RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 331 - DALE BOHLENDER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado, at a public hearing held on the 21st day of August, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 331, being the property of Dale Bohlender, described as part of the South Half Southwest Quarter of Section 8, Township 4 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: The South Half of the Southwest Quarter of Section 8, Township 4 North, Range 65 West of the 6th P.M., excepting therefrom a tract more particularly described as follows: Commencing at the southwest corner of said Section 8, thence north on the west section line thereof a distance of 85 feet more or less to a point due west of a steel pipe located on the north line of the drainage canal, thence east 30 feet more or less to said steel pipe which constitutes the true point of beginning, thence north parallel to and 30 feet distant from the west line of said section along the east line of the county road a distance of 208' more or less to a steel pipe placed on the east line of said county road, thence due east a distance of 208' more or less to a steel pipe which is 208' directly east of the Northwest corner of the tract herein described, thence South parallel to the westerly line of the tract herein described to a steel pipe on the north side of the drainage canal at a point 208' more or less east of the point of beginning, thence west along the north side of said drainage canal a distance of 208' more or less to the point of beginning, containing one acre more or less. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not F i , iis- 33/ 780774 within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-lA(3) of the Weld County Subdivion Regu- lations. NOW, THEREFORE, BE IT RESOLVED by the Board of County -Com- missioners of Weld County, Colorado, that the hereinabove described parcel of land owned by Dale Bohlender, be and hereby is , exempt from the definition of the terms "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS, 1973, as amended. The property on which the recorded exemption has been requested is described as Pt . SzSW4 Section 8, T4N, R65W of the 6th P.M. , Weld County, Colorado. This property is located lz miles south of the Town of LaSalle. The pro- perty contains approximately 79 acres of irrigated land with Class I , II , and III irrigated soils . The request is to split the property into parcels of 1 . 106 acres and 77. 89 acres . Mr. Dale Bohlander desires to transfer the 1 acre plus par- cel to Duane Bohlender, his son. Duane now lives on the farm in a small tenant house which his family has outgrown. He would like to build a new house on the farm to oversee his operation in the future. Based upon the information submitted and the adopted poli- cies in the County, the Department of Planning Services Staff recommends the request be approved for the following reasons : 1 . The proposed split conforms with Section 9-2 of the Weld County Subdivision Regulations (intent clause of the Recorded Exemption Procedure) , Section 3 . 3A. of the Weld County Zoning Resolution (the intent clause of the Agri- cultural Zone District ) , and the Weld County Comprehensive Plan since the use would be compatible to surrounding agricultural uses.
