Dear Mr. McDonald,
I have been informed that the Weld County Public Works Department ("County") is planning to
acquire land from Hoshiko Land, LLC ("HLLLC") in addition to what is needed for the
expansion of CR 47, for the purpose creating detention ponds to contain storm water flow
originating from the future Weld County Parkway ("Project").
If this is, in fact, true, then this letter constitutes formal, written notification that HLLLC
strenuously objects to such plans on the basis that HLLLC will already be required to contribute
more than its fair share of land for the benefit of the Project. All of land to be taken for the
Project will come from the west side of CR 47 between CR 62 and CR 64, the majority of which
is owned by HLLLC, instead of being taken equally from both sides of the road.
In summary, for the County to propose taking additional land from IILLLC for storm water
detention purposes instead of piping it directly back to the S. Platte River, as it legally should be,
is unacceptable.

I am going to respond to Dennis' email and let him know we would be happy to meet with him to further discuss his
concerns. However, I am sending you a more detailed email should you speak with him separately, since we have not
met since our last work session on November 14th. As you know, staff has been meeting with the individual landowners
to discuss the WCR 47 design along with their current irrigation practices. The meetings have been going very well and
until we received Dennis' letter, we had no idea there was any issue related to the project. Staff has gone above and
beyond to be readily available to discuss any and all concerns with the land owners along the corridor. Dennis did not
attend last week's irrigation landowner meeting, but sent Hunter. So I cannot guarantee what information Hunter
communicated back to Dennis.
Here is what staff has been communicating:
1. Facts about WCR 47 ROW, which the arterial minimum requirement is 140'. There are some locations where
additional ROW is needed to accommodate the existing irrigation, field stormwater drainage, and the newly
anticipated road runoff. Based on our current design, here is a table showing proposed ROW amounts. For

2. The roadway stormwater flows are approximately 13% of the overall flows on the west side of the road. Most of
the drainage flowing to the western swale is coming from the farm fields and airport.
3. The only retention area on the project is on the east side of WCR 47 north of WCR 66, for roadside drainage
only. These areas can't drain anywhere now because of the topography. Currently, the drainage goes into the
adjacent farm fields, which we didn't want to do, especially with increased runoff from our widened road
section. In areas where we can't send the drainage south, we identified these small retention swales which are
shoehorned in between the road and the ROW. Hoshiko is located south of WCR 64 on the west side, so these
facilities do not affect his property. The small retention pond on the east side of WCR 66 primarily affects Lutz
(also discussed at the meeting).
4. There is also a larger retention area north of WCR 66 on Feit's property, which has always drained to a low point
on Feit's field (the design is based on historic drainage patterns). The water level never got high enough to
overtop the road, so it's always been a retention area. The plan is to dig an actual pond in our ROW, so the
water can get off his field during storm events.

5. There are no detention or retention area south of WCR 66, except for a small roadside swale on the East side of
WCR 47, which affects Lutz and was discussed with him at the meeting.
6. All the stormwater flows south toward the Poudre River; however, these flows are intersected by the Ogilvy
irrigation ditch and then to the S. Platte River. If the flows are not intercepted by the Ogilvy Ditch, there is an
overflow west of the intersection in the Ogilvy that will discharge to the Poudre River.
7. The existing roadside ditch parallel to Hoshiko's property is flat. Therefore, the stormwater runoff from his farm
overloads the existing roadside ditch, which typically would handle stormwater within a 140' ROW. In previous
meetings, Dennis told staff his field floods when it rains because water cannot run out of his field fast
enough. Staff has taken this into account and are trying to keep the stormwater flowing towards the river by
conveying the water in a roadside ditch and not on his farmland. To make this happen the roadside ditch needs
to be wider in this area. However, this widened area along Hoshiko's property is NOT a detention or retention
pond, but is widened due to the flat longitudinal roadside ditch slope, so we can ensure the historic flows return
to the S. Platte River. As we get closer to the river, the land gets flatter.
8. Piping the storm water, irrigation, and roadway stormwater flows to the river will not work as well as the
designed open channel flow. All of the flows have been comingled prior to the project and as designed will
remain comingled afterward. Technically, the county would only have to pipe the widened roadway flows,
which is nominal. Currently, our roadside ditch receives at least three quarters of a mile of this farmland runoff
and tail water from his irrigation.
As we have discussed with the Commissioners, it is not our plan to install a stormwater pipe for this project. If the BOCC
wants staff to consider this option, I would recommend we have a follow up work session to discuss in more detail as
soon as possible.

As you know, it is Weld County's practice to work with the landowners on the minimum ROW needed to construct a
project. There are no detention ponds proposed along your property for storm water conveyance. I know you were
unable to attend last week's meeting, but I think it would be best for us to meet with you and explain the design, so we
can ensure we are all on the same page. Please let me know what day and time works best for you, so we can get
something scheduled as soon as possible.
