RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 27, 2017 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 27, 2017, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Julie A. Cozad, Chair Commissioner Steve Moreno, Pro-Tem - EXCUSED Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer - EXCUSED Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of November 22, 2017, as printed. Commissioner Freeman seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Freeman moved to approve the Certification of Hearings conducted on November 22, 2017, as follows: 1) USR17-0041 — Matthew and Carrie Carrol, dba Carrol Excavation and Repair, Inc. Commissioner Conway seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: In response to Commissioner Conway, Bruce Barker, County Attorney, stated he needs to meet with the Board confidentially concerning the Martin Marietta decision that was made last week. There were no amendments to the agenda. >, = CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. __=x PUBLIC INPUT: Dave Kisker, resident of Johnstown, speaking on behalf of the People United for Responsible Government, expressed his frustration with the Board of County Commissioners and hopes the Commissioners will start working with the public and cooperatively with each other. Mr. Kisker submitted his letter as Exhibit "A". tA Jim Piraino, resident of Johnstown, expressed his disappointment with the Board passing the Martin Marietta project, and would like to see the Board work more closely with the public. a/ I I / aO I'7 Minutes, November 27, 2017 Page 1 2017-3966 BC0016 NEW BUSINESS: _ 1) CONSIDER CONTRACT ID #1556 THIRD AMENDMENT TO DIAGNOSTIC SERVICES AGREEMENT FOR WOMEN'S WELLNESS CONNECTION PROGRAM AND AUTHORIZE CHAIR TO SIGN — BANNER HEALTH, DBA NORTH COLORADO MEDICAL CENTER: Dr. Mark Wallace, Director of the Department of Public Health and Environment, presented the third amendment with Banner Health/North Colorado Medical Center for imaging studies that need to be completed for the Women's Wellness Connection Program. He stated the changes are mostly clerical. Commissioner Conway moved to approve said amendment and authorize the Chair to sign. The motion was seconded by Commissioner Freeman and it carried unanimously. 2) CONSIDER REVISIONS TO FEE SCHEDULE FOR FEES COLLECTED BY THE WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT: Dr. Wallace requested the approval for the revisions to fee schedule for the Public Health Services to make sure all clinical services and supplies are adequately covered. Commissioner Freeman moved to approve said revisions to the fee schedule for Public Health Services. The motion, which was seconded by Commissioner Conway, carried unanimously. 3) CONSIDER REVISIONS TO FEE SCHEDULE FOR ENVIRONMENTAL HEALTH FEES COLLECTED BY THE WELD COUNTY DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT: Dr. Wallace requested the approval for the revisions to the fee schedule for Environmental Health Services to ensure that costs are adequately covered. He then reviewed the details of all changes to the fees, as stated in the fee schedule. Commissioner Conway moved to approve said revisions to the fee schedule for Environmental Health. Seconded by Commissioner Freeman, the motion carried unanimously. El 4) CONSIDER APPLICATION FOR TIER I EMERGENCY MEDICAL SERVICES LICENSE AND AUTHORIZE CHAIR TO SIGN - FREDERICK -FIRESTONE FIRE PROTECTION DISTRICT: Dr. Wallace stated the Department of Public Health and Environment offers administrative support when reviewing the license and application requirements. He explained the Weld County Emergency/Medical Trauma Service (EMTS) Council reviewed the applications for each ambulance service on November 20, 2017. Commissioner Conway moved to approve said application for a Tier I EMS License and authorize the Chair to sign. The motion was seconded by Commissioner Freeman and it carried unanimously. 5) CONSIDER APPLICATION FOR TIER I EMERGENCY MEDICAL SERVICES LICENSE AND AUTHORIZE CHAIR TO SIGN - FRONT RANGE FIRE RESCUE: Dr. Wallace stated this application was reviewed by the EMTS Council on November 20, 2017, and after technical review recommends approval. Ron Bateman, Fire Chief, presented a letter dated Oct 24, 2017, which outlined a moving violation which occurred by an employee. In response to Chair Cozad, Chief Bateman, stated there are no concerns in waiving the traffic offense. Mr. Barker referred to Section 7-3-50 of the Weld County Code which states "Unless waived by the Board of County Commissioners, no person shall be employed by an ambulance service as an ambulance crew member. Who has been convicted of any of the following offenses with the previous tweleve (12) months from the date of application: felony, misdemeanor or Clas I or Class II traffic offense". Commissioner Conway moved to waive the traffic offense. Seconded by Commissioner Freeman, the motion carried unanimously. Commissioner Freeman moved to approve said application for a Tier I EMS License and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. Commissioner Freeman moved to approve said application for a Tier I EMS License and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. Commissioner Conway moved to approve said application for a Tier I EMS License and authorize the Chair to sign. The motion was seconded by Commissioner Freeman and it carried unanimously. The motion, which was seconded by Commissioner Conway, carried unanimously. 10) CONSIDER APPLICATION FOR TIER I EMERGENCY MEDICAL SERVICES LICENSE AND AUTHORIZE CHAIR TO SIGN -THOMPSON VALLEY EMERGENCY MEDICAL SERVICE: Dr. Wallace stated this application was reviewed by the EMTS Council on November 20, 2017, and after technical review recommends approval. Commissioner Conway moved to approve said application for a Tier I EMS License and authorize the Chair to sign. The motion, which was seconded by Commissioner Freeman, carried unanimously. Commissioner Freeman moved to approve said application for Tier I EMS License and authorize the Chair to sign. The motion was seconded by Commissioner Conway and it carried unanimously. 12) CONSIDER APPLICATION FOR TIER I EMERGENCY MEDICAL SERVICES LICENSE AND AUTHORIZE CHAIR TO SIGN - PLATTE VALLEY AMBULANCE SERVICE: Dr. Wallace stated this application was reviewed by the EMTS Council on November 20, 2017, and after technical review recommends approval. Commissioner Conway moved to approve said application for a Tier I EMS License and authorize the Chair to sign. The motion was seconded by Commissioner Freeman and it carried unanimously. Commissioner Freeman moved to approve said application for a Tier III EMS License and authorize the Chair to sign. The motion, which was seconded by Commissioner Conway, carried unanimously. 14) CONSIDER APPLICATION FOR TIER III EMERGENCY MEDICAL SERVICES LICENSE AND AUTHORIZE CHAIR TO SIGN - STADIUM MEDICAL, INC: Dr. Wallace stated this application was reviewed by the EMTS Council on November 20, 2017, and after technical review recommends approval. Commissioner Conway moved to approve said application for a Tier III EMS License and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. Commissioner Conway thanked Dave Bressler, Chair EMTS Council and various agencies for being present at the Board meeting. 15) CONSIDER ENERGY AND MINERAL IMPACT ASSISTANCE GRANT APPLICATION FOR COUNTY ROAD 18 IMPROVEMENTS PROJECT (TIER I) AND AUTHORIZE ELECTRONIC SUBMITTAL: Elizabeth Relford, Department of Public Works, presented the request for funding to assist with repairing road damage created from intense oil and gas truck activity on County Road (CR) 18 for approximately 4.3 miles. She stated the amount being requested is $200,000.00. Commissioner Freeman moved to approve said application and authorize electronic submittal. Seconded by Commissioner Conway, the motion carried unanimously. 16) CONSIDER ENERGY AND MINERAL IMPACT ASSISTANCE GRANT APPLICATION FOR COUNTY ROAD 90 IMPROVEMENTS PROJECT (TIER II) AND AUTHORIZE ELECTRONIC SUBMITTAL: Ms. Relford reviewed the application to request funding in the amount of $750,000.00 to assist with full depth reconstruction of approximately 5.6 miles of County Road 90 from County Road 45.3 to County Road 57. Commissioner Conway moved to approve said application and authorize electronic submittal. Seconded by Commissioner Freeman, the motion carried unanimously. 17) FINAL READING OF CODE ORDINANCE #2017-09, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 2 ADMINISTRATION (SMALL TRACT OIL AND GAS LEASES), OF THE WELD COUNTY CODE: Commissioner Conway moved to read Code Ordinance #2017-09 by title only. The motion was seconded by Commissioner Freeman, and it carried unanimously. Mr. Barker read the title for the record and stated there have been no changes since the second reading. No public testimony was offered concerning this matter. Commissioner Freeman moved to approve on Final reading. Seconded by Commissioner Conway, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2017-09 was approved on final reading. As the recent election showed, it's not just me. Or Jim Piraino. Or Tonya Van Bober. Or even Doris Williams. 27316 of us sent you a message. Although it was specifically against l�, the message was about more than that. We are telling you in no uncertain terms that we are not happy about the way you are running this County. We are not happy that you wasted 150,000 of our hard earned dollars in your retaliation attempt against the Council. We are not happy that you didn't take the audit results seriously and use their guidance as an opportunity for improvement. We are not happy with your refusal to acknowledge your illegal mileage compensation to your members. We are not happy with the X33,000 that you now must pay the IRS. We are not happy with your ethical lapses and money wasting decisions. And no, we are not happy that you have disenfranchised 80,000 of us by not giving Commissioner Conw. a coordinator role or that you are dr-trying to eliminate hun, our from those committees where he adds the most value. Have you forgotten that you are supposed to be public servants, not kings and queens? 27,316. In an off year election. That's more votes than elected most of you. So now, we challenge you. We challenge you to work with us instead of against us. Help us fix the Code and Charter so that the Council can play its intended oversight role. Help us fix the comprehensive plan so that land use is not an arbitrary, unpredictable and unfair process that fails to protect the health, safety and welfare of Weld County residents. Help us stop the socialistic transfer of property wealth from individuals to busineses by not requiring them to compensate their neighbors. That's not property rights. That's crony capitalism! And yes, make sure that all 5 of you participate in management of the County. We need every one of you to be doing the people's work. It's time to pull up your "big boy pants", put aside your petty bickering and get to work. Your actions have now hurt enough people. Have cost the taxpayers enough money. Have resulted In enough lawsuits. And made Weld County the laughing stock of the state. It's time to get busy doing the people's work. We want to help. We want to be involved. And we look forward to finding constructive solutions. But we'll fight you every step of the way unless things change dramatically and quickly.
