BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
AUGUST 9, 2017
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, August 9, 2017, at the hour of 9:00 a.m.
la ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Julie A. Cozad, Chair
Commissioner Steve Moreno, Pro -Tern
Commissioner Sean P. Conway
Commissioner Mike Freeman
Commissioner Barbara Kirkmeyer

• MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of August 7, 2017, as printed. Commissioner Moreno seconded the motion, and
it carried unanimously.
• AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Kirkmeyer moved to approve the Consent Agenda as printed.
Commissioner Freeman seconded the motion, and it carried unanimously.
PUBLIC INPUT:
• Dale Hall, a former County Councilman and Commissioner, requested that the Board place upon
the ballot the business of the County Council remaining an institution in Weld County, to allow the people
to decide whether the County Council should be dissolved. Mr. Hall believes the County Council is no
longer representing the interests of the people of Weld County. Commissioner Cozad thanked Mr. Hall
for his testimony.
• Virginia Buczek, a former County Councilwoman, likewise requested that the Board consider
placing the matter on the ballot to remove the County Council as an institution of Weld County.
Ms. Buczek expressed that she believes the County Council takes power away from voters, and is an
unnecessary use of taxpayer dollars. Commissioner Cozad relayed her and her fellow Commissioners'
appreciation for Ms. Buczek's time.

Roberta Green, County resident, then asked for the Board's consideration of the use of a road right-
of-way adjacent to her property on County Road 51. Ms. Green submitted Exhibit "A", which she mailed
to the County Commissioners and to Congressman Ken Buck. She requested a response from the
County Commissioners within a week. Commissioner Cozad thanked Ms. Green for presenting her
concerns, and stated a response will be submitted once the Commissioners have an opportunity to review
the submitted documents.
• Chris Eikenberg, County resident, expressed her concerns about obstacles in the road right-of-way
adjacent to her and Ms. Green's property and County Road 51. She requested the Board remove the
obstacles. Ms. Eikenberg also noted concerns regarding the Weld County Sheriff's Office. She felt
threatened by the Sheriff's Office when she was standing in the right-of-way near her parents property
(Case Number 16WO2634). Ms. Eikenberg then stated that the Commissioners should ensure the people
of Weld County know that the County Council exists as a system of checks and balances for Weld County.
Commissioner Cozad thanked Ms. Eikenberg for speaking, and stated the Commissioners will respond
to her concerns along with Ms. Green's letter.
• Commissioner Cozad read a letter, Exhibit "B", from Marge Klein, a former County Councilwoman,
regarding the dissolution of the Weld County Council because she does not believe it is a good use of
taxpayer dollars.
• Ms. Eikenberg asked to have a second Public Input session to discuss the County Council, and
Commissioner Cozad said it was against policy because Ms. Eikenberg had already addressed the topic
of the County Council while she spoke earlier during Public Input.
(Clerk's Note: Exhibit "C" was submitted by Don Mueller after Public Input closed. The letter is
regarding the requested ballot item for dissolution of the County Council.)
le COMMISSIONER COORDINATOR REPORTS: Commissioner Conway attended the South Platte
Roundtable and the Colorado Water Conservation Board approved the Poudre Learning Center grant for
water conservancy education. Commissioner Moreno attended the Island Grove Park Advisory Board
and they discussed the very successful Fair. Commissioner Moreno also attended the Small Business
Development Center (SBDC) meeting, which has recently relocated, and numbers are exceeding their
initial estimates. Commissioner Moreno then spoke about the Front Range meeting and found the
proposed Human Services legislation that was presented by Commissioner Kirkmeyer to be interesting.
Commissioner Kirkmeyer attended a Bright Futures Board meeting and they discussed the organization
of the program and deliberated about hiring a director. The Bright Futures Board will request that
Don Warden, Director of Finance and Administration, attend and share information about the
sustainability of the program. Commissioner Cozad spoke about attending the Ault Parade with
Commissioners Freeman and Moreno, and she is very proud to attend events in the smaller communities
in Weld County. Commissioner Cozad spoke about the Fair Board meeting and the changes Island Grove
is anticipating, and she commended the Americorp group. Commissioner Cozad stated that next year is
the 100th Anniversary of the Fair. The Commissioners recently attended the Oil and Gas meeting, and it
was very well attended. They are looking at restructuring the way meetings are conducted to make Public
Input more organized. Commissioners Cozad and Moreno also attended the Energy Proud barbeque at
Island Grove.
BIDS:
El 1) APPROVE BID #61700095, ADULT COMMUNITY CORRECTION SERVICES - DEPARTMENT
OF JUSTICE SERVICES (CONT'D FROM 7/12/2017): Barbara Connolly, Controller, reviewed the two (2)

bids received and stated staff recommends awarding the bid to Intervention, Inc. Commissioner Conway
moved to approve said bid. The motion was seconded by Commissioner Kirkmeyer, and it carried
unanimously.
2) APPROVE BID #B1700114, HOUSEHOLD HAZARDOUS WASTE PICKUP SERVICES -
DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT (CONT'D FROM 7/26/2017): Ms. Connolly
reviewed the two (2) bids received and stated staff recommends awarding the bid to Clean Harbors
Environmental Services. Commissioner Freeman moved to approve said bid. The motion was seconded
by Commissioner Moreno, and it carried unanimously.
• 3) APPROVE BID #B1700118, GRADER BLADES (NO. 2) - DEPARTMENT OF PUBLIC WORKS:
Ms. Connolly reviewed the three (3) bids received and stated staff recommends awarding the bid to
4 Rivers Equipment. Commissioner Moreno moved to approve said bid. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.
• 4) PRESENT BID #B1700120, AXIS CAMERAS AND ONSSI LICENSES - DEPARTMENT OF
INFORMATION TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology,
presented the three (3) bids received and stated staff will bring back a recommendation on August 23,
2017.
• 5) PRESENT BID #1700121, 918 ROOF TOP UNITS - DEPARTMENT OF BUILDINGS AND
GROUNDS: Ms. Connolly presented the two (2) bids received and stated staff will bring back a
recommendation on August 23, 2017.
OLD BUSINESS:
1) CONSIDER CONFIRMING ACCEPTANCE OF GRANT OF RIGHT-OF-WAY FOR CR 35.5,
NORTH OF CR 8 (CONT'D FROM 7/12/2017): Bruce Barker, County Attorney, recommends acceptance
of the grant of right-of-way. Commissioner Conway moved to approve said acceptance of the grant of
right-of-way. Seconded by Commissioner Freeman, the motion carried unanimously.
NEW BUSINESS:
• 1) CONSIDER 2017-2018 OUT -OF -HOME CONTRACT PROVIDER LISTS AND RATES FOR CPA
GROUP HOME/CENTER PROVIDERS AND RESIDENTIAL CHILD CARE FACILITY PROVIDERS:
Jamie Ulrich, Department of Human Services, presented the lists and 1.4 percent increase in rates for
2017-2018, Group Home and Center Providers and Residential Child Care Facility Providers.
Commissioner Kirkmeyer moved to approve said provider lists and rates. Seconded by Commissioner
Conway, the motion carried unanimously.
• 2) CONSIDER CONTRACT ID #1332 PURCHASE AND SALE AGREEMENT (GROVER TOWER)
AND AUTHORIZE CHAIR TO SIGN - NOTE ACQUISITIONS, INC., C/O MARK FULLING: Mike Wallace,
Director of Public Safety Communications, presented the purchase agreement for the Grover Tower
property. Commissioner Conway expressed his gratitude for staff's time and effort, and moved to approve
said purchase and sale agreement and authorize the Chair to sign. The motion was seconded by
Commissioner Moreno and it carried unanimously. The Commissioners all echoed Commissioner
Conway's sentiment.
• 3) CONSIDER CONTRACT ID #1332 ACCESS EASEMENT AGREEMENT AND AUTHORIZE
CHAIR TO SIGN - HOWARD AND ROBERTA FOSTER: Mr. Wallace presented the access easement
agreement for the Pawnee Buttes Site. Commissioner Freeman moved to approve said access easement

agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Conway,
carried unanimously.
4) CONSIDER CONTRACT ID #1333 PURCHASE AND SALE AGREEMENT (TIMNATH TOWER)
AND AUTHORIZE CHAIR TO SIGN - NOTE ACQUISITIONS, INC., C/O JOHN GAZZO: Mr. Wallace
presented the purchase and sale agreement for the Timnath Tower. Commissioner Conway moved to
approve said purchase and sale agreement and authorize the Chair to sign. Seconded by Commissioner
Kirkmeyer, the motion carried unanimously. Commissioner Conway stated this Timnath Tower is very
important for ensuring county -wide coverage.
Ei 5) CONSIDER REAPPOINTMENT OF BARBARA CONNOLLY TO BOARD OF RETIREMENT:
Commissioner Kirkmeyer moved to approve said reappointment. The motion was seconded by
Commissioner Moreno, and it carried unanimously.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
There being no further business, this meeting was adjourned at 9:37 a.m.

Having served on the Weld County Council for several years, I find the County Council to be a huge
waste of the Weld County Taxpayers money. For the taxpayers to pay mileage for the five council
members to travel to meetings, take up space for an office, in the Weld County Administration Building,
have a part time secretary ---just to do their main task of setting elected officials salaries when the State
Legislature already does that for counties without a County Council it is time for the Council to be
dissolved!!
The Weld County Council is not being responsive to the public when it took over a year to respond to a
citizen request and vote to have a performance audit on an elected official's office and to date, the
taxpayers still do not have the audit results.
As a former County Council member and a taxpayer in Weld County, I am in favor of the County
Commissioners asking the voters if they think the Weld County Council should be dissolved.
