CIVIL RES`DURCES,LU ENGINEERS & PLANNERS October 18, 2017 Mr. Eric Scott Division of Reclamation, Mines, and Safety 1313 Sherman Street, Room 215 Denver, Colorado 80203 RE: La Poudre Amendment, Permit No. M-1983-090; Response to Preliminary Review Dear Mr. Scott: This letter is being generated to satisfy the adequacy review dated September 19, 2017 for the La Poudre Amendment. The italicized items are the current comment and the bold text are the responses: Rule 6.2 - General Requirements of Exhibits: 6.2.1(2) Maps and Exhibits Maps, except the index map, must conform to the following criteria. (a) show name of Applicant; - Applicant name is on all sheets. (b) must be prepared and signed by a registered land surveyor, professional engineer, or other qualified person; - The maps were prepared by a qualified person. (c) give date prepared; - The required dates are on all sheets. (d) identify and outline the area which corresponds with the application; (permit boundary) - The permit boundary and amendment boundary is included on all the maps. (e) with the exception of the map of the affected lands required in Section 34-32.5-112(2)(d), C.R.S. 1984, as amended, shall be prepared at a scale that is appropriate to clearly show all elements that are required to be delineated by the Act and these Rules. The acceptable range of map scales shall not be larger than 1 inch = 50 feet nor smaller than 1 inch = 660 feet. Also, that a reap scale, appropriate legend, map title, date and a north arrow shall be included. - The scale of the maps is 1"=200' and all pertinent items are depicted appropriately. Please make sure that all provided maps and exhibits conform to the requirements of Rule 6.2.1(2). The maps contain ail the required information. EXHIBIT C - Pre -mining and Mining Plan Map(s) of Affected Lands (Rule 6.4.3): One or more maps may be necessary to legibly portray the following information: (a) all immediately adjacent surface owners of record for the entire permitted area; - The exhibits depict all adjacent owners surrounding the entire gravel mine and not just the amendment or "Affected Area". (b) the name and location of all creeks, roads buildings, oil and gas wells and lines, and power and communication lines on the area of affected land and within two hundred feet of the affected land; - The exhibits depict all utilities surrounding the site within 200 - feet of the affected area to best of our knowledge. (d) the total area to be involved in the operation, including the area to be mined and the area of the affected lands (see definition "Affected Land"); - The total area and affected area have been updated. (h) In conjunction with Exhibit! — Soils information, Subsection 6.4.9, soils information may be presented on map in this section. Soils map legend is shown on 'Map 3" but soils data seems to be given on 'Map 2a" - please revise for consistency. - Map 2a has been updated and contains no soils data. EXHIBIT E - Reclamation Plan (Rule 6.4.5) (2)(e) A plan or schedule indicating how and when reclamation will be implemented... The permittee will need to specify at this time if the proposed reclamation for the "wildlife pond" and the pond immediately east of the wildlife pond as depicted on the provided maps will be reclaimed as a lined reservoir, unlined reservoir, or backfilled to original grade. This also applied to the exposed groundwater ponds located within the permit located south of the Cache La Poudre River. - Discussions have been ongoing concerning the Wildlife Pond between the Miner, The Town of Windsor and Central Colorado Water Conservancy District. The current plan is to reclaim 75% of the pond as potential wetlands and 25% to be uplands. There has also been significant discussions concerning slurry lining the pond and using if for water storage but the plan has been to reclaim 15% of the pond as open water/wetlands. The permitted will also need to provide detailed information to describe how lined reservoir within the floodplain will be constructed to withstand flood events. Installation of armored inlet/outlet structures to provide controlled filling and draining of reservoirs is common method to prevent reservoir failure during flood events. - The La Poudre River flooded in 1999 and as a result damage occurred to the slurry lined ponds and the Sinclair Gas/Oil Line bisecting those two pits. Around 1999/2000 Tuttle Applegate designed a spillway to convey water over and into the most downstream pond (east pond). The spillway design included modeling the 100 -year flow of 690 cfs and conservatively analyzed the downstream east pond as half full, therefore resulting in higher erosion forces along the spillway path. The spillway was constructed between the two ponds and located at a low point to convey flows safely between the two ponds. During the 2013 flood the Site received significant flooding but no major damage to the slurry wall embankments occurred. The reclamation cost breakdown required for Exhibit L should reflect the reclamation option chosen for these exposed groundwater areas. - The reclamation cost breakdown includes all ponds as slurry lined ponds. The bond has not changed and includes the entire boundary of 284.4 acres. EXHIBIT F - Reclamation Plan (Rule 6.4.6)." The map(s) of the proposed affected land by all phases of the total scope of the mining, shall indicate the following. (a) The expected physical appearance of the area of the affected land, correlated to the proposed mining and reclamation timetables, The map must show proposed topography of the area with contour lines of sufficient detail to portray the direction and rate of slope of all reclaimed lands; and - The reclamation plans include the timetable to reclaim the outstanding mined out area. The exhibit also shows the contours and slopes. (b) Portrayal of the proposed final land use for each portion of the affected lands. - The reclamation plan map shows the ultimate reclamation of the mined out areas. EXHIBIT G - Water Information (Rule 6.4.6):: (2) If the operation is expected to directly affect surface or groundwater systems, you shall.' Page 3 Mr. Eric Scott September 29, 2017 (a) Locate on a map (in Exhibit C) tribunary water courses, wells springs, stock water ponds, reservoirs. and ditches on the affected land and on adjacent lands where such structures may be affected by the proposed mining operations. - The required geological attributes are shown on the maps. At this time, the figures submitted show at least 4 groundwater wells on or adjacent to the permitted area. The text provided does not identify or provided any information for any of these wells, and in fact, list a well iD that does not appear to be shown on the provided map at this time. Please revise for completeness and consistency between text and maps. - There was some incorrect information the original maps. The information shown on the maps has been updated. The wells surrounding the Site via a search on the Division of Water Resources website show the following wells. Permit #244775 - "old" domestic well owned by the Lee's (currently permitted for mining) Permit 050985-MH - Monitoring well located on the Serfer Pit Permit #78322-F - Gravel Pit Permit Well (N/A) Permit #12168-R - Irrigation well north or the North La Poudre Mine Site EXHIBIT L - Reclamation Costs (Rule 6.4.12). (1) All information necessary to calculate the costs of reclamation must be submitted and broken down into the various major phases of reclamation. You must provide sufficient information to calculate the cost of reclamation that would be incurred by the state. The current bond for the site was calculated for reclamation of all exposed groundwater utilizing the previous DRMS policy of bonding for 20% of the total slurry wall cost utilizing a $3 per sq. ft rate for estimating total slurry wall installation costs. This policy has been rescinded and the permitee will now be required to submit financial warranty for the full cost of lining or backfilling as appropriate for the approved reclamation plan. This should also include cost for installation of appropriate flood control structures for reservoir in the flood - The current bond is $915,820. The recalculated bond is $1,274,808.52. See attached Table. Please provide a detailed reclamation estimate including tasks and unit rates for completing the reclamation as proposed in Exhibits E and F in addition to grading, topsoil replacement, and revegetation, this estimate shall include costs for draining, re -sloping, fully lining or backfllliag all exposed groundwater areas, and installation of flood control structures as appropriate. If the SED has approved the liner for the eastern "slurry lined pond" please provide a copy of the approval documentation. - See updated Table and attached documentation. EXHIBIT S - Permanent Man -Made Structures FRule 64,79 .• Please note that roadways and above -ground or underground utilities (if present) within 200 feet of the proposed affected area are considered permanent man-made structures. In accordance with Rule 6.4.19, when mining operations will adversely affect the stability of any significant, valuable and permanent man-made structure located within 200 feet of the affected area, the applicant may either.' a) Provide a notarized agreement between the applicant and the person(s) having an interest in the structure, that the applicant is to provide compensation for any damage to the structure; or - The notarized agreements have all been mailed to all structures owners to best of the permitees knowledge. An engineering analysis has also been performed. See attached letter. b.) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining operation. -The ponds have been reclaimed for at least 15 years. The only pond remaining reclamation is the "Wildlife Pond", this pond is finished mining and has been like this for at least 3 to 4 years. There has been no negative impacts to surrounding structures and has withstood a significant flood in 2013. Page 4 Mr. Eric Scott September 29, 2017 Please provide evidence (certified letter to structure owners) that a notarized agreement between the structure owners and the applicant was pursued' If an agreement is unable to be reached a geotechnical assessment may be provided to demonstrate that the structures shall not be damaged. The certified mailings are attached. A geotechnical report has been drafted and is attached to this review. The original geotechnical report is attached as well. You must provide information sufficient to demonstrate that the stability of any structures located within two hundred (200) feet of the operation or affected land will not be adversely affected. Additional Information You will also need to provide the Division with proof of notice publication and notice to all property owners within 200 feet of the affected area. Any letters from other commenting agencies/entities received by the Division to date have been included with this correspondence for you to review. - The actual publication and an email from the publisher is attached and a verification has also been emailed. All return receipts to date are attached. This concludes the Division's preliminary adequacy review of this application. This letter shall not be construed to mean that there are no other technical deficiencies in your application. Other issues may arise as additional information is supplied Please remember that the decision date for this amendment application is November 7, 2017. As previously mentioned, if you are unable to provide satisfactory responses to any inadequacies prior to this date, it will be your responsibility to request an extension of time to allow for continued review of this application. If there are still unresolved issues when the decision date arrives and no extension has been requested, the application will be denied. La Poudre Gravel Mine. The site is located north of the Cache La Poudre River, east of WCR 13 and south of Highway 392. The site is within Section 19, Township 6 North, Range 67 West of the 6th Principal Meridian. The project is located in Weld County, Colorado as show in the attached amendment figures. Per the Division of Reclamation, Mining and Safety (DRMS) when an amendment to an existing permit is filed the applicant is required to discuss prior operations and mining limits with respect to surrounding structures located around the existing permit boundary and 200' from the "Affected Area", This letter describes the existing La Poudre Mine boundary and existing activities related to slope stability. Structure agreements have been mailed out to the following structure owners. The majority of these owners are more than 200' outside of the "Affected Area" • Overhead Power Line (Western & Eastern Boundary)(PVREA) • Drainage Easements (CDOTiWindsor) • Gas Line (Northern Boundary)(DCP) • Gas Line (Western & Northern Boundary)(XCEL) • Gas Facility (XCEL) • Telephone (West & North)(Century Link) • Pond (West of site)(United Water & Sanitation District) • Cable (West)(Comcast Link) • Cable (West)(Dark Corn) • Residents (eastern boundary) (Osborne, McCosh, Brown) CURRENT MINING CONDITIONS Bestway Concrete & Aggregates has completed mining the original La Poudre mine, except for under the existing processing area. The "Wildlife Pond" on the west side of the Site is currently mined out. The slurry lined ponds on the east side of the site are mined out and filled with storage water. The slurry lined ponds are owned and operated by Central Colorado Water Conservancy District (Central). These ponds have been approved slurry lined ponds by the State Engineer's Office since 2011 and are 100% reclaimed. The ponds to the south have been mined out and Mr. Mark Johnson October 16, 2017 Page 2 reclaimed since at least 1999. The Wildlife Pond was proposed to be left as open water storage but there has been discussions to reclaim the pond as a slurry lined pond. Since all ponds are reclaimed except the Wildlife Pond the only potential for slope stability issues arises from the Wildlife Pond. The mine slopes are 2 horizontal to 1 vertical and shallower in spots. The excavation is approximately 20 to 25 feet deep. The material onsite is 3 to 4 feet of overburden and 15 to 20 feet of sand and gravel overlying bedrock. The bedrock is the Denver Claystone formation. The alluvial sand and gravel are cohesion -less and range from 30 to 40 degree friction angles. The overburden and claystone have friction angles in the 20 to 30 degree range and typical have cohesions of 200 psf. Groundwater is approximately 5 to 10 feet below grade. A slope stability analysis on the "Lee Amendment"adjacent to the site to the north using very similar parameters as stated above resulted in a minimum setback to surrounding structures of 30 -feet at a 2.5 horizontal to 1 vertical excavation slope. The minimum setback from Weld County Road 13 is 96 -feet and is sufficiently spaced away from the mine highwall and safe for surrounding structures. CONCLUSIONS The original La Poudre Mine has been mined out and no further dewatering or mining will occur. The east area has been mined out for approximately ten years and the west area for approximately two years. The west area (wildlife lake) is not slurry lined and will be backfilled or slurry lined in the future. The east area has been slurry lined and is being used by Central Colorado Water Conservancy District. The mining areas are safe to surrounding structures. LIMITATIONS Our review is based on regional geologic mapping, present mining plans, public well construction data, and stability analyses using typical strength parameters for the various strata in the critical sections. Should the mining plans change or subsurface conditions vary from those portrayed in this letter, we should be contacted in order to re- evaluate the potential effects on permanent man-made structures. Stability analyses were run at the structure in question and were not run on failure surfaces closer to the highwall. Note also that surcharge loads due to temporary material stockpiles and overburden berms were not considered in the analysis as there are no plans to have berms or stockpiles around the perimeter of the mine. Hall Irwin commits to having a representative from Sinclair Pipeline Company present on site during the spillway construction. 3. The 1998 flood inundated most of the three ponds on the north side of the river, however the only evidence of significant damage occurred where flow was concentrated between ponds 5 and 4. This damage will be. mitigated and controlled in the future by the construction of a spillway. All other locations where water enters and exits the ponds seem to be able to withstand the erosional forces of the river and it is not thought that additional spillways are necessary. Precipitation Our position, as stated in the January 3, 2011 letter, is that 100% of the rainfall does not make it to the pump and therefore 100% should not be used as a credit against pumping. This is important as the more rainfall that can be shown to flow through the pump, the less ground water inflow would be documented during the leak test. Thus an overestimation of rainfall leads to an underestimation of ground water inflows. In an effort to show accepted common practice, your email provided a list of eighteen other approved leak test that Deere & Ault was involved with and all of which used 100% precipitation: I reviewed nine of those tests whose data I had readily available. Of those nine sites, one recorded no rainfall data during the test and therefore did not include precipitation in its mass balance equation, four elected not to use rainfall data as it would have produced a negative leak value, and the other four would have passed regardless of the rainfall percentage used. In the "Shores Ponds A Leak Test Report' in discussing why precipitation was riot included you state 'Including the preajoitalion values, results in a negative leakage value. This is likely due to a significant portion of the rainfall infiltrating into the soil and being taken up to replace soil moisture In the dry soils rather than resulting in effective runoff at the dewatering sump." With this liner approval, La Poudre Reservoirs Number 3 and Number 4 may be used to store water in accordance with the 1999 SEO Guidelines.
