Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: A Major Amendment to MUSR15-0019 to include additional parking, additional expansion of the existing milk processing plant, along with additional future expansions This project is south of and adjacent to CO HWY66 and is east of CR13. Parcel number: 120930000034, 120930100001, 120930100002, 120930100020, & 120930100021 Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions or assistance for drainage requirements at 970-353-6100. URBANIZING VS NON -URBANIZING DRAINAGE AREA: This area IS within an Urbanizing Drainage Area: Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. The applicant has submitted a drainage report dated May 2016 stating that they meet exception 1.A.12 Individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. This drainage narrative is accepted. If the USR is split up or the applicant sells parcel 120930100002, this will no longer be valid. Detention pond waived and a simple drainage narrative: A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for an exception to detention requirements listed below. The drainage narrative must include at the minimum: 1. Description which exception is being applied for and supporting rationale 2. Where the water originates if it flows onto the property from an offsite source 3. Where it flows to as it leaves the property 4. The direction of flow across the property 5. If there have been previous drainage problems with the property Exceptions. 1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property. Exceptions shall be supported with a drainage narrative. a. No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4) areas remain applicable. 12) Individual parcel with an unobstructed flow path and no other parcel(s) between the Federal Emergency Management Administration (FEMA) regulatory floodplain channel and the project. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact a Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692- 3575. Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This site is in a FEMA regulatory floodplain. A flood hazard development permit is required for any development in the floodplain. Contact the floodplain planner Diana Aungst at 970-353-6100. CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. The applicant shall show and label the accepted drainage features and drainage flow arrows. Water quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume. (Department of Planning Services -Engineer) 2. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. If parcel 120930100002 changes ownership or is removed from 4MJUSR16-03-1405, the drainage plan for the USR will need to be modified to ensure that it is brought into compliance with Weld County Code. Note: The original 4MJUSR16-03-1405 application that was submitted in June 2016 has been modified to include one (1) additional processing building (350,000 square feet maximum size) and the boundary of the permit has been expanded to include two additional parcels (Lot C and D of RECX16- 0091). This project is south of and adjacent to State Highway 66 and is east of CR 13. Parcel numbers 120930000034, 120930100001, 120930100002, 120930100020, & 120930100021. Access is from State Highway 66. Roads: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. The application indicates the proposed development will be serviced by Little Thompson Water District and Saint Vrain Sanitation District. The existing dairy operation is not included in this amendment. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, Section 30- 20-100.5, C.R.S. 3. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations.
