Our office represents John Moser, Morwai Dairy LLC and West Moser, Inc., who are landowners nearby the site of the planned USR. I should first state that none of our clients oppose the plan proposed by Farmers Reservoir and Irrigation Company, but our clients did wish our office to contact your office and express the particular concern our clients have with regard to motor vehicle traffic in the area. Among other things, our clients operate Morwai Dairy LLC, and a related composting facility, on properties which are very near the site of the USR application. As you can understand, there is a considerable amount of motor vehicle traffic, including large semi -trucks and trailers transporting both milk and compost materials in the area. Additionally, our clients have a number of employees who commute to the Morwai Dairy site. Our clients also advise us that both Noble Energy Company and Anadarko Petroleum Inc. have drilled and are operating a number of oil and gas wells in the nearby area. In particular, those oil field operations result in a significant number of oil field trucks being placed on Weld County Road 30 and Weld County Road 32, west of County Road 49. In addition, our clients naturally have plans for the future use of their properties, which may typically add some additional burdens to the traffic patterns in and near the Milton Reservoir site. Our clients wish us to simply bring this to the attention of the Weld County Planning Department in order that the Planning Department might be keenly aware of the concerns the neighbors have of increased traffic and the need for appropriate monitoring of the traffic by the Weld County Planning Department. It is naturally expected that the increase in traffic flow on the nearby roads, increased significantly perhaps by the approval of the USR application, may result in serious traffic congestion throughout the area. Naturally, our clients' operations, which have been in effect for many years, produce WITWER, OLDENBURG, BARRY & GROOM, LLP April 20, 2017 Page 2 significant agricultural smells from the dairy, composting and related operations. Our clients feel that it is extremely important that the applicant, as well as any potential future users of the USR, are made aware of the existence of our clients' operations nearby, and that such operations naturally generate smells, flies and other products from their operation. Our clients do not have a solution by any means to the increase in the traffic demands on nearby roadways, but our clients wish to express to the Weld County Planning Department that the increase in use which maybe brought about by granting the USR application, as well as the naturally planned increase in use as the properties develop in the coming years, should be studied very carefully in implementing road and traffic designs in the coming years. Our clients appreciate your considered attention to this matter, and if you should have any questions or if you wish to discuss this with our office or with our clients, you should feel free to contact us at your convenience. Yours very truly, WITWER, OLDENBURG, BARRY & GF3,bOMyLP John J. Darryl/ JJB: rew CC: John Moser West Moser Inc. Morwai Dairy LLC 19 May 17 Dear Weld County Commissioner, I'd like to voice my support of Haven Sporting Club and their plans for Milton Reservoir. I've lived in Weld County for 39 years and I have never been able to use the lake in my own backyard. I am excited to finally see the lake getting put to recreational use and finally be able to share it with my family! I've been in the construction industry for 25 years out of Weld County and can only hope the developments with this land will lead to future business for Weld County. Haven Sporting Club has been a great steward of Milton Reservoir for the short time it has been open. They've made incredible improvements to the land in just a couple months, clearing thousands of tons of debris and trash from the property. We've loved being able to be out on the lake for the last couple months and hope to be able to camp for many years to come. Thank you for your consideration, pig. ki ,2 --q 5yL p.O. jCi)( ` Eirse y , Cactejci Yy 19 May 17 Dear Weld County Commissioner, I'm writing to you to express my upmost support for Haven Sporting Club and their plan for commercial camping on Milton Reservoir. I've been a resident of Weld County for 41 years and a business owner of Colorado for 21 years. I live around one mile from Milton Reservoir and couldn't be more supportive of Haven's plans. As a shareholder in Frico, I have a unique perspective on what Haven Sporting Club will do for Weld County and my family. n Haven Sporting Club with their boats on the water will improve the quality of water through turbulence and algae. Right now the water is treated through chemicals (copper disulphate). By allowing boats to create the turbulence on the water, you'll greatly reduce the number of chemicals required to keep the lake healthy. a In the past, Frico has wanted to stock the lake with fish to maintain the proper ecology. We haven't been able to do that because pelicans would eat them, putting up further road blocks to naturally sustaining the lake. ▪ The improvements they've made on the property will help with rodent control for the ditch company and the local farmers. o I've lived here for 41 years and never been able to use the lake recreationally. This is a dream come true for my family. Turning this lake into a recreational lake will turn increase my property value but give us a chance to have some fun locally. I appreciate your time. Skarka RE: Case No.: USR 17-0012 Owner: Farmers Reservoir and Irrigation Company Applicant: Haven Sporting Club, LLC Proposed Project: USR for Recreational Facilities and Uses Including Public or Commercial Camping (150 seasonal camping sites in the agricultural zoned district) Dear Mr. Gathman. I represent Lonnie R. Ford and Ella Lee Ford, owners of the real property located at 15994 Weld County Road 47, LaSalle, Colorado 80645. The legal description of the property owned by Mr. and Mrs. Ford is the NW ;/4 of the NW '/4 of Section 13, Township 3 North, Range 65 West of the 6th P.M., Weld County, Colorado. I am enclosing a copy of the Warranty Deed by which Mr. and Mrs. Ford took title which was recorded on April 17, 1985 at Reception No. 02006041, Weld County Clerk and Recorder's office. I am also enclosing a copy of Recorded Eicemption Nn.? 212 -13 -2 -RE 3688 which was recorded on March 1, 2004 at Reception No. 3157916, Weld County Clerk and Recorder's office regarding my clients' real property. I am also enclosing a copy of a map indicating one of the proposed access points, "East Gate Entrance", which would cross the land owned by Mr. and Mrs. Ford. Mr. and Mrs. Ford have several objections to the pending Application for Use by Special Review. First, they have never consented to the applicant or Farmers Reservoir and Irrigation Company's use of the proposed East Gate Entrance across their real property from Weld County Road 47. (East Gate Entrance) It is Mr. and Mrs. Ford's understanding that historically the projected East Gate Entrance has only been used by oil companies to maintain oil wells and related infrastructure, but Mr. and Mrs. Ford have never consented to the applicant, Haven EXHIBIT 5 Chris Gathman Weld County Department of Planning Services May 26, 2017 Page 2 Sporting Club, LLC, or Farmers Reservoir and Irrigation Company to use said access point, and it is their position that should the applicant or Farmers Reservoir and Irrigation Company use the "East Gate Entrance" across their property, it would be considered trespass. Second, Mr. and Mrs. Ford rent the property located at 15994 Weld County Road 47, LaSalle, Colorado to tenants and they are they quite concerned about the projected increase in traffic which the applicant projects will be using Weld County Road 47 which is a gravel road. The increase in dust, noise, and exhaust fumes created by the increase in traffic on Weld County Road 47 is a concern to Mr. and Mrs. Ford and their tenants. For these reasons, Mr. and Mrs. Ford object to the pending Application for Use by Special Review submitted by Haven Sporting Club, LLC, and they request that their application be denied. Our clients own real property either adjacent to or very close to the area of the proposed recreational facility at the Milton Reservoir. John Moser and I had the opportunity to meet at considerable length with Mr. Derek Sowell, representative of the applicant for USR 17-0012. At the time of that meeting, Mr. Moser was satisfied with the representations made by Mr. Sowell, and in particular, Mr. Moser was pleased to discover that the primary access route for recreation users of Milton Reservoir would be from County Road 49 westward along County Road 32 to the reservoir. Since it is Mr. Moser's understanding that the vast majority of recreational users will follow that route, the concerns over additional traffic interfering with or compounding the difficulties in use of the nearby roadways should be substantially reduced. As I believe my previous correspondence to you indicated, our clients are not opposed to the application for use of Milton Reservoir for such recreational purposes. Our clients' concern has been the additional burdens on the nearby roadways and possible interference with existing or future traffic patterns. By and large, these concerns have been properly addressed. EXHIBIT May 26, 2017 Page 2 Please allow this letter to serve as a supplement to my earlier correspondence to your offices concerning this USR application. I appreciate your attention to this matter. Barry JJB: rew CC: John Moser, Ellen Moser Wes Moser Inc., Morwai Dairy LLC johnmoser@comcast.net Derek Sowell derek@havensboarding.com Dear Mrs. Kirkmeyer , and all others that this would apply to: We live at 15114 CR 47 LaSalle, Co. We have been there since 1995, before pelican lake, before the Anadarko and Saddle Butte Oil stations. I was at the meeting for Saddle Butte. We were very much against the plant, but the commissioners said it was good to go, there were only four or five houses back there, well I am one of those houses. We now live with decreased property values because of the ugly tanks and pipes in the corner of that section of land also to include a salvage yard for the oil tanks. We have joined the Heaven sporting club, to be able to go down to the lake and camp. It has always been off limits for everyone that lived out there. Until pelican lake estates went in and they leased the surface right to the water. But still no one on the east side could access. They gave up the rights, Haven sporting club now has them for ten years. WE ARE THRILLED!!!! We are able to go there, they have cleaned it up s0000 much and made it a wonderful relaxing place and BEST of all it will give our property value back to us, you know the one the county took away from us with the oil facility, the corner that will blow us all up, the one we hear alarms going off every Saturday, and the ground shakes, and the lights at night that shine in our bedroom windows. But the people on the other side of the lake don't want campers, at night we try to see the campfires and to see if there is noise, there is NOTHING! They want to preserve the wildlife, they never even used it, we never seen a sail boat or anyone for that matter, Haven sporting club has made it clean and beautiful, along with all of the members, wildlife will not be affected. They have made a lot of rules for people to follow moor than any other lake than we have ever been at. We have had nothing but trouble from the county with easements, oil field, etc_.. This is a GOOD thing for this area. They are not accessing any area of the pelican lake houses. No one is entering or exiting through there. Everything is on the east side of the lake, The oil truck have messed up the road for us to get to our house, we are always asking for it to be fixed, and pelican lake is saying they don't want people to drive on the roads that don't live there, where do you think the oil trucks come from??? The lake don't belong to pelican lake estates, or so they think. It is MILTON RESERVOIR! Its for the people who want to enjoy it. We are willing to pay for a membership that will improve my property instead of it always being something bad, its a GREAT!II thing. I will plan on being at the meeting on July 19 at 10:00, I am willing to talk to anybody about this situation or easements etc... My phone number is 970-301- 0453. We were both born and raised in Colorado and love the outdoors, particularly boating and camping. As I am sure you are aware, camping spots are very hard to come by in this beautiful state because of the rise in population. When we heard about the Haven Sporting Club memberships we were absolutely thrilled and jumped at the opportunity. We have already spent four weekends at the lake and plan on many more. We have done a lot of clean up and work at our lot including grading, ptcicirlg np trash and debris, mowing, and setting up a dock. We have three young kiddos and we really enjoy the chill, laid back culture that Haven has provided. It is calm and quiet; a place full of hardworking and responsible adults and their lovely children. We vehemently request that you do not prohibit us from camping at this beautiful lake. Please do not deprive my family of the amazing memories I am sure we will make this summer and many to come in the future. Thank you for your consideration, Beth Welsh Weld County Commissioners Re: USR17-001 Good Day, I am a resident of Weld County and I would like to support the application for a campground at Haven Sporting Club. I believe that this will be a great addition to the property and County that will add recreation opportunity for my family and other residents. Over the last decades Milton Reservoir had become an area that was overgrown, filled with debris, and had fences that were falling down or missing. Since they have taken over the transformation has been huge_ I am very impressed with the work and commitment they are making to create a space that is beautiful and benefitting our area. With the addition of the campground I know that groups like the Girls Scouts and Boy Scouts will have a place to camp. Also in their plans that they have shared there will be opportunity for many types of camping and events including for the area school. This is a strong contribution to our community. With the clean up that Haven has clone there will be a return of wildlife for our enjoyment. As a concerned environmental citizen I know the restoration work that they have done is important and will preserve the land. This is important to me. I support the application for the campground and look forward to its development. Sincerely, EXHIBIT I 1a Weld County Planning Services 155 N. 17th Ave Greeley, CO 80631 RE: Case No. USR 17-0012 Dear Weld County Commissioners, As an outdoorsman with a high concern for the environment, I am writing to endorse Haven Sporting Club's plans for Milton Reservoir, as their work will improve our natural resources and therefore benefit all of Weld County. Instead of exploiting Milton Reservoir for commercial gain, Haven is going to great lengths to improve the state of its environment. They have replaced over seven miles of cattle fences, removed harmful weeds so that more beneficial plants can grow, and cleaned up the debris, which had previously damaged the environment and posed a high risk for fires. Haven has reintroduced cattle to graze on the land, and they are currently preparing to plant 500 acres of native grasses, dryland corn, milo and millet, which will create an ideal habitat for other wildlife. In order to protect this habitat, they educate their members and guests on how best to care for the local plants and animals. Haven Sporting Club has further proven their environmental by joining the Colorado Parks and Wildlife Aquatic Nuisance Species prevention program. Finally, they are state certified as a Negative Prevention Water, and they ensure that all boats on the property meet environmental standards. I trust the work that Haven Sporting Club is doing, since they have already proven themselves to be wise and careful stewards of Colorado's natural resources. Please approve USR17-0012. Opening up Milton Reservoir will benefit our community both now and in the years to come, as investing in our environment means investing in our tomorrow. Thank you for your consideration I Sincerely, EXHIBIT Weld County Planning Services 155 N. 17'h Ave Greeley, CO 80631 RE: Case No. USR 17-0012 Dear Weld County Commissioners, As a constituent, I am writing to ask that you approve Haven Sporting Club's application to open Milton Reservoir up for commercial camping because doing so will bring economic and social gain to our entire community. The work that Haven is undertaking at Milton is an excellent example of how to make the most of the natural resources that we have without using them up. The greatest wealth of Colorado is her landscapes, and Weld County needs to utilize the gorgeous reservoirs that we have instead of wasting them away behind locked fences. Haven's plans for the property would create new job openings within the reservoir and would also boost the economy beyond Milton through members' continued shopping and eating. Small businesses would see increased sales as Denver residents travel through Weld County on their way to the reservoir. Colorado Parks and Wildlife wouid benefit by selling new hunting and fishing licenses, while nearby vendors would sell gear to new sportsmen. Furthermore, the environmental improvements that Haven has been investing in the land have increased its value for FRICO shareholders, while their agricultural expansion is giving many local farmers a higher earning potential. Haven's application USR17-0012 is a good business decision for Weld County. For us to continue moving forward together, we should support this plan and invest in our own backyard. I appreciate your time and attention. Sincerely, 17' 7' [z .M Y,, CU May 30, 2017 To whom it may concern: I would like to write this letter to support the application for Haven Sporting Club to open a campground at Milton Reservoir. In the time that the applicants have taken over the management of the land there have been great changes that have supported the return of agriculture to the property. Haven replaced cattle fences, removed weeds, and brought cattle back to the property. By reintroducing things like native grasses, Haven will be restoring the property to a valuable resource in the County. I appreciate the care that Haven has taken to make sure that they are an active part of the neighborhood. The manager at the lake has helped by keeping an eye on the surrounding properties and reporting any out of place behavior. I am very happy to have Haven as our neighbors and I know that with the campground they will continue to add value to our County. Please let me know if I can help further. Respectfully. Vehicles made earlier than 2000 are prohibited as they may contaminate the soil and water. • Haven brings awareness for animal species, the necessity to be environmentally friendly, and protect animals and vegetation. • There are future plans to ensure recreational activity on -site education will finally be possible for members and residents! Clearly, Haven has displayed their dedication to wildlife, which must be taken as a priority in Weld County. Thank you for your consideration. Opening up the reservoir for commercial camping would not simply be good for members; it would also be good for the land itself and for the community. I am a long-time club member, and over the years I have seen that Haven undertakes its plans with wisdom, careful planning, and ethical responsibility. For example: • Haven has updated over seven miles of cattle fences in the reservoir, cleared out the trash and debris that had polluted the area, and planted healthier natural grasses throughout the property where harmful weeds used to grow. • They are a part of the Colorado Parks and Wildlife Aquatic Nuisance Species prevention program and are certified as a Negative Prevention Water. • All members and guests of Haven Sporting Club must abide by prudent club guidelines and receive additional training in how to enjoy and protect nature at the same time, which makes us more responsible sportsmen when we enter other locations. • Haven's plans for Milton Reservoir will create new opportunities for jobs, training programs, and youth camps and activities. Haven Sporting Club has been developing Milton Reservoir with more than their own gain in mind; they have been cultivating the property to enrich the entire county. By bringing camping to Milton Reservoir, Haven will relieve some of the crowds around other lakes and give residents a safe, controlled environment in which to relax. I believe that USR17-0012 is a smart idea that needs to be implemented. Please contact me if you wish to know more about my views. Thank you! Sincerely, • 5/26/2017 County Commissioners, I am sending this letter to confirm that I support the application for Haven Sporting Club to open a campground at Milton Reservoir. I believe this will be of great economic benefit to Weld County. The campground will make sure that there are new jobs created when it is approved. Members who spend time in the area will increase spending by shopping, eating, and getting supplies at local businesses. This will add to the existing improvements made at Milton Reseivoir that have added value to the property for the shareholders of FRICO. I have also seen that there are plans to develop property for education like: water, wildlife, minerals, agriculture, photography, sailing, canoeing, kayaking, and fishing. I am impressed by the level of development and dedication to preserving the area to date and for this reason I believe that the club will continue to enhance the beauty and value of the area and this will benefit the County overall. The addition of the campground will create further opportunity for public access and use of the area. I know that the work that Haven has done has been tremendous, including: • Improving the wildlife habitat through restoration of spaces to enhance populations of deer, bird species, and natural predators • Cleaning up thousands of tons of debris to restore the lake • Preparing to plant 500 acres of native grasses • Replacing over seven miles of cattle fences I am pleased to have them as my neighbour and this campground will benefit the area economically as well. I really feel this will add to the local businesses and add value to our County. The campground will be a place I use with my family. For all of the reasons noted above I support this application. Regards, EXHIBIT Weld County Planning Services 155 N. 17th Ave. Greeley, CO 80631 RE; Case No. USR 17-0012 Dear Weld County Commissioners, As you know, Haven Sporting Club has applied for permit for commercial camping at Milton Reservoir. I am writing to offer my strong support for their endeavor as I have seen the transformation under their care already for the property. Many of us have been deeply concerned about the state of the reservoir, and surrounding area when the previous lessor had that property. That has all changed now with Haven Sporting Club, including access to this prized land. I have grandchildren and knowing that the property is being cared for in that way, will be available to enjoy for all, and will be there for my great-grandchildren means a great deal to my family. Our neighbors also feel similarly and want to have access to this beautiful land that is being carefully restored to how it was meant to be. After decades of neglect, Haven has turned what was once an overgrown, fire hazard full of debris and rotting wood and brush into a wildlife habitat with a beautiful lake and a place that visitors from the surrounding area and state can truly use safely and enjoy. It will mean jobs for our community and education for our young people, such as youth camping and outdoor events, public and private school outdoor field trips, and Boy/Girl Scouts events at the reservoir. This means revenue for our county and state from the sale of hunting and fishing licenses, as well as vehicle, recreational and boat registration and purchases. It also has increased the value of the property, which in turn benefits our residential and business property values, as well as those those of local farmers. Weld County has been extensively developed and the natural habitat deserves equal attention as to care and development. With Haven, this can finally be possible after almost 60 years of neglect, disuse and barred access. It would mean a lot to the community, county and state to have this permit approved and it would make a real difference to the youngest generation, my grandchildren„ and for generations to come. Weld County Planning Services 155 N. 17th Ave Greeley, CO 80631 RE: Case No. USR 17-0012 Dear Weld County Commissioners, Please approve Haven Sporting Club's application USR17-0012, since it is an environmentally conscientious plan for allowing commercial camping at Milton Reservoir and sharing Colorado's beauty with its citizens. am a member of Haven Sporting Club and a resident of Weld County, and I have experienced firsthand the care that they take to abide by all local and state ordinances and to do responsible, sustainable business. Haven requires all members and guests to abide by strict guidelines so that those of us enjoying the property are not endangering its future well-being. For example, they will not allow vehicles older than 2000 into the reservoir in order to protect the water and soil from increased contamination, and they will inspect every boat that is brought onto the Milton property. Additionally, they educate all members on how best to care for the animals and plants that we encounter, which makes us more responsible stewards of the environment not only while at Haven but also while interacting with other parts of Colorado's landscape. Of course, I am also interested in the recreational opportunities that would come from allowing camping at Milton Reservoir. This would be an excellent location for young people and families to spend more time outdoors and would therefore increase revenue, benefiting both the individuals enjoying the reservoir and our local economy. I am satisfied with Haven's plan to offer a pleasant nature experience to community members in a way that sustains the environment rather than exploiting it. I am firmly in favor of USR17-0012, and l hope that you will approve it soon. Thank you so much! Sincerely, /07 Dear Weld County Commissioner, As is well known, Haven Sporting Club has removed thousands of tons of debris over the last couple months, drastically improving the agriculture of the area. This in and of itself is excellent, but it is important as well to look at the impacts on heritage community decisions have. If USR17-0012 is approved, Haven will give historical families access to the Milton Reservoir once again; a privilege which was formerly taken from them, Haven Sporting Club will provide high potential revenue to farmers whilst preserving the outdoor heritage of Weld County. Hunting, Fishing, Ccimpr'g and Waterskiing agriculture heritage has declined, but will be able to reemerge with the services provided by Haven Sporting Club. Strengthening our heritage is an integrally important in Weld County and in Colorado- Clearly, approving USR17-0012 so that ',laver' Spartij7rgg Club will be able lo operate in Weld County will be an excellent move to preserving °lit rich heritage. I truly believe that this development will benefit our County in the strengthening of community. It will provide opportunities for outdoor enthusiasts like myself to participate in water activities like kayaking and canoeing. Another great benefit will be the availability of the campground for community groups such as Girl Guides and Boy Scouts, It is important in building the traditions of Weld County to have spaces for these groups to use to learn new skills. Weld County residents oftef7 struggle to find peaceful sites for outdoor recreation that ore not crowded by tourists While Denver's expansion has brought wonderful growth to our community, its urban lace .arid busy masses have also made it more difficult for the people of Weld County to find mon-lents of rest in nature. We need a private, protected patch of land where we can be rejuvenated. Haven plans to create opportunities at Milton for hunting, fishing, camping, waterskiing, and more. Although Colorado is famous for its natural recreation, the sad reality is that Weld County citizens have had a steady decline in hunting and fishing over thn past six decades. Creating a new space where we can rediscover our connection with the outdoors would help preserve our community's culture and introduce a new generation to the simple joys of being outside. Just as the times we live in are becoming increasingly complex, so progress for Colorado must also be complex. The right step for Weld County is to embrace the twenty-first century with its technological and economic advances— while also holding fast to our natural inheritance and outdoor roots. Their accomplishments on a property that many had long forgotten or written oft for decades speak for itself. They have: 1. With an approved application for commercial camping, this will only continue to benefit those same people and businesses, which further adds to the communities, county and state as a whole This also means an increase in employment for residents and increased revenue for all businesses surrounding the reservoir. The positive benefits of Haven's care of the land is extensive. They have already made an incredible impact on the lake, wildlife and natural habitats of the land. Their planned endeavors tor education and recreation are greatly needed as the lakes and state parks of Colorado are overcrowded and Haven will provide a safe boating and camping environment for all those who visit. In the past two months, Haven Sporting Club has made tremendous strides to address the neglect left by previous lessors and restore the reservoir to its proper state of care as a habitat lit for wildlife and visitors to enjoy for many years to come. Haven Sporting Club is currently evolving to be approved for commercial camping on their grounds. This application, submitted to the county, If approved, would lurther the positive development of the property and allow access to it by the community and visitors from all over. This access has been denied to us for many decades and we are eager to see the reservoir and surrounding property put to full and beneficial use. The domino effect on our community, county and state is far-reaching: b Haven has cleared thousands of tons of debris, some of it a fire hazard. I am a member of the Club and cannot say enough about what they have achieved in a very short period of time on precious land that has been ignored for far too long my previous lessors. As a native Colorado resident, with children who have grown up in Weld County, I value the land and unique environment here. We are fortunate to have such a beautiful piece of land in our community, and even more fortunate that Haven has taken on this enormous task of making it usable again and ensuring that the habitat, wildlife and the environment, are not only protected but restored. • There are already signs of increasing numbers of deer, a variety of species of bird, and also natural predators, which are so important to maintain a balance in a delicate ecosystem. • They have removed thousands of tons of debris and deadfall, which were a fire hazard and a danger to the surrounding communities. • They are ensuring that older model cars, prior to 2000, are not allowed on the premises to protect the land that they are making pristine by their efforts. • They have replaced over 7 miles of cattle fences and have brought livestock to graze as livestock. They will also be growing their own feed grain as well, • They have voluntarily joined the Colorado Parks and Wildlife Aquatic Nuisance Species prevention program, and have paid to become certified with the state as a Negative Prevention Water in order to ensure every boat that enters does not bring in any invasive species. • The rent for Haven is quite higher in order to operate their sporting club and this additional revenue offsets any costs to local farmers in regards to cost of irrigation water. It also pays for: o Maintenance and improvement of irrigation ditches, and o Maintenance and improvement of water storage facilities Haven only adds to the community with its efforts and the revenue it generates. As a member, I shop at local businesses, have purchased needed equipment and gear, and dine and shop in and around the reservoir. I hope to see more residents and visitors enjoy what I know is possible at Haven and will only continue to improve under their leadership. Sincerely, 6\r\y''\& aL. 7IND5 S, 91-uifor6,j 1L. This is an excellent development for this area. So far my experience with Haven has been a positive one. I know I am excited about the work that they are doing cleaning up the lake and the land around it. Haven is bringing many benefits to our County: • Being a good neighbor, cleaning up the property and watching out for any safety issues B Protecting the environment, protecting animals and vegetation by cleaning up the area and restoring natural grasses and making sure the waterway is not polluted by invasive species • Supporting local community groups, creating a public space to enjoy outdoor activities. I know that the work they have done so far has had an impact and l am happy to know that the property will be taken care of for future generations to enjoy. The campground will be a good addition to this work. We believe that the current and future upkeep of the reservoir provided by Haven as well as their plans to improve and beautify the land will benefit our community and county. Haven has made many positive changes already and has ambitious plans to continue to do so: 1. They have cleared the land of unwanted and dead weeds, trees and bushes, which has made it more accessible and friendly for wildlife to return and nest there. 2. They have paid for certification by the state to be part of a voluntary program to prevent the spread of nuisance species, such as mussels. They are one of the only private lakes to do so in the state. 3. They have restored the land to make possible for agricultural use as well and already have grazing cattle being raised for livestock. 4. They are going to plant native grasses as well as dryland corn, milo and millet to be used for feed grain for the livestock. 5. They plan on being a location for education in regards to camping, boating, wildlife, hunting, and fishing. 6. Their entire focus is on restoration, awareness and protection of environment and wildlife, recreation and education, and becoming environmentally friendly to animals and vegetation. This is all part of their mission at what they teach to their members and guests with every visit. 7. In fact, they are not allowing cars that are from prior to the year 2000 on the premises to protect the environment from any contamination that comes with older models. This part of the country values our outdoor spaces and natural habitats. We want to have full access to enjoy them and to protect them. Haven does all this and more. O There are already signs of increasing numbers of deer, a variety of species of bird, and also natural predators, which are so important to maintain a balance in a delicate ecosystem. * They have removed thousands of tons of debris and deadfall, which were a fire hazard and a danger to the surrounding communities. • They are ensuring that older model cars, prior to 2000, are not allowed on the premises to protect the land that they are making pristine by their efforts. • They have replaced over 7 miles of cattle fences and have brought livestock to graze as livestock. They will also be growing their own feed grain as well. • They have voluntarily joined the Colorado Parks and Wildlife Aquatic Nuisance Species prevention program, and have paid to become certified with the state as a Negative Prevention Water in order to ensure every boat that enters does not bring in any invasive species. I hope to see more residents and visitors enjoy what I lmow is possible at Haven and will only continue to improve under their leadership. I have personally seen the property deteriorate over the decades and am thrilled to see it being well taken care of and put to good use. The amazing transformation of the property speaks volumes to the care and commitment of Haven Sporting Club to the land, the wildlife, and the future of the lake, neighborhood and county: c Haven Sporting Club has recently been certified with the state as a Negative Prevention Water and inspects every boat before entering their property. In fact, they are one of the only private lakes that has joined the Colorado Parks and Wildlife Aquatic Nuisance Species prevention program. • In only two months, they have removed thousands of tons of debris, invasive species of plants, and fallen and rotting trees and brush. a They are already increasing and improving the wildlife habitat to attract more native wildlife to the area. Development like this is crucial to our area. We need stewards of the land who are willing to invest in sustainable improvements to our land, water and wildlife while also providing jobs, education and recreation to our residents. • This means better property values for residents and businesses. e A significant attraction to the area that will bring in more revenue. a Education will be available to visitors regarding invasive species, hunting, fishing, camping, boating and safety, agriculture, and native wildlife and plants. a Opportunities for hunting, fishing, photography, camping, boating, youth camping and outdoor events and more. Agriculture is an important segment of our community and has had pressure placed on it by urban development. In just two short months, Haven has already removed thousands of tons of refuse and deadfall, removed invasive weeds and replaced them with beneficial plants and grass, has replaced over 7 miles of cattle fences, and returned cattle to the open pastures to graze and raise livestock. In addition, they are working to plant another 500 acres of native grasses and wildlife habitat. This will make a difference in terms of attracting wildlife and also safeguarding the land from issues later with issues with weeds and overgrowth_ For over 30 years, no one has access to that beautiful land while it continued to deteriorate and actually become a fire hazard, Now, the plans are to provide a multi -purpose recreational area open to all with plans for outdoor education for boating, fishing, hunting, camping, wildlife, minerals, and agriculture. This means a better understanding of how to take care of the land and use it safely. This is especially important for our young people. All of this adds up to revenue for local, county and state resources and best practices for the use of valuable and precious land, particularly as they have voluntarily joined to become part of the Colorado Parks and Wildlife Aquatic Nuisance Species prevention program. All of their actions to date have shown an incredible respect and care for our land and all that resides in it, from the smallest plant and creature to the neighbors and community at large. Benefits for Preserving Heritage ▪ The expansion of the Denver metro has put significant pressure on available Agricultural land in Weld County. Pelican Lake Ranch is an example of this which converted Agricultural land into residential homes in the Weld County Agricultural Zoned District. Milton Reservoir was formerly leased by this residential development which prevented the historical local families from enjoying this amazing property. Haven Sporting Club is giving these historical families access to the reservoir once again_ • Lease of Milton Reservoir went out to competitive big in the summer of 2016. Many uses were presented for Milton Reservoir. Haven Sporting Club was awarded the lease because their proposal provided a high revenue potential for Farmers while preserving the outdoor heritage of Milton Reservoir and Weld County. • Hunting, Fishing, Camping and Waterskiing is part of the Agricultural heritage of Weld County. That is why these items are listed as an Use of Right in Weld County. It is Haven Spoiling Club business plan to provide these services to the constituents of Weld County. • Over the past 60 years, the hunting heritage in Weld County has been on a significant decline limiting mothers, fathers and children easily accessible places to hunt, fish and recreate (including camping). Haven's number one concern is upholding the heritage that has been lost due to urban development in Weld County. Benefits to Constituents • Allows users to escape to a natural area of Colorado to detach from busy life style. • increase quality family time away from distractions • For 30 years, Milton Reservoir has been closed off to the public. Colorado Parks and Wildlife would benefit by selling new hunting and fishing licenses, while nearby vendors would sell gear to new sportsmen. Furthermore, the environmental improvements that Haven has been investing in the land have increased its value for FRICO shareholders, while their agricultural expansion is giving many local farmers a higher earning potential. For example: m Haven has updated over seven miles of cattle fences in the reservoir, cleared out the trash and debris that had polluted the area, and planted healthier natural grasses throughout the property where harmful weeds used to grow. a They are a part of the Colorado Parks and Wildlife Aquatic Nuisance Species prevention program and are certified as a Negative Prevention Water. ▪ All members and guests of Haven Sporting Club must abide by prudent club guidelines and receive additional training in how to enjoy and protect nature at the same time, which makes us more responsible sportsmen when we enter other locations. Thank you! They have made so many environmental improvements to the property that I cannot list them all in one letter. Some of their developments include: • Haven has chosen to pay extra rent to the FRICO shareholders in order to invest in the maintenance and improvement of irrigation ditches and water storage facilities. • Their environmental education programming empowers local residents to care for the resources that we have. They teach members and guests how to protect key flora and fauna while keeping the community informed about the dangers that Aquatic Nuisance Species like mussels pose to bodies of water• . In two months' time, Haven has updated old cattle fencing, removed trash and weeds from the land, and made plans to reintegrate native grasses back onto the property. • Haven has made decisions with the dual ends of improving the environmental health of the property and of increasing the aesthetic beauty of members' lots. Weld County could not find a more responsible tenant for Milton Reservoir than Haven Sporting Club, and I trust the plans that they have made for its future. I stand with USR17-0012 and hope that you will do the same. Thank you for your time, and please contact me with any questions. Over the last decades Milton Reservoir had become an area that was overgrown, filled with debris_ and had fences that were falling down or missing. Since they have taken over the transformation has been huge. I am very impressed with the work and commitment they are making to create a space that is beautiful and benefitting our area. Instead of exploiting Milton Reservoir for commercial gain, Haven is going to great lengths b improve the state of its environment. They have replaced over seven miles of cattle fences, removed harmful weeds so that more beneficial plants can grow, and cleaned up the debris, which had previously damaged the environment and posed a high risk for fires. Haven has reintroduced cattle to graze on the land, and they are currently preparing to plant 500 acres of native grasses, dryland corn, milo and millet, which will create an ideal habitat for other wildlife, In order to protect this habitat, they educate their members and guests on how best to care for the local plants and animals. I served on the Barr -Milton Watershed Association for about six years and am very familiar with the water quality issues and the measures that were taken to improve the water quality of Milton Reservoir including stopping the cattle grazing on Milton and Lake Christina due to the direct pollution caused by cows around and in the shallows of the lakes. In this busy and sometimes scary world that our children and grandchildren live in, it would be a blessing to Weld County and Northern. We strongly believe that the world can truly be a better place if these very basic opportunities of being able to work together, play together, grow together and enjoy the beauty of the great outdoors together are available For families. Opportunities to build fasting relationships in settings like this are missing in our society today and we can't imagine what could possibly keep Weld County from wanting to support such a wonderful endeavor and investment in the Future of Families and children. With sincere appreciation for your consideration, 711,_ Crary and Cyndi Thalwian 785O Hillsboro Court S. Fort Collins, CO 50525 EXHIBIT so tip'-CQl2 To: Weld County Planning Commission, Weld County Commissioners From: Jane Evans Cornelius, Hampton and Kay Cornelius, Coyote Ridge Ranch RE: USR17-OO2 As adjacent land owners, we strongly oppose the issuance of permits for 150 camping spots and related activities for the following reasons: 1) Milton Reservoir and the surrounding area is a sensitive riparian environment which supports many forms of wildlife (some endangered or threatened). That environment would suffer significant damage. See Environmental Impact Study done in 1997 for details. "No wake" boats with 5-10 HP motors and minimum human activity was recommended. 2) 150 camping spots pose a serious threat for wildfire. The county does not have the resources/emergency responders to prevent and/or control this threat. Overnight camping, by its nature, will increase risk of fire and other potentially dangerous outcomes. Do Weld County emergency responders have the ability to quickly and effectively react to and manage emergencies that are CERTAIN to occur? There have been multiple wildfires in the county in recent years, and as we saw early this spring in northeastern Colorado, suclkfires have devastating effects on agricultural lands, local communities, and local economies. That argument can be made easily and strongly, especially as volunteer firefighting agencies would be responsible. 3) Oil and gas activity, multiple wells, and a spider web of pipelines multiply the danger. 4) The promoters of Haven Sporting Club have demonstrated questionable business practices and a total disregard for adjacent landowners. We have had issues with cattle owned by a sub lessee that posed a real threat to our operation. 5) 150 campers will produce human waste and trash which cannot be safely and properly disposed. This will create issues for adjacent landowners and for irrigators using the water. 150 campers is almost 2 times the number of houses in Pelican Lakes Subdivision. 6) 150 campers pose a threat to county roads due to increased traffic and an increased expense to the county with no commensurate increase in revenue. 7) There is a risk of trespassers, ATVs and dirt bikes to adjoining landowners. 8) Milton Reservoir is an irrigation compound primarily being used to store water for agricultural and municipalities. The lake is regularly drained down to low water levels and occasionally emptied for dam maintenance. Pollutants.are multiplied to unsafe levels during low water levels. 9) As a final prong of argument, this club seems to have a sense of entitlement. Holding a day -use permit for fishing and boating in no way suggests entitlement to further use, regardless of the fees club members pay. It's important to remember the lake's primary mission is to serve as part of a water -management and delivery system for Front Range agriculture and communities. Limited fishing and boating are logical -secondary uses, but construction and use of an overnight EXHIBIT (11) 3- -Co camping facility require a much higher level of public oversight, response preparedness, and associated cost. That might not make sense, given that the expense would amount to a special accommodation for a single group of private owners: In summary, the issuance of permits for 150 campsites and the related uses by Haven Sporting Club would have a negative impact on the health and welfare of Weld County residents.
