HomeMy WebLinkAbout20171874.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JUNE 26, 2017 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, June 26, 2017, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway — EXCUSED at 10:00 a.m. Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of June 21, 2017, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on June 21, 2017, as follows: 1) USR17-0016 — WW, LLC. Commissioner Moreno seconded the motion, which carried unanimously. El AMENDMENTS TO AGENDA: There were no amendments to the agenda. CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. PRESENTATIONS: 1) RECOGNITION OF SERVICES, SHERIFF'S OFFICE - ROBBIE KORGAN-REED: Steve Reams, Sheriff, recognized Ms. Korgan-Reed and presented her with a plaque and pin. He thanked her for her many years of dedicated service to the Weld County citizens. Ms. Korgan-Reed extended her appreciation for the many experiences while being employed with the County. Chair Cozad read the certificate for the record. Each one of the Commissioners thanked Ms. Korgan-Reed for her service to Weld County citizens and thanked her family for their sacrifice and invited her come back to volunteer on one of the many boards. / agf ao l -7 Minutes, June 26, 2017 Page 1 2017-1874 BC0016 • 2) RECOGNITION OF SERVICES, SHERIFF'S OFFICE — TERRANCE D. REED: Chair Cozad read the certificate for the record. Each one of the Commissioners thanked Mr. Reed for his outstanding years of service, integrity and keeping the Weld County citizens safe and for the sacrifice of his family. They congratulated him on his retirement and stated that Weld County is blessed to have both himself and his wife serve the residents of Weld County. Sheriff Reams thanked Mr. Reed for his sacrifice and perseverance at his job and, all his hard work while with Weld County. (Clerk's Note: The meeting was paused for a photo opportunity.) • PUBLIC INPUT: No public input was given. BIDS: 1) APPROVE BID #B1700099, PUBLIC WORKS SOIL LAB REMODEL - DEPARTMENT OF BUILDINGS AND GROUNDS: Barbara Connolly, Controller, stated staff recommends approving the low bid from TCC Corporation for $117,416.00. Commissioner Freeman moved to approve said low bid. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. El 2) PRESENT BID #B1700103, ELEVATOR MODERNIZATION (EXHIBITION BLDG.) - DEPARTMENT OF BUILDINGS AND GROUNDS: Ms. Connolly presented the two (2) bids received and stated staff will bring back a recommendation on July 10, 2017. 3) PRESENT BID #B1700095, ADULT COMMUNITY CORRECTION SERVICES - DEPARTMENT OF JUSTICE SERVICES: Ms. Connolly presented the two (2) bids received and stated staff will bring back a recommendation on July 12, 2017. OLD BUSINESS: • 1) APPROVE RESCINDING RESOLUTION 2017-1658, DATED MAY 31, 2017, AND APPROVE CONTRACT ID #1181 ENERGY AND MINERAL IMPACT ASSISTANCE GRANT AGREEMENT FOR PHASE 2 OF CR 390 PAVING AND AUTHORIZE CHAIR TO SIGN: Elizabeth Relford, Department of Public Works, requested the Board approve the DOLA grant contract as orginally presented, because the State of Colorado refused to execute the contract with the previously sent revisions. She explained they have a deadline and would like to start paving soon. In response to Chair Cozad, she stated this contract is mainly for materials. Commissioner Kirkmeyer moved to rescind Resolution #2017-1658 and approve the orginal grant version, and authorize the Chair to sign. The motion was seconded by Commissioner Freeman, and it carried unanimously. In response to Commissioner Conway, Commissioner Kirkmeyer stated she is working with Bruce Barker, County Attorney, and the Attorney General's Office concerning the problematic language. • 2) APPROVE RESCINDING RESOLUTION 2017-1659, DATED MAY 31, 2017, AND APPROVE CONTRACT ID #1182 ENERGY AND MINERAL IMPACT ASSISTANCE GRANT AGREEMENT FOR CR 105 INTERSECTION IMPROVEMENT AND AUTHORIZE CHAIR TO SIGN: Ms. Relford presented the request to approve the orginal version of the contract for the County Road 105 Intersection Improvement project. She stated the timing issue isn't as critical as the previous item but there could be impacts if the contract is not in place by the end of the year. Commissioner Kirkmeyer moved to rescind Resolution #2017-1649, approve the original grant version and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. Minutes, June 26, 2017 Page 2 2017-1874 BC0016 NEW BUSINESS: 1) CONSIDER CONTRACT ID #1167 CONTRACT AMENDMENT #2 FOR HEALTHY COMMUNITIES PROGRAMS AND AUTHORIZE CHAIR TO SIGN: Dr. Mark Wallace, Director of Department of Public Health and Environment, presented the contract amendment for a program called Healthy Communities, which will allow the Health Department to provide diagnosis and treatment services for children and pregnant women who are enrolled in Health First Colorado and Colorado's Medicaid program. Commissioner Moreno moved to approve said amendment #2 and authorize Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 2) CONSIDER AGREEMENT FOR PROVISION OF COMMUNITY CORRECTIONS SERVICES AND AUTHORIZE CHAIR TO SIGN - INTERVENTION INC., DBA INTERVENTION COMMUNITY CORRECTIONS SERVICES (ICCS): Doug Erler, Director of the Department of Justice Services, presented the agreement to delivery of correction services within the County. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Conway and it carried unanimously. le 3) CONSIDER LEASE AGREEMENT FOR PROVISIONS OF COMMUNITY CORRECTIONS SERVICES AND AUTHORIZE CHAIR TO SIGN - INTERVENTION, INC., DBA INTERVENTION COMMUNITY CORRECTIONS SERVICES (ICCS): Mr. Erler stated this lease agreement is for the community corrections facility and includes a 2.7% increase in the lease amount. Commissioner Freeman moved to approve said lease agreement and authorize the Chair to sign. Seconded by Commissioner Moreno, the motion carried unanimously. le 4) CONSIDER CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2010-10467) FOR PARCEL #0961-16-1-04-021 - NINE -FOOT DEEP DRAINAGE POND FOR THE BALSAM VILLAGE SUBDIVISION: John Lefebvre, Weld County Treasurer, presented the cancellation for a pond that should have been exempt, because it is a common area. Mr. Lefebvre explained the City of Greeley has agreed to withdraw their special assessment. Commissioner Conway moved to approve said cancellation of tax lien sale certificate. Seconded by Commissioner Moreno, the motion carried unanimously. 5) CONSIDER CANCELLATION OF TAXES ON CERTAIN PERSONAL PROPERTY: Mr. Lefebvre stated the personal property is for the Subway business that was closed and equipment was liquidated and the Treasurer was not notified of the liquidation. Commissioner Freeman moved to approve said cancellation of the tax lien certificate. The motion was seconded by Commissioner Kirkmeyer and it carried unanimously. 6) CONSIDER CANCELLATION OF TAXES ON A CERTAIN MOBILE HOME: Mr. Lefebvre stated taxes follow the property and the mobile home is gone. Commissioner Moreno moved to approve said cancellation of taxes. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. 7) FINAL READING OF CODE ORDINANCE #2017-04, IN THE MATTER OF REPEALING AND REENACTING WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION, OF THE WELD COUNTY CODE (BOARD AND COMMISSION APPOINTMENTS): Commissioner Kirkmeyer moved to read Code Ordinance #2017-04 by title only. Seconded by Commissioner Conway, the motion carried unanimously. Bruce Barker, County Attorney, read the title for the record and stated there are no changes from the last reading. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve on final reading. The motion, which was seconded by Commissioner Conway, carried unanimously. Minutes, June 26, 2017 Page 3 2017-1874 BC0016 PLANNING OLD BUSINESS: 1) ZONING VIOLATION, ZCV17-00116, AGAINST ALEJANDRO JAY BARRON FOR VIOLATION OF THE WELD COUNTY CODE (CONT'D FROM 6/19/2017): Bob Choate, Assistant County Attorney, recommended dismissing this matter because the staff reported the property has come into compliance. Wendi Inloes, Department of Planning Services, confirmed they met with the property owner and the property is complying. Commissioner Kirkmeyer moved to dismiss said zoning violation, ZCV17-00116. Seconded by Commissioner Moreno, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
