Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Frank Haug Planning Services Department representative, Chris Gathman Public Works Department representative, Evan Pinkham Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated September 29, 2017, and duly published October 4, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of the Sharon McDonald Trust, do David Goracke, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0039, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (outdoor Recreational Vehicle storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Frank Haug, Assistant County Attorney, made this a matter of record. w_= Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated the applicant's intent for outdoor Recreational Vehicle storage on approximately 14.5 acres of a 35 -acre parcel. He described the storage site will be implemented in two (2) phases with Phase One developing the first 8.4 acres and Phase 2 developing the remaining 6.1 acres and that at full buildout the site will allow for 300 vehicles. Mr. Gathman reviewed the hours of operation, number of employees, and screening plan, and clarified there is a Recorded Exemption, RE17-0105, in conjunction with this USR application. He explained the site development is set back from the main road and he described the surrounding property uses. He stated the site is located within the three (3) mile referral area of the Towns of Frederick, Firestone, Erie and the City of Dacono, and is within the Intergovernmental Agreement and Cooperative Planning Agreement boundary for the Town of Frederick. He stated the Town of Frederick provided an email for the record stating the proposal had been discussed and the Town was foregoing the requirement for annexation, as RV and Boat Storage Facilities are not allowed in the Town limits of Frederick. However, the Town requested the access onto Tipple Parkway be paved to reduce mud and dirt tracking and, furthermore, they requested the right to require turn lanes to and from the site if the need arises. Mr. Gathman explained the applicant signed an agreement with the Town of Frederick regarding turn lanes and it is part of the record. He stated a total of 14 referrals were sent out and 13 were received and have been addressed in consideration of Conditions and Development Standards. He displayed photos and entered the favorable recommendation of the Planning Commission into the record as written. In response to Mr. Haug, Mr. Gathman stated the Recorded Exemption has already been approved and he will correct the legal description to reflect: Lot B of Recorded Exemption, RECX17-0105. 11 Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements to work with the Town of Frederick for the Access Permit. Hayley Balzano, Planning Services Engineer representative, presented the drainage and grading requirements and stated the applicant submitted a preliminary drainage report and a final drainage report and detention pond design is required prior to recording the USR map. She further reviewed the Conditions of Approval and Development Standards relevant to engineering. A� = Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and stated the use of a portable toilet is acceptable and the application indicates the applicant will provide a portable toilet by the office site. She reported the application also indicated the applicant may add a residence for an on -site manager and, if so, the existing septic system will need to be reviewed. She stipulated the requirement for a permit if an RV Dump Station is added and clarified there will be no washing of vehicles on -site. Ms. Light reported the noise is limited to Commercial levels and she stated Development Standards (DS) #11-20 address typical Environmental Health items. David Goracke, applicant, stated he retired after 20 years of being a police officer and then opened his own business fixing RVs and boats, sold the business, met Sharon McDonald and considers her like a mother. He explained the application for the USR as an investment to make money and to be available to care for his granddaughter. Mr. Goracke stated he would live in the on -site residence, on Lot B, when it is built and he cited the benefits of the location and his experience in both law enforcement and his prior business and how it works for all involved. Ell Zack Santen, Town of Frederick Planning Department, reviewed the reasons for the requests regarding paving and turn lanes. In response to Commissioner Kirkmeyer, he clarified RV and Boat Storage facilities are allowed in Town limits; however, the number allowed has been reached based on space requirements and adjacent uses. 2017-3853 PL0842 HEARING CERTIFICATION - SHARON MCDONALD TRUST, C/O DAVID GORACKE (USR17-0039) PAGE 3 Matt LeCerf, Town Manager of Frederick, clarified the accesses from similar facilities are paved and he reviewed the annexation regulations and stated the communication has been positive with the applicant. In response to Commissioner Conway, he agreed that if this location were annexed, the Use would be allowed to remain. In response to Commissioner Conway, Mr. Goracke stated he would appreciate increasing the number of employees to five (5) full-time and one (1) part-time employee. Ms. Light clarified the septic requirements. In response to Commissioner Freeman, Commissioner Kirkmeyer suggested amending the hours of operation to 24 hours a day, seven (7) days a week. The Board agreed to the aforementioned changes. Mr. Gathman interjected there is an existing hangar building for some indoor storage and an office and the applicant would need a Change of Use Permit. Chair Cozad suggested a new Condition of Approval (COA) #1.H to read, "The applicant shall apply for a building permit to change the use of the existing hangar building." Chair Cozad reviewed the changes for the applicant. In response to Chair Cozad, Mr. Goracke indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. Eli Commissioner Moreno moved to approve the request of the Sharon McDonald Trust, c/o David Goracke, for a Site Specific Development Plan and Use by Special Review Permit, USR17- 0039, for any Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (outdoor Recreational Vehicle storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended, and entered into the record. The motion was seconded by Commissioner Conway. Commissioner Kirkmeyer provided her reasons for supporting the application. Commissioner Conway agreed with her comments.
