EXECUTIVE SESSION
Executive Session to Discuss Personnel Matters, Pursuant to CRS § 24-6-402(4)(f); to Review
and Consider, Pursuant to CRS 24-6-402(4)(g), Documents Protected by the Mandatory
Nondisclosure Provisions of the of the Colorado Open Records Act; and to Confer with the
County Attorney for the Purposes of Receiving Legal Advice on Specific Legal Questions,
Pursuant to CRS § 24-6-402(4)(b).
Motion to go into ES:
Motion for the Board of County Commissioners to go into executive session to discuss personnel
matters, pursuant to CRS § 24-6-402(4)(f); to review and consider, pursuant to CRS 24-6-
402(4)(g), documents protected by the mandatory nondisclosure provisions of the Colorado
Open Records Act; and to confer with the County Attorney for the purposes of receiving legal
advice on specific legal questions, pursuant to CRS § 24-6-402(4)(b); and to limit the persons
present in the executive session to the five County Commissioners, County Attorney Bruce
Barker, Human Resources Director Patti Russell, and Michele Sturgell, Manager, Workplace
Investigations, Mountain States Employers Council. There of course needs to be a second and
the vote needs to be 4/5 (two-thirds).
Statement by Chair after vote:
The Board of County Commissioners is at (state time) going into executive session, which will
be held in the St. Vrain Conference Room. Persons authorized by the Board of County
Commissioners to be present in the executive session are Commissioners Cozad, Moreno,
Conway, Freeman and Kirkmeyer, County Attorney Bruce Barker, Human Resources Director
Patti Russell, and Michele Sturgell, Manager, Workplace Investigations, Mountain States
Employers Council.
Statement by Chair after everyone present in executive session: (start recording)
It is Monday, February 13, 2017, at (state time). The Board of County Commissioners is now in
executive session in the St. Vrain Conference Room at 1150 O Street, Greeley, Colorado, to
discuss personnel matters, pursuant to CRS § 24-6-402(4)(f); to review and consider, pursuant to
CRS 24-6-402(4)(g), documents protected by the mandatory nondisclosure provisions of the
Colorado Open Records Act; and to confer with the County Attorney for the purposes of
receiving legal advice on specific legal questions, pursuant to CRS § 24-6-402(4)(b). A motion
to go into executive session for these reasons was made, seconded, and voted favorably by a two-
thirds majority of the Board members at the Board's open meeting held on this date. Present are:
Commissioners Cozad, Moreno, Conway, Freeman and Kirkmeyer, County Attorney Bruce
Barker, Human Resources Director Patti Russell, and Michele Sturgell, Manager, Workplace
Investigations, Mountain States Employers Council. We will now begin the executive session.

Because this is an executive session called pursuant to CRS § 24-6-402(4), all things discussed
and any documents reviewed in executive session are CONFIDENTIAL.
Conduct of executive session:
Adjournment from executive session:
A motion must be made and seconded to adjourn from executive session. This motion, second
and vote must take place in the open meeting (the board is voting to come out of executive
session). Although CRS § 24-6-402(4) does not specify the number of affirmative votes needed
to adjourn, it is best to get an affirmative vote of 2/3. After the vote, the Chair then says the time
and that the executive session of the Board on Monday, February 13, 2017, is now concluded
and the Board will reconvene in its open meeting.
Statement by Chair after return from executive session:
The Board of County Commissioners is now reconvening in open meeting at (state time) after
meeting in executive session. The executive session was held from (state start time) until (state
end time). In the executive session, the Board discussed personnel matters, pursuant to CRS §
24-6-402(4)(f); reviewed and considered, pursuant to CRS 24-6-402(4)(g), documents protected
by the mandatory nondisclosure provisions of the Colorado Open Records Act; and conferred
with the County Attorney for the purposes of receiving legal advice on specific legal questions,
pursuant to CRS § 24-6-402(4)(b). An electronic recording was made of the executive session,
except during discussions with the County Attorney constituting attorney -client communications.
Present during the executive session were Commissioners Cozad, Moreno, Conway, Freeman
and Kirkmeyer, County Attorney Bruce Barker, Human Resources Director Patti Russell, and
Michele Sturgell, Manager, Workplace Investigations, Mountain States Employers Council.
