RESOLUTION RE: APPROVE VACATION OF SPECIAL USE PERMIT, SUP -403 - NCL INVESTMENTS, LLC, CIO JOSEPH O'BRIEN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated December 26, 1979, the Board approved Special Use Permit, SUP -403, for a dairy operation for Dale and Dee Benson on the following described real estate, to -wit: Lot A of Recorded Exemption, RE -427; being part of the NW1/4 of Section 8, Township 7 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board has received a request from AGPROfessionals, LLC, on behalf of NCL Investments, LLC, do Joseph O'Brien, 3050 67th Avenue, Greeley, Colorado 80634, to vacate said Special Use Permit, SUP -403, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. Or, the applicant shall request to partially vacate SUP -403 in accordance with Section 23-2-280.B of the Weld County Code if they wish to remove one or more proposed lots from the SUP boundary. The subject vacation shall be completed prior to recording the Recorded Exemption plat."
