BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
SEPTEMBER 27, 2017
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, September 27, 2017, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner Julie A. Cozad, Chair

Commissioner Sean P. Conway
Commissioner Mike Freeman
Commissioner Barbara Kirkmeyer — arrived at 9:01 a.m.

MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County
Commissioners meeting of September 25, 2017, as printed. Commissioner Conway seconded the
motion, and it carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.
CONSENT AGENDA: Commissioner Moreno moved to approve the Consent Agenda as printed.
Commissioner Freeman seconded the motion, and it carried unanimously.
PROCLAMATIONS:
1) ADULT EDUCATION AND FAMILY LITERACY WEEK - SEPTEMBER 25-30, 2017: Chair Cozad
read the certificate for the record to encourage Weld County residents to invest in adult education.
Commissioner Kirkmeyer emphasized the importance of Adult Education and the Bright Futures
Program. Commissioner Conway stated Weld County has a strong history of supportive Adult literacy
programs. (Clerk's Note: the Board paused the meeting for a photo opportunity.)
PUBLIC INPUT: No public input was given.
COMMISSIONER COORDINATOR REPORTS: = Commissioner Freeman announced he met
with Commissioners from Morgan County. He also reported he will be handing out gas monitors at Eaton
Town Hall on September 28, 2017, between 6:00 and 7:00 p.m. Commissioner Conway attended an
Elected Officials Luncheon in Carbon Valley. He stated he and the other Commissioners attended the

City of Greeley Chamber of Commerce for the Leadership Weld County Group which encourages
participants to take on a leadership role. Lastly, he attended the Grand Opening of the Gilcrest Library.
Commissioner Moreno attended the Greeley -Weld Airport Board meeting and then attended the
Upstate Board meeting with Commissioner Freeman. a Commissioner Kirkmeyer stated she was at
the Energy Committee in Denver. She and Commissioner Conway and Chair Cozad attended the
opening of the Evans Fire Station. She stated she met with the Town of La Salle to discuss ways to
improve the safety of the U.S. Highway 85 Corridor. She reported she distributed gas monitors in the
Town of Hudson and then she will go to the Town of Erie on Thursday. Lastly, she reported they are done
negotiating the Memorandum of Understanding for the Colorado Works Program and the Child Care
Program. Commissioner Kirkmeyer thanked Karin McDougal, Assistant County Attorney, and Jamie
Ulrich, Department of Human Services, for their hard work on getting all the information. a Chair Cozad
stated she distributed the gas monitors in the Town of Firestone. She thanked Karla Ford,
Commissioners' Office Manager, and the Planning Staff for making sure that the residents receive gas
monitors. She stated she will be at the Town of Milliken at the Front Range Fire Station, to distribute
monitors. She attended the Freedom Parkway meeting. She spoke at a Regional Women's Conference,
a group called Zanta addressed Domestic Violence and Human Trafficking issues. She also gave a
hand-out to the Board regarding Preventing Substance Abuse. She stated she will continue to advocate
for our County Veterans to work on getting a Veteran's Medical Clinic here in Weld County. Commissioner
Conway expressed his appreciation to Maria Seacrest, representative of Senator Gardner's Office for
arranging the conference call to address concerns about a Veterans Clinic.
BIDS:
kg 1) PRESENT BID #B1700133, PROXIMITY DOOR SYSTEM UPGRADE - DEPARTMENT OF
BUILDINGS AND GROUNDS: Rob Turf, Department of Purchasing, presented the six (6) bids and stated
staff will bring back a recommendation on October 11, 2017.
• 2) PRESENT BID #B1700134, CISCO SWITCHES - DEPARTMENT OF INFORMATION
TECHNOLOGY: Ryan Rose, Director of the Department of Information Technology, presented the twelve
(12) bids received and stated staff will bring back a recommendation on October 11, 2017.
• 3) PRESENT BID #B1700135, FORTINET MAINTENANCE — DEPARTMENT OF INFORMATION
TECHNOLOGY: Mr. Rose reviewed the seven (7) bids received and stated staff will bring back a
recommendation on October 11, 2017
4) PRESENT BID #B1700136, FORTINET FIREWALLS — DEPARTMENT OF INFORMATION
TECHNOLOGY: Mr. Rose presented the eight (8) bids received and stated staff will bring back a
recommendation on October 11, 2017.
NEW BUSINESS:
• 1) CONSIDER 2018-2020 COMMUNITY SERVICES BLOCK GRANT (CSBG) APPLICATION
AND PLAN PROPOSAL AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of the Department
of Human Services, reviewed the terms of the grant application for a three (3) year plan. She stated the
funds are to assist low-income residents of Weld County. No public input was offered concerning this
matter. In response to Commissioner Conway, Ms. Griego stated they obtained input from the
community through the Human Services Committee Board, who represents both the low-income
population as well as community agencies, and elected officials. Commissioner Kirkmeyer moved to
approve said Community Services Block Grant and authorize the Chair to sign. Seconded by
Commissioner Conway, the motion carried unanimously.

• 2) CONSIDER CONTRACT ID #1441 EXPENDITURE AUTHORIZATION FOR VARIOUS
WORKFORCE DEVELOPMENT PROGRAMS AND AUTHORIZE CHAIR TO SIGN: Ms. Griego
presented the Expenditure Authorization in the total amount of is $1,205,115.00, which supports
Employment Services of Weld County. Commissioner Conway moved to approve said expenditure
authorization and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer,
and it carried unanimously.
3) CONSIDER CONTRACT ID #1442 EXPENDITURE AUTHORIZATION FOR MIGRANT
SEASONAL FARM WORKER PROGRAM AND AUTHORIZE CHAIR TO SIGN: Ms. Griego presented
the expenditure authorization for the total amount of $18,166.00, to provide support for the Migrant
Seasonal Farm Worker Program. Commissioner Freeman moved to approve said expenditure
authorization and authorize the Chair to sign. The motion, which was seconded by Commissioner
Moreno, carried unanimously.
• 4) CONSIDER CONTRACT ID #1443 AGREEMENT TO PURCHASE OUT -OF -HOME
PLACEMENT SERVICES AND AUTHORIZE CHAIR TO SIGN - LUTHERAN FAMILY SERVICES
ROCKY MOUNTAINS: Ms. Griego reviewed the details of the agreement for the negotiated rate
increase. Commissioner Freeman moved to approve said agreement and authorize the Chair to sign.
The motion was seconded by Commissioner Moreno, and it carried unanimously.
5) CONSIDER CONTRACT ID #1451 MEMORANDUM OF UNDERSTANDING FOR MEDICAID
ELIGIBILITY DETERMINATIONS AT SCHOOL -BASED HEALTH CENTER AND AUTHORIZE CHAIR
TO SIGN - SUNRISE COMMUNITY HEALTH: Ms. Griego presented the memorandum of
understanding with Weld County School District 6 to provide eligibility determination functions at School
Based Health Centers, supporting family health insurance needs at Sunrise Community Health.
Commissioner Freeman moved to approve said memorandum of understanding and authorize the Chair
to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously.
El 6) CONSIDER CONTRACT ID #1452 MEMORANDUM OF UNDERSTANDING FOR MEDICAID
ELIGIBILITY DETERMINATIONS AT SCHOOL -BASED HEALTH CENTER AND AUTHORIZE CHAIR
TO SIGN - WELD COUNTY SCHOOL DISTRICT 6: Commissioner Freeman moved to approve said
memorandum of understanding and authorize the Chair to sign. The motion, which was seconded by
Commissioner Kirkmeyer, carried unanimously.
PLANNING:
• 1) CONSIDER RECORDED EXEMPTION, RECX17-0136 - CHRISTOPHER AND KAREN BERG:
Ryder Reddick, Department of Planning Services, presented the request from the applicant to divide
Lot B into a two (2) lot Recorded Exemptions (RE) with one parcel being 10.28 acres and the other parcel
4.0 acres. He presented photos of the site and gave background on the RE. He stated the RE to divide
it into Lot A and B was recorded on February 23, 2009, and Lot B was 14.28 acres. He reported the
applicant stated there was no note on the plat advising they could not do another two -lot RE on Lot B,
because it is under the 35 -acre requirement. He explained the applicant wants to divide Lot B, for his
daughter to be able to build a future single-family home.
Christopher Berg, applicant, thanked the Commissioners for taking the time to evaluate his request.
In response to Commissioner Kirkmeyer, Mr. Reddick explained the property SPLIT met the intent
of the RE requirements, in 2009. Mr. Berg stated he wants another home built on the lot with room for
horses. In response to Commissioner Kirkmeyer, Mr. Berg clarified there is only a single-family home on

Lot A, and presented the history of the property. He stated, in 2009, they split off part of the parcel, sold
it, and maintained the 15 acres. Commissioner Kirkmeyer explained there isn't a need for a RE to farm
and lease ten (10) acres. She emphasized the intent of the RE process was not to be used to create
subdivisions. Commissioner Conway clarified the applicant was not aware the requirements for a
Recorded Exemption changed in 2010.
• Bruce Barker, County Attorney, stated when a landowner leases out part of a parcel, it creates an
interest and meets the definition of a Subdivision, according to the Weld County Code and clarified the
definition of a land split, according to the State statute.
• Commissioner Freeman stated the applicant's extenuating circumstances are that he was trying to
save the parcel and he is not attempting to avoid the subdivision requirements. Commissioner Freeman
stated he is in support of the recorded exemption. Commissioner Conway concurred with Commissioner
Freeman.
• In response to Commissioner Kirkmeyer, Mr. Berg stated there is a lease and already he submitted
with his application.
• Commissioner Kirkmeyer stated she feels that the applicant is evading the subdivision requirements
and she doesn't believe there are extenuating circumstances. Commissioner Moreno stated he agrees
with Commissioner Kirkmeyer.
• Chair Cozad stated she is in support of the approval of the RE, because she believes there are
valid extenuating circumstances, and read Code Section 24-8-20.A, which states the "Recorded
Exemption is a land division process used to divide a lot into separate parcels." She stated there is an
exisitng 40 -foot shared access.
• Mr. Reddick indicated there will be a note on the plat that the lot will not be subdivided again.
• Chair Cozad stated the extenuating circumstances are the landowner was not notified and there
wasn't a note on the plat. Commissioner Freeman clarified Lot B can always be split, with extenuating
circumstances. Commissioner Kirkmeyer addressed the notification process and referred to the process
of the Code change that there should be a demonstration of extenuating circumstances.
• Commissioner Conway moved to approve said Recorded Exemption, which was seconded by
Commissioner Freeman. Upon a roll call vote, the motion passed three to two, with Commissioners
Kirkmeyer and Moreno opposed.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved
