RECOMMENDED ACTION:
The historic flow is across Mr Lang's property. Public Works crews have done nothing to
alter that nor have we lowered the road surface to increase the amount of highwater flow
that Mr. Lang would experience. My response letter was reviewed by COmmissioner
Freeman and is attached.

Mr Lang,
Thank you for your letter of May 23, 2017 in reference to the heavy rainfall issue on CR 84. As
you are aware, the natural flow of the runoff water is south across CR 84 from Mr. Simpson's
property onto yours. The area is exceptionally flat through there making it impossible to divert
water via a roadside ditch either east or west in order to avoid your property. The historic flow
of the runoff is across your property.
Working within the right-of-way, Public Works crews widened the road surface and re -graveled
the roadway through the low area. We lowered the road surface by less than an inch. We know
this from comparing the drift line from previous high water events to the drift line from the one
that occurred last month. As you stated in your letter, you received heavy rainfall from that
particular storm and varying degrees of flooding should be expected through low lying areas, and
your property is in a low lying area.

On May 18, 2017, Weld County, Colorado experienced heavy rainfall. I experienced
increased flooding duration and inundation due the road construction performed by Weld
County crews in August 2016. The county lowered the surfaced grade of road 84 from 4-
6 inches. Prior to the county's actions the roadway provided some detention storage
south of road 84. I receive runoff of my neighbor's field and upstream, which are
unwanted waters. The County's action created increased drainage problems at 20622 and
20708 CR 84. See attached photos.
On September 23, 2916, I met with Mike Livengood, Curtis Hall, and Duane Neibauer
regarding how the County work increased flooding problems. Presently the county has 3
— 18 inched culverts that drain directly onto my lands with NO outfall drainage system. I
explained this condition to the Weld County officials. Their answer was "we have the
right to drain water on to your land," AND they drove off..
So why is this elevation of county road 84 so critical to me? There is no outfall
channel/road ditch to Owl Creek on road 84. At my expense with no financial assistance
from the County. I installed a 15 inches culvert under the L -W Irrigation Canal. You
compute the hydraulics: 3 -18 inch culvert under road 84, county road 84 acting as broad
crest weir all pouring into my 15 inch culvert. I need the upstream detention storage to
give my Pipe some relief during flood. Why do I have to provide a flood control system
for the County? Why don't upstream property owners have to install on site detention for
storm runoff?
In the past, prior to road re -grade I have experienced more intense rainfall amounts with
less inundation. I await your timely response to this unacceptable condition.
