided. 2. The Tri-Area Planning Commission has recommended approval of the operation so long as the applicant adheres to the requirements of the State Health Department, removes the outdoor facilities that are now in existence on the property and the operation is limited to 400 sows and 2500 feeder pigs. 3. Petitions supporting the application have been filed and have been made a part of the application. 4. The Town of Frederick has recommended approval of the application with the stipulations which were included by the Tri-Area Planning Commission. 20 . In order for the proposed operation to be considered viable in the proposed location, the following changes would be necessary in the Special Use Permit plan and development standards: a. The number of animals to be confined on the property should be reduced to 460 sows and boars and 2700 feeder pigs, in Item #2 of the development standards b. The development standards should reflect that all operations, in- cluding breeding pens and quarantine pens will be enclosed within buildings. c. Measures for dust abatement should be included in the development standards. This would include provision for sufficient ground cover to be maintained on the remainder of the property to control dust and erosion from the operation. d. It should be stipulated in the development standards that the ex- isting operation, including pens and other structures would be re- moved within 6 months of approval of the application. e. It should be stipulated in the development standards that there shall be no discharge from the proposed lagoon into streams or other bodies of water or other adjacent drainage systems. f. It will be necessary to amend the proposed plot plan in order to reflect the reduced pen and building capacities stipulated under these recommendations. h. The development standards should contain specifications or reference to specifications indicating how the lagoon system will be sealed in order to avoid waters from the lagoons from entering permeable sub- strata and causing water pollution in underground sources. i . As requested in the letter to Mr. Yoder, June 10, 1975, written response to the State Health Department's letters and questions should be submitted to this office and amendments made to the development standards reflecting the resolution of these problems. 2. It is felt that petitions in support of the proposed operation should be reviewed with regard to where the people who signed the petitions live, particularly in the Casa Grande Estates area. It is felt that these signatures would be most valid if in fact those people were the ones who are most directly impacted by the proposed operation. 3. A variance to Section 6.1 .4. of the Weld County Zoning Regulations which states that such operation shall be located 2,640 feet from any E, R, H, MH, T, B or S zone was necessary for this operation to be considered. This variance was granted by the Board of Adjustment on June 12, 1975. It is felt that the advertisement for this particular hearing concerning the variance was somewhat misleading in that it only referred to a variance for a set back and gave little indication or insight into the particular problem which was being addressed. Therefor, it is felt by the staff that all efforts should be made to determine that the surrounding property owners are fully aware of the proposed operation and be granted a full hearing before this Commission. 4. It is recommended that the staff take immediate action to advertise this application for hearing before the Board of County Commissioners . Ad- vertisement of this application at this point in time would allow suf- ficient time for the applicant to make necessary changes for the appli- cation and for the application to be reheard before the Planning Com- mission prior to going before the Board of County Commissioners for final action. It is felt that by proceeding in this manner, we can prevent further delays with reference to the application and still have sufficient time for the Planning Commission to develop final recommendations to the Board of County Commissioners. The success of this approach will , however, depend upon the applicant pursuing diligent action in making the necessary changes to the application. 5. Per State Health Department suggestions, the following corrections and/or additions to the Special Use Permit plan and development standards are necessary: a. A complete drainage and sewage plan showing means of channelling contaminated and non-contaminated water into lagoon (pipe sizes, SUP 282 O ; 1 Page 3 lagoon dimensions and depth, size of settling tanks, appropriate cross-sections, etc. , be included in plan). b. That the lagoon shall be lined to reduce seepage to at least 0.25 inches per day. c. That an application for a discharge permit shall be filed with the Water Quality Control Division of the Colorado Department of Health and that notice of the granting of such a permit be forwarded to this office. d. That aeration facilities shall be installed if deemed necessary by the State Health Department to eliminate odors. The hearing before the Planning Commission was on July 15, 1975. The decision at that meeting was to table the appli- cation pending certain changes to the plat as submitted. We definitely are opposed to having this special use permit for hog feeder operation since this is a nice residential area and we truly feel this would be a liability rather than an asset, so I am giving you this notice in writing that I am opposed to such a permit, since I still own two separate lots near this description. No problems are anticipated providing the waste treat- ment system is designed for proper disposal of treated waste effluent and for minimum odor production. 2. Insufficient data is presented to adequately assess the treatment system design. Missing information includes expected organic waste production, efficiency of organic removal in the settling tanks, size of the settling tanks, lagoon water depth, efficiency of organic removal in the lagoon, lagoon organic loading and quality of final , treated effluent. 3. From the submitted drawing, it is assumed that the lagoon depth would be 5.5 feet, giving about 12,400 square feet of water surface area. At 0. 1 gallons per square foot per day, average daily evaporation rate, evaporation would dis- pose of about 1 , 240 gallons per day. Since the lagoon will have to be totally sealed, how will proper disposal of the remaining 3,260 gallons per day be accomplished? 4. Specific attention, however should be considered as to the promise by the owner, Mr. Rouch to eleminate the outdoor facilities now in operation upon approval of the new facilities. This Commission was presented a program by Mr. Rouch at our last meeting. The facilities they said, were based on a maximum of Four Hundred sows. If they should wish to exceed this number we will no longer recommend the issuing pf the special land use permit. We cannot justify a greater expansion of the facilities than was asked originally of Four Hundred sows. Both of these soils have moderate to severe limitations for reservoirs and sewage lagoons because of permeable substrata. The soil survey is made on the basis of 50 to 60 inch borings. There will be approximately 3 people in First Phase and 7 people in all Four Phases . Sows are to be housed in a Gestation barn . 20 sows will be farrowed each week. Pigs will be weined at 3 to 4 weeks and placed in a Nursery Barn for up to 5 or 6 weeks . When pigs are taken to Nursery Barn , sows are returned to Gestation Barn , where in 3 to 7 days breeding will take place and sows will be kept in Gestation barn for about 114 days when they will again be returned to the Farrowing Barn . Pigs will be sold or taken to Finishing Barn at 40# . Gestation Farrowing and Nursery Barns will have slats over 4 x 4 pits , the full length of building on each side , made with concrete . A 30" pipe will be used as an overflow to flow water to lagoon . Pits will be used as a septic tank to digest most of solids so nearly all water flow to lagoon will be free from solid waste. A mix mill will be installed on premises to mix and grind feed used on farm. Grain and Concentrate will be purchased . Water is to be supplied by a 5/8 in . Water Tap from Central Weld County Water District. Water consumption for all four phases should not exceed about 4 , 500 to 5 , 000 gal . per day. Most work on farm will be in day-light hours or from 6 A. M . to 6 P . M . Lagoon will be nearly free of odor because of water flowing to it is nearly free of solid waste .
