'1 i `--t i 01 w1 t !b. a i i a 1l f fie J RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 47 :79 :7 FOR A MICRO- WAVE TOWER SITE ON A TRACT OF LAND LOCATED IN PART OF SEC- TION 15, TOWNSHIP 3 NORTH, RANGE 61 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 23rd day of May, 1979 at the hour of 9 :00 o'clock a.m. for the purpose of hearing the application for the granting of a Conditional Use Permit for a microwave tower site on the following described real estate, to-wit: A tract of land in the Northeast Quarter of Section 15, Township 3 North, Range 61 West of the Sixth Principal Meridian, Weld County, Colorado, said tract being more particularly described as follows: Commencing at the Northeast corner of said Section 15; thence South 0°44 ' 20" East along the East line of said Section 15 a distance of 1245.4 feet; thence South 89°15 ' 40" West a distance of 50 .0 feet to the True Point of Beginning; Thence continuing South 89°15 ' 40" West a distance of 400 .00 feet; thence South 0°44 '20" East and parallel with the East line of said Section 15 a distance of 400. 0 feet; thence North 89°15 ' 40 " East a distance of 400 .00 feet; thence North 0°44 ' 20" West and parallel with but 50 .0 feet distant from the East line of said Section 15 a distance of 400 .0 feet to the Point of Beginning and containing 3 . 67 acres , more or less. WHEREAS, a representative of the petitioner was present, and WHEREAS, evidence was presented in support of the granting of the Conditional Use Permit for a microwave tower site, and WHEREAS, Section 3 . 3 .D. of the Weld County Zoning Resolu- tion authorizes such a use in an Agricultural District upon the granting of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those 790237 fit present, has studied the request of the petitioner and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permit for a microwave tower site on the hereinabove described real estate complies with all of the conditions as set forth in Section 3 . 3 .D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado that the application of Kansas-Nebraska Natural Gas Company for a Conditional Use Permit for a microwave tower site on the hereinabove described tract of land be, and hereby is , granted subject to the following: 1. The Development Standards contained in the Condi- tional Use Permit. 2. No building or electrical permits shall be issued on the Conditional Use Permit area until the Development Standards for the Conditional Use Permit have been placed on the Conditional Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Planning Commission recommendations dated May 15, 1979 be, and hereby are, incorporated as the findings of fact of the Board of County Commissioners in this matter. Highway 85 APPEARANCE: Sam T'31ep DISCUSSION: This item was continued from the May 1, 1979 Planning Commission meeting for a field trip to be taken individually by the members to see the site and also so that someone from Fort Lupton could reply to their letter or be present at this hearing for clarification on their decision to deny the request . ITom Honn first stated that the Comprehensive Plan was adopted by,'-the Cit of Fort Lupton in February of 1969 . It was revised in 1973 which the Cit is currently using as well as the County Planning staff. Planning Commission lutes Page 2 May 15 , 1979 Sam Telep stated that it is hard to address a comprehensive plan when it was never adopted. under the law. Rose Bowles , City Administrator of the Town of Fort Lupton, confirmed the adoption of the comprehensive plan as stated by Tom Ho In previously. She also stated that the Fort Lupton Planning Commission voted to deny the change of zone request . Discussion followed regarding why the Town objected to the change of zone request . Corky Calder of the Fort Lupton Planning Commission stated that the Fort Lupton comprehensive plan restricts movement to the west . Development should move west and south. Russ Anson commented on the legality of the Fort Lupton comprehensive plan stating that the Weld County Planning Commission is not bound to the decisions of Fort Lupton and can presume the plan is valid. Rose Bowles read into the record the minutes of the Fort Lupton Town Board meeting which stated that the plan was adopted on February 14 , 1969. Discussion again followed. MOTION: Be it th refore resolved to recommend denial based on the staff ' s recommendation to the Board of County Commissioners . Motion by Fred Otis, seconded by Irma White. Kennedy DISCUSSION: This item was also continued from the May 1, 1979 Planning Commission meeting for clarification from the State Highway Department regarding their recommendation for this request . Wally Jacobson of the State Highway Department stated that in reviewing the request they would like to amend their previous recommendation in that the additional 12 ' will not be needed. The existing acceleration lane should only extend to the proposed driv7way and an appropriate taper be made on the east bound lane of 392 . For service in the future and as a result of a meeting with the Town of Windsor, a 16 ' median and 4 lanes will be utilized. Jim Gilbert then brought up the subject of the traffic flow at the intersection of 392 and 257 stating that something should have been done long before Mr. Kennedy' s proposal to help the situation. Ruth Fidino, Town Planner for the Town of Windsor, stated that she agreed with the traffic problem but that Mr. Kennedy' s proposed use will add more problems. Also that something should a worked out between Mr. Kennedy and. the State Highway Department to sha 'e the -cost of the improvement . Mr. Kennedy then commented that he did not f el the traffic flow would affect the traffic flow that much. Discussion followed regarding any possible impacts that could result at the intersecti n. MOTION: Be it th refore resolved to recommend approval to the Board of County Commission rs based on the staff ' s recommendation .with the elimination of. the State Highway Department' s recommendation. Planning Commiss ' on, ' -eting Page 3 May 15 , 1979 • APPLICANT: Harper Livestock Company CASE NUMBER: SUP-388 :79 : 10 SUBJECT: Sheep Feedlot LEGAL DESCRIPTION: Pt . SW4 and Pt . NE*, Section 27, T7N, R65W LOCATION: z mills north and 31 miles east of Eaton APPEARANCE: Tom Hellerick and Tom Norton DISCUSSION: Mr. Hellerich, attorney representing Mr . Harper, first gave a short presentation regarding Mr . Harper' s experience in the livestock business . He stated that he has been in the sheep business for 19 years and has been involved in the livestock industry all his life and that he will not only belthe seller of the sheep, but the owner of the business as well . He wil be living on the premises. Tom Norton, engineer, then explained how tht operation will be operated by the use of a map presentation. He also stated that drainage will be west and picked up in a settling pond. The water from the storage pond will be utilized for irrigation . He hen went into a great amount of detail in explaining the pollution control measures that will be utilized on the site and read into the record a letter in response to the Weld County Health Department as regards wastewater retention, other permits required, noise levels and fly and mosquito control . Tom Honn read the staff' s recommendation for approval and thelDevelopment Standards. John Hall of the Weld County Health Department expressed concern regarding the sealing of the lagoon and what measure will be taken regarding this . Mr. Norton stated that a proposal for sealing the lagoon has been proposed to the State Health Department , but they have not yet received anything back from them. Mr. Hall stated if their proposal poses no problem to the State Health Department, then the County Health Department would have no problem either with it . The floor was then opened to anyone who wished to express their opinion regarding the request . At this time Cynthia Berthurum expressed concern regarding fugitive dust and odor. Gene Inloes of the Weld County Extension Service responded to her concern about fugitive dust in that there will be dome dust at certain times throughout the year depending on the management and housekeeping of the operation and the amount of rainfall. Orville Green stated he was concerned about flooding of Owl Creek and Lone Tree Creek as did Eugene Clark. Jim Davis was concerned about flooding, .16ollution and decrease in his property value . Mrs. Berna Scott was concerned about dust and odor as she now has three feedlots surrounding her property. Alfred Miller, owner and operator of the feedlot to the west, stated he was in favor of the proposal and feels the applicant will manage the operation very well and follow all rules and, regulations as required. MOTION: Be it therefore resolved to recommend approval to the Board of County •Commissiolers based on the staff ' s recommendation . Motion by Percy Hiatt , seconded by Ben Nix. Planning Commission i lutes Page 4 May 15 , 1979 DISCUSSION: Mr. all first gave a brief background of information on the sport of trapshooting. This trapshooting range is a relocation of the range in Lkrimer County. It is unlike hunting in that there are very strict riles and regulations to be followed as regards ammunition used, etc . and must be adhered to at all times. The range will have a 5 trap layout with a clubhouse and will eventually expand to a 9 trap layout on 36 acre of property. The property is not suitable to farming. Access will be from County Road 74 . The noise level will be low. Discussion followed regarding the regulation of shell loads . Tom Honn then read the sta f ' s recommendation for approval and the Development Standards . He th n stated that the staff had raised two subjects of concern in the Development Standards . These concerns were the landscaping around the area and the four consecutive days of operation . Mr. Hall stated they would prefer not having shrubbery on the north side of the range as it is distracting to shooters and does not really provide a good sound barrier. Also, most shoots only last 2-3 days at the most . The staff' s Development Standards state no longer than four consecutive days. Discussion followed. John Hall of the Weld County Health Department stated that a noise stud was conducted on the site with a reading of slightly over the required noise level . However, off the site the reading is acceptable . Jim Gilbert stated he had site reviewed the property and feels this would be a txjemendous asset to the area and of great benefit to the County. MOTION: Be it therefore resolved to recommend approval to the Board of County Commissioners based on the staff ' s recommendation. NE*, Section 15 , T3N, F61W LOCATION: Approximately 9 miles northeast of Roggen on the north side of II 76 APPEARANCE: Murrabr Brown DISCUSSION: Mr. Brown stated that Kansas-Nebraska Natural Gas Company is in the process of moving their corporate headquarters from Hastings, Nebras a to Lakewood, Colorado. In view of this, they need to extend their towers l from Sterling, Colorado to Lakewood. The towers are used for supervisory control, facsimile data, intercompany telephone service which is used for alarming and remote control valving. The micowave system is used to insur gas delivery to their customers. The proposed site is leased, will be unmanned, electrically operated and will pose no pollution problem, odor or fire hazard. Tom Honn then read the staff ' s recommendation for approv 1 and the Development Standards . No further comments or questions. MOTION: Be it therefore resolved to recommend approval with the Development Standards to the Bard of County Comrissioners based on the staff ' s recommendation. NW4 NW , Section 2, T1N, R67W LOCATION: Southe st of the intersection of County Roads 21 and 14 APPEARANCE: Stev Theede DISCUSSION: This application was continued from the May 1, 1979 Planning Commission meetin for further clarification on the status of the following: Nightlloading; the circular access driveway that was to have been paved; greenbelt for landscaping around the perimeter of the site for visual screening; plans submitted include only one meter manifold. Steve Theede then stated that effective immediately there will be no night loading. This has been done on a somewhat limited basis and will nowibe discontinued. He stated there is a concrete driveway which was installed in 1978. There is gravel on both sides of the road. They felt they have met the intent of the stipulation in the Special Use Permit as regards paving. Trees were planted around the perimeter of the site, but since there is no inter on the property most of them have not survived. They have installed some aluminum lattice work in the woven wire fence as an alternative to the visual screening. There are three meter manifolds on the site instead of one as stipulated. They feel this allows traffic to get unloaded faster and get off County Road 21. Bob Johnson, safety coordinator and registered engineer for Continental Pipeline Company, briefly reviewed the safety precautions at the facility. He also explained the alarm system that is utilized a d how the system failed when the spillage occurred. Jack Berger, Jr. a d Jack Berger, Sr. both again expressed their feelings in that they canno believe anything Continental Pipeline Company says they will do. They als expressed concern regarding safety of the condesate and because Weld County has no fire code and therefore no authority. The applicant then dec ded it would be best if the application were withdrawn at this time. APPLICANT: . Contin ntal Pipeline Company CASE NUMBER: CUP-46 :79 :6 SUBJECT: Amend CU -22 - Crude Oil Truck Unloading Facility LEGAL DESCRIPTION: Pt . NW4, Section 20, T2N, R66W LOCATION: Northea t of the intersection of U.S . Highway 85 and County Road 18; APPEARANCE: Steve Theede DISCUSSION: This pplication was also continued from the May 1, 1979 Planning Commission hearing. Mr. Theede stated that this proposal is to include the addition of one truck unloading driveway. It would allow them to handle Continental Pipeline 's truck volume which are now presently being unloaded at Spindle A. The adddition of the driveway will not require an additional meter u loading facility. One 500 barrel tank and one 1, 000 barrel tank will b added. There will be two small unloading pumps added with some increase in truck traffic. Tom Honn then read the staff ' s recommendation for approval and the Development Standards . Tom Honn stated this is required because of the number of people using the facility and the daily volume at the site. The rental to be paid to the lessor by the lessee shall be Four Hundred and No 100 Dollars ($400.00) , payable on January 22, 1979, and annually in advance the eafter. Rental is subject to review and revision after each five-year term of the lease. This lease may be extended or renewed, by agreement between the lessor and the lessee for any period up to ten (10) years, prior to the date of expiration. Such extension to be subject to the same terms of review and rea praisal at the end of each five-year period as for the original lease. In consideration of the foregoing the following covenants, conditions, and restrictions are hereby agreed to between the lessee and the lessor: 1. All improvements and construction on said premises shall be structurally sound, pleasing in appearance, and shall conform to applicable building codes. Plans for such improvements and construction are subject to review by the lessor for conformance with the terms of this lease. 2. Adequate sanitation and water facilities shall be provided for the improvements and structures on the premises and these facilities shall meet the requirements of all local, county, state, and federal agencies empowered to regulate such facilities. 3. The lessee agrees to conduct all operations on the leased premises in a workmanlike manner and will not create, or allow, any nuisance or noxious odors, or any other situation detrimental to the peace and well-being of the community. All wastes of any kind must be removed from the leased premises and ahy unsightly or unsanitary conditions created or allowed must be eliminated, re oved, and corrected within 30 days of written notice from the lessor. Failure to so eliminate, remove, or correct the conditions may be cause for cancellation of this lease. Under no condition may any timber, trees, stone, or other dative materials be removed from the premises without first obtaining the written permission of the lessor. - 2 - I 4. In the event this lease expires, or is terminated, or cancelled for violation of any of its terms and conditions, it is understood and agreed that the lesse¢ shall have 90-days from the date of expiration, termination, or cancellation)) to remove from said premises all structures and appurtenances placed thereon and shall restore the surface of the land as near as practicable to its original condition, unless the lessor determines otherwise. The lessee may, with the consent of the lessor, sell said buildings, improvements and property to a ubsequent lessee, provided such sale is completed within said 90-day period. If the lessee fails to remove all such structures and appurte- nances within he time indicated, they shall become the property of the lessor, but will not relieve the lessee of liability for the cost of their removal and the restoration of the site. 5. The premises herein described shall be fenced by the lessee at his own expense, if required to do so by the lessor. The lessee will conduct his operations according to all applicable safety laws and regulations and will take every precaution to keep the premises in a safe condition. The lessee shall be respohsible for all injuries to persons or property and will pay for any damages, including damages from fire, caused by his operation. 6. It is understood and agreed that this lease is for the sole and only purpose herein set forth, and no other, and in the event the lessee, his successors and assigns shall at any time use or attempt to use the same for any other purpose whatsoever, without the written consent of the lessor, then, in that case, this lease shall become null and void, and of no effect, and any or all such rights and privileges herein granted shall revert to the lessor. 7. The lessee shall not sublet in whole, or in part, the privileges herein granted, or assign this agreement, without the written consent of the lessor, and i is agreed that subletting of this lease or any transfer or assignment, of attempted transfer or assignment of this lease, or of any of the rights hereby granted, without the consent in writing, shall be void and at the option of the lessor shall terminate this agreement. 8. The lessor leases only the land and furnishes no materials, improvements, utilities, or other facilities. All improvements or structures placed on the land shall be at the expense of the lessee, and the lessee shall pay all charges for the installation, modification, maintenance, and use of I 3 - 1 I utilities and for all services connected therewith, and shall pay any taxes levied on the property. The lessee may use water produced on the site for use on the site, provided he makes no claim to the ownership of any water rights developed. 9. It is hereby agreed by and between the parties hereto that should the said lessee remain in possession of said premises after the termination of this lease, either, by expiration of term or otherwise, that the said lessee shall be liable for rental during said possession; that said rental shall in no case be less than the rate agreed upon in this instance, but that the said I lessor may reappraise said property and fix a new rate which shall be paid by said "lessee du ing said continued occupancy. It is further agreed by and between the pa ties hereto that at the option of the said lessor, the said lessee shall be e construed to be in possession of said premises and to be occupying the same so long as the said premises are used in any way to any extent whatso- ever by said lessee, or so long as any of his improvements remain on said premises. It ' s expressly agreed that such continued occupancy shall not I establish a ne or extended lease term. 10. The lessee hereby agrees that he will build no structure of any kind on this land except the structures listed above and will not change the use of any structure, without first obtaining the written consent of the lessor. 11. The lessee hereby agrees to hold the lessor harmless for any damages incurred to any party as a result of the lessee's occupation of the I leased premises. I I 12. This lease is subject to any and all easements or rights-of-way legally obtained and now in full force and effect, if any there be. 13. The lessor reserves: a. The right at all reasonable times during the life of this lease to go upon said premises and every part thereof, for the purpose of • inspecting same, and of ascertaining whether or not the lessee is carrying out the terms, covenants, and agreements in this lease contained. b. The right to any and all minerals, ores, and metals of any kind and character, and all coal, asphaltum, oil, gas, clay, limestone, geothermal, or other like substances in or under said land, the right of ingress - 4 - I and egress for the purpose of mining, together with enough of the surface of said land as may l be necessary for the proper and convenient working of such minerals and s�ibstances. c. The right to hold, appropriate, sell or otherwise dispose of any improvements owned by the lessee upon said premises, to insure the payment of any delinquent rentals due the lessor, or any other adjudicated claims of the ' essor against the lessee on account of the damages, expenses I incurred, or otherwise. d. The right at any time to grant a right-of-way upon, over, or across said premises for any lawful purpose, but such grants shall be so made as to not interfere with the operations of, nor destroy the property of, the lessee. e. The right to order the sale of all or any portion of said premises durin the term hereof, as provided by law. The lessor shall, if sale is ordered, give the lessee thirty (30) days notice by mail of the date, time, and place of sale. In the event the premises, or any part thereof, are sold, such sale shall be subject to the terms of this lease and lessee shall accept such sale as an assignment of lessor's rights, duties, and obligations under this lease to the purchaser of the premises. Provided further, in the event such assignment by lessor to the purchaser of the land is prohibited by law, or in the event lessee shall give notice within 10 days prior to the date, time, and plac of sale, of its election of an option to terminate the lease, then this lease shall terminate as to the entire premises leased and lessee shall have ninety (9D) days from the date, time, and place of sale to vacate the premises sold Is provided herein. 14. The lessee shall execute a good and sufficient bond, with sureties to be approved by the lessor, for the payment of rentals due the lessor, and the faithful performance of all the covenants and agreements in this lease herein provided, and in accordance with the provisions of the statutes of the State of Colorado. It being further agreed that should the lessee fail to pay the rental, or any part thereof, upon the date when the same is due, or shall fail to keep each and every one of the covenants or agreements as herein provided, I I I'. I I ii I , then it shall be lawful for the lessor, at its election, to declare the term of this lease ended, and to re-enter and take possession of the said premises, or any part thereof, and upon the termination of this lease, either by expiration or cancellatior, for any cause whatsoever, if said lessee shall remain in possession thereof, he shall be deemed guilty of an unlawful detainer of said premises, and shall be subject to eviction and removal, forcibly or otherwise, with or without process of law. It is agreed, however, that the lessee shall be given thirty (30) days notice in writing of an alleged breach of covenants, except payment of rental, within which time the lessee shall have the opportunity to correct and remedy any of the alleged defaults in performance, to the satisfaction of the lessor. 17. No assignment of this lease shall be valid unless it shall have been entered upon the records of and approved by the lessor, and payment of assignment consideration made. IAny' assignment of this lease shall in no way ' i release the lessee from liability to the lessor. 18. Said lease may be cancelled at the end of any lease year at the pleasure o€ the lessee, providing lessor is given notice of such cancellation at least ninety (90) days prior to the end of any lease year. i 19. It is also further expressly understood and agreed by and between the parties hereto that in case the lessee shall refuse or neglect to pay rentals whbn due, or shall in any,manner fail to comply with any of the requirements o€ this lease, the lessor is authorized to incur any expenses which it may deem advisable in making collection or otherwise enforcing the provisions of this lease, and the lessee shall reimburse the lessor on account of any and all expenditures so made or expenses incurred, including costs of suit. Windblown deposits of sand and silt are known to exist on this site, and .excessive differential settlement could occur to heavily loaded foindations unless appropriate precautions are taken. The most suitable course of action may be to found the structure on the underlying bedrocll. However, the depth to bedrock on this site may be excessive, and another alternative may have to be considered. At any rate, we recommend that geotechnical investigations be conducted by qualified personnel so that the nature and engineering properties of the subsoils can be determined, and appropriate foundation design criteria formulated.
