Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for a site specific development plan and use by special use permit for an
equestrian event center for up to 200 people, a riding arena, f/a mile practice track, barns and
pasture for 40 horses an operating office, a shop for tack sales, gardens, and a caregiver
apartment on a 15 acre parcel identified as Lot A of RE -4329. The proposed water supply is an
existing well on the adjacent 29.36 acre parcel immediately west of the subject property,
which currently operates under well permit no. 67932-F. No estimates of water use for the
proposed project were provided.
Well permit no. 67932-F was issued on March 16, 2009 pursuant to Section 37-90-137(4) and
the findings of the State Engineer dated March 16, 2009 to withdrawal water from the
nontributary Laramie -Fox Hills aquifer underlying a 29.4 acre parcel using an existing well.
The uses of this well are limited to commercial and domestic purposes, not to exceed 3 acre-
feet per year. No information was provided regarding how this well is currently used on the
29.4 acre site where it is located. The application materials mention that there are as much
as 6.8 acre-feet of water available for withdrawal underlying the 29.4 acre parcel subject to
permit no. 67932-F. Though this water may be located under the parcel, only the amount
allowed to be withdrawn pursuant to permit no. 67932-F, 3 acre-feet per year, may be
utilized until such a time as the applicant obtains a permit to withdrawal a larger amount of
water from the Laramie -Fox Hills aquifer underlying the property.

Though the currently permitted uses of the well appear to fit the proposed uses described in
the application, it is unclear if the existing well permit, or a well permit with an increased
withdrawal capability, could provide enough water to satisfy the proposed project. The
Division of Water Resource does not administer or enforce shared well agreements. However,
should the applicant share the well between the two properties, we encourage them to
obtain a well sharing agreement so that each party knows their rights and responsibilities
associated with the well.
The application materials indicate that a storm water detention structure may be constructed
as a part of this project. The applicant should be aware that, unless the structure can meet
the requirements of a "storm water detention and infiltration facility" as defined in section
37-92-602(8), Colorado Revised Statutes, the structure may be subject to administration by
this office. The applicant should review DWR's Administrative Statement Regarding the
Management of Storm Water Detention Facilities and Post-Wildland Fire Facilities in
Colorado, attached, to ensure that the notification, construction and operation of the
proposed structure meets statutory and administrative requirements. The applicant is
encouraged to use Colorado Stormwater Detention and Infiltration Facility Notification
Portal, located at https://maperture.digitaldataservices.com/gvh/?viewer=cswdif, to meet
the notification requirements.
The well must operate in accordance with all terms and conditions of well permit no. 67932-
F. From the information provided it is unclear if the well operated under permit no. 67932-F
can supply an adequate amount under the terms and conditions of the well permit to meet
the water requirements of the proposed project and any existing water commitments. If you,
