BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
MAY 8, 2017
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, May 8, 2017, at the hour of 9:00 a.m.
• ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

Commissioner Steve Moreno, Pro-Tem
Commissioner Sean P. Conway
Commissioner Mike Freeman
Commissioner Barbara Kirkmeyer - EXCUSED

• MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of May 3, 2017, as printed. Commissioner Freeman seconded the motion, and
it carried unanimously.
El CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of
Hearings conducted on May 3, 2017, as follows: 1) PUDZ16-0002 — Lawrence and Jacquelyn Bebo, and
2) USR17-0004 — Gary Reinke. Commissioner Conway seconded the motion, which carried
unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed.
Commissioner Conway seconded the motion, and it carried unanimously.
PROCLAMATIONS:
• 1) WELD COUNTY POLICE OFFICERS WEEK - MAY 14-20, 2017, NATIONAL PEACE
OFFICERS MEMORIAL DAY - MAY 15, 2017, AND WELD COUNTY FALLEN OFFICER MEMORIAL
TRIBUTE CEREMONY - MAY 18, 2017: Chair Pro-tem Moreno read the proclamation into the record.
Donnie Patch, Undersheriff, thanked the Board for their support for the Sheriff's Office. He stated Police
Officers Week allows the agency to honor their fallen heroes, and he provided details for the memorial
ceremony held at Bittersweet Park where flags will be lowered and all names of fallen heroes across the
country will be read aloud. Each Commissioner expressed appreciation for the sacrifices and commitment

of all the law enforcement agencies that serve Weld County. (Clerk's Note: Meeting was paused for a
photo opportunity.)
• PUBLIC INPUT: No public input was given.
NEW BUSINESS:
• 1) CONSIDER DECLARING CERTAIN EQUIPMENT AS SURPLUS PROPERTY, AUTHORIZE
SALE OF SAME TO RIO GRANDE COUNTY, AND DELEGATE AUTHORITY TO CONTROLLER TO
SIGN ANY NECESSARY DOCUMENTS: Barbara Connolly, Controller, stated she was contacted by the
Coronor of Rio Grande County regarding the need for a vehicle. Ms. Connolly advised the County does
have a coronor vehicle, which is no longer required for use and stated Rio Grande offered $2,350.00.
Commissioner Freeman moved to approve said sale of equipment and authorize the Controller to sign
any necessary documents. The motion was seconded by Commissioner Conway, and it carried
unanimously.
• 2) CONSIDER CONTRACT ID #1138 APPLICATION TO PUBLIC UTILITIES COMMISSION FOR
IMPROVEMENTS TO RAILROAD CROSSING AT CR 49 AND AUTHORIZE CHAIR TO SIGN: Clay
Kimmi, Department of Public Works, stated the application is made to the Colorado Public Utilities
Commission so the Union Pacific Railroad (UPRR) can complete the final railroad crossing design and
schedule construction for the railroad crossing of CR 40, just north of CR 54. He stated UPRR has
anticipated construction to be between August and October of this year, for an estimated cost of
$102,638.00, which has already been worked into the bid amount. He stated there are efforts to attempt
to not delay work of the CR 49 project. Commissioner Conway moved to approve said application and
authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously.
• 3) CONSIDER TEMPORARY CLOSURE OF CR 10 BETWEEN CRS 45 AND 47: Janet Lundquist,
Department of Public Works, stated this is an emergency road closure which will remain closed until
completion of formal repairs. The closure is tentatively scheduled between May 1, 2017, through
May 12, 2017, due to a collapsed culvert. She stated the residents of the area have been notified. The
motion to approve said road closure, which was made by Commissioner Freeman, and seconded by
Commissioner Conway, carried unanimously.
El 4) CONSIDER CANCELLATION OF BOARD OF COUNTY COMMISSIONERS MEETING
SCHEDULED FOR JUNE 7, 2017: Commissioner Moreno stated this cancellation is due to the June
Conference for the Colorado Counties, Inc. (CCI) scheduled at that time. The motion to approve said
cancellation of meeting, which was made by Commissioner Freeman, and seconded by Commissioner
Conway, carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
