does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-28-
101 (10) , CRS 1973, as amended, and
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as
amended, and Section 2-1A (3) of the Weld County Subdivision
Regulations;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Dr. Gerald D. Mossberg, Shelby
L. Burke and Claudia Burke, be exempt from the definition of the
terms, "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A (3) of the Weld County Subdivision Regulations.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 29th
day of December, A.D. , 1976.

Re: Recorded Exemption #243
Dear Commissioners:
The attached plat and related items are in reference to a request by
Gerald D. Wbssberg for a Recorded Exemption. The subject property
is described as part of the EA of Section 24, the EA SW4 of Section 24,
and part of the Si NW* of Section 24, all in T4N, R65W of the 6th P.M. ,
Weld County, Colorado. The location of the applicant property is 9 miles
east of Gilcrest and also 6 miles south and 2 miles west of Kersey, on
the NW corner of the intersection of County Roads 42 and 49. The request
is to split a 10 acre parcel with existing improvements fran a parcel
containing 369.62 acres.
The total area is currently non-irrigated agricultural land with soil
conservation capability of predaninately Classes V and VI. The pro-
posal as submitted will permit the applicant to bring two separate
parcels together for the purpose of locating circular pivot irrigation
systens. Placing two parcels together and creation of a 10 acre parcel
fran the combined parcel would not create any additional parcels fran the
current situation. Also,soil capability would be inuieased, if irrigated,
to predaninately Classes II, III and IV.
Based on the information submitted and the policies of Weld County, the
Staff recommends the request be approved for the following reasons:
1. The request canplies with the Weld County Comprehensive Plan,
the Intent clause of the Zoning Resolution, and the Intent
clause for Recorded Exemption in that the agricultural lands
are to be developed for higher and more productive agricultural
activity and the use is set in an agricultural surrounding and
will therefore be compatible;

2. The Farmers Reservoir and Irrigation Company has approved the
request subject to four zequirenents which would be completed
subsequent to the Recorded Exemption. being approved;
3. The County Engineer indicated the sequest should not create
any engineering problems;
4. The Environmental Health Services indicated a favorable
recommendation; and
5. All required items for Recorded Exemption have been submitted.

Dear Gerry,
Your request for a new headgate, weir and high side irrigation was
presented to the Farmers Reservoir and Irrigation Company board of directors
on December 1, 1976. The Board's decision was to approve your request
upon your completion of the below listed requirements.
1. A copy of your title or deed to the proposed sprinkled
property.
2. A copy of your agreement for the land to be used by the
proposed pond.
3. Verification of your ownership of the 7 shares of water
owned in the Milton division.
4. Completion of the Farmers Reservoir and Irrigation Co.
permit for high side irrigation.
Upon our receipt of the above listed items, we will fill out and send
to you, for your signature, the permit referred to in item #4.
It is also to be noted and understood that all expenses incurred from
the installation of the new headgate, tube and weir shall be borne by the
applicant.

Second Party agrees to transfer by way of exchange to First
Parties seven shares of the capital stock of The Farmers Reservoir
and Irrigation Company water for delivery from the Milton Re-
servoir in Weld County, Colorado, which shares are or will be
owned by Second Party, plus the sum of Twenty-Seven Thousand Nine
Hundred Ninety-Seven Dollars ( $27,997. 00) boot to be paid First
Parties. Said water stock is valued at $2,800. 00 per share.
Said water stock to be delivered to First Parties on the
date of closing of this transaction, together with delivery of
warranty deed and possession of said real property by First
Parties to Second Party.
The cash considerations for said property to be payable in
the manner following:
( a ) The sum of Five Hundred Dollars ( $500. 00) paid
herewith, receipt of which said sum is hereby acknowledged by
First Parties.
(b) The balance of said cash, namely $27,497. 00, shall
be payable on date of closing and delivery of warranty deed and
possession of said property in cash or certified funds.
THE FOLLOWING CONDITIONS SHALL ALSO APPLY:
1 . An abstract of title to said property, certified to date,
or a title insurance policy as evidenced by a title commitment in
an amount equal to the total consideration paid for said property,
at First Parties ' option and expense, shall be furnished to Second
Party on or before December 20, 1976.
2. Title to said water stock, free and clear of all liens
and encumbrances, shall be furnished First Parties on date of
closing, and title to said real property shall be merchantable
in First Parties and shall be conveyed unto Second Party by a
good and sufficient warranty deed on date of closing, conveying
said property free and clear of all liens and encumbrances and
reservations and easements, other than easements for public
highways, and prior mineral reservations of record.
3. First Parties shall comply fully with all subdivision
regulations of Weld County by obtaining from the Board of Weld
County Commissioners an exemption of this sale and exchange from
the terms of said subdivision regulations, if required under the
laws of the State of Colorado or the subdivision regulations of
Weld County, Colorado. Second Party shall operate his sump so
there will be no excessive seepage damage to adjoining land of
First Party, and will line said sump if necessary.

Dear Sirs:
I have contracts to purchase approximately 360 acres in section
24 Range 65 West 6 p.m. Weld County, Colorado. Approximately 280
acres of this land belongs to Shelby L. and Claudia Burke who will
keep ten acres with their existing home. This ten acre parcel is the
recorded exemption that we are applying for. The domestic water
supply to this parcel is by an existing domestic well and the sewage
is disposed of by an existing septic tank.
The adjoining 90 acres belongs to F. A. and Nancy Colman
which is identical to the Burke property which is wheatland and sage
brush which has been out of production four or five years. I plan
to develop it with circle sprinklers and put the land under irrigation.
I have purchased several shares of Farmers Reservoir and Irrigation
Milton Stock and have leased additional water to irrigate with.
I have applied for a permit for high side irrigation by the
Farmers Reservoir and Irrigation Co. At present I do not have
adequate water to irrigate with but feel confident that I may
purchase or lease enough water for adequate irrigation if I get
approval of this project.

EXCHANGE AGREEMENT
THIS AGREEMENT, Made and entered into this /V day of
December, 1976, by and between F. A. COLMAN and NANCY COLMAN,
hereinafter referred to as First Parties, and GERALD D. MOSSBERG,
hereinafter referred to as Second Party,
W I T N E S S E T H :
Whereas, the Parties intend to exchange ditch stock be-
longing to Second Party for land belonging to First Parties,
the First Parties hereby agree to convey by way of exchange to
Second Party the following described property, to-wit :
Parcel 1. A tract of land being the f% of the SWS>
and part of the S>.i of the NW%;4 of Section 24, Township 4 North,
Range 65 West, 6th P.M. , Weld County, Colorado being more
particularly described as : Considering the east line of said
Section 24 to bear 3. 00° 00' 00" W. , and all bearings relative
thereto:
Beginning at the S;,1 Corner of said Section 24; thence along the
south line of the E% of the SWki of said Section 24 S. 89° 53 ' 26" W. ,
1316. 11 feet to the SW Corner of the E?, of the SW': of said Section
24 ; thence along the west line of the E!$ of the S&I of said Section
24, N. 00° 32' 56" E. , 2673. 73 feet to the NW Corner of the Lt. of
the SW17,4 of said Section 24 ; thence along the south line of the
N'W%i of said Section 24, S. 89° 55' 42" W. , 304.46 feet to a point
on the east right-of-way line of The Farmers Reservoir and
Irrigation Company' s Gilmore Canal ; thence, N. 21° 08' 44" E. ,
53.64 feet along said right-of-way of the Gilmore Canal; thence,
N. 89° 55 ' 42" E. , 744. 52 feet to a point on a curve to the right
which has a central angle of 35° 44' 14" and a radius of 1619. 00
feet and the chord of which bears N. 58° 54 ' 45" E. , 993.54 feet
to a point on the east line of the SE%� of the NMi of said Section
24; thence along the east line of the SEk' of the NW/,:4 and the east
line of the E! of the SW'a of said Section 24, S. 00° 21 ' 00" W. ,
3234. 74 feet to the point of beginning. The above described tract
contains 87. 59 acres, more or less excluding rights-of-way reserved
for County Road purposes along the southerly side of said tract.
Parcel 2. A tract of land located in the NW% of Section
24, Township 4 North, Range 65 West, 6th P.M. , Weld County,
Colorado being more particularly described as : Considering the
east line of said Section 24 to bear S. 00° 00' 00" W. , and all
bearings relative thereto :
Beginning at a point on the south line of the N'W%i; of said Section
24 whence the Wa Corner of said Section 24 bears S. 89° 55 ' 42" W. ,
600.40 feet, thence, N. 00° 04 ' 18" W. , 303.43 feet; thence, N.
89° 55' 42" E. , 417. 80 feet to a point on the west right-of-way
line of The Farmers Reservoir and Irrigation Company' s Gilmore
Canal ; thence, S. 21° 08' 44" W. , 325.49 feet along said right-
of-way of the Gilmore Canal to a point on the south line of the
NW/14 of said Section 24; thence, S. 89° 55' 42" W. , 300. 00 feet
to the point of beginning. The above described tract contains

4. General taxes for calendar year 1976 shall be paid in
full by First Parties . All of the 1977 taxes shall be paid by
Second Party.
5. Closing of this transaction, delivery of warranty deed
and water stock, and possession of said property shall be on or
before March 1, 1977. Title to said real property shall be con-
veyed to Second Party and his wife, Janice Sue Mossberg, as joint
tenants.
6. No land leveling shall be done by Second Party, his
agents or employees, on the real estate involved herein until
this transaction is closed.
THIS AGREEMENT IS EXPRESSLY CONTINGENT UPON Second Party
being able to complete the purchase of approximately 280 acres
of land in the East Half of Section 24, Township 4 North,
Range 65 West of the 6th P. M. , Weld County, Colorado, from
Shelby L. Burke and Claudia Burke, pursuant to the terms of
Agreement of sale and purchase of said property entered into
between Second Party and the said Shelby L. Burke and Claudia
Burke on the 28th day of August, 1976, and also pursuant to
the terms of Supplemental Agreement between said parties, con-
cerning said property and executed on the day of December,
1976.
In the event the sale of the property belonging to the said
Shelby L. Burke and Claudia Burke cannot be completed pursuant
to the terms of said Agreement and Supplemental Agreement here-
inabove referred to, on or before March 15, 1977, then this Agree-
ment shall be terminated and the down payment shall be retained
by First Parties and Second Party shall be relieved of all other
obligations hereunder, and First Parties shall pay the survey
bill.
In the event First Parties are unable to timely comply with
any Weld County and State subdivision rules, this Agreement shall
be cancelled and held void and the down payment shall be returned
to Second Party and First Parties and Second Party shall be re-
lieved from all obligations hereunder.
Time is of the essence hereof, and if any payment or any
other condition hereof is not made, tendered, or performed by
either• Party as herein provided, then this contract, at the
option of the party who is not in default shall be terminated
and of no effect, and both parties hereto released from all
obligations hereunder. In the event, however, the nondefaulting
party elects to treat this contract as being in full force and
effect then nothing herein shall be construed to prevent its
specific performance.
This Agreement shall bind the parties hereto their heirs,
personal representative and assigns.

THIS AGREEMENT, Made and entered into this day of
August, 1976 by and between SHELBY L. BURKE and CLAUDIA BURKE,
hereinafter referred to as Sellers, and GERALD D. MOSSBERG,
hereinafter referred to as Purchaser,
Vi I T N E S S E T H :
Subject to compliance with and the fulfillment of the
terms and conditions hereinafter set forth, Sellers hereby
sell and Purchaser hereby purchases the following described
property, to-wit :
The E of Section 24, Township 4 North, Range 65
West of the 6th P.M. , Weld County, Colorado,
DXCEPTING THEREFROM:
( a ) Parcel conveyed to Donald W. Faith I. Burke
by warranty deed recorded on June 27, 1969,
under Reception No. 1533439, Weld County Records;
(b) Parcel conveyed to Cecil M. & Lois M. Kier by
warranty deed recorded on February 5, 1975,
under RecePtion No. 1653514, Weld County Records ;
( c ) Parcel conveyed to Lloyd E. & Karolyn K. Burke
by warranty deed recorded on October 16, 1972,
under Recertion No. 1599740, !Meld County Records;
ALSO RESERVING AND EXCEPTING unto Sellers the SW%; of
the SE of the SE% of said Section 24, and further
RESERVING AND EXCEPTING unto Sellers an undivided
three-fourths interest in and to all of the oil , gas
and other minerals for a period of fifteen ( 15 ) years
from the date of warranty deed transfering above
property to Purchaser. Upon the expiration of said
l5 year period all interest of Sellers in and to said
oil , gas, and other minerals, rentals, royalties, or
any interest therein shall be and become the nrorerty
and estate of Purchaser herein. It being the intent
of the Parties hereto that after the expiration of
said 15 year period the Purchaser shall have full
ownershin of all the oil , gas and other minerals,
rentals, royalties and any interest therein, in, on,
and along all of the .pro: erty herein sold to Purchaser.
said property to be conveyed to Purchaser hereunder shall contain
ap- roximately 280 acres, at and for a total purchase price of
$400. 00 ner acre, said acreage to be definitely determined by
survey of said Property by a duly licensed Colorado land surveyor
at the sole expense of Sellers . Said purchase price to be raid in
the manner following :
( a ) ' The sum of $1 , 000. 00 aid herewith, receipt of which
said sum is hereby acknowledged by Sellers .
( b) 10'i of said total purchase Write ( the sum of $1, 000. 00
paid herewith shall be included to arrive at said 10% of
the total purchase Price ) on date of closing of this
transaction and delivery of warranty deed.
( c ) The balance of said Purchase Price shall be evidenced by
Purchaser' s promissory note, dated and executed on the
date of closing, secured by first deed of trust on the

for interest, from the date thereof, at the rate of
7s ;2; per annum. Said hr1nciral balance shall be raid
in nine equal annual installments , together with
accrued interest on the unpaid arincigal balance, on
the anniversary date of this Agreement. First annual
installment shall be due one year from the date of
this Agreement.
THE FOLLCIJIIJG CONDITIONS SHALL ALSO APPLY:
1 . An abstract of said nronerty, certified to date, or a
title insurance policy as evidenced by a title commitment in an
amount equal to purchase price, at Sellers ' option and expense,
shall be furnished to Purchaser on or before November 1, 1976.
2. Title shall be merchantable in the Sellers and convey-
ance shall he by a good and sufficient warranty deed to Purchaser
on date of closing, conveying said rrorerty to Purchaser free and
clear of all liens and encumbrances excepting easements for public
highway.
3. By instrument recorded in Book 314, Page 37] , 'iLeld County
Records, the Farmers Reservoir and Irrigation Co. was granted a
stria of land 50 feet in width for the West branch of the Neres
Canal. Said strip is not being used by said company and Sellers
hereby agree to remove said cloud on the title by obtaining a
uit Claim Deed from said company or other apnronriate action
that may be required to remove the same.
4. Sellers shall comely fully with required land use exemp-
tions and specifically with the recorded exemption provisions of
Weld County, Colorado, or any other political subdivision having
jurisdiction.
5. General taxes for calendar year 1976 shall be paid in
full by Sellers.
6. Closing of this transaction, delivery of Warranty deed,
promissory note and deed of trust and possession of said Property
shall be on or before November 25, 1976.
TILLS AGREEMENT IS EXPRESSLY CONTINGENT UPON:
1 . Purchaser being able to purchase twelve ( 12 ) shares of
The Farmers Reservoir and Irrigation Company water at a price
not exceeding .x4, 000. 00 per share, as evidenced by a binding
contract obligating the owner of such shares of said water to
sell the same to Purchaser at a rrice not exceeding $4,000. 00
per share. Said binding agreement to be fully executed on or
before October 15, 1976.
2. Purchaser being able to obtain a right of way for a
lateral ditch of sufficient capacity to carry said water from
the main ditch of The Farmers Reservoir and Irrigation Company
through the West Half of said Section 24, and further, together
with Purchaser being able to obtain storage facilities in the
West Half of said Section 24 , adjacent to said main ditch of
sufficient size to adequately and feasibly irrigate the , roperty
purchased, at a total cost to Purchaser not exceeding $3, 500. 00
for said lateral right of way and storage facility.
In the event said conditions listed hereinabove cannot be
met or obtained by duly executed commitments on or before October
15, 1976, this Agreement shall be terminated and the down payment
shall be returned to Purchaser and the Sellers and Purchaser shall
be relieved from all obligations hereunder.

personal representative and assigns.

conditions contained in said Agreement could not be met prior
to November 25, 1976, including, but not by way of limitation,
a completed survey of said property and compliance with sub-
division regulations of 'Weld County by obtaining from the Board
of Weld County Commissioners an exemption of said sale and
purchase from the terms of said subdivision regulations ; and
• WHEREAS, it is the desire of Sellers and Purchaser that
said original Agreement be amended as hereinafter set forth in
order to complete said sale and purchase,
NUN. THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS :
1. That the said Agreement entered into between the
parties hereto on the 28th day of August, 1976, be and the same
is hereby amended in the following respects :
( a) That on the date of closing of this trans-
action_, delivery of warranty deed and possession of said premises,
Purchaser shall pay, in addition to the 10% of said total purchase
price as defined in said Agreement, the further sum of 68, 000. 00.
( b) That the balance of said purchase price, as
evidenced by Purchaser' s promissory note, shall be secured by
first deed of trust on all that part of the Nei of said Section
24 sold to Purchaser, and said deed of trust shall not include
any part of the SRI of said Section 24, as security for the pay-
ment of said promissory note.
( c ) That an abstract of title of said property,
certified to date, or a title insurance policy as evidenced by
a title commitment in an amount equal to the purchase price, at
Sellers ' option and expense shall be furnished to Purchaser on
or before December 20, 1976.
( d ) Closing of said sale and purchase, delivery
of warranty deed, promissory note, deed of trust and possession
of said property shall be on or before December 31 , 1976, if

approval can he obtained from the Board of Commissioners of
Weld County, Colorado for an exemption of the sale of said
property from the Weld County .subdivision Regulations prior
to the 31st day of December, 19'16, if such approval cannot
be so obtained on or before December 31, 1976, closing of
this transaction and delivery of deed, note, and deed Jof
trust and possession shall be delayed until such approval can
be obtained, provided that if such approval cannot be obtained
prior to March 15, 1977, then the original Agreement and this
Supplemental. Agreement shall be terminated and the parties
hereto shall bo relieved of all liability to sell and to pur-
chase said property and the down payment shall be returned to
Purchaser.
( e ) All other provisions of said original Agree-
ment not amended hereby shall be and remain in full force and
effect.
This Supplemental Agreement shall bind the parties hereto
their heirs, personal representatives and assigns .
