To Whom It May Concern;
I am writing this letter in regards to Case # USR16-0029 and should be considered an objection to the
proposed project. My objections are as follows:
1. Since the area in question is zoned agricultural, all activities should be such. Tack sales and
horse show events are not agricultural but business related. As such this project should not be
allowed to proceed unless a re -zoning hearing is set. The site needs to be re -zoned commercial
for the proposed activities and taxed accordingly.
2. Even according to the traffic study commissioned by the applicant, the volume of vehicles will
increase. The report's conclusion of "minimal" impact is a relative term which is open to
opinion as to just what minimal means. Perhaps a better measure would be a percentage
increase in traffic volume. I suggest that would be a measure that is not as opinion driven and
then the individual land owners can decide if that is minimal or not. Another concern is that
these activities have been going on already for some time now and I have recently observed on
at least one occasion cars from the venue in question, exiting using the private access to the
east that is only for residents with approved easement along Rd. 45 coming north from Rd. 22.
This is why a traffic control plan and appropriate enforcement needs to be in place to ensure
people leaving will exit along the canal road rather than taking a more convenient short cut.
3. My suspicion is that the Farmers Ditch Co. who granted the access to the property in question
based on a residential request, is unaware of this change from the original plan. Farmers Ditch
Co. may have an additional charge for the change of use intended. The proposal should not be
allowed to proceed until Farmers Ditch Co. approves the change and all extra fees are collected.
4. As with any public event, alcohol may be carried in. I worry about the resulting behavior from
over drinking and the trash left to accumulate on fences and neighboring properties. An
enforced plan to control these potential problems needs to formulated and approved by county
officials.
5. The sanitation plan is based on a maximum of 2000 gallons/day. That means for a population of
200, each attendee is allowed 10 gallons. A small amount especially if the population exceeds
200. The 2000 gallon maximum is somewhat critical because beyond that amount, different
wastewater regulations apply and discharge permitting becomes necessary. My objection here
is one of monitoring. How will anyone know if the 2000 gallon limit is breached? Is the honor
system supposed to work, or is Weld County going to monitor and act accordingly if the 2000
gallon maximum is exceeded? What is the point of having these limits on legal documents if no
one checks after the plan is approved? There is far too much room for undetected violation.
6. What are the hours of operation? Can there be night events when the noise will be more
noticeable? I object to any disruption of the peace and tranquility that drew some of us here.
In summary, my most strenuous objection is the potential lack of monitoring to insure compliance with
the numbers stated by the applicant. If there is approval granted based on target numbers, then there
must be monitoring to guarantee the applicant stays below those maximums. In this application I
cannot find any monitoring plan involving an independent 3rd party. This is a major flaw with this
proposal and because of it, I object to the plan being approved.
