Bonanza Creek has chosen to replace its existing tower installation with a larger 190 ft structure. This new structure will provide a larger load capacity and increase the amount of communications equipment able to be mounted at the Section 16 Tower. In addition, the increased height will allow for better coverage on both the new UHF licensed frequency and the 5 GHz unlicensed frequencies. Bonanza Creek will also be upgrading to a larger solar power installation and a 9' 9" x 9' 6" building to support the additional communications equipment installed. All existing equipment will be duplicated on this new structure, with a single exception: The existing 5 GHz redundant link between the Section 16 tower and the Bonanza Creek Field Office will be replaced. This link is going to be upgraded to equipment operating on a 6 GHz frequency licensed with the FCC. The current set of double 2 ft dishes at each end of this link will be replaced by a single 4 ft dish at each end. This new equipment will be installed in a 1+1 hardware redundant configuration to allow for maximum availability. This is in keeping with Bonanza Creek's stated goal of providing the greatest Safety, Environmental protection, and Production efficiency. The following new equipment will be added to increase traffic capacity: • 1 additional frequency in the UHF band licensed by the FCC. This will add a new licensed communications channel to manage connectivity with additional critical field equipment. • 4 additional 5 GHz base stations. This will provide high speed communications to assets in the field that are unable to be served by the existing infrastructure, due to load limitations. The property will be used as a location for a communications tower to gather operating data at the pads and allow field personnel the mean to connect to out SCADA host, XSPOC. 2. The communications town proposal is consistent with the Weld County Code, Chapter 22 of the Comprehensive Plan because we have worked diligently not only with the property owner but surrounding land owner to locate the tower in a mutually agreeable area, central to many of Bonanza Creeks operations and out of the site of all existing and proposed development. 3. Oil and gas wells and facilities are a Use by Right with in an Agricultural Zone. Although the communications tower is not directly related to a specific oil and gas well or facility it is an integral part of the oil and gas operations. Bonanza Creek worked closely with the surface owner of the property as well as the surrounding surface owner to choose the most central, least impactful area for the communications tower. In addition, by creating a Subdivision Exemption that runs with the term of the lease the property will be restored to Agricultural Zoning one the tower is removed. 4. DivFision - Antennas and Toltvers Sec. 23-4-820. - General requirements. A. TELECOMMUNICATION FACILITIES on Residential Properties. TELECOMMUNICATION FACILITIES may not be placed on properties or buildings used primarily for residential purposes. This does not apply to buildings containing eight (8) or more dwelling units or farms and ranches containing dwelling units. B. TELECOMMUNICATION FACILITIES are allowed as a use by right or accessory use on a property as follows: 1. TELECOMMUNICATION ANTENNA, ATTACHED AND TELECOMMUNICATION ANTENNA, CONCEALED are permitted by administrative review in all zone districts. 2. TELECOMMUNICATION ANTENNA TOWERS are not allowed in the following zone districts: R-1, R-2, R-3, R-4, R-5, E and PUD (with Residential uses). 3. TELECOMMUNICATION ANTENNA TOWERS are permitted either as a use by right, accessory use. or Use by Special Review in the following zone districts: C, I, A and PUD (with Commercial or Industrial uses). C. Accessory uses to a TELECOMMUNICATION ANTENNA AND TELECOMMUNICATION ANTENNA TOWER shall not include offices, broadcast studios, long-term vehicle storage or other outdoor storage, or other uses not needed to send, receive or relay transmissions. Sec. 23-4-830. - Standards for Telecommunication Antenna Towers. A. TELECOMMUNICATION ANTENNA TOWERS are allowed as a use by right, accessory uses, subject to Zoning Permit for TELECOMMUNICATION ANTENNA TOWER requirements, or as a Use by Special Review Permit, per the height guidelines below. The height of a TELECOMMUNICATION ANTENNA TOWER is defined as the distance from the finished grade at the TELECOMMUNICATION ANTENNA TOWER base to the highest point of the TELECOMMUNICATION ANTENNA TOWER. Overall TELECOMMUNICATION ANTENNA TOWER HEIGHT includes the base pad, mounting structures and panel antennas, but excludes lightning rods and whip antennas. Use Accessory by Right Use or Zoning Permit for ANTENNA Use by Special Review approval required Permit J TELECOMMUNICATIONS TOWER Up to 35 feet in height > 35 feet up to 70 feet in height Greater than 70 feet in height Per this standard, we are submitting a Use by Special Review permit application for this proposed tower because it is greater than 70 feet high. B. Radial Spacing. TELECOMMUNICATION ANTENNA TOWERS over thirty-five (35) feet high must be located at least one thousand (1,000) feet from other TELECOMMUNICATION ANTENNA TOWERS over thirty-five (35) feet high that are capable of supporting TELECOMMUNICATION FACILITIES. Closer spacing between TELECOMMUNICATION ANTENNA TOWERS may be granted through the Use by Special Review process. This radial spacing requirement does not apply to facilities located at designated antenna farms. The new tower will be more than 1000' from any other telecommunication antenna towers once the existing tower is removed. C. In addition to meeting the Use by Special Review standards set forth in Article II, Division 5 of this Chapter or the Zoning Permit for Telecommunication antenna tower permit application requirements set forth in Section 23-4-870, the applicant shall submit documentation addressing the following standards: 1. Existing or approved TELECOMMUNICATION ANTENNA TOWERS cannot accommodate the telecommunications equipment planned for the proposed TELECOMMUNICATION ANTENNA TOWER. There are no existing or approved telecommunication antenna towers that can be used to meet Bonanza Creeks Energy needs. 2. The TELECOMMUNICATION ANTENNA TOWER shall not constitute a hazard to aircraft. The tower is too low to create a hazard to aircraft. 3. The TELECOMMUNICATION ANTENNA TOWER shall be placed on the property to contain on site all ice -fall or debris from TELECOMMUNICATION ANTENNA TOWER failure. The tower is being place, in the center of a 380' x 380' lot. The lot will be able to contain on -site all ice -fall or debris from the tower. 4. The proposed TELECOMMUNICATION AN TENNA TOWER shall be designed and provide for CO -LOCATION. The applicant may provide written justification and evidence why GO - LOCATION is not possible. The Board of County Commissioners may revoke permits or other administrative approvals if conditions for approval of a TELECOMMUNICATION ANTENNA TOWER includes CO -LOCATION, but: a. The TELECOMMUNICATION ANTENNA TOWER owner is not willing to provide space for other carriers at a fair market rate when it would not impair the structural integrity of the TELECOMMUNICATION ANTENNA TOWER or cause interference. b. The TELECOMMUNICATION ANTENNA TOWER owner modifies the structure in a way to make CO -LOCATION impractical or impossible. c. If approval is revoked, the facility must be removed at the owner's expense. The proposed tower is 190' tall. Bonanza Creek Energy is open to co -location on their tower. Bonanza Creek previously submitted a letter addressing co -location opportunities available on the tower. The TELECOMMUNICATION ANTENNA TOWER shall have the least practicable adverse visual impact on the environment. The tower is located in a very remote location so visual impacts on the ernenvironment won't be an issue. 6. The proposed TELECOMMUNICATION ANTENNA TOWER shall not emit radiation that will adversely affecthuman health. The tower will not emit radiation that will adversely impact human health. 7. The proposed TELECOMMUNICATION ANTENNA TOWER shall be the minimum height needed to a c commodate the TELECOMMUNICATION ANTENNA. The proposed tower is 190' tall which is the minimum height needed by Bonanza Creek Energy to meet their needs in the proposed location. 8. The proposed TELECOMMUNICATION ANTENNA TOWER shalt comply with all applicable federal and State regulations. The proposed tower will comply with all applicable federal and State regulations. 9, The design of the proposed TELECOMMUNICATION ANTENNA TOWER shall insure structural integrity. The tower has been designed by an engineer to be structurally sound. Copies of the signed, stamped plans are included in the previously submitted application package. 10. The proposed TELECOMMUNICATION ANTENNA TOWER shall have adequate measures to discourage unauthorized climbing and to insure the security thereof A security fence is proposed around the tower to discourage unauthorized climbing and provide safety. 11. All reasonably possible sites for the TELECOMMUNICATION ANTENNA TOWER have been considered, and the proposed site is the most appropriate, available site from a land use perspective. The proposed site for the tower was selected by Bonanza Creek Energy because of its proximity to the oil and gas facilities it will serve. Bonanza Creek was not able to find any other existing towers areas that they could co -locate on to meet their needs. 12. The proposed TELECOMMUNICATION ANTENNA TOWER shall not adversely impact wildlife. Consistent with the requirements set forth in Bonanza Creek Energy's lease with the State, the Colorado Parks. and Wildlife took a look at the proposal for a tower on the property and determined that there are no known impacts to wildlife. The security fence will keep wildlife away from the tower. 13. A Decommissioning Plan. Adequate financial assurance to cover the decommissioning of the facility may be required as a condition of approval of the Decommissioning Plan. Bonanza Creek Energy will remove the tower, its foundation and the associated building and then reclaim the land back to its native state. D. TELECOMMUNICATION ANTENNA TOWER and Equipment Setbacks. 1. TELECOMMUNICATION ANTENNAS, ATTACHED and other appurtenances may encroach up to two (2) feet into the minimum building setbacks in the underlying zoning district but must not extend over property lines. N/A 2. Minimum setbacks for TELECOMMUNICATION ANTENNAS, CONCEALED are the same as the minimum building setbacks in the underlying zoning district. N/A 3. Minimum setbacks for TELECOMMUNICATION ANTENNA TOWERS are as follows: a. From property lines of properties in the A, C, I and PUD (with Commercial or Industrial uses) zones: one hundred percent (100%) of the TELECOMMUNICATION ANTENNA TOWER HEIGHT but not less than minimum building setbacks and offsets in the underlying zone district. The 190' tower is proposed to be located in the center of a 380' x 380' lot so that the tower will be set back over 190' from the lot line. b. From subdivision exemption boundaries for temporary use of a parcel for Telecommunication Antenna Tower Facilities in the A, C, I and PUD (with Commercial or Industrial uses) zones: one hundred percent (100%) of the TELECOMMUNICATION ANTENNA TOWER HEIGHT but not less than minimum building offsets in the underlying zone district unless evidence of a recorded easement granted by the underlying property owner, which allows for the fall of the tower onto the burdened property is provided. As an alternative, the applicant can provide stamped documentation from an engineer demonstrating that the tower and debris will fall completely within the boundary of the subdivision exemption. The 190' tower is proposed to be located in the center of a 380' x 380' lot so that the tower will be set back over 190' from the lot line. 4. Guy wires and equipment buildings and cabinets. No partof the TELECOMMUNICATION ANTENNA TOWER system, including any guy wire anchors, shall extend closer to the property boundary than minimum building setbacks and offsets in the underlying zone district. No guy wires are proposed with this antenna. All buildings and equipment are located further than the minimum building setback and offsets. E. Equipment Design. 1. A TELECOMMUNICATION ANTENNA, ATTACHED on a roof may extend up to fifteen (:15) feet over the height of the building or structure and may exceed the underlying zoning district height limitation. TELECOMMUNICATION ANTENNAS, ATTACHED mounted on a building or structure wall must be as flush to the wall as technically possible, and must not project above the top of the wall, and must be located, painted and/'or screened to be architecturally and visually compatible with the building it is attached to. N/A 2. TELECOMMUNICATION ANTENNA TOWERS should be painted or coated in earth -tone colors that blend, to the extent possible, with the surrounding building and natural environment. unless State or federal regulations require specific colors. The proposed tower will be an unpainted, steel structure that will blend iii with the natural environment. 3. TELECOMMUNICATION ANTENNA TOWERS must not be artificially lighted unless required by the FAA or other State or federal agency. Security lighting on the site may be mounted up to twenty (20) feet high and must be directed toward the ground to reduce light pollution, prevent offsite light spillage and avoid illuminating the TELECOMMUNICATION ANTENNA TOWER. No lighting is proposed on the tower. 4. Equipment buildings must be compatible with the architectural style of the surrounding building environment with consideration given to exterior materials, roof form, scale, mass, color, texture and character. Equipment buildings must be constructed with materials that are equal to or better than the materials of the principal use. Equipment cabinets mustbe located,painted and/or screened to be architecturally and visually compatible with the surrounding building and natural environment. The small equipment building (10'x/0') will be a steel structure and will be located right next to the tower. Screening is not necessary for this building as it and the tower are located in a very remote location where they will not be seen from public right-of-way or any occupied buildings. 5. The maximum permissible noise level shall adhere to the maximum permissible noise levels allowed in the underlying zone district as delineated in Chapter 14, Article IX of this Code. There will he no equipment on the site that will generate noise beyond the boundaries of the site. F. Base or Accessory Site Design. 1. If determined to be required by either the Director of the Department of Planning Services or the Weld County Board of Commissioners in the course of processing a Zoning Permit for a Telecommunication Antenna Tower Facility or Use by Special Review Permit, screening and landscaping appropriate to the context of the site and in harmony with the character of the surrounding environment may be installed when any part of the facility is visible from public rights -of -way or adjacent properties. Has not been determined to be required. 2. Existing vegetation and grades on the site should be improved or preserved to the extent possible. The new tower is being place on an existing graded well site, it will be able to accommodate the tower and small equipment building with very little site disturbance. 3. Signage at the site is limited to nonilluminated warning and equipment identification signs. This does not apply to concealed antennas incorporated into freestanding signs. Signage will be limited to non -illuminated warning and equipment identification signs. 4. TELECOMMUNICATION ANTENNA FACILITIES, except those in the C and I zones, must not include manned offices, long-term vehicle storage or other outdoor storage, or other uses not needed to send, receive or relay transmissions. The site will not include any of the above. G. Abandonment. If the Use by Special Review has not commenced within three (3) years from the date of approval, or is discontinued for a period of three (3) consecutive years, it shall be presumed inactive or abandoned. The COUNTY shall initiate an administrative hearing to consider whether to grant an extension of time to commence the use or revoke the use. If the use is revoked, it shall be necessary to follow the procedures and requirements of this Division in order to reestablish any subsequent Use by Right or Use by Special Review. Upon the determination that the use has been abandoned. the facility owner has ninety (90) days to re -use the facility or transfer the facility to another owner who will re -use it or remove the facility. Evidence of such shall be provided, in writing, to the Department of Planning Services. 1. Removal of abandoned TELECOMMUNICATION ANTENNA TOWERS shall be addressed in all lease agreements and shall specifically address the duties and obligations of the lessee and its assigns as well as the property owner regarding the removal of TELECOMMUNICATION ANTENNA TOWERS deemed by the County to be abandoned. Has been addressed with the State of Colorado Land Board. 2. If required by the Director of Planning Services or the Board of County Commissioners, the applicant or owner shall submit an Improvements Agreement agreeing to remove the improvements as shown in the application, plans, plat and other supporting documents. The agreement shall be made in conformance with the County policy on collateral for improvements. The agreement shall be approved by the Board of County Commissioners prior to commencement of operations, as applicable. Has not been determined to be required. Sec. 23-4-840. - Supplemental Use by Special Review Permit application requirements for Telecommunication Antenna Towers. A. Application Contents. In addition to requirements outlined in Article II, Divisions 3 through 5 of this Chapter, applications for administrative or Use by Special Review approval of proposed TELECOMMUNICATION FACILITIES, and additions or modifications to existing facilities, must include the following: 1. A Site Plan showing the location and legal description of the site; on -site land uses and zoning; adjacent roadways; parking and access; areas of vegetation and landscaping to be added, retained, replaced or removed; setbacks from property lines; and the location of the TELECOMMUNICATION NICATION FACILITY, including all related improvements, buildings and equipment. - Included 2. A vicinity map showing adjacent properties, general land uses, zoning and roadways: - Included a. Within one hundred (100) feet of a proposed attached antenna site. b. Within a distance of one (1) mile of a proposed TELECOMMUNICATION ANTENNAS, CONCEALED, temporary TELECOMMUNICATION ANTENNA TOWER or micro -cell TELECOMMUNICATION ANTENNA TOWER site. Within a distance of one (1) mile of a proposed TELECOMMUNICATION ANTENNA TOWER site. 3. Elevation drawings of the proposed TELECOMMUN-ICATION FACILITY showing all TELECOMMUNICATION ANTENNAS, TELECOMMUNICATION ANTENNA TOWERS, structures, equipment buildings and cabinets, fencing, screening, landscaping, lighting and other improvements related to the facility, showing specific materials, placement and colors. - Included 4. Our recommendation for your SCADA communications system is based on your need to meet the three foals listed below. 1. The safety of your company personnel and contractors . The ability to react and deal with any potential environmental impact 3 The management of production equipment and resources To meet these goals and cover the required production area, the system should be installed on a tower located at your State Antelope Section 16 location. The coverage of the proposed Section 16 Tower is illustrated by the shaded green area on Exhibit E The system proposed to operate your production system requires 2 licensed 900MHZ MAS (Multiple Address System) frequencies. These frequencies will be licensed by the Federal Communications Commission to Bonanza Creek and will have no co -channel users within a 70 mile radius. This will preclude any communications inference which could marginalize your stated goals. One frequency will allow for collection of historical data, the other licensed frequency will allow for the operation and monitoring of remote controls at production facilities. There are frequencies available for use at your Section 16 location. In addition there will be a 900MHZ ISM Band (Industrial, Scientific and Medical) system installed on the tower as well. This system, more commonly known as a "spread spectrum" Wage system operating in the 902-928MHZ band will allow immediate use of field assets already operating in the field and using such technology. This system, a non -licensed system, is subject to interference from other operating systems within the area. The Ethernet link from your field office to the main tower will be provided by a redundant 5.8GHZ microwave system with 28db gain radome covered dish antennas. I first attempted to contact the listed owners on the day I received the list, Oct 18, have tried multiple times and again today. (Tuesday, October 29, 2013) Exhibit A --Basin Electric (CUP -37): I spoke with the Manager of Basin Electric. I explained what I needed and he thought there would not be enough room on their tower to allow Bonanza Creek to effectively operate, but as he was not a technician, he referred me to a Mr. Dave Schneider who is "the telecom guy." So far, Mr. Schneider has not returned my calls. In any case, as illustrated on Exhibit A, the coverage of an installed system on CUP -37 would exclude most of the Bonanza Creek production area. The primary coverage on a system installed on Cup -37 is indicated by the green shading on the map on Exhibit A. The required coverage area immediately surrounds the labeled Section 16 tower as illustrated on Exhibit E. Exhibits B and C--Gutterson Ranches LLC (U R-937) (Exhibit B); (USR 1014) (Exhibit I was able to finally contact Mr. Shawn Gutterson and he told me he really had nothing to do with these matters that his brother Art took care of all that and he would email me his contact information which he finally did. Mr. Art Gutterson returned my call but was not sure what space was available on his towers. Shawn Gutterson acknowledged that the southern most of the two towers would not provide any coverage for Bonanza Creek's asset area. Even the "North" tower would not enable the shorter range WiFi coverage needed to accomplish your stated safety and environmental goals. 2Page In talking to other users in the area, I learned the Gutterson Ranch towers are not accessible after certain hours of the day and would preclude maintenance or troubleshooting except at times convenient to the owner. This could be a problem in maintaining your system. It was also mentioned the towers and associated buildings are not well maintained. Due to the critical nature of the communications system you propose to install, it's goal of providing safety for yours and your contractor's personnel in a remote area and the added need to monitor your oil and gas production assets to prevent any environmental impact in that area, 24/7 access to system components is essential. As illustrated on Exhibits B C, the coverage of an installed system on both USR-937 and USR 1014 would exclude most of the Bonanza Creek production area. The primary coverage on a system installed on USR-937 is indicated by the green shading on the map on Exhibit B. The primary coverage on a system installed on USR-1014 is indicated by the green shading on the map on Exhibit C. The required coverage area immediately surrounds the labeled Section 16 tower as illustrated on Exhibit E. Exhibit D--TowerCom (USR-1334) Of the two potential phone numbers found for Towercom, 925-964-9055 has a recording saying it is "not a working number." By the tones on answering, I assume 925-964 9050 to be a fax number. From a review of aerial mapping of the property, there is some doubt if this tower actually exists. In addition, as illustrated on Exhibit D, the coverage of an installed system on USR 1334 would exclude most of the Bonanza Creek production area as illustrated in Exhibit E. Frequency Availability COMSEARCH, a Washington DC based frequency coordinating company operates a database of available licensed 900MHZ MAS frequencies. A search of their database on November 3, 2013 indicates only one frequency is available for use near the locations for (USR-937) (Exhibit B) (USR 1014) (Exhibit C). The Comsearch database is searched for frequency availability in such a way so that there can be no co -channel users within 70 miles, so this information will be true of the other towers we are concerned with as well. As we have established previously, the two frequencies your system requires are available for your use at your Section 16 location. The CO SEARCH QuickLook document documenting frequency availability is attached. In conclusion, to best meet your stated goals, the construction of a tower at your Section 16 location is essential.
