Explain, in detail, the proposed use of the property. The proposed facility is reflected in the attached "Imperial Horse Racing Facility plat map", the facility is envisioned to allow for the training, conditioning, and racing of horses on weekends on the 80 -acre property that is currently under contract. The race track is envisioned as a straight 600 -yard -long dirt track by 52 feet wide that is leveled and groomed with a tractor. A fence and starting gate will differentiate the track and horse areas to those areas available to the spectators. There will be no boarding any of the race horses on the property. Instead, the horses and their grooms and riders would trailer onto the property for each race or workout. Thus, there are no stalls or barns envisioned for the race facility or any commercial use. The diagram also supplies information about the proposed infrastructure of the project. There is one (1) entrance edit 30 ft wide for 2 -way traffic on the south side of the property, one (1) horse trailer /emergency entrance & exit located on the west side of the property 25ft wide. Sufficient parking area for spectators, participants, parking area for horse trailers and restrooms (portable units TBD) The races are anticipated to be either a match style race wherein two (2) horses race against one another or a derby style race wherein up to a total of four (4) horses compete against each other. These races will necessarily be conducted during daytime hours. Weather permitting, races would be held regularly on weekends. The facility would allow certain numbers of spectators to watch the races. Typically, the entire event will last between one (1) and six (6) hours. While most races will garner crowds between 200 and 500, there are envisioned instances during the year where up to two thousand people may attend. No alcohol, weapons, or contraband will be allowed on the Property. At this time, no food or beverage sales are envisioned by us. We might hire licensed vendors to sell food. We plan to provide contracted private security for all events held open to the public. (Minimum of 2 security guards for every 350 persons attending the event, and at least 5 additional security guards for security within and among the spectators) we will provide enough trash containers throughout the property in order to prevent trash from getting away, and have a trash pickup crew that will be in charge of cleaning up trash while and after the event; this will include the pick-up of trash along CR 37 and CR 96 where we expect our traffic to come from. Anyone that will be on the track such as the rider and the helper sign off a liability waiver before they step inside the track. Also, at the entrance we will make an adult sign a waiver for any underage child that will be with them on the horse/trailer area. The area that will be used as parking for the trucks with horse trailers will be fenced off from the rest of the public. 2. Explain how this proposal is consistent with the intent of the Weld County Code. Chapter 22 of the Comprehensive Plan. The proposed use will be consistent with the intent of the Weld County Code described in Chapter 22 of the Comprehensive Plan. This Facility will not interfere with the agricultural goals depicted in Sec. 22-2- 10 since the property will be left with its natural landscape and vegetation as is and impact to surrounding agricultural lands would be minimal. The adjacent properties are used for agricultural purposes with no residences. We will take the necessary steps to ensure that adequate water, security, sewage disposal, access and fire protection is available on the property. Waste handling plan • We will maintain the property's environment quality by taking the necessary measures in preventing any littering by providing enough garbage bin containers throughout the property, as well as having a trash crew to pick up trash during and after the event. • Garbage will be collected through a local garbage disposal company. We will have an adequate sized dumpster on site by main entrance and collect garbage from the containers placed throughout the property and accumulate all garbage in dumpster for easy removal by company. • We will have a trash crew pick up any unforeseen trash along the property perimeter and along County Road 96 and County Road 37. • Waste that will be generated on site include food and beverage containers (brought by licensed food vendors or by spectators themselves). Materials expected Styrofoam, plastic, aluminum and paper. Fire Protection/Emergency and Security Plan • Nunn Volunteer Fire Department will be advised of any and all operational days. • We plan on minimizing safety and health hazards to the spectators by providing enough licensed security guards (minimum of 2 security guards for every 350 persons attending event, and at least S additional guards for security within and among spectators) to be on site throughout the entire event to check vehicles as they enter premises and to patrol property while the event takes place making sure that spectators are in adequate area that will be provided for them. • No alcohol, weapons or any sort of contraband will be allowed onto the property, and if found it will be confiscated by the hired security company. • Trained persons in emergency medical technology will be hired and will be present on large events. Minimum 2 persons for the first 350 persons and 1 for every 350 persons after that with at least 1 emergency ambulance) ▪ In the event of an emergency, a staff member will meet with the Emergency Personnel and guide them to the situation. Appropriate fencing will be determined by the County either three -strand wire fence or pipe fence. *The whole acreage will be fenced to contain parking and attendees enclosed by regular three- strand wire fence or pipe. Horse trailer parking area will be sectioned off to the spectators to prevent them from entering that site without having appropriate justification as to why they must be in the horse area (such as jockey, horse crew team etc). and any minor must be accompanied by an adult to access horse area. • This enclosed horse trailer area will have a 25 -ft. wide exit with gate set back 100 ft. and recycled asphalt leading onto the property. This exit is to be located at the West side of the Property along County Road 37. This West access will be primarily be used for horse trailers to exit the property to relieve traffic accumulation on the main entrance that will be located on the South side of property along County Road 96, and will be used as an emergency access for Emergency Personnel. Main entrance will be 30 ft. wide giving enough space for two-way traffic (entrance/exit). Cattle guards will be installed for tracking purposes. Horse trailers will enter through this gate and head Northeast to trailer parking area and regular spectators will be directed to parking area. Sanitary Sewage • We will furnish an adequate number of portable toilets for sanitary sewage purposes to accommodate the amount of people expected. (minimum 1 toilet for every 100 males and 1 toilet for every 100 females) A local company will be hired to furnish the portable toilets and to dispose of sewage as well. • We want to use portable toilets instead of a septic system since the property does not have a septic system or septic permit, water or well permit nor source of electricity and events are not held on a daily basis. Manure handling plan • Any on -site manure will be spread with manure -spreader tractor attachment throughout the property in the open 40 acre space shown on "Imperial Horse Racing Facility" site plan. The Weld County Comprehensive Plan, Chapter 22 A. Policy 2.2 outlines to "Allow commercial and industrial uses, which are directly related to or dependent upon agriculture, to locate within agricultural areas when the impact to surrounding properties is minimal or mitigated and where adequate services and infrastructure are currently available or reasonably obtainable..." This horse racing facility only needs the open land that is already adequate to conduct horse racing and will cause minimal impact to surrounding properties which are vacant. Having no neighbors around diminishes any traffic concerns that would arise if there were residences close by. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23, Zoning and the zone District which it is located. The property will be in compliance with the design standard in Sec. 23-3-50 C. Recreational facilities and uses including: 1. Race tracks and race courses, if permit is granted. Bottled water and portable toilets will be available to the site to serve the use permitted. Adequate fire and emergency protection measures will be taken as well. Adequate provisions will be made to protect health, safety, and welfare of everyone on the property. The access shall be located and designed to be safe; ingress and egress will not prevent a safety hazard to the minimal traveling public on both County Road 96 and County Road 37 or to the vehicles accessing the property. During the high traffic hour, which would typically be at the end of the event, traffic will be directed by security company or staff to mitigate traffic hazard. This use is proposed to be located in the Agricultural Zone District and Prime Farmland will not be removed from production, this land will remain in agricultural zoning for a use directly to agricultural, ranching, and agri-business operations. A noise report is not applicable since there are no close neighbors to the property, only vacant farm land. No noise nuisance is envisioned that would interfere with the vacant adjacent properties. The facility will not be open after daylight hours. No source of light will be needed for this use. Property will be maintained in such manner that grasses and weeds will not grow taller than what the county allows; constant maintenance will be done by tractor and disc by us. Any agency responses or staff comments will be considered and will be appropriately incorporated into the final use and site design. 4. Describe what type of uses surround the site. Explain how the proposed use is consistent and compatiblewith surrounding land uses. Agricultural farm land surrounds this property. The nearest residential structure will not be affected by the horse racing facility, nor will its traffic. We will let horse owners know that they should travel East on County Road 90 from Hwy 85, North on CR 39 West on CR 96 to access the property on Road 37, to mitigate dust. 5. What are the hours and days of operation? Its envisioned to have racing facility open year-round on select weekends (weather permitting) • There will be instances when no racing will take place since the same group of horse owners are the ones racing against each other. • Racing doesn't necessarily take place both Saturday andSunday. Most of the time it's either or. Large events might take up both days. • Saturday 10:00am — 7:00pm or Sunday 10:00arn 7:00pm IA (weather and daylight permitting during - SPRING -SUMMER SEASON) * Saturday 10:00am — 4:00pm or Sunday 10:00am — 4:00pm R (weather and daylight permitting during fall/winter starting after daylight savings- FALL -WINTER SEASON) Employees may remain on site after hours to complete maintenance or cleaning 6. List the number of full time and/or part time employees proposed to work at this site. • Approximately 20 employees (maximum for large events) will be on site during the event. These include: security personnel, emergency personnel, parking attendants and cleaning crew. • At least one employee will be certified in both CPR and First Aid. • Ornelas family► may be onsite at any given time for maintenance and upkeep. 7. Horses are the only expected animal for weekend events. The maximum amount of horses expected are 40 on big events. 10. Describe the type of lot surface and the square footage of each type. 40 Acres will be left as is (grass) under the CRP plan. The other 40 acres will be mowed down to accommodate the horse track and parking area. Cattle guards will be used for tracking purposes on both access points. 6 Lea -to stalls will have dirt surfaces. 11. How many parking spaces are proposed? Once application is approved and permit is granted, access culverts will be installed along CR 37, cattle guards will be installed on both access points, property will be fenced all around, fencing to divide horse trailer parking will be installed, horse track will be leveled and groomed by tractor, horse track fencing will be installed, mesh fence will be installed to keep spectators out of horse track, 6 lean-to horse stalls will be built. We intend to complete all of this in one month after permit approval. Home(s) construction will begin in January of 2018, thus the additional two access points along CR 37 will be installed. Property is now under contract and closing date is set with Land Title Company to be done on or before July 20, 2017. Engineering Questions: 1. Describe the expected travel routes for site traffic. The vehicles will access the facility from North Weld County Road 39, West on WeldCounty road 96. Property is located on the corner of intersection of County Road 96 and County Road 37. 3. Describe the travel distribution along the mutes. Travel distribution is expected to be 95% from the South (County Road 96) and 5% from the West (County Road 37) 4. Describe the time of day that you expect the highest traffic volumes from above. The highest traffic volume is expected at the end of the events. Either 4pm or 7pm depending on the season. 5. Describe where the access to the site is planned. Two access points to this site are planned. The main entrance being located on the South side of the property (Weld County Road 96). Horse trailer exitfemergency exit located on west side of property. (County Road 37) Eventually in January of 2018, 2 more access points will be added to the property once home(s) construction start along CR 37. 6. Drainage Narrative: A. Does your site qualify for an exception to stormwater detention? Yes. Water does not accumulate on property, no low spots known. Access point along County Road 37 will have culvert in order to have access onto the property. Access point along County Road 96 does not need a culvert since property sits above the County road. The addition of fences and lean tos meets exception 1.a.8 for sites where the development of the site does not change the imperviousness of the site. Tracking control will be achieved with cattle guards so as to not increase the imperviousness of the site. II. Where the water originates if it flows onto the property from an offsite source? Dust Abatement Plan: The following measures will ensure compatibility of the proposed use to the surrounding properties: • Dust is to be handles by a water truck during event days if needed. • The track and most affected portion of County Road 96 and County Road 37 is proposed to be watered to suppress dust during events if necessary. • Any manure generated on site will be spread on property by us. • Waste materials will be handled, stored, and disposed in a manner that controls blowing debris, and other potential nuisance conditions. • The proposed animal's units to be on this site during events will not exceed the units by right in the agricultural zone district. • Waiver will be requested herein from the requirements of a noise report and lighting plan as the use anticipated will not be in need of them. We are asking for portable toiletsbecause we will not be open for more than 6 months in a year. Last time the Planning commissioners were fine with portable toilets for the reason being if you look at it there are 53 Saturdays this year. If we ended up opening every Saturday and Sunday (which is impossible) we would be open for 106 days; not even for 4 months. The training, conditioning and racing take place on the same weekends. Dates of operation? There aren't any set dates. I stated Spring to Summer on Saturday and Sunday from 1 Oam to 7pm and fall to winter from 10am to 4pm to give a range of the hours. Most racing that takes place will not even take up 3 hours.(less than 500 people) Races will be conducted weather permitting only and there are many weekends that facility will not be open due to the fact that the crowds that race each other are always the same ones. A horse needs a minimum of 1 month of recovery and retraining to be ready for a new race. Now, on bigger events (2000 people max) those only occur 3-5 times a year and do take up loam to 7pm.
