WHEREAS , the Board of County Commissioners of Weld County,

the affairs of Weld County, Colorado, and

co WHEREAS , a public hearing was held on March 2nd, 1977 , in

the Chambers of the Board of County Commissioners , Weld County,
Colorado, for the purpose of hearing the petition of George

a change of zone from "A" Agricultural to "E" Estate District,
for a tract of land located in the South Half of the South Half
(Si , Si) of Section 14 , Township 6 North, Range 66 West of the
Sixth Principal Meridian, Weld County, Colorado and being more
particularly described as follows :

WHEREAS , the petitioner was present, and
WHEREAS , there was no opposition to the request of the
petitioner for a change of zone upon the aforementioned tract
of land, and
WHEREAS , Sections 8. 2 and 8. 3 of the Weld County Zoning
Resolution authorized the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts , and
WHEREAS , the Board of County Commissioners heard all the
testimony and statements of those present, has studied the
request of the petitioner and the recommendations of the Weld
County Planning Commission, and having been fully informed and
satisfied that the request for rezoning complies with the Weld
County Comprehensive Plan and the conditions set out in Sections
8. 2 and 8. 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the petition of
George Hoecher for a change of zone from "A" Agricultural to
"E" Estate District on the above described tract of land be, and
hereby is granted.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 2nd day of

I hereby certify that pursuant to a notice dated January 24, 1977,
duly published January 28, and February 18, 1977 in the Greeley
Booster, a public hearing was held on the request of George Hoecher
for a -Change of Zone, A-Agriculture to E-Estate District. Testimony
was heard and after some discussion, Commissioner Dunbar made the motion
to grant the request. Commissioner Carlson seconded the motion and
it passed unanimously. All five commissioners were in attendance at
the hearing.

along St. Hwy. 392 and with the existing housing development within

development in the subject 47.020 acre parcel with the understanding
that the property only lacked approval of a Final -Plat when in fact
the Preliminary Plan approval had expired.
A preliminary plan including the land within the Est and 2nd Filing
of Pinnacle Park Subdivision along with the 47.020 acres in this
rezoning application was approved by the Board of County Commissioners
in 1268. Final Plat applications for the 1st and 2nd Filings of
Pinnacle Park 8ubd. were approved -in 1968 and 1969 respectively,

Section Z.2 of the Official Subdivision Regulations of Weld
County (Revised August 31, 1966) required submission of a
Final Plat within one year of approval of a Preliminary Flan.
Since no Final Plat was filed on the 47.020 acres in question
at this time within the 12 month time limit, the Preliminary
Plan approved in 1968 is now void on the subject 47.020 acres.
Additionally Weld County regulations now require the property
to be rezoned to permit residential development at the pro-
posed density.
The capital improvements which the developer has already
completed entails the installation of an underground tile
drain pipe system to alleviate problems with the high ground
water table present in the area.

The Colorado Divisi-on of Highways has reviewed the following and would like
to request that due consideration be given the following comments.
Pinnacle -Park - along S.H. 392

Change of zoning from A to C-UD (Ault Commercial Plaza) .
Submittal of Preliminary Plan.
The Division has no objections to the zoning changes ; however, there are some
conflicts on the preliminary plan and highway access along US 85 in this area.
US 85 in this area is designated as a freeway, and access is controlled -by a
Freeway Agreement with Weld County. At the present time, the Division has access
control the length of the east property line extending from the northeast corner
across the front and then anglin-g to intersect County Road 80 right of way. A
letter from Mr. David Fraser, District IV Maintenance Superintendent, to Mr.
Carrell V. Deacon addressed a request for widening the median opening near the
northeast corner of the property. He stated in paragraph 3, "The only road that
we would permit onto State -Highway 85 with a median crossing would be a county
road. " This would also apply to any approaches onto US 85 in this area due to
the access being controlled.
Mr. Fraser's comment on a frontage road was made to inform the developer
that direct access from US 85 would not be allowed. The preliminary plan shows
frontage road openings alon-g the access control line. The Division would request
that access to the -property be directly off of County Road 80. This would allow
for better traffic control in the future. The purpose of a freeway is to control
the number of conflicts the traveling public will have; this includes vehicles
entering or leaving the freeway. Thus, accesses are permitted only at designated
public roads as determined by the -Division and the County.

This will acknowledge your request to make comments on the Pinnacle Park
subdivision , George Hoecher rezoning application.
The preliminary plans for this subdivision are lacking in some nece-s-sary
information in order to make adequate and complete comments . The plan
lacks information as to the purpose of each lot , in other words , whether
horse or cattle will be allowed to he -kept and the number allowable. No
soils survey information, surface drainage plan, vegetative protection
and restoration plan, or erosion control plan are available to compare
for adequacey. Therefore , my comments will have to be of general nature
on what information is available.
The -predominating soil type for the area is Olney loamy sand. This is
a deep -well drained light textured soil. The surface , -however , is
susceptible to wind erosion if left unprotected , and _water erosion is
a hazard. The land slope is quite uniform and appears to have been
leveled for farming.
Kim loam is the other soil type found in the subdivision area. It is a
deep well drained , medium to light textured soil. Like -Olney it is sus-
ceptible to wind erosion with unprotected surface.
Both sails have slight limitations to septic tank filter field instal-
lation. The Kim loam has moderate limitations for use as _roads and streets
and to dwellings with or -without -basements due to its limited ability to
support a load. The -Olney soil also has low strength for use as roads and
streets.

The preliminary plan makes mention of a possible water table problem
and the fact that a tile drain is to be installed to lower the water
table to a 8.0 foot depth so as not to interfere with installation of
septic tank filter fields. There is no supporting data to indicate the
direction of flow of the underground water nor any indication as to the
depth of the impervious layer that the water is traveling on. Without
such information it is difficult to determine whether the drain system
as shown on the plan will adequately lower the table to insure compli-
ance with the Colorado Department of Public Health requirements . I
would suggest the developer perform an adequate drainage investigation
and prepare proper design. The use of the water line trench granular
fill as an interceptor and carrier does not appear to be adequate
unless there is some provision to have the granular fill material on
an established Trade and then it is doubtful if it -would carry enough
flow to adequately serve as an conduit. We also wonder if an easement
has been granted to go under Greeley No. 2 Canal to he able to put
drain water into Seeley gulch.
There is no surface drainage plan available for review but it appears
that all surface 'runoff from this area will flow into'Greeley No.2
Canal. During development and construction there should be some pro-
vision. made for a desilting basin or some other structure in surface
drainage system to remove water tonne soil particles prior to discharge
into the -canal, to prevent damage to the canal system.
There seems to be no problem form outside flooding and there are no
major drainages that flow through the area.
An erosion control and vegetative protection and restoration planWt.
should be prepared to provide surface -soil protection by permanent
,grass cover. These soils are susceptible to wind -erosion and should
be protected during development phase as -well as against overgrazing Ir+�
