RE: APPROVAL OF RENEWAL APPLICATION FOR A TAVERN LIQUOR LICENSE FROM
FIERA ENTERTAINMENT, LLC, DBA EL CAPORAL, AND AUTHORIZE CHAIR TO
SIGN - EXPIRES MARCH 23, 2018
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Fiera Entertainment, LLC, dba El Caporal, presented to the Board of County
Commissioners of Weld County, Colorado, an application for the renewal of a Tavern Liquor
License, for the sale of malt, vinous and spirituous liquors, and
WHEREAS, pursuant to Exhibit 5-H of the Weld County Code, said applicant has paid the
sum of $175.00 to the County of Weld for the renewal of the existing license, and
WHEREAS, said applicant has exhibited a State Liquor License for the sale of malt, vinous
and spirituous liquors for consumption by the drink on the premises only, outside the corporate
limits of any town or city in the County of Weld at the location described as follows:

WHEREAS, the Licensee shall host "responsible vendor" training every six (6) months as
agreeable to the Colorado Department of Revenue Liquor Enforcement Division, and this training
shall be open to other area licensees. Each employee shall be "responsible vendor" trained, and
the Licensee shall provide documentary evidence that each employee has been "responsible
vendor" trained to the Weld County Sheriff's Office within thirty (30) days of the first available
"responsible vendor" class after hiring. Evidence of such shall be included in the referral report
submitted by the Sheriff's Office at the time of annual renewal.

NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, having examined said application and the other qualifications of the applicant,
does hereby grant License Number 2017-6 to said applicant to sell malt, vinous and spirituous
liquors for consumption by the drink on the premises only, only at retail at said location; and the
Board does hereby authorize and direct the issuance of said license by the Chair of the Board of
County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which
license shall be in effect until March 23, 2018, providing that said place where the licensee is
authorized to sell malt, vinous, and spirituous liquors for consumption by the drink on the premises
only, shall be conducted in strict conformity to all of the laws of the State of Colorado and the
rules and regulations relating thereto, heretofore passed by the Board of County Commissioners
of Weld County, Colorado, and any violations thereof shall be cause for revocation of the license.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of March, A.D., 2017.

record shows Elvira Mercado as a victim in a fraud case. The case, 16W025385, was closed as a victim fail to prosecute.

Liquor Clerk (Rafaela is no longer employed with Weld County). El Caporal, a licensed Tavern, is owned and
operated by Fiera Entertainment, LLC. The license expires on March 23, 2017. A completed renewal
application has been submitted and is currently being reviewed. The establishment is allowed to operate under
a grace period while the renewal application is reviewed by both Weld County and the State of Colorado.

I just got off the phone with the owner, Elvira, and she informed me that Jesus is an employee of hers who
orders alcohol on her behalf. I informed her of the rules in concern of a registered manager, and the process to
do so. Because she turned her renewal application in late, and will already be operating under a "grey period"
while we wait for the State to review the application, she would like to keep the renewal application on the
agenda for tomorrow. She will discontinue allowing Jesus to order alcohol on her behalf until they have
registered him as a manager. She plans to submit paperwork tomorrow after the hearing. Is this an okay plan,
or are we going to have to continue it?
I reviewed my notes, and it looks like something like this has been handled through a probable cause hearing
in the past, but whether or not that is necessary is up to you. I have zero experience with probable cause
hearings for liquor applicants.

Good Afternoon Elvira,
Per our conversation this morning, please see the attached "Permit Application and Report of Changes" form
to register a manager, and the "Individual History Record" form. If you wish to register Jesus as a manager,
both forms will need to be completed, Jesus will need to submit himself to fingerprinting with the Weld County
Sheriff's Office for the purposes of a background check, and he will also need to submit three letters of
character reference.
State Liquor Code
12-47-412. Tavern license.
(4) Each tavern licensee shall manage or have a separate and distinct manager for each licensed premises and
shall register the manager of each licensed premises with both the state and the local licensing authority. No
person shall be a registered manager for more than one tavern license.
(5) The registered manager for each tavern license or the tavern licensee shall purchase alcohol beverages for
one licensed premises only, and the purchases shall be separate and distinct from purchases for any other tavern
license.
(6) When a person ceases to be a registered manager for a tavern license, for whatever reason, the tavern
licensee shall notify the licensing authorities within five days and shall designate a new registered manager within
thirty days.
(7) The state licensing authority or the local licensing authority may refuse to accept any person as a registered
manager unless the person is satisfactory to the respective licensing authorities as to character, record, and
reputation. In determining a registered manager's character, record, and reputation, the state or local licensing
authority may have access to criminal history record information furnished by a criminal justice agency subject to
any restrictions imposed by such agency.
(8) The tavern licensee shall pay a registration fee not to exceed seventy-five dollars for actual and necessary
expenses incurred in determining the character, record, and reputation of each registered manager. Such fee
shall be paid to both the state and the local licensing authority.

202(2)(a)(I)(G), and 12-47-202(2)(a)(I)(J), C.R.S. The purpose of this regulation is to define the difference
between a licensee/owner and a manager and the method of payment to the manager.
A. Each license under the Colorado Liquor or Beer Codes must be held by the owner of the establishment, which
is licensed. "Owner" means the person or persons whose proprietary interest is such that they bear risk of loss
other than as an insurer, and have opportunity to gain profit from operation or sale of the establishment.
In determining who is the "owner", elements considered beside risk of loss and opportunity for profit will include:
Possession, who controls the licensee, who guarantees its debts, who is beneficiary under its insurance policies,
who acknowledges liability for federal, state or local taxes.
B. Owners may hire managers, and managers may be compensated on the basis of profits made, gross or net. In
such cases, (except through an I.R.S. qualified retirement account), the financial interests of the manager(s) must
be reported on the forms prescribed by the Liquor Enforcement Division. The manager may be required to
complete an individual history report and be subject to a background check. A license may not be held in the
name of the manager.
C. A spouse of a licensee may hold a license in their own right if they are the owner of the licensed establishment,
regardless of whether they file separate or joint income tax returns.

D. A partnership interest, limited or general, a joint venture interest, or ownership of a share or shares in a
corporation which is licensed, constitutes ownership.
