BOX 758 GREELEY, COLORADO 80632 May 16, 2017 To: All Weld County School District Superintendents As we advised all Weld County school districts last year, in accordance with Title III of the Bankhead-Jones Farm Tenant Act (7 U.S.C. 1012), the USDA Forest Service is required to make payments to counties for receipts from USDA Forest Service land from grazing fees and mineral receipts. For the first time in 2016, Weld County received funds from oil and gas extraction payments from the Pawnee Grasslands located in Weld County. In 2009, House Bill 09-1250 was passed that created a new methodology to allocate the funds received from the Forest Service. Under the new allocation methodology, 25% of the funds must be used for county roads and bridges and 25% must be allocated to the schools in the county. The other 50% is to be allocated between the two purposes at the direction of a committee of three County Commissioners and three school district representatives. As promised last year, Weld County has worked with the US Forestry Service to get the Bankhead Jones Farm Tenant Act allocation amount in April so Weld County school districts will know their allocation amounts for their 2017-2018 budgets. As anticipated, due to the drop in oil prices and lower production in the Pawnee Grasslands, the amount is substantially lower than the 2016 amount of $7,307,170.16. The amount for 2017 is $1,553,307.06, which is still a significant amount of money compared to past years. In 2016, the mechanism and agreements with all Weld Schools Districts to allocate the funds were put in place in accordance with HB 09-1250. The Superintendents from RE -5J, RE -9, and RE -12 were selected by all Weld County School Districts for the ongoing committee to work with the Weld County Commissioners to develop an allocation formula. It was the intent that the formula developed would be the ongoing formula for the allocation process, which worked well last year. I have attached last year's resolution of the committee allocating the funds. The attached resolution calls for a meeting to review the formula and approve the allocation amount each year. On Monday, May 15, 2017, at 4:00 p.m., the committee met and approved the attached 2017 worksheets showing the amounts to be allocated to the respective Weld County school districts for 2017. Per state law, the funds are to be distributed no later than September of each year. We would plan on distributing them in early July after we receive the funds from the US Forestry Service.
