Thanks, •aryJo Farrell 1 • • • June 28, 2017 To Weld County Commissioners and Planners: I am writing to you to reluctantly support the permit application from Haven Sporting club to offer commercial camping at its Milton Reservoir lease. I would prefer that they not be there at all, for reasons I will enumerate below, but I suppose we need to have them permitted so we have at least SOME hope of regulation over their activities. If you do grant this permit request, please do so with regulations and restrictions in place, and please tell us how you plan to enforce them as they relate to these topics: - -Sanitation - -Density - -Fire prevention and boating safety --Wildlife preservation Do not be swayed by Derek Sowell's glossy video presentation, or rely on any statements he makes, as he has proven time and again that he is pretty flexible with his facts. For example, he originally stated that he wanted to put only 30 campsites in there, and then he changed it to 80, and now he is talking about 150. Also, he swore that we would not see any traffic impact from his club members; we are already seeing more trucks, boats and campers coming through our neighborhood, and we are picking up more trash. Our entryway is clearly marked No Lake Access, but apparently, they don't read. We are also seeing his camping members hauling boats across the dam with ATV's (which is prohibited) and accessing our boat ramp (which is private property.) We also are finding our gate left open to Lake Christina, and suspect people are down there poaching fish. Derek makes it sound like this is just a small impact on Milton Reservoir and surrounding property. Don't be misled by his characterization. On those 150 sites, he proposes allowing two camping trailers per site, and each club member can have up to 20 guests. So now we are looking at 300 camping trailers, and up to 20 people per site, or somewhere around 3000-6000 people on a holiday weekend. This lake is not that big, only about 2000 acres at its fullest, and that number of people and boats will quickly overwhelm it. Derek also says he has sanitation figured out: all the camping and skiing people will use their RV's self-contained holding tanks, and he will put some porta-potties out. Last time I looked, he had only about 8-10 potties down there, and that number clearly does not support the kind of crowds that will pack in there over the July 4th holiday. Also, having been a boater and camper myself for many years, I can tell you that if you have 20 people all using an RV bathroom, that holding tank capacity fills up pretty quickly. The rest of the time, they'll be using the lake and the beach as a bathroom while they ski and swim. The closest pumpout stations are in Hudson and Kersey, and I don't know of any honey wagon service that makes Saturday and Sunday calls in our area. And how is it that they are allowed to use an irrigation reservoir for human contact water sports, anyway? Not many big reservoirs (Lake Dillon, Green Mountain Reservoir) allow swimmers in the drinking and farming water. Milton Reservoir waters food crops downstream, as well as crops for agriculture. Do we really need all that untreated human waste trickling down to the farms below there? For at least 30 years, we have cooperated fully with the Barr Milton Watershed water quality standards and have kept gas powered vessels and humans out of that water. Why this sudden change? Also, we have a fully -stocked catch -and -release fishing pond downstream from Milton (Lake Christina.) What impact will all the human pollution have on our fish? Along with campsites, it is inevitable (especially when you are dealing with the demographic that is most drawn to waterskiing and camping, that is, young males 19-34) that they want to have open fires and shoot off fireworks and firearms. This reservoir is smack in the middle of some of the most arid dryland pasture anywhere. It is quite remote, and straddles two separate fire department jurisdictions. What are their plans for restricting fire -building and fireworks? Haven says they will have supervision on site, but so far, that has not happened. While we are on the topic of safety, how do they plan to regulate the number of boats on the lake at any one time? When there are collisions, drownings, and injuries, what resources are in place for emergency response? And how is it that Haven is already operating this enterprise before the proper permits have been granted? Another of Haven's empty promises was that they would somehow keep boaters away from the pelican and eagle nesting areas on the west side of the lake. We are not seeing any buoys or signs so far; in fact, we have seen boaters or campers running their vessels right up to the edge of the peninsula (actually more of an island at high water) and irritating the nesting pairs and their fledgelings. We have 700 pelicans out there, along with at least three pairs of eagles, and we do not appreciate people coming along to annoy them. If you do grant this permit, please do so with careful consideration of all these concerns. Please place clear restrictions on Haven's ability to operate, as they have not demonstrated their willingness to do so themselves, so far. Thank you for your consideration. Sir, With respect to the Request by Haven, for Commercial camping at Milton Res. The Commissioners should be provided photos of the actual Wildlife. The Haven group during the June 9th presentation, presented photos pertinent to their request, but lacked images of the great amount of Wildlife enjoying the west side of the Reservoir . As a resident of Weld county and a Neighbor to the Reservoir , I feel that the Population of White Pelicans, Bald and Golden eagles , and very numerous other wildlife, deer and birds , will be greatly disturbed if the Haven/ FRICO group are not restricted on the activities which they may and have been engaging in ,on the west side of the Reservoir. The attached are actual photos taken by long range photography in very current past years 2014 & 2015 , at the Reservoir . The volume / numbers of the White Pelican , Herons ( both Blue & White) are quite large and the commissioners should be made aware of the great wildlife treasure that exists and be guarded by employing restrictions which help insure the continued undisturbed nesting and breeding in their current locations. Platteville, CO 80651 970-785-2255 I have been a home owner at Pelican Lake Ranch for 14 years and have loved Milton Reservoir as a destination for birdwatching, canoeing and enjoying nature with my grandchildren. I am glad that others are going to be able to enjoy this wonderful site and want to ensure that there are regulations in place so future generations can do the same. Reckless behavior in the name of sports entertainment can ruin what has taken nature years to develop. Every precaution must be taken to be certain that this doesn't happen. Following are my concerns: 1. Supervision. With the proposed 150 campsites, easily 750 campers and guests could be onsite enjoying the campsites, lake and hunting privileges at any one time. These numbers necessitate supervision to oversee all "Club" activities. Signs and regulations mean nothing if no one is in charge. It has been noted in meetings with Haven prior to the June 6th hearing that supervision would be provided 24/7. At the June 6th meeting Haven changed their position to say that there would be no supervision whatsoever. This is not acceptable as neighbors adjacent to Haven property cannot bear the responsibility of watching and documenting infractions that may alter this precious preserve. • Haven must designate an Onsite Club Manager to be available to club members to keep problems in check and, additional staff on holidays and weekends when more campers are present. 2. Fire. In the time I have lived here, several fierce and frightening fires have occurred. A simple spark from an oil truck ignited cheat grass behind my home. The fire department arrived in good time and extinguished it. My husband and I then left to run errands and upon our return learned the entire hill had reignited and neighbors and fire departments worked together to put the fire out. Fortunately, the wind worked in their favor and no homes were damaged. The danger of fire is heightened with the high density of campers, visitors and boaters that will be permitted to be onsite at any one time. Therefore, safety must be addressed with: • Regulations regarding campfires and fireworks. • Fire hydrants and provisions for fires. • Instructions on what to do and how to evacuate if there is a fire. 3. Birdlife and Wildlife. Milton Reservoir is a sanctuary teeming with bird and wildlife. It is imperative that these areas will be preserved for future generations. Seldom do you find such a pelican rookery. Milton is the nesting site of pelicans, eagles, great blue heron, cormorants, great horned owls and many other species. I have encountered as many as 28 deer at one time along the shoreline. • Regulations designating where boating is not allowed. • Boating speed limits for specific areas. • Buoys to define areas to not trespass. • Signs depicting Preserve areas. • Frequent patrolling and supervision required. 4. Lake Christina & Surrounds. The Beebe Draw Authority Board and POA have spent considerable time and money to develop the amenities for the Pelican Lake Ranch community. The fishing lake, trails, picnic areas, equestrian arena and jumps and restrooms are to be enjoyed solely by our families and guests. • These areas are off-limits to Haven Sporting Club members. • All hunting and target shooting on Haven property must be directed away from PLR property. Limit weapon types to Shotgun only where all discharges are at least 300 yards from PLR property. • Hunting and target practice of any kind is strictly not allowed on or toward PLR property. 5. Health & Safety. For the 14 years I have lived here, there has been regular checking of the water quality of Milton Reservoir. It has been regularly deemed unsafe for swimming. With algae blooms, agriculture run-off and at times, botulism, swimming should continue to be discouraged. • Monitor water quality frequently -- especially in late summer when the lake's water level is low. • Provide notice to campers and boaters of water and weather conditions, so their safety is not compromised. • Provide potable water and restroom facilities specified to the optimum number of campers. • Provide varmint resistant trash containers and regular trash pick-up. 6. Landscape. Campers are paying a generous fee for the use of Milton Reservoir for their pleasure. Camping spots should be welcoming, attractive and clean. • Provide plantings and boulders to visually divide spaces and provide shade and privacy. • Construct campfire sites for functionality and safety. That environment would suffer significant damage. See Environmental Impact Study done in 1997 for details. "No wake" boats with 5-10 HP motors and minimum human activity was recommended. 2) 150 camping spots pose a serious threat for wildfire. The county does not have the resources/emergency responders to prevent and/or control this threat. Overnight camping, by its nature, will increase risk of fire and other potentially dangerous outcomes. Do Weld County emergency responders have the ability to quickly and effectively react to and manage emergencies that are CERTAIN to occur? There have been multiple wildfires in the county in recent years, and as we saw early this spring in northeaster Colorado, suck,fires have devastating effects on agricultural lands, local communities, and local economies. That argument can be made easily and strongly, especially as volunteer firefighting agencies would be responsible. 3) Oil and gas activity, multiple wells, and a spider web of pipelines multiply the danger. 4) The promoters of Haven Sporting Club have demonstrated questionable business practices and a total disregard for adjacent landowners. We have had issues with cattle owned by a sub lessee that posed a real threat to our operation. 5) 150 campers will produce human waste and trash which cannot be safely and properly disposed. This will create issues for adjacent landowners and for irrigators using the water. 150 campers is almost 2 times the number of houses in Pelican Lakes Subdivision. 6) 150 campers pose a threat to county roads due to increased traffic and an increased expense to the county with no commensurate increase in revenue. 7) There is a risk of trespassers, ATVs and dirt bikes to adjoining landowners. 8) Milton Reservoir is an irrigation compound primarily being used to store water for agriculture and municipalities. The lake is regularly drained down to low water levels and occasionally emptied for dam maintenance. Pollutants are multiplied to unsafe levels during low water levels. 9) This club seems to have a sense of entitlement. It's important to remember the lake's primary mission is to serve a part of a water -management and delivery system for Fron-t Range agriculture and communities. Limited fishing and boating are logical secondary uses, but construction and use of an overnight camping facility require a much higher level or public oversight, response preparedness, and associated cost. Such construction and use might not make sense, given that the expense would amount to a special accommodati on for a single group of private owners. The county will need to spend more money maintaining County Road 47. County Road 47 is not presently suitable for the high traffic of vehicles pulling big campers and boats. Plus there will be the increased cost of public oversight, emergency response preparedness and wildfire mitigation with no commensurate increase in revenue to the county. 10) Our most significant objection is that the surrounding land is a strong productive agricultural area which has a significant positive effect on Weld County and Colorado economics. These operations could be hampered and negatively impacted by a large commercial camp ground and boating, hunting, shooting club. The negative economic impact to nearby farms, ranches, dairies and feed lots will not be offset by an increased tax base or spending in Weld County since that is projected to be insignificant. I would like to see regulations put in place to protect the wildlife in the area. Under the stewardship of the previous leaseholder, Milton Reservoir is now the home of one of the largest white pelican rookeries in the area. It also is home to bald eagles, deer, owls and other wildlife. Colorado Parks and Wildlife has restrictions on human encroachment, and I would like to see these upheld. At least part of the lake and shoreline should be dedicated to wildlife and not open to recreational use. Perhaps buoys could be placed in the lake to indicate the boundary and surveillance put in place to restrict boats in the nesting areas. Surveillance or other barriers should also be put in place to protect the property of neighbors to Milton Reservoir. Any member of Haven Watersports that does not uphold these restrictions should lose their memberships, and be fined under existing laws for disturbing nesting sites and trespassing. It may be, given the wildlife protections, that 150 campsites is an excessive number of campsites. Currently there are 70 campsites in operation. I would like to see the number of campsites limited to the 70 sites, at least until we can determine the effects of the operation. Having campers at 150 campsites will also impact public safety since there are limited emergency service capabilities in the area, not to mention the traffic on County Roads. Our east and north fence lines are the dividing line between our property and the property owned by FRICO. The application is for commercial camping facilities on the east side of Milton Reservoir. My concern is primarily the hunting aspect of the recreational area which apparently will be a part of the facility. Fall hunting preparations have already begun, with the strip mowing of property on the southwest side of the reservoir. This area is against our east fence on the south side of our property. Access to this hunting area will be at the corner of WCR 32 and WCR 43, which is against our north fence line. Currently this gate is accessed by Anadarko Petroleum for tank maintenance and pumping. Additional traffic through this gate for hunting purposes will create hardship, as the fence is maintained by our family. Careless and additional traffic on the sandy road against our fence will further destroy the fragile native grass, leading to wind erosion of the soil, costlier and more frequent fence repairs. The existing road is just a track, very close to the fence line, which is a livestock pasture. Prevailing north wind means that the fence can have tumbleweeds, and one careless cigarette or spark from an engine along this fence would have devastating results on dry fall grassland, with fire racing straight toward two houses. The possibilities of potential problems associated with hunting this close to livestock are endless. The most obvious is livestock injury or death by careless hunters. Other considerations are trespassing onto private property for bird retrieval, hunting dogs mixing with our livestock, fire, trash, and additional fence repair. As Weld County is a right to farm county, agricultural users should not be expected to change their long-established practices to accommodate intrusions of urban users. We shouldn't have to move our livestock away from the proposed hunting area for safety, but I'm not convinced that Haven would enforce intelligent, safe hunting practices as evidenced by the attached article regarding one of the partners of Waterfowl Haven Outfitters, associated with Haven Sporting Club, LLC. Would you want this kind of irresponsible, dangerous hunting against your property? The parcel of property that has been strip mowed for fall hunting has well tank batteries in virtually every direction, 2 houses northwest, one house southeast — all within several hundred yards of the planned fall hunting area. Please study these factors when considering the above application. I request that there be no hunting around Milton Reservoir, not only for the safety of the livestock and property, but for migratory and nesting birds who have called Milton Reservoir their home for generations. He faces two counts of felony menacing, along with prison time if found guilty. Arnold was arrested May 7 on suspicion of those charges, and his bond was set at $15,000 the next day. That same day, he bonded out of jail, which usually requires a payment of about 10 percent of the set amount. The charges Arnold face stem from April 22 and 23 incidents. According to the affidavit, Kevin Dunnigan owns the property neighboring Arnold's land, just outside of Kersey on Weld County Road 388, and often let Arnold use it for guided hunting trips Trouble started when the Dunnigans and their friends began to hunt in the area, the affidavit stated. Arnold would "harass" them, according to the report. On April 22, two of the Dunnigans' family friends claimed Arnold appeared and began yelling at them and firing guns. When Dunnigan's son, Taylor Dunnigan, took a friend out hunting for turkey the next day, he warned his friend Arnold might cause trouble. As a 4`h generation Weld County rancher, raising the 5`h generation, this permit carries a lot of heavy concern for land owners surrounding Milton Reservoir. Unfortunately, due to the situation, we regretfully approve the use of commercial camping so restrictions can be put in place, protecting surrounding land owners. We DO NOT want this to become a day -use situation. As previously mentioned, commercial camping carries a lot of concern. One of the largest concerns we have concerns wildfires. Our pastures are on the southwest side of the reservoir. While that is not on the side that camping will be taking place, the concern is for the north prevailing winds that kick up out of nowhere, day or night. The Haven folks have said that campers are required to have a 5 gallon bucket of water next to their firepits, but with no one on staff, how can anyone know that those rules are being carried forward by their campers? If a fire is to breakout, and winds to gust like they tend to do, a fire will be on top of our land in a short amount of time. Not only will there be a loss of grazing lands, but a loss of livestock, housing, barns, shops, and in the worst scenario, human life. Ranchers are not known to let others fight for them, so you have to understand that we'd be out there fighting the fires, risking our own lives to save livestock, buildings, our livelihood. Another concern we have are activities that go with commercial camping. The planning commissioners put a restriction on the use of ATV's, which we greatly appreciated! This will help to keep trespassing down because it will be harder for them to "wander" past their campsites. One other restriction I'd love to see imposed is no not allow any kind of hunting. The places where Haven has mentioned that hunting would take place is on our side of Milton, next to our fence line. This poses a number of hazardous situations. First is the concern of his guide, which also happens to be his brother in law. He has been arrested for firing upon other hunters across a fence line (see article). With our fences being the border between where they'd be hunting and our land, it greatly concerns me to have someone like this in charge of the hunting permit. We check our fence lines often and ride out through the cows to check their health. I don't want to be afraid to check my own livestock for the fear of being shot at. Additionally, if they are hunting and they drop a bird onto our land, they have to trespass to get that bird. Furthermore, how do we make sure they are not shooting toward our land and our livestock? There's just too many variables for this to make any sense to grant them permission to do. During the planning commission hearing Derek Sowell, Haven Watersports, also made a passing comment about allowing tent camping on the southwest side of the reservoir. Nowhere in their permit paperwork does it say anything having to do with tent camping in a different area of the reservoir. The permit paperwork talks about RV camping on the east side. I'd love to see a restriction put on them to make sure this does not happen and that the only camping will be on the east side. Above and beyond I'd also like to voice concern for the lack of responsibility that Haven has taken on when it comes to their "guests." In all of the original documents they said that there would be a time staff member on grounds at all times to make sure their codes and rules were being met. Somewhere along the way they abandoned that though, and there is no longer a staff person on premises. So, there lies a lot of questions: how do they ensure that fires are kept in the firepits; how do we know that a bucket of water is next to said fires; how are they keeping boat speeds to the appropriate speed; how are they ensuring that boats are staying away from wildlife areas; how are they making sure that trash is picked up; how are they ensuring that there are enough portable toilets for the number of campers (if each spot can have up to 20 people, Haven representatives have said they will have 1 portable toilet per every 4 occupied campsites -that's 80 people for 1 toilet! See Utilities document); how are they ensuring that campers are staying where they're supposed to; who has access to a landline (there is very limited cell phone signal out there) in case of an emergency? The folks at Haven seem to have a problem with restrictions and authority and feel that they make the rules. As landowners we have caught them in a number of lies just to get what they want. They show videos that make it look like our part of the county is a wasteland and that they have the only beautiful piece of property. As you drive out in your respective districts, you know how valuable the land in Weld County is, and know that as agriculturalists, we make sure the land is in better shape than when we purchased it or when it was handed down to us. It's up to us to make sure our lands are fertile and beautiful to hand down to the next generation. Don't be fooled by the ridiculous video you'll be shown. In closing, we regretfully approve the commercial camping permit, but with restrictions placed on it to ensure that our lands around this area will be safe and protected. • Please limit the number of not only campers/RV's, but the actual number of guests that can be at the reservoir (if you read their numbers and multiply it out, there would be in the upwards of more than 1000 people on any given weekend if the spaces are filled and they bring their maximum number of guests). • Please require that there be an on -duty staff member there at all times, day and night to make sure that all guidelines and restrictions are being followed. • Please do not allow tent camping or camping of any kind on the south and southwest sides. • Please continue to enforce the restricted use of AN use. • Please include a restriction on hunting. I understand that's a different permit, but as a safety mechanism for both livestock and humans, I think it would be justified putting in this restriction. Thank you for your time and consideration. Milton Reservoir has rare and interesting nesting birds, making it a unique and very important breeding bird site in Colorado: • Two pairs of Bald Eagles nest on the north and west central parts of the reservoir. This species is a Species of Greatest Conservation Need in Colorado and listed as State Imperiled. • Up to 300 pairs of American White Pelicans nest on Crazy Horse Point and Rookery Point, on the west side of the reservoir. This is one of just two currently active nesting pelican colonies in all of Colorado. This species also is a Species of Greatest Conservation Need and State Imperiled. • Up to six other waterbird species nest in the pelican colony, including herons, egrets, and cormorants. No other wetland in Colorado has this unique combination of nesting species. At Bird Conservancy, we work to conserve birds and their habitats through science, education and land stewardship. Since 1988, we have been tracking Bald Eagle nests in Colorado through our Bald Eagle Watch program and waterbird breeding colonies through our Colony Watch program. At Milton Reservoir, our primary concern is the protection of the nesting birds. lf the nesting birds are disturbed by the presence of humans or excessive noise and commotion, they can experience lower nesting success or entirely vacate the area. White pelicans in particular have an extreme reaction to disturbance, with the entire colony being abandoned, even if they have chicks to feed. Just one disturbance could cause all of the nests to fail. The birds at Milton are not used to a lot of human activity and noise near their nests and there is no guarantee that they will habituate to new activity. To protect the nesting birds and ensure they continue to nest at Milton Reservoir over the long-term, we recommend that a protective buffer zone is established around the eagle nests and waterbird colonies. No people should enter the zone during the breeding season (February 15 — September 1), either from land or water. No scientific research has been done to establish the appropriate size of the buffer zone for this group of species in this type of wetland. Therefore, we support the general guidelines of 1/2 mile protection around the eagle nests (as recommended by Colorado Parks and Wildlife) and 300 yards around the waterbird colonies (as recommended by Environment Canada in their Guidelines to Avoid Disturbance at Waterbird Colonies). In order for the buffer zone to be effective, we recommend a written plan for establishing and enforcing the protection zone. I was invited to view Haven's campsites this summer. I have to admit that they have cleaned up the area for their campers on the east side of the lake. They had plenty of trash bins, and port pots. Trash was one of my concerns. Another concern, was the fire pits. In which they did have designated fire pits. Will Haven keep this in place if they get permitted? Please make this a regulation that they have to have adequate trash bins, plenty of port pots, and rings around their fire pits. Fire is a real concern out here on the dry lands. But a question did come in mind, seeing all the campers in the area. How could they be doing this when they are not even permitted yet? This is my 3"' response concerning the 150 campsites. I don't know how many people that they are allowing per campsite. But with 4 people per campsite, that will be 600 people. The campsites arc side by side. I can't help but think that it is all about the money for Farmers Resoirvoir Company along with Haven Sporting Club. It is about cramming as many people into an area as possible to fulfill their desire to have a successful sporting club, and to fulfill their obligation to F.R.I.C.O. , in spite of how uncomfortable it may be for the people that has lived in this area for most of their lives. We have all worked hard to be able to live out here, and to live out here is hard work. Please let them try and handle what they have set up now. Seine of the people on the east side seem to not mind all the traffic and noise. But for the people on the south and west side, they do not want it. I want to fill safe at my home. Please don't let them have 150 campsites. That is too many people in one area without supervision. I have seen less and less. Wildlife and people do not mix. If you have seen wildlife once in an area and they have seen you, they will probably not seen again. Because of the population of people wanting to get out to the country, the wildlife have very few areas that they stay in. We need to reserve places for them to go or they will diminish. Haven cleaned up the area on the west side of Milton Reservior. In a way they cleaned it up too good. They have mined a lot of the habitat for various wildlife and waterfowl. I hope that they are not thinking about doing the same thing on the east side. Save the east side for the wildlife and the waterfowl. Less work, more wildlife and more waterfowl. I think that this is not about giving people another place to get out of town. I can't help but think that it is all about the money for Farmers Resoirvoir Company along with Haven Sporting Club. It is about cramming as many people into an area as possible to fulfill their desire to have a successful sporting club, and to fulfill their obligation to F.R.I.C.O. , in spite of how uncomfortable it may be for the people that has lived in this area for most of their lives. We have all worked hard to be able to live out here, and to live out here is hard work. Please let them try and handle what they have set up now. Some of the people on the cast side seem to not mind all the traffic and noise. But for the people on the south and west side, do not want it. I want to fill safe at my home. If I wanted a neighbor, I would have moved in to town a long time ago. Please don't let them have 150 campsites. That is too many people in one area without supervision. I would assume that Haven is going to have hunting that they will charge a fee for, plus what they are charging the campers. They will be profiting from both, hunting and camping. How much is enough and how much is too much? In fact my Grandfather, with his horses, helped build the Milton dam. I am also a shareholder in FRICO (Farmers Reservoir and Irrigation Co) who leased use to Haven Sporting Club. I have serious concerns about the impact of this proposal on the physical and cultural environment of the surrounding community AND on the very significant wild life and bird habitat that now surrounds Milton Reservoir. I hope you will give serious consideration to limiting the size and impact of this 'Sporting Club' proposal, which in its very intrusive proposed scope, as far as I know, is unanimously opposed by residents of the surrounding community. AND if the camping and waterskiing activity of this proposal is not limited to the east shore and east half of the lake, serious harm will be done to the bird and wildlife habitats that are primarily along the west shore of the lake. I am also concerned about the ethics and integrity of the project as one of the two persons preparing this 'Sporting Club' proposal was recently arrested by local law enforcement for alleged improper use (firing) of guns in a hunting turf dispute with his neighbors. (see Greeley Tribune, May10, 2017, "Hunting store owner faces felony menacing charges after officers say he fired on hunters" and July 10, 2017, "Court date pushed back in case of Greeley hunting store owner accused of firing on hunters and yelling racial slurs" Without a permit, the applicant has already started developing proposed campsites. This arrogance and disregard for required due process should also call into question the good will and integrity of the applicant. For the good of the wild life in this area, for the relative quiet for the neighborhood, and for asking new neighbors to respect the rule of law I'd like to see this application denied in its entirety. Short of that, I'd like to see: 1) Camp sites be limited to 1/2 the number proposed (75 or less of the 150 proposed) 2) That no camping of any kind (short term or 'commercial' (long term))or other recreational use be allowed on the west, south or north sides of the reservoir, ie, only allowed on the very east side. 3) That no boating with larger than fishing trolling motors be allowed within 1/4 to 1/2 mile of the west side of the lake where the concentration of important wild life exists. A method to enforce and monitor this restriction must be developed by the applicant and reviewed by the County. 4) If any part of the permit is approved, that the County insure and monitor necessary safety (fire department availability and access) and adequate hygiene (toilet) facilities and trash control. 5) To properly monitor and provide services, including adequate access roads, the taxpayers of Weld County will likely incur significant expense. In doing so, I can undoubtedly say that this past summer I have not witnessed any changes within the contents of Milton Reservoir in conjunction of Algae, or other water habits or contaminations, from this year in comparison to years past. Could this be attributed to activity on the water or could this be attributed to the current year's weather and other things — I cannot attest. But to my observation of the lake over the past 13 years I can assuredly say that I see no difference at this time. In the 13 years of my residence here, my family and I have enjoyed the peacefulness and beauty of living across from Milton Reservoir. It is one reason that my wife and I chose to have our wedding in our front yard! Many a time we have encountered seeing deer, hawks, wild turkey, pheasant, raccoons, and beavers in and around the vicinity of the lake at any given time throughout the changing seasons. And when discussion began of having Milton Reservoir turned into an active recreational boating facility it was certain that our time of peaceful country living was about to come to an abrupt halt. However, I couldn't have been more wrong. As a matter of fact, a deer was eating out of our bird feeder in the front yard just three weeks ago! It was the first time of ever finding a deer in our actual front yard! As the first summer of active boating is coming to an end, I can without doubt say that the impact or disruption to the area has been minimal if not obsolete. The current members of the Sporting Club have been gracious and noninvasive of our quiet country living. Although traffic has increased on the county road, the culprits of speeding and stirring up dust comes from the local kids in the area (and even the school bus drivers!) rather than from the Sporting Club members. The county maintenance road grading has not been past my house any more, nor any less, than when the Oil & Gas industry boom occurred four years ago. My wife and I still sit on the deck and enjoy the evening weather, but now we do so with something more than just the birds to watch — the boaters that dot Milton Reservoir. It would be within the best interest of Weld County to approve the boating requests of Haven Sporting Club. That environment would suffer significant damage. See Environmental Impact Study done in 1997 for details. "No wake" boats with 5-10 HP motors and minimum human activity was recommended. 2) 150 camping spots pose a serious threat for wildfire. The county does not have the resources/emergency responders to prevent and/or control this threat. Overnight camping, by its nature, will increase risk of fire and other potentially dangerous outcomes. Do Weld County emergency responders have the ability to quickly and effectively react to and manage emergencies that are CERTAIN to occur? There have been multiple wildfires in the county in recent years, and as we saw early this spring in northeaster Colorado, suck fires have devastating effects on agricultural lands, local communities, and local economies. That argument can be made easily and strongly, especially as volunteer firefighting agencies would be responsible. 3) Oil and gas activity, multiple wells, and a spider web of pipelines multiply the danger. 4) The promoters of Haven Sporting Club have demonstrated questionable business practices and a total disregard for adjacent landowners. We have had issues with cattle owned by a sub lessee that posed a real threat to our operation. 5) 150 campers will produce human waste and trash which cannot be safely and properly disposed. This will create issues for adjacent landowners and for irrigators using the water. 150 campers is almost 2 times the number of houses in Pelican Lakes Subdivision. 6) 150 campers pose a threat to county roads due to increased traffic and an increased expense to the county with no commensurate increase in revenue. 7) There is a risk of trespassers, ATVs and dirt bikes to adjoining landowners. 8) Milton Reservoir is an irrigation compound primarily being used to store water for agriculture and municipalities. The lake is regularly drained down to low water levels and occasionally emptied for dam maintenance. Pollutants are multiplied to unsafe levels during low water levels. 9) This club seems to have a sense of entitlement. It's important to remember the lake's primary mission is to serve a part of a water -management and delivery system for Front Range agriculture and communities. Limited fishing and boating are logical secondary uses, but construction and use of an overnight camping facility require a much higher level or public oversight, response preparedness, and associated cost. Such construction and use might not make sense, given that the expense would amount to a special accommodation for a single group of private owners. The county will need to spend more money maintaining County Road 47. County Road 47 is not presently suitable for the high traffic of vehicles pulling big campers and boats. Plus there will be the increased cost of public oversight, emergency response preparedness and wildfire mitigation with no commensurate increase in revenue to the county. 1O) Our most significant objection is that the surrounding land is a strong productive agricultural area which has a significant positive effect on Weld County and Colorado economics. These operations could be hampered and negatively impacted by a large commercial camp ground and boating, hunting, shooting club. The negative economic impact to nearby farms, ranches, dairies and feed lots will not be offset by an increased tax base or spending in Weld County since that is projected to be insignificant. Conditions of Approval and Development Standards requiring —require the applicant to attempt to address the recommendations of Colorado Parks and Wildlife outlining setbacks from -active breeding pairs-(Bald-ag4es. Red -Tailed Hawks and Pelicans)and coordinate with them on an annual basis have been included. B. Section 23-2-230.B.2 -- The proposed use is consistent with the intent of the A (Agricultural) Zone District. Section 23-3-40.C.7 allows Recreational facilities and Uses including public or commercial camping (150 seasonal camping sites) as a Use by Special Review in the A (Agricultural) Zone District. C. Section 23-2-230.B.3 -- The uses which will be permitted will be compatible with the existing surrounding land uses. Additionally- two-(2)--letter-s• of support have been received These -letters have expressed -support for: 1) Applicant's efforts to remove trash and debris around -the—fake, providing ---recreational—opportunities; 2) Providing recreational opportunities for property owners near the reservoir (along with 2017-2125 PL2481 SPECIAL REVIEW PERMIT (USR17-0012) - FARMERS RESERVOIR AND IRRIGATION COMPANY. C/O HAVEN SPORTING CLUB PAGE 4 others); 3) Boats on the water will increase turbulence and improve water quality; 4) The -improvements on the property will assist -with rodent control for surrounding farmers and property owners. Various letters and testimony, both in support of and in opposition to the proposal, have been received. The applicant has a number of regulations that members using the site must adhere to (including restricting fires to designated fire pits. regulating speed of boats on the lake. etc.)_ Several Conditions of Approval and Development Standards are proposed to address impacts to wildlife. -Camping setbacks from breeding pairs of Eagles, Red-tailed Hawks and Pelicans (in the event that this situation occurs) address -the recommendations of Colorado Parks -and Wildlife- as stated in -the -referral response dated. Apr# -20. 2017. The applicant has submitted a revised Access Permit limiting the number of accesses to one (1) access point on the west side of the lake (off of County Road 32 right-of-way) and two (2) access points on the east side of the lake. These access points do not directly border County Road 47. A Condition of Approval is attached requiring the applicant to provide proof of legal access off of Courty Road 47 as a Condition of Approval of this application prior to recording the USR map. Section 23-2-230 B.4 -- The uses which will be permitted will be compatible with future development of the surrounding area. as permitted by the existing zoning, and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The proposed USR site is not located within the three (3) mile referral area of any municipality. nor within the boundaries of an existing Cooperative Planning Agreement area. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act. Section 30-20-100.5 C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 111. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act. Section 30-20-100.5. C.R.S. 4-812. Waste materials shall be handled. stored. and disposed of in a manner that controls fugitive dust, fugitive particulate emissions. blowing debris. and other potential nuisance conditions. The facility shall operate in accordance with Chapter 14, Article I. of the Weld County Code. 4413. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's Air Quality Regulations. 4514. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone District, with the exception of the hours between 10:00 p.m. and 7:00 a.m., which shall be subject to the noise levels allowed in the Residential Zone District. as delineated in Section 25-12-103. C.R.S. 1615. Adequate drinking. handwashing and toilet facilities shall be provided for employees of the facility. at all times. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On -site Waste Water Treatment Systems. 1716. In the event the facility installs a water system and that water system serves more 25 persons on a daily basis, the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). 1817. For ten (10) or less customers or visitors per day, two (2) or less full time employees on site. or temporary use (under 6 months a year) portable toilets and bottled water are acceptable. We are proactive • We leased Milton Reservoir in February 2017 • 3 Months Before our Lease � November 10/ 2016 we met with Weld County Planning staff to discuss our plans. � November, 2016/ we met with the representatives of Pelican Lake Ranch to offer inclusion in our plans since they lost the lease. � We applied for a permit even though many Waterski Clubs are operating in Weld County with the same type of commercial camping without a USR. We care about our neighbors � We met with the previous lessors in November, January, February and March. � We went door to door shaking hands and introducing ourselves to our neighbors. � We sent letters to our neighbors. � We hosted a community meeting and invited all our neighbors. We care about safety � Our members are subject to a contract consisting of 7,100 words of rules and regulations designed to protect the safety of our members and neighbors. • We don't allow fire works. • All fires have to be in regulated fire pits, they must be monitors, and two five gallon bucks of water have to be readily available. • And countless other rules and regulations to address safety, noise, water safety and much others. These Rules Work — We Have ZERO Incidents We are supporting first responders � We have been working directly with Platteville FD and La Salle FD. • We are working with the local first responders to help them organize a massive 10 department exercise at Milton Reservoir. That is one round trip per member per month. � Our members don't drink and drive because they are allowed to sleep in their 5th wheel overnight. � Our members follow the rules because they are highly vetted and are subject to lose a large membership fee if they violate our rules. � We have terminated 4 members already for violating rules. Denial of this USR will result in more traffic and less safety. I Without this USR, we will have to pivot to a day use operation. � Traffic will increase because there will be one round trip per day for each visitor. � Without overnight camping, it will be more difficult to limit our membership to highly vetted members who follow all our rules and regulations. � Anyone who chooses to drink alcohol will be force to drive home instead of spending the night. Approval of this USR is good for Weld Count and the Neighbors � We have improved and are continuously improving this forgotten reservoir in Weld County to be the best reservoir in the state. � We are bringing new economic development outside the oil and gas industry that dominates the area. � We believe in service, servant leadership and we are a positive addition to the community. � This USR will result in less traffic/ less noise and improved safety for the surrounding landowners.
