HomeMy WebLinkAbout20173568.tiffRESOLUTION RE: APPROVE CERTIFICATION OF WEED ENFORCEMENT LIEN - HOLLY CLIFFORD WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Section 15-2-70 of the Weld County Code, the Board of County Commissioners may certify to the Weld County Treasurer any assessment for weed enforcement work not paid within 33 days, to constitute a lien against each lot or tract of land until paid, and WHEREAS, the Vegetation Management Specialist performed weed enforcement work on property owned by Holly Clifford, 23288 County Road 4, Hudson, CO 80642, and further described as Parcel #147336000043, located in Section 36, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado, and WHEREAS, a Billing Invoice was sent by Certified Return Receipt mail on September 13, 2017, in the amount of $840.00, and evidence of delivery and receipt was not received, to date, said Billing Invoice has not been paid, and WHEREAS, after review, the Board deems it advisable to certify a lien against the property, described as Parcel #147336000043, in the amount of $840.00. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that a lien against the property, described as Parcel #147336000043, in the amount of $840.00, be, and hereby is, certified, pursuant to Section 15-2-70 of the Weld County Code, because of failure to pay within 33 days of the completion of weed enforcement work. A letter was mailed to the landowner on October 2 regular mail notifying them that a lien was being requested at the Monday, October 16 meeting with the Board of County Commissioners. In compliance with County Code, Section 15-2-70, Failure to Pay Assessment, I request that the weed enforcement bills listed below be certified by resolution by the Board of County Commissioners to the County Treasurer to be collected as taxe in accordance with Section 35-5.5-109(5)(a) C.R.S. Only one (1) enforcement mowing was carried out on private lands. This landowner has not paid the enforcement mowing bill and therefore a lien needs to be placed on the property so the bill is paid along with the property taxes. The landowner is Holly Clifford 23288 CR 4 Hudson, CO 80642; 147336000043; TIN, R65W, Sec 36. The Scotch thistle covered 70% of the property. The thistle averaged four (4) feet in height. The infestation on this property was first identified on June 9 when a neighbor filed a complaint. A hang -card was left on the chained closed gate. A postcard was sent on June 12 trying to reach the absentee landowner at the only address we have for them. An effort was made to track down a phone number or other address for the landowner. This was not successful. A legal notice was mailed on June 14 both certified and regular mail. Once the legal notice expired, right of entry from the Board of County Commissioners was requested on July 10. The mowing enforcement was carried out on July 18. The mowing enforcement bill is $700 for the contractor and $140 for the 20% administrative fee for a total bill of $840.00. The Assessor fee for placing the lien will be $93.33 bringing the grand total to $933.33. What options exist for the Board? (Include consequences, impacts, costs, etc. of options) I. Allow the lien to be placed on the property for the full amount of $933.33 2. Allow the lien to be placed on the property for the amount of $777.78 (not include the 20% administrative fee) 3.
