HEARING CERTIFICATION DOCKET NO. 2017-23 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR17-0001, FOR ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - CHERYL CRABBE, GILBERT JAMES BERNAL, JR., AND RANDE BERNAL A public hearing was conducted on March 29, 2017, at 10:00 a.m., with the following present: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Stephanie Frederick Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Department representative, Janet Lundquist Planning Services Engineer representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated February 16, 2017, and duly published February 21, 2017, in the Greeley Tribune, a public hearing was conducted to consider the request of Cheryl Crabbe, Gilbert James Bernal, Jr., and Rande Bernal, for a Site Specific Development Plan and Use by Special Review Permit, USR17-0001, for one (1) single-family dwelling unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and stated this property was originally approved for zoning permit, under ZPSD11-0005, which allowed the second residence to be occupied by a family member or a caregiver. The Crabbe's would like the option to utilize the second home as a rental property and they have a Power of Attorney present, as a representative for Cheryl Crabbe. He described the surrounding land uses and stated the site is located within the three (3) mile referral area of the Town of Kersey. He explained that a total of thirteen (13) referrals were mailed out and seven (7) responses were received. He displayed images of the site and surrounding areas, and entered the favorable recommendation of the Planning Commission into the record as written. 12- Chair Cozad clarified that the original permit allowed the second home for a family member and the new USR will allow applicant to use the second home as a rental. CG � 0LCC&(C', PECNB), -ILCLO CT6(SF) 2017-0838 PL2465 HEARING CERTIFICATION - CHERYL CRABBE, GILBERT JAMES BERNAL, JR., AND RANDE BERNAL (USR17-0001) PAGE 2 • Evan Pinkham, Department of Public Works representative, provided a brief overview of the transportation plans and requirements and stated an Access Permit, AP11-00245, utilizing County Road 55 was approved. He reported the traffic narrative indicated six (6) daily round trips and neither tracking control nor an Improvements Agreement will be required. El Hayley Balzano, Planning Services Engineer representative, stated the applicant has submitted an acceptable Drainage Narrative and will need to show the drainage flow arrows on the map. El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions and reported water for the site is provided by the Central Weld County Water District and both residences have permitted septic systems. • Kirstene Duhl represented the applicants and stated she had no further comments. • No public testimony was offered concerning this matter. El Commissioner Kirkmeyer requested the deletion of Development Standards #3, #4, #5, #10 and #11 because they aren't applicable for a single-family dwelling. • In response to Chair Cozad, Ms. Duhl indicated she and the applicants has reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Kirkmeyer moved to approve the request of Cheryl Crabbe, Gilbert James Bernal, Jr., and Rande Bernal for a Site Specific Development Plan and Use by Special Review Permit, USR17-0001, for one (1) single-family dwelling unit per lot other than those permitted under Section 23-2-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
