WHEREAS, heretofore by Resolution of the Board of County Commissioners,
Weld County, Colorado, a certain tract of land numbered RE 114 was approved
for recording as a recorded exemption pursuant to subdivision regulations as
were adopted by Weld County, Colorado, and
WHEREAS, it has now come to the attention of the Board that the parcel
of land that was approved for recorded exemption and numbered RE 114 was
erroneously described and said error has been brought to the attention of the
Board at this time, and
WHEREAS, it has now been determined by the Board that the parcel as
contained in the aforementioned recorded exemption numbered RE 114 should
be deleted in toto and that the hereinafter described legal description is the
correct parcel of land that should be exempt from the definition of "subdivision"
and is hereinafter more particularly described as follows:
That portion of the Northeast Quarter of Section 32, Township
6 North, Range 66 West of the 6th Principal Meridian, County
of Weld, State of Colorado, more particularly described as
follows:
Beginning at the Northeast corner of said Section 32, thence
along the North line of said Northeast Quarter West 1183. 50
feet to the TRUE POINT OF BEGINNING; thence South 0°07'40"
West 220. 00 feet; thence East 198. 00 feet; thence South 0°07'40"
West 243. 40 feet; thence South 0°04'20" West 1119. 84 feet to
the centerline of the Cache La Poudre River; thence along said
centerline the following courses and distances: North 54°30'06"
West 222. 26 feet; thence North 42°18'48" West 241 83 feet;
thence North 72°36'48" West 14. 81 feet to the East line of that
certain parcel of land described in Deed recorded in Book 554,
Reception No. 1476288, Records of said County; thence along
said Easterly line North 05°09'53" East 106. 72 feet to the Northerly
line of said land described in Book 554, Reception No. 1476288;
thence along said Northerly line North 68°55'47" West 610. 30
feet; thence North 0°45'07" West 945. 31 feet more or less to the
Northerly line of said Section 32; thence along said Northerly
line East 734. 60 feet more or less to the TRUE POINT OF
BEGINNING.
Said described parcel contains a gross acreage of 24. 52 acres,
more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of Weld,
State of Colorado, desires to acknowledge the aforementioned error in the
legal description as shown in the previous resolution as RE 114, and does
further desire to exempt the hereinabove described parcel of land upon the
recommendation of the Weld County Planning Director for the reasons as
stated and pursuant to its authority under CRS 106-2-33 (d), 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described
tract of land owned by Pete M. Koehn and Joyce B. Koehn, Greeley, Colorado,

be exempt from the terms "subdivison" and "subdivided land" as provided
for in the new Weld County Subdivision Regulations at Section 2-1, A. , (3)
adopted August 30, 1972.
BE IT FURTHER RESOLVED that the prior division of land heretofore
exempt and identified by exemption number 0805-32-1-RE114 be, and it
hereby is declared to be rescinded in toto and held for naught.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 5th day of February, A.D. ,
1975.

Dear Sirs:
The enclosed plat is in reference to a recorded exemption, numbered
RE114, which was approved by resolution dated March 27, 1974. It was
recently brought to the attention of the firm of Hogan and 0lhausen, P. C.
that the original plat was in error.
The error occurs in the southern end of the property and is shaded. The
acreage of the total parcel of ground is reduced from 26.56 acres to
24.52 acres.
The Plan ing staff recommends the Addendum plat be approved to correct
the igipal plat which is in error.

of the State of Colorado , enacted Senate Bill #35 as relates
to Chapter 106 of the Colorado Revised Statutes , and
WHEREAS , on August 30 , 1972 , the Board of County
Commissioners of Weld County, Colorado , adopted Subdivision
Regulations for Weld County, Colorado to comply with the
prescribed Senate Bill #35 , and
