Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated July 14, 2017, and duly published July 19, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Lisa Beilman, c/o Bob Christie, for a Change of Zone, COZ17-0005, from the PUD (Planned Unit Development) Zone District to the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and described the site location in relation to relevant County roads. She stated 15 referrals were sent out, with eight (8) referral responses indicating no concerns or including recommendations that have been considered by staff. Ms. Aungst stated the site is a 55 -acre lot with no structures and was Zoned as a PUD (Planned Unit Development), PZ-1999, in 2005, and the current buyer wants to construct a single-family residence and not complete the PUD. She reported the area is residential and agricultural in nature making the proposed use compatible; however, she noted the minimum lot requirement would have to be waived due to not meeting the 80 -acre requirement. Ms. Aungst displayed images and entered the favorable recommendation of the Planning Commission into the record as written. In response to Chair Cozad, Ms. Aungst stated the parcel was created with a Recorded Exemption, RE -3685. The Board discussed whether a waiver is necessary. After further discussion, Mr. Choate verified the additional note on the plat. Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements and stated an Access Permit has been approved, AP#17-00338, stipulating to utilize the existing access point. He provided the average daily traffic counts and stated neither tracking control nor an Improvements Agreement are required. CG PLCm(Y1/ c ck). PLC H8), HLCLL), CT&TT) 10/5/17 2017-2924 PL1830 HEARING CERTIFICATION - LISA BEILMAN, C/O BOB CHRISTIE (COZ17-0005) PAGE 2 • Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements and clarified the Change of Zone does not impact the drainage on the site. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated Environmental Health has no outstanding issues with this request. • Robert Christie, applicant, stated his intent is to build a residential home and continue the agriculture and farming on the property, and he hopes to get involved with a local horse rescue program. • No public testimony was offered concerning this matter. • In response to Chair Cozad, Mr. Christie indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards. • Commissioner Kirkmeyer suggested deleting Conditions of Approval (COA) #1.C.6 and #1.C.7. Commissioner Freeman added a recommendation to delete COA #1.B.6. The Board agreed to these deletions. • Chair Cozad reviewed the amendments and Mr. Christie again indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. • Commissioner Conway moved to approve the request of Lisa Beilman, do Bob Christie, for a Change of Zone, COZ17-0005, from the PUD (Planned Unit Development) to the A(Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as amended and entered into the record, and to include the minimum lot size waiver. The motion was seconded by Commissioner Moreno, and it carried unanimously.
