Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Project description: Amend USR1360 to remove development standard #22 22. Use by Special Review Permit #1360 will be considered invalid fifteen (15) years from the date of the Board of County Commissioners resolution. Should the owners of the Batch Plant wish to continue operating, they must be approved for a Planned Unit Development. This project is west of and adjacent to County Road 7 and is south of Highway 119. Parcel number: 131309100081 Roads: This project is within the boundaries of a known Regional Urbanization Area (RUA). The applicant shall follow the requirements as defined in Chapter 26 of the Weld County Code. Drainage Requirements: Please contact Department of Planning Services/Engineering Development Review for questions or assistance for drainage requirements at 970-353-6100. URBANIZING VS NON -URBANIZING DRAINAGE AREA: This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site. Detention pond waived and a simple drainage narrative: A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for an exception to detention requirements listed below. The drainage narrative must include at the minimum: 1. Description which exception is being applied for and supporting rationale 2. Where the water originates if it flows onto the property from an offsite source 3. Where it flows to as it leaves the property 4. The direction of flow across the property 5. If there have been previous drainage problems with the property Exceptions. 1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and welfare of public and private property. Exceptions shall be supported with a drainage narrative. a. No stormwater detention will be required for sites that meet any of the following conditions. Requirements of the Municipal Separate Storm Sewer System (MS4) areas remain applicable. 8) Development of sites where the change of use does not increase the imperviousness of the site. The applicant has submitted a Drainage Narrative stating that they will meet exception 1.A.8 Development of the sites where the change of use does not increase the imperviousness of the site. No new improvements are proposed on the parcel. The site historically drains to the water body on the parcel to the west, also owned by Martin Marietta. Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This site is in a FEMA regulatory floodplain. A flood hazard development permit is required for any development in the floodplain. Contact the floodplain planner Diana Aungst at 970-353-6100. CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. The applicant shall show the drainage flow arrows. (Department of Planning Services -Engineer) 2. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around the property. COMMENTS: General Project Information/Location: Project description: A Site Specific Development Plan and 2nd Amended Use by Special Review Permit No. USR-1360 for Mineral Resource Development Facilities including a Concrete Batch Plant and a request to remove Development Standard No. 22 (Use by Special Review Permit #1360 will be considered invalid fifteen (15) years from the date of the Board of County Commissioners resolution. Should the owners of the Batch Plant wish to continue operating, they must be approved for a Planned Unit Development) in the A (Agricultural) Zone District This project is south of and adjacent to State Highway 119 and is west of and adjacent to CR 7. Parcel number 131309100081. Access is from CR 7. Roads: County Road 7 owned and maintained by the Town/City (Municipality) of Frederick. The Municipality has jurisdiction over all accesses within their jurisdiction. Please contact municipality to verify the access permit or for any additional requirement that may be needed to obtain or upgrade the permit. The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) to verify the access permit or for any additional requirements that may be needed. (State Highway 119) CONDITIONS OF APPROVAL: A. The plan shall be amended to delineate the following: 1. Show the approved Municipality of Frederick access(es) on the site plan and label with the approved access permit number if applicable. CONDITION OF APPROVAL: 1. Show the floodplain and floodway (if applicable) boundaries on the map. Label the floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel Number or appropriate study. (Department of Planning Services) DEVELOPMENT STANDARDS: 1. A Flood Hazard Development Permit is required for all construction or development occurring in the floodplain or floodway as delineated on Federal Emergency Management Agency (FEMA) FIRM Community Panel Map #08123C -1890E effective date January 20, 2016 (St. Vrain Creek Floodplain). Any development shall comply with all applicable Weld County requirements, Colorado Water Conservation Board requirements as described in Rules and Regulations for Regulatory Floodplains in Colorado, and FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. The FEMA definition of development is any man-made change to improved or unimproved real estate, including but not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. Box 435 • Frederick, CO 80530-0435 Phone: (720) 382-5500 • Fax: (720) 382-5520 www.frederickco.gov December 13, 2016 Mr. Ogle, Thank you for the opportunity to review information associated with the Martin Marietta application, Case Number: 2MJUSR16-03-1360. This property is well within the Town of Frederick comprehensive planning area, and is adjacent to properties that are in the Town's jurisdiction. Town staff has reviewed the request and finds that it does not comply with the Town's commercial designation for that property. Such commercial uses typically include restaurants, retail shops, offices, grocery stores and the like. Town staff is not opposed to the applicant continuing its current operations in that location, but there are a number of concerns beyond the existing land use that the Town would like for the applicant to address. Such concerns include: 1. The property is currently accessed solely by Aggregate Blvd, which is owned and maintained by the Town of Frederick. Because the property is not within the Town's jurisdiction, no tax revenues are currently paid by Martin Marietta to the Town to offset the cost of maintenance and repair of the roadway even though the site generates heavy truck traffic. 2. It appears as though the right-of-way needed to eventually widen the section of Aggregate Blvd adjacent to the property has not been dedicated to the Town. Because the property is not within the Town's jurisdiction and any land use cases associated with the property will not be reviewed by the Town, there is no point within the foreseeable future where the Town will have the opportunity to exact the needed right-of-way. 3. The processing equipment on -site is an eyesore and the property currently has no landscaping. The Town recognizes that the area was much more rural when the plant was initially constructed and became operational. However, as more urban/suburban development occurs in the area in the form of retail, office, residential and other uses, the less visually compatible the plant will be. Because the property is not within the Town's jurisdiction and any land use cases associated with the property will not be reviewed by the Town, there is no point within the foreseeable future where the Town will have the opportunity to regulate the appearance of the facility. 4. The site is largely unpaved. As a result, traffic accessing Aggregate Blvd, which is owned and maintained by the Town of Frederick, track mud and dust out onto the roadway. Because the site is not within the Town's jurisdiction, the Town cannot regulate site surfacing issues. 5. While law enforcement service to the site is currently provided by the Weld County Sheriff's Department, deputies often have to travel from Greeley or other far-flung portions of the County to provide service. In these situations, Frederick Police Officers are obligated to take calls for service if they are in the area. Frederick Police Officers typically wait until deputies arrive to provide service except in emergency situations where they provide service immediately. Frederick Police Officers can be tied up on these kinds of calls for extended periods of time without reimbursement to the Town for their time. Town staff has had discussions with the applicant about the possibility of annexing into Frederick, and would like to pursue that possibility further as a preferred option. Staff believes that the issues of concern outlined above would most appropriately be addressed through the Town's annexation process.
